YASMINA (VOICE ASSISTANT) TERMS OF USE

 

Please read these Terms of Use carefully. By using the Yasmina Voice Assistant service or any part thereof, you unconditionally accept these Terms of Use, which form a binding agreement between you and us. If you do not agree to these Terms of Use, please do not use the Yasmina Voice Assistant service.

 

Terms and Definitions

These Terms of Use constitute an offer of Direct Cursus Technology LLC (the Company) to an Internet user (User) for the provision by the Company of a voice assistant to the User through the device and mobile application or website, as a case may be (Service).

Yasmina shall mean the voice assistant service “Yasmina” provided by the Company, which is used according to the Terms set forth hereby.

By using the Yasmina, the User agrees that the Privacy Policy, which located on the page at: https://yango.com/legal/yango_yasmina_privacy_policy, is an integral part of this Terms, and its term fully apply to the User when using the Service.

By starting to use the Service/its individual functions, the User is deemed to have accepted these Terms, as well as the terms of all the above documents, in full, without any reservations or exceptions. If the User disagrees with any of the provisions of these documents, the User does not have the right to use the Service.

These Terms may be changed by the Company without any special notice; the new version of the Terms comes into force from the moment it is posted on the Internet at the address specified in this paragraph, unless otherwise provided by the new version of the Terms. The current version of the Terms is located on the page at: https://yango.com/legal/yasmina_termsofuse.

If Company has made any changes to these Terms with which the User does not agree, he is obliged to stop using the Service.

 

1. Use of the Service. Certain functions of the Service

1.1. The User can read more about the mechanism of operation of the voice assistant, how to activate it and instructions for use at: https://yasmina.yango.com/support/assistant.

Performing the functions of the Service is possible only if you have access to the Internet. The User independently receives and pays for such access on the terms and rates of their telecom operator or Internet access provider.

1.2. The Service provides the User with the opportunity to make queries by voice dialing and receive brief information (quick response) on certain queries, activate the dialogue mode with the voice assistant or activate the function of voice assistant, application, device, with which the voice assistant interacts.

The voice assistant's responses are generated automatically using the algorithm training function based on User remarks and open data.

The User agrees that Company cannot be responsible for any voice assistant reactions acquired during communication with the User.

Furthermore, the Company is not responsible for the accuracy, relevance, correctness of information in answers of voice assistant. Company does not guarantee that any answer will be generated or a response will be given to the User's request; in particular, Yasmina may offer to reformulate the request.

The User is notified and agrees that answers of voice assistant is not an expression of anyone's opinion, Company's position, or a statement of facts. Answer cannot under any circumstances be regarded as guidance or advice when making decisions or taking any actions.

1.4. The Service provides the User with the ability to activate special voice assistant skills to call third-party software products (bots, chats and other services) and/or interact with third-party organizations (hereinafter referred to as Partners).

The User’s interaction with Partners and/or their software products is carried out by the User independently (without the participation of the Company). Company is not a party to the legal relationship established between the User and the Partner and is not responsible for:

  • financial and any other transactions made between the User and the Partners, as well as for any consequences of the User’s acquisition of goods/works/services of the Partners;
  • designation and description of any skill. Company does not confirm or deny compliance with the law, accuracy or reliability of the description of any skill;
  • content, relevance, legality of information provided by Partners, including information about the goods/work/services they offer, their actual availability, cost, etc.;
  • processing by Partners of the User’s personal data provided to them when accessing software products and/or goods/works/services of Partners.

If there are reasonable assumptions about a possible violation by the Partners of the law, the rights and interests of third parties by the information posted by them and/or the illegal nature of the Partner’s activities, the User can send a complaint through the functionality of the Service.

If facts of violations of these Terms and the provisions of the documents mentioned herein as well as the conditions and special requirements for Partners are revealed based on the results of consideration of the complaint by Company, measures may be taken to eliminate violations and/or sanctions against the violator, including possible restriction of access to the Service.

For the purpose of quality control, as well as to comply with legal requirements, Company stores the history of interaction between Users and Partners. Company processes the specified information under the conditions specified in the Privacy Policy located at https://yango.com/legal/yango_yasmina_privacy_policy.

1.5. Some functions of Company or third parties that the User may use through the Service (such as listening music and radio) may be available to the User only if there is an active subscription of the Yango Play on the terms and conditions of the Yango Play subscription, available online at https://yango.com/legal/uae_yango_play_conditions.

1.6. The Company is not a party to relations related to the production, acquisition, use, and maintenance of third-party devices, which are managed using the functions of the Service. The Company does not guarantee the safety and efficiency of third-party devices, or their compatibility with the Service. To ensure the safety of the User and the safety of his property, it is strongly recommended checking the execution of given commands and the correct operation of devices after activating relevant voice command in the Service.

When connecting and using a device using the Service function, the Company can collect the following information: identifiers, types, names, models, versions of devices connected to the Service, User settings (name and location of the device specified by the User), device status, device usage statistics in Service. The received data is processed under the terms of the Privacy Policy located at https://yango.com/legal/yango_yasmina_privacy_policy solely for the purpose of ensuring the operation of the Service function.

1.7. The User is hereby notified and agrees that the Company may automatically receive information about the activated skills of the Service, the commands made, voice recordings, User-made queries. Voice recordings, including User replicas addressed to the Service when it is activated, in order to recognize the requested command and, then, perform the required function of the Service.

Received data may be also processed for the purpose of analyzing, developing and improving the Service and certain functions of it, except for the script of voice input of a message and making entries in the User's calendar, which do not provide for the transfer and use of received recordings. The user can specify the settings for the use of his data.

 

2. Intellectual property

2.1. The Service may contain images, audio, video, text materials and data (including those generated using special functions and skills of the Service) (hereinafter referred to as the Content).

Any and all rights to all objects that make up the design of the Service as a whole and its individual elements, as well as any rights to the Service software, to the neural network algorithm for creating texts and answers belong to the Company.

Rights to units of Content that are objects of intellectual property rights and included in the Service (text, visual, audio/video content, etc.) belong to its respective rightsholders. The User shall be responsible for any infringement of the intellectual property rights of the Company and (or) the other rightsholders of the relevant units of Content or third parties, in accordance with applicable law.

The use of the Content and any other intellectual property included in the Service is permitted solely for the personal non-commercial purposes of the User. Company does not guarantee access to certain objects of intellectual property for any specific period of time, as well as the availability of such objects on the User’s territory.

2.2. By starting to use the Service, the User guarantees that he/she does not and will not take any actions aimed at circumventing technical means of protection against unauthorized use of the Content. Any copying, reproduction, processing, distribution, making available to the public, bypassing of technical protection measures or other use of the Content beyond the capabilities provided by the Service, as well as any use thereof for commercial purposes without the prior consent of Company is prohibited.

2.3. Company is not responsible for any infringement of the intellectual property rights of third parties committed by the Partners when they use their software products available to Users of the Service under the terms of clause 1.3. of these Terms. If infringements are detected, the User has the right to report these facts through the functionality of the Service.

 

3. Limitations

3.1. The service is provided on an “as is” basis. Company does not provide any guarantees regarding the error-free and uninterrupted operation of the Service or its individual functions, or the fitness of the Service for the specific purposes and expectations of the User.

The Service is provided exclusively for the personal use by the User at home in a limited circle of people for entertainment purposes and does not have the purpose of causing any harm/damage to either the User or third parties.

3.2. Use of the Service by a minor is permissible with the knowledge and consent of their legal representative and under their control after the legal representative familiarizes themself with these Terms and fully accepts their provisions on their behalf. Company does not guarantee the absence of information in the Service that does not correspond to the age category of a minor.

3.3. The information provided in the Service is for reference purposes only. The Company cannot guarantee the actuality, reliability and relevance of the information available through the Service, and is not responsible for such information.

The information in the Service is not a statement of facts and under no circumstances can be regarded as guidance or advice when making decisions or performing any actions.

3.4. These Terms shall be governed by and construed in accordance with the laws of the Dubai International Financial Center (DIFC) and any dispute concerning these Terms or their interpretation shall be subject to the jurisdiction of the DIFC courts (including Small Claims Tribunal for Claims). If questions, statements or claims arise, the User has the right to report them through the functionality of the Company Service. If Company and the User fail to reach agreement, the issue may be resolved in court at the location of Company.

الشروط والتعريفات

التالي هو شروط استخدام المساعد الصوتي الخاص بشركة Direct Cursus Technology LLC (المشار إليها فيما يلي باسم "الشركة") لمستخدم الإنترنت (المشار إليه فيما يلي باسم "المستخدم") عبر إصدار الكمبيوتر أو تطبيق الجوال أو الموقع الإلكتروني، حسب الحالة (نوع الخدمة).

"Yasmina" تعني خدمة المساعد الصوتي "Yasmina" التي تقدمها الشركة، والتي يتم استخدامها وفقا للشروط المنصوص عليها بموجبه.

باستخدام "Yasmina"، يوافق المستخدم على أن سياسة الخصوصية، الموجودة على الصفحة على: https://yango.com/legal/yango_yasmina_privacy_policy، هي جزء لا يتجزأ من هذه الشروط، وتنطبق شروطها بالكامل على المستخدم عند استخدام الخدمة.

من خلال البدء في استخدام الخدمة/وظائفها الفردية، يعتبر المستخدم قد قبل هذه الشروط، وكذلك شروط جميع المستندات المذكورة أعلاه، بالكامل، دون أي تحفظات أو استثناءات. إذا لم يوافق المستخدم على أي من أحكام هذه المستندات، فلا يحق للمستخدم استخدام الخدمة.

يجوز للشركة تغيير هذه الشروط دون أي إشعار خاص؛ تدخل النسخة الجديدة من الشروط حيز التنفيذ منذ لحظة نشرها على الإنترنت على العنوان المحدد في هذه الفقرة، ما لم ينص الإصدار الجديد من الشروط على خلاف ذلك. يتوفر الإصدار الحالي من الشروط على الصفحة على: https://yango.com/legal/yasmina_termsofuse.

إذا قامت الشركة بإجراء أي تغييرات على هذه الشروط بحيث لا يوافق عليها المستخدم، فإنه ملزم بالتوقف عن استخدام الخدمة.

 

1. استخدام الخدمة. بعض وظائف الخدمة

1.1. يمكن للمستخدم قراءة المزيد عن آلية عمل المساعد الصوتي وكيفية تفعيله وتعليمات استخدامه على الرابط التالي: https://yasmina.yango.com/support/assistant.

لا يمكن تنفيذ وظائف الخدمة إلا إذا كان لديك إمكانية الوصول إلى الإنترنت. يتلقى المستخدم بشكل مستقل هذا الوصول ويدفع مقابله وفقًا لشروط وأسعار مشغل الاتصالات أو مزود الوصول إلى الإنترنت الخاص به.

1.2. توفر الخدمة للمستخدم فرصة إجراء استفسارات عن طريق الاتصال الصوتي وتلقي معلومات مختصرة (استجابة سريعة) حول استفسارات معينة أو تفعيل وضع الحوار مع المساعد الصوتي أو تفعيل وظيفة المساعد الصوتي أو التطبيق أو الجهاز الذي يتفاعل معه المساعد الصوتي.

يتم إنشاء استجابات المساعد الصوتي تلقائيًا باستخدام وظيفة تدريب الخوارزمية بناءً على ملاحظات المستخدم والبيانات المتاحة.

يوافق المستخدم على أن الشركة لا يمكن أن تكون مسؤولة عن أي ردود فعل للمساعد الصوتي يتم الحصول عليها أثناء التواصل مع المستخدم.

علاوة على ذلك، فإن الشركة ليست مسؤولة عن دقة وملاءمة وصحة المعلومات في إجابات المساعد الصوتي. لا تضمن الشركة أنه سيتم إنشاء أي إجابة أو سيتم تقديم رد على طلب المستخدم؛ وعلى وجه الخصوص، قد يطلب المساعد الصوتي "Yasmina" إعادة صياغة الطلب.

يتم إخطار المستخدم ويوافق على أن إجابات المساعد الصوتي ليست تعبيراً عن رأي أي شخص أو موقف الشركة أو بيان للحقائق. لا يمكن بأي حال من الأحوال اعتبار الإجابة بمثابة توجيه أو نصيحة عند اتخاذ القرارات أو اتخاذ أي إجراء.

1.4. توفر الخدمة للمستخدم القدرة على تنشيط مهارات المساعد الصوتي الخاصة للاتصال بمنتجات برامج خارجية (الروبوتات والمحادثات والخدمات الأخرى) و/أو التفاعل مع مؤسسات خارجية (المشار إليها فيما يلي باسم الشركاء).

يتم تفاعل المستخدم مع الشركاء و/أو منتجاتهم البرمجية من قبل المستخدم بشكل مستقل (دون مشاركة الشركة). الشركة ليست طرفًا في العلاقة القانونية القائمة بين المستخدم والشريك وليست مسؤولة عن:

  • المعاملات المالية وأي معاملات أخرى تتم بين المستخدم والشركاء، وكذلك أي عواقب تترتب على حصول المستخدم على سلع/أعمال/خدمات الشركاء؛
  • تعيين ووصف أي مهارة. لا تؤكد الشركة أو تنفي الامتثال للقانون أو صحة أو موثوقية وصف أي مهارة؛
  • المحتوى والملاءمة ومشروعية المعلومات المقدمة من قبل الشركاء، بما في ذلك المعلومات حول السلع/العمل/الخدمات التي يقدمونها، وتوافرها الفعلي، وتكلفتها، وما إلى ذلك؛
  • معالجة الشركاء لبيانات المستخدم الشخصية المقدمة لهم عند الوصول إلى منتجات البرامج و/أو السلع/الأعمال/الخدمات الخاصة بالشركاء.

إذا كانت هناك افتراضات معقولة حول انتهاك محتمل من قبل الشركاء للقانون وحقوق ومصالح الجهات الخارجية من خلال المعلومات التي نشروها و/أو الطبيعة غير القانونية لأنشطة الشريك، فيمكن للمستخدم إرسال شكوى من خلال وظيفة الخدمة.

في حالة اكتشاف أي انتهاكات لهذه الشروط والأحكام الواردة في المستندات المذكورة هنا بالإضافة إلى الشروط والمتطلبات الخاصة للشركاء وفقا لتقدير الشركة بعد نظر الشكوى، فقد يتم اتخاذ الإجراءات وفرض العقوبات اللازمة ضد الطرف المنتهك أو المخالف، بما في ذلك تقييد وصوله إلى الخدمة.

لغرض مراقبة الجودة، وكذلك للامتثال للمتطلبات القانونية، تقوم الشركة بتخزين سجل التفاعل بين المستخدمين والشركاء. تقوم الشركة بمعالجة المعلومات المحددة وفقًا للشروط المحددة في سياسة الخصوصية الموجودة على الرابط https://yango.com/legal/yango_yasmina_privacy_policy.

1.5. فقط إذا قام المستخدم بالاشتراك في خدمة Yango Play وفقا للشروط والأحكام الخاصة بالخدمة، فقد تتاح له بعض الميزات التي تقدمها الشركة أو الجهات الخارجية والتي قد يستفيد منها المستخدم من خلال الخدمة (مثل الاستماع إلى الموسيقى والراديو) عبر الإنترنت على الرابط التالي: https://yango.com/legal/uae_yango_play_conditions.

1.6. الشركة ليست طرفا في العلاقة القانونية الخاصة بإنتاج واقتناء واستخدام وصيانة أجهزة الجهات الخارجية والمتاحة في "الخدمة" الخاصة بنا. الشركة لا توفر أي ضمانات خاصة بسلامة وكفاءة أجهزة الجهات الخارجية أو توافقها مع الخدمة. لضمان سلامة المستخدم وأجهزته، فيوصى بشدة بالتحقق من تنفيذ الأوامر الصادرة والتشغيل الصحيح للأجهزة بعد تنشيط الأمر الصوتي ذي الصلة في الخدمة.

عند توصيل جهاز واستخدامه عبر الخدمة، فيمكن للشركة جمع المعلومات التالية: أرقام تعريف وأنواع وأسماء وموديلات وإصدارات الأجهزة المتصلة بالخدمة وإعدادات المستخدم (اسم وموقع الجهاز المحدد من قبل المستخدم)، وحالة الجهاز، وإحداثيات استخدام الجهاز المتصل بالخدمة. تتم معالجة البيانات المستلمة بموجب شروط سياسة الخصوصية المتوفرة على https://yango.com/legal/yango_yasmina_privacy_policy فقط لغرض ضمان تشغيل الخدمة.

1.7. يتم بموجبه إخطار المستخدم ويوافق على أنه قد تتلقى الشركة تلقائيا معلومات حول الميزات المفعلة للخدمة والأوامر الصادرة والتسجيلات الصوتية والاستفسارات التي يقدمها المستخدم. التسجيلات الصوتية، بما في ذلك النسخ طبق الأصل التي يقدمها المستخدم داخل الخدمة عند تنشيطها، من أجل التعرف على الأمر المطلوب ثم تنفيذ الميزة المطلوبة من الخدمة.

قد تتم أيضا معالجة البيانات المستلمة بغرض تحليل وتطوير وتحسين الخدمة وبعض ميزاتها، باستثناء نص الإدخال الصوتي للرسائل والبيانات التي يدخلها المستخدم في مفكرته والتي لا تنص على النقل والاستخدام للتسجيلات المستلمة. يمكن للمستخدم اختيار الإعدادات الخاصة باستخدام بياناته.

 

2. الملكية الفكرية

2.1. قد تحتوي الخدمة على صور وصوت وفيديو ومواد نصية وبيانات(بما في ذلك تلك التي تم إنشاؤها باستخدام وظائف ومهارات خاصة للخدمة) (يشار إليها فيما يلي باسم المحتوى).

الشركة لديها جميع الحقوق المتعلقة بجميع العناصر التي تشكل تصميم الخدمة ككل وعناصرها الفردية، بالإضافة إلى أي حقوق لبرنامج الخدمة وخوارزمية الشبكة لإنشاء النصوص والإجابات.

حقوق وحدات المحتوى التي تعتبر من عناصر حقوق الملكية الفكرية والمضمنة في الخدمة (المحتوى النصي والمرئي والصوتي/الفيديو إلخ) تكون مملوكة لأصحاب الحقوق المعنيين. يتحمل المستخدم المسؤولية عن أي انتهاك لحقوق الملكية الفكرية للشركة و\أو أصحاب الحقوق الآخرين لوحدات المحتوى ذات الصلة أو الخاصة بجهات خارجية، وفقا للقانون المطبق.

يسمح باستخدام المحتوى وأي ملكية فكرية أخرى مدرجة في الخدمة فقط للأغراض الشخصية غير التجارية للمستخدم. لا تضمن الشركة الوصول إلى بعض عناصر الملكية الفكرية لأي فترة زمنية محددة، فضلاً عن توفر هذه العناصر على ممتلكات المستخدم.

2.2. من خلال البدء في استخدام الخدمة، يضمن المستخدم أنه لن يتخذ أي إجراءات تهدف إلى التحايل على الوسائل التقنية للحماية ضد الاستخدام غير المصرح به للمحتوى. يحظر أي نسخ أو إعادة إنتاج أو معالجة أو توزيع أو نشره أو التحايل على تدابير الحماية الفنية أو أي استخدام آخر للمحتوى بما يتجاوز القدرات التي توفرها الخدمة، وكذلك أي استخدام له لأغراض تجارية دون موافقة مسبقة من الشركة.

2.3. الشركة ليست مسؤولة عن أي انتهاك يرتكبه الشركاء لحقوق الملكية الفكرية الخاصة بجهات خارجية عند استخدامهم لمنتجاتهم البرمجية المتاحة لمستخدمي الخدمة بموجب شروط البند 1.3 من هذه الشروط. في حالة اكتشاف أي انتهاكات، يحق للمستخدم الإبلاغ عنها من خلال الخدمة.

 

3. القيود

3.1. يتم تقديم الخدمة على أساس "حالتها الراهنة". لا تقدم الشركة أي ضمانات فيما يتعلق بالتشغيل الخالي من الأخطاء وغير المنقطع للخدمة أو ميزاتها الفردية أو ملائمة الخدمة للأغراض المحددة وتوقعات المستخدم.

يتم توفير الخدمة حصريًا للاستخدام الشخصي للمستخدم في المنزل في دائرة محدودة من الأشخاص لأغراض الترفيه وليس بغرض التسبب في أي أذى/ضرر للمستخدم أو لأطراف ثالثة.

3.2. يسمح باستخدام الخدمة من قبل الشخص القاصر (ما دون السن القانوني) بمعرفة وموافقة ممثله القانوني وتحت رقابته بعد أن يطلع الممثل القانوني على هذه الشروط ويقبل أحكامها بشكل كامل نيابة عنه. لا تضمن الشركة عدم وجود معلومات في الخدمة لا تتوافق مع الفئة العمرية للقاصر.

3.3. المعلومات المقدمة في الخدمة هي لأغراض مرجعية فقط. لا تقدم الشركة أي ضمانات حول واقعية وموثوقية وملائمة المعلومات المتاحة من خلال الخدمة، ولا تتحمل المسؤولية عن هذه المعلومات.

المعلومات المتوفرة في الخدمة ليست بيانا للحقائق ولا يمكن اعتبارها بأي حال من الأحوال بمثابة توجيه أو نصيحة عند اتخاذ القرارات أو تنفيذ أي إجراءات.

3.4. تخضع هذه الشروط وتفسر وفقًا لقوانين مركز دبي المالي العالمي (DIFC) وأي نزاع يتعلق بهذه الشروط أو تفسيرها يخضع للاختصاص القضائي لمحاكم مركز دبي المالي العالمي (بما في ذلك محكمة المطالبات الصغيرة للمطالبات). في حالة ظهور أسئلة أو بيانات أو مطالبات، يحق للمستخدم الإبلاغ عنها من خلال وظيفة خدمة الشركة. في حالة عدم توصل الشركة والمستخدم إلى اتفاق، فقد يتم حل القضية عبر القضاء (المحاكم) وفقا لموقع الشركة.
