Terms of Use of Yango Delivery

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Delivery FZ-LLC (hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango Delivery service (hereinafter referred to as the Service).

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yango may, at any time amend provisions of the Terms without notice to the User. The current version hereof is available at: https://yango.com/legal/yango_termsofuse_delivery.

1.4. The User shall stop using the Service, if he or she disagrees with any amendments to the Terms. If User continues using the Service, it is considered as provision of his or her express consent to the new terms and conditions.

1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for delivery services or other services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

1.7. For the avoidance of doubt, Yango does not provide delivery services. Nothing in these Terms shall be interpreted in a way that Yango is performing delivery services, or that the User has engaged Yango for such delivery services, or that the third-party partner who is actually providing such services is an agent or subcontractor of Yango. Delivery services is done exclusively by the third-party providers, who provide those services as an individual, standalone service providers, in their own name and for their own account, and shall be obliged to have all necessary licenses and permits and to comply with all other requirements. The Service is aimed at the User to place its request and engage the third-party partner directly, and Yango does not bear any responsibility or liability for the third-party partners or the services they provide, neither to the User not to any other person.

1.8. All conversations the User holds with the support team and partners of the Service can be recorded to control quality and improve services.

1.9. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.10. Yango reserves the right to limit User access to the Service temporarily or permanently without explanation, including a case of violation of these Terms by the User, receipt of an order from an authorized body, causing damage to Yango or to third parties (as well as to prevent such actions), creating danger to others, protecting the rights and legitimate interests of Yango and third parties, receiving repeated complaints about the actions of the User or persons, in respect of which the User places through the Service information about the potential demand for delivery services or other services, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services is provided by partners of the Service. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. When demand for services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yango thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.7. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

The User is considered to have cancelled a service if he or she has not delivered the shipment for delivery to the pick-up place within 10 (ten) minutes from the moment of the courier's actual arrival, taking into account waiting time specified for the corresponding tariff (if applicable).

2.8. The User authorizes Yango to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.9. The time of arrival of the courier at the place of departure indicated by the User in the Request is approximate and can be changed depending on the traffic situation and other external factors. Yango notifies about the change in the arrival time of the courier by sending an information message to the User's mobile phone number or otherwise at the discretion of Yango.

2.10. The User is responsible for the contents of the items transferred for delivery to partners and couriers, and undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components, fireworks, flares and ammunition;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg. In case of ordering a delivery service by foot courier, the size of the transferred items (width, length, height) cannot exceed 50x50x50; the weight of the transferred items cannot exceed 10 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Yango’s partners may set other limits on items to be delivered.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yango’s partner provide delivery services. At the same time, a Yango’s partner may deny delivery services to the User, if the Yango’s partner/ representatives of the Yango’s partner discover any non-deliverable items.

2.11. The Partner or his Representative accepts shipments for delivery according to the number of packages, provided that the package of the shipment is satisfactory, without checking the internal contents by the Partner or his Representative.

2.12. The User agrees that the shipment is considered delivered to the recipient, provided that the package of the shipment is intact (there are no traces of opening the package, damage to the package and other characteristic traces of physical impact).

 

3. Function of cashless payment for delivery and other services

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yango acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango acting as a payment recipient or with Yango involved as another party to settlements or a party to information exchange.

3.2. The User shall choose the relevant form of payment in the Service interface. If the User selects a wire payment, the payment to the partner's address in Cash or otherwise directly to the partner's representative, without additional notification of Yango by changing the payment method in the Service interface (if possible), shall be prohibited. The debit of Yango funds from the Linked Card shall be deemed correct and corresponding to the payment method selected by the User, and no refund shall be made by canceling the debit.

At the same time, if it is impossible to pay by wire for any reason (including, but not limited to, temporary technical unavailability of this function, temporary or permanent impossibility of wire payment using a Linked Card, insufficient funds on the Linked Card), the User undertakes to ensure there is sufficient funds on the Linked Card to repay the arrears on Partner's services as soon as possible, but in any case no later than 30 calendar days from the moment of rendering the relevant service to the User.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.4. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

The User may also indicate the Linked Card in the interface of third-party services supporting integration with the Service and payment participants and providing authorization of the User's payment without transmitting information about the Linked Card to Yango.

The procedure for using the third-party services specified in this Clause shall be governed by the rules stipulated by such third parties. Yango shall not be liable for the User's use of such third-party services and shall not guarantee the correctness and safety of such third-party services.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yango does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.12. When indicating their details pursuant to cl. 3.5 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.13. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.14. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.15. Yango reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated hereof, if Yango thinks fit.

3.16. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yango signed with such third party.

Conditions d'usage du service Yango Delivery

 

1. Dispositions générales

1.1. Les présentes Conditions (ci-après — « Conditions ») représentent une offre de la société Yango Delivery FZ-LLC (ci-après — « Yango ») à l'utilisateur du réseau Internet (ci-après — « Utilisateur ») concernant l'utilisation du service Yango Delivery (ci-après — « Service »).

1.2. Il est considéré qu'en procédant à l'utilisation du Service ou de ces fonctionnalités séparées, l'Utilisateur accepte les présentes Conditions dans leur intégrité, sans aucune restriction ni réserve. Dans le cas où l'Utilisateur n'accepte pas une des dispositions des Conditions et/ou des Documents réglementaires, l'Utilisateur ne peut pas utiliser le Service.

1.3. Yango a le droit de modifier les dispositions des présentes Conditions à tout moment et sans notification à l'Utilisateur. La version en vigueur des présents Conditions est publiée à : https://yango.com/legal/yango_termsofuse_delivery.

1.4. L'Utilisateur doit cesser d'utiliser le Service s'il n'est pas d'accord avec les modifications apportées aux présentes Conditions. La poursuite de l'utilisation du Service après la modification des Conditions sera considérée comme l'acceptation explicite par l'Utilisateur de leur version modifiée.

1.5. Le Service donne à l'Utilisateur la possibilité de publier, à titre gratuit, l'information relative à la demande potentielle de l'Utilisateur de service de livraison ou d'autres services, ainsi que la possibilité de prendre connaissance des informations relatives aux offres des organisations qui fournissent des services dans le domaine susmentionné et de rechercher de telles offres selon les critères fixés par l'Utilisateur. Toutes les fonctionnalités du Service existant actuellement, ainsi que tout leur développement ou l'adjonction de toutes fonctionnalités nouvelles constituent l'objet des présentes Conditions.

1.6. En fonction de la région de séjour de l'Utilisateur, l'accès à toutes ou à certaines fonctionnalités du Services peuvent être bloqué ou limité. L'accès de l'Utilisateur aux fonctionnalités depuis une certaine région est considéré comme bloqué (limité), si l'Utilisateur ne peut pas s'en servir directement. L'application de tous moyens techniques ou logiciels pour contourner ces limitations est interdite. Les dispositions des présentes Conditions qui régissent les fonctionnalités du Service l'accès auxquelles est bloqué (limité) pour l'Utilisateur ne sont pas applicables jusqu'à ce que l'Utilisateur ne puisse s'en servir directement. Les informations concernant l'accessibilité des fonctionnalités du Services dans une région correspondante sont fournies à l'Utilisateur à la demande de celui-ci adressée à Yango.

1.7. Pour éviter toute ambiguïté, Yango ne fournit pas de service de livraison. Rien dans les présentes Conditions ne doit être interprété comme impliquant que Yango fournit les services de livraison, ou que l'Utilisateur a engagé Yango pour la prestation de tels services de livraison, ou que le partenaire tiers qui fournit effectivement de tels services est un agent ou un sous-traitant de Yango. Les services de livraison sont réalisés exclusivement par des prestataires tiers qui fournissent ces services en tant que prestataires de services indépendants et autonomes, pour leur propre compte et à leurs propres frais, et qui sont tenus de disposer de toutes les licences et autorisations nécessaires et de respecter toutes les autres exigences. Le Service est conçu pour permettre à l'Utilisateur de placer sa demande et d’engager directement un partenaire tiers, et Yango n'engage aucune responsabilité pour les partenaires tiers ou pour les services qu'ils fournissent, que ce soit envers l'Utilisateur ou envers toute autre personne.

1.8. L'Utilisateur accepte que toutes les conversations qu'il a avec le service d'assistance et les partenaires soient enregistrées à des fins de contrôle de la qualité et de développement des services.

1.9. Par l'utilisation du Service, l'Utilisateur donne son accord pour la réception des messages publicitaires. L'Utilisateur a le droit de renonces à la réception des messages publicitaires, en appliquant les fonctionnalités correspondantes du Service ou en suivant les indications du message publicitaire reçu.

1.10. Yango a le droit de limiter temporairement ou définitivement l'utilisation du Service par l'Utilisateur sans motiver sa décision, y compris en cas de violation des présentes Conditions par l'Utilisateur, de réception d'un ordre d'un organisme autorisé, de dommages causés à Yango ou à des tiers (ainsi que pour la prévention de telles dommages), de création de danger pour les autres, de protection des droits et des intérêts légitimes de Yango et de tiers, de réception de plaintes répétées concernant les actions de l'Utilisateur ou de personnes pour lesquelles l'Utilisateur publie des informations sur la demande potentielle de services de livraison et/ou d'autres services par l'intermédiaire du Service, ainsi que de prendre toutes autres mesures concernant l'Utilisateur qui doivent assurer le respect des exigences de la législation ou des droits et des intérêts légitimes des tiers.

 

2. Utilisation du Service. Certaines fonctionnalités du Service

2.1. Le Service est mis à disposition de l'Utilisateur pour l'utilisation personnel non commercial.

2.2. Les informations sur les services de livraison et/ou sur des autres services sont fournies par les partenaires du Service. Pour plus d'informations sur les services proposés, l'Utilisateur peut contacter les partenaires du Service ou fournir ses coordonnées via les fonctionnalités du Service, afin que les partenaires du Service puissent contacter l'Utilisateur eux-mêmes et lui fournir des informations sur les services proposés.

2.3. Yango n'engage pas la responsabilité pour le contenu ou pour l'actualité des informations fournies par les partenaires du Service, y compris pour les informations relatives aux prix des services des partenaires, ainsi que à leur disponibilité à un moment donné. L'interaction de l'Utilisateur avec le partenaire concernant l'acquisition des services est effectuée par l'Utilisateur lui-même (sans participation de Yango), conformément aux règles de la prestation des services définies par les partenaires. Yango n'engage pas la responsabilité pour les opérations financières et pour toutes autres opérations effectuées par l'Utilisateur et par le partenaire, ainsi que pour toutes les conséquences de l'acquisition des services des partenaires par l'Utilisateur.

2.4. L'Utilisateur peut avoir l'accès aux fonctionnalités de l'évaluation des services des Partenaires, ainsi que de la publication des commentaires ou des avis relatifs au Service ou aux services des partenaires. Les notes et les avis des Utilisateurs sont publiés sur le site du Service et peuvent également être accessibles depuis les sites des tiers. Yango se réserve le droit de refuser la publication de tous notes ou avis, ainsi que d'effacer ou de bloquer à tout moment la note/l'avis publiés par l'Utilisateur, à sa convenance et sans aucune explication.

2.5. Au cours des périodes où la demande de services est élevée (y compris les jours fériés, les jours des manifestations publiques et dans d'autres cas), les tarifs pour les services des partenaires peuvent être augmentés. Yango informe de l'augmentation des tarifs par la publication de la notification correspondante sur le site du Service, ou par l'envoi d'un message informationnel au numéro mobile de l'Utilisateur ou par tout autre moyen à la convenance de Yango.

2.6. Si le Service assure la réservation des services de livraison (ci-après — « réservation des services de livraison »), la commande sera disponible pour confirmation par le partenaire du Service à une heure plus proche de celle spécifiée par l'Utilisateur dans la commande (au plus tôt 30 minutes avant le début de la livraison réservée). Le coût des services réservés sera calculé et indiqué dans le Service lors de la commande des services de livraison. Le prix peut changer en fonction des circonstances indiquées sur le site web du service.

2.7. Le partenaire peut facturer des frais pour l'annulation de la commande du service par l'Utilisateur si cette annulation a lieu après l'arrivée du livreur à l'endroit indiqué par l'Utilisateur. Ce montant est calculé de la même façon que le coût de la prestation du service selon le tarif correspondant pour la période du moment de l'arrivée effective du livreur au lieu d'expédition ou du moment de l'arrivée du livreur au lieu d'expédition (selon la dernière éventualité) et jusqu'au moment de la renonciation de l'Utilisateur au service. L'Utilisateur peut annuler la commande du service en envoyant la notification correspondante au partenaire via le Service.

Il est considéré que l'Utilisateur a annulé le service s'il n'a pas remis le bien à livrer au lieu d'enlèvement du bien dans la délai de dix (10) minutes suivant l'arrivée effective du livreur, en tenant compte du temps d'attente spécifié pour le tarif correspondant (si applicable).

2.8. L'Utilisateur autorise Yango à traiter les informations personnelles (y compris les données à caractère personnel) de l'Utilisateur et à partager ces informations personnelles avec les partenaires, ainsi qu'à traiter ces informations personnelles dans le but de fournir à l'Utilisateur les fonctionnalités du Service. Lorsque l'Utilisateur accède au Service, ses informations personnelles sont transmises pour être traitées conformément aux conditions et aux fins définies dans la Politique de confidentialité disponible à l'adresse (https://yango.com/legal/yango_privacy_notice).

2.9. L'heure d'arrivée du représentant du partenaire au lieu d'expédition indiqué par l'Utilisateur dans la Demande est approximative et peut être modifiée en fonction des conditions de circulation et d'autres circonstances externes. Yango informe des changements d'heure d'arrivée d'un représentant du partenaire en envoyant un message d'information sur le numéro de téléphone portable de l'Utilisateur ou par tout autre moyen à la discrétion de Yango.

2.10. L'Utilisateur engage la responsabilité du contenu des envois remis aux partenaires et à leurs représentants et s'engage à ne pas remettre les objets suivants :

  • armes portatives de combat, armes non militaires et armes de service, munitions, pièces détachées et composants, arcs et arbalètes de sport, armes conçues pour émettre des signaux lumineux, fumigènes et sonores, armes électriques, dispositifs à électrochocs et coupures à étincelle, armes blanches, matraques, poings américains, shurikens, fléchettes, boomerangs et autres objets destinés pour frapper, écraser, lancer, poignarder et couper, à l'exception des équipements sportifs, des dispositifs techniques spéciaux et des composants à double utilisation, des feux d'artifice, des fusées et des cartouches de signalisation ;
  • stupéfiants, substances psychotropes, leurs précurseurs et analogues ;
  • substances actives, toxiques, radioactives, explosives, vénéneuses, corrosives, inflammables et autres substances dangereuses, y compris celles qui sont sous pression ;
  • poisons, animaux venimeux, substances vénéneuses, plantes vénéneuses et graines de plantes vénéneuses ;
  • monnaies nationales et étrangères ;
  • publications imprimées, matériaux graphiques, films, photos, matériaux audio et vidéo contenant de la propagande en faveur de changements violents du système constitutionnel, de la destruction de la sécurité nationale, de la guerre, de la supériorité sociale, raciale, nationale, religieuse, de classe et de clan, de la brutalité, de la violence et de la pornographie ;
  • denrées périssables sans emballage spécial ;
  • objets et substances qui, par leur nature ou en raison de leur emballage, peuvent être dangereux pour les personnes, contaminer ou détériorer (endommager) d'autres biens, des personnes ou des objets qui se trouvent à proximité d'eux ;
  • animaux et plantes, matériaux biologiques ;
  • objets nécessitant des véhicules spécialement équipés pour leur transport, y compris denrées alimentaires ;
  • liquides dans des récipients ouverts ;
  • objets encombrants dont la somme des gabarits (sauf cas particuliers) en longueur, largeur (deux diamètres ou axes à la base du rouleau) et hauteur dépasse 150 cm, objets dont la longueur dépasse 150 cm ; le poids des objets remis ne doit pas dépasser 20 kg. Si le service de livraison par un coursier est commandé, les gabarits (largeur, longueur, hauteur) des objets remis ne doivent pas dépasser 50x50x50 cm ; le poids des objets remis ne doit pas dépasser 10 kg ;
  • objets fragiles sans emballage spécial ;
  • tous autres objets dont la circulation est interdite ou limitée dans le pays où le service est fourni.

Les partenaires peuvent imposer des limitations supplémentaires en ce qui concerne les objets destinés à la livraison.

L'Utilisateur est informé des exigences spécifiées ci-dessus et il reconnaît qu'en cas de non-respect desdites exigences, il est seul responsable de toutes les conséquences négatives pouvant survenir lors de la prestation de services par les partenaires. Toutefois, le partenaire ou son représentant a le droit de refuser de fournir le service à l'Utilisateur si la présence des objets dont la livraison n'est pas admise est constatée.

2.11. Le partenaire ou son représentant accepte les objets destinés à la livraison en définissant le nombre de colis sans que le partenaire ou son représentant vérifie le contenu de l'emballage de l'objet, à condition que l'objet soit emballé de manière adéquate.

2.12. L'Utilisateur accepte que l'objet expédié soit considéré comme livré au destinataire à condition que l'emballage de l'objet soit intact (pas de traces d'ouverture, d'endommagement de l'emballage ou d'autres signes caractéristiques d'un impact physique).

 

3. Fonctionnalité de paiement sans espèces

3.1. Le paiement du service de livraison ou des autres services fournis à l'Utilisateur conformément à l'information publiée par lui à l'aide du Service relative à la demande du service correspondant peut être effectué de manière suivante :

3.1.1. Directement au prestataire des services en espèces ou par tous autres moyens prévus par les fonctionnalités du Service (ci-après dénommés dans le texte des présentes Conditions et dans l'interface du Service « Espèces »). Le paiement par le moyen de paiement susmentionné est effectué sans participation de Yango et n'est pas régi par les présentent Conditions.

3.1.2. Au moyen d'un paiement sans espèces, à l'aide d'une Carte bancaire attachée (paragraphe 3.5. des présentes Conditions) ; dans ce cas Yango agit de la part du partenaire correspondant et fait intervenir le processeur de paiement agréé, le processeur de paiement électronique ou tout autre entité participant au règlement assurant l'interaction informatique et technique et est le bénéficiaire du paiement en qualité de l'agent du Partenaire (ci-après — « paiement sans espèces »). Yango ne garantit pas l’absence d'erreurs et de défaut de fonctionnement du Service en ce qui concerne la possibilité du paiement sans espèces, en outre, la société Yango a le droit de faire intervenir les tiers (sous-agents) pour assurer le respect des engagements pris par Yango.

Selon la région de l'Utilisateur, les paiements sans espèces peuvent être effectués sans participation de Yango en qualité du bénéficiaire du paiement ou avec la participation de Yango en qualité de l'autre partie au règlement ou de la partie à l'échange d'informations.

3.2. Le choix du moyen de paiement est effectué par l'Utilisateur dans interface du Service. Si l'Utilisateur choisit le paiement sans espèces, le paiement en espèces ou utilisation d'un autre mode de paiement directement au représentant du partenaire n'est pas autorisé sans notification supplémentaire à Yango faite par voie de modification du mode de paiement à l'aide de l'interface du Service (s'il y a une telle possibilité). Le prélèvement des fonds par Yango sur la Carte bancaire attachée est considéré comme correct et approprié à la méthode de paiement choisie par l'Utilisateur, aucun remboursement n'est effectué à la suite de l'annulation du prélèvement.

Toutefois, dans le cas où il est impossible d'effectuer le paiement sans espèces pour toute raison que ce soit (y compris, mais sans s'y limiter, dans le cas d'inaccessibilité technique temporaire de cette fonctionnalité, d'impossibilité temporaire ou permanente d'effectuer le paiement sans espèces avec une Carte bancaire attachée, insuffisance de fonds sur la Carte bancaire attachée), l'Utilisateur s'engage à garantir la disponibilité de fonds suffisants sur la Carte bancaire attachée pour couvrir le solde restant dû au partenaire dans les meilleurs délais et, en tout état de cause, au plus tard 30 jours civils après la prestation du service concerné à l'Utilisateur.

3.3. Dans le cas du paiement sans espèces, à la convenance de Yango, il est possible d'effectuer une seule transaction pour le montant total correspondant au coût du service, ainsi que plusieurs transactions correspondant aux certaines parties du prix du service. Dans ce cas, le paiement peut être effectué par tout moyen susmentionné au cours de la prestation du service ou après son achèvement.

3.4. La Carte bancaire attachée peut être identifiée dans l'interface du Service par l'Utilisateur qui fournit des données suivantes :

  • Numéro de la carte bancaire
  • Date de validité
  • Cryptogramme visuel

Si les données relatives à la carte bancaire sont exactes et valables, et si l'utilisation de cette carte dans le cadre du Service est possible du point de vue technique, la carte bancaire susmentionnée acquiert le statut de la Carte bancaire attachée et peut être utilisée pour le paiement sans espèces (paragraphe 3.1.2. des présentes Conditions). Toutes les Cartes attachées s'affichent dans l'interface du Service ; par souci de commodité de l'Utilisateur, 4 derniers chiffres du numéro de la Carte attachée sont affichés.

La Carte attachée peut également être spécifiée par l'Utilisateur dans l'interface de services tiers qui supportent l'intégration avec le Service et les participants au paiement et qui assurent l'autorisation du paiement fait par l'Utilisateur sans transmettre d'informations sur la Carte attachée au Service de Yango.

Les modalités de l'utilisation des services des tiers visés dans le présent paragraphe est régie par les règles desdits tiers. Yango n'engage pas la responsabilité pour l'utilisation de ces services tiers par l'Utilisateur et ne garantit pas l'exactitude et la sécurité de ces services des tiers.

3.5. Lors de l'addition d'une Carte attachée, ainsi que dans le cas où la fonctionnalité de paiement sans espèces est choisi par l'Utilisateur pour le paiement d'un service concret, le prélèvement d'un montant correspondant à 1 dollar américain au maximum est effectué dans le but de vérifier l'exactitude et la validité des données de la Carte attachée ; dans le cas de la transaction réussie, le montant indiqué est remboursé à l'Utilisateur. La tentative échouée du prélèvement du montant indiqué signifie l'impossibilité d'adjonction de cette Carte attachée et/ou l'inaccessibilité de la fonctionnalité de paiement sans espèces.

3.6. Lors du paiement sans espèces d'un service, l'Utilisateur a la possibilité d'effectuer, à sa convenance, un paiement sans espèces complémentaire au bénéfice du Partenaire dont le montant est égal à un certain taux du coût du service payé (ci-après dénommé dans le texte des présentes Conditions et dans l'interface du Service « Pourboire »).

3.7. Lors de l'adjonction de la Carte attachée, ainsi qu'à tout moment après son adjonction, l'Utilisateur a la possibilité de fixer ou de modifier le montant du Pourboire par défaut dans l'interface du Service ; le montant du Pourboire pour un service concret peut être modifié par l'Utilisateur dans l'interface du Service après l'achèvement de la prestation de ce service.

3.8. Le Pourboire (montant par défaut ou montant spécialement indiqué par l'Utilisateur pour un service concret) sera prélevé sur la Carte attachée, si, au cours de 30 minutes après l'achèvement de la prestation du service, l'Utilisateur donne une note positive (4 à 5 étoiles) et appuie le bouton « Terminé » ou s'il n'attribue aucune note au service (n'indique pas le nombre d'étoiles) et appuie le bouton « Terminé ».

3.9. Dans le cas où, au cours de 30 minutes après l'achèvement de la prestation du service, l'Utilisateur donne une note négative (1 à 3 étoiles) et appuie le bouton « Terminé », le Pourboire ne sera pas prélevé sur la Carte attachée.

3.10. Dans le cas où, au cours de 30 minutes après la prestation du service, l'Utilisateur appuie le bouton « Terminé », le montant du Pourboire (montant par défaut ou montant indiqué par l'Utilisateur spécialement pour un service concret) sera bloqué sur la Carte attachée pendant 24 heures au cours desquelles l'Utilisateur a la possibilité d’augmenter et de réduire le montant du Pourboire pour le service correspondant. Après l'achèvement de la période indiquée, le prélèvement du Pourboire dont le montant a été fixé par l'Utilisateur (par défaut ou pour le service concret) est effectué.

3.11. Yango n'a pas d'accès aux données des cartes bancaires fournies par l'Utilisateur et n'engage pas la responsabilité pour la sécurité et pour la confidentialité des données transmises lors des paiements sans espèces. Le paiement sans espèces est effectué par l'Utilisateur avec la participation du processeur de paiement agréé, du processeur de paiement électronique ou d'une autre entité participant au règlement et assurant l'interaction informatique et technique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement.

3.12. Lors de l'indication de ses données conformément au paragraphe 3.5. des présentes Conditions et lors de l'utilisation ultérieure de la Carte attachée, l'Utilisateur confirme et garantit l'exactitude et l'exhaustivité des informations fournies relatives à la carte bancaire valable émise à son nom ; le respect par lui des règles des systèmes de paiements internationaux et des exigences de la banque émettrice de la Carte attachée, y compris en ce qui concerne les modalités de la réalisation des paiements sans espèces.

3.13. L'Utilisateur comprend et accepte que toutes les actions effectuées dans le cadre du Service avec l'utilisation du numéro mobile confirmé par lui, y compris en ce qui concerne le paiement sans espèces à l'aide de la Carte bancaire attachée sont réputées d'avoir été effectuées par l'Utilisateur.

3.14. Dans le cas du désaccord de l'Utilisateur avec le fait et/ou avec le montant du paiement sans numéraire et dans le cas des questions liées à l'utilisation de la Carte attachée dans le cadre du Service, l'Utilisateur a le droit de s'adresser à Yango par téléphone dont les numéros sont indiqués par le Service et/ou via l'interface du service assistance clients (formulaire de contact) dans le délai de 14 jours à compter de la date de réalisation du paiement sans espèces ou de la date des autres actions ou événements faisant l'objet de la demande.

Si, suite à la vérification d'une telle demande Yango prend la décision de remboursement intégral ou partiel du montant du paiement sans espèces, ce remboursement est effectué sur le compte bancaire de la carte bancaire qui a été utilisée pour le paiement sans espèces. Le remboursement des fonds est effectué par l'Utilisateur avec la participation du processeur de paiement agréé, du processeur de paiement électronique ou d'une autre entité participant au règlement et assurant l'interaction informatique et technique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement.

3.15. Yango se réserve le droit d'exiger à tout moment la justification par l'Utilisateur des données indiquées par lui dans le cadre du Service, y compris des données de la Carte attachée et de demander pour cela de fournir des pièces justificatives (notamment, des pièces d'identité) dont le défaut de présentation peut, à la convenance de Yango, être considéré comme la présentation des informations inexactes et peut entraîner les conséquences prévues dans les présentes Conditions.

Les dispositions relatives aux conditions et aux modalités de paiement des services de livraison spécifiées dans la présente section ne s'appliquent pas lorsqu'un tiers paie ces services à la place de l'Utilisateur en vertu d'un accord distinct signé par Yango avec ce tiers.

Terms of Use of Yango Delivery

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Delivery FZ-LLC (hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango Delivery service (hereinafter referred to as the Service).

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yango may, at any time amend provisions of the Terms without notice to the User. The current version hereof is available at: https://yango.com/legal/yango_termsofuse_delivery.

1.4. The User shall stop using the Service, if he or she disagrees with any amendments to the Terms. If User continues using the Service, it is considered as provision of his or her express consent to the new terms and conditions.

1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for delivery services or other services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

1.7. For the avoidance of doubt, Yango does not provide delivery services. Nothing in these Terms shall be interpreted in a way that Yango is performing delivery services, or that the User has engaged Yango for such delivery services, or that the third-party partner who is actually providing such services is an agent or subcontractor of Yango. Delivery services is done exclusively by the third-party providers, who provide those services as an individual, standalone service providers, in their own name and for their own account, and shall be obliged to have all necessary licenses and permits and to comply with all other requirements. The Service is aimed at the User to place its request and engage the third-party partner directly, and Yango does not bear any responsibility or liability for the third-party partners or the services they provide, neither to the User not to any other person.

1.8. All conversations the User holds with the support team and partners of the Service can be recorded to control quality and improve services.

1.9. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.10. Yango reserves the right to limit User access to the Service temporarily or permanently without explanation, including a case of violation of these Terms by the User, receipt of an order from an authorized body, causing damage to Yango or to third parties (as well as to prevent such actions), creating danger to others, protecting the rights and legitimate interests of Yango and third parties, receiving repeated complaints about the actions of the User or persons, in respect of which the User places through the Service information about the potential demand for delivery services or other services, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

1.11. Compensation policy regulating the terms of managing compensation of the damage occurred as the result of placing the request for the delivery services via the Yango electronic delivery platform in Ghana is available at: https://yango.com/legal/compensation_policy_delivery_ghana.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services is provided by partners of the Service. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. When demand for services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yango thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.7. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

The User is considered to have cancelled a service if he or she has not delivered the shipment for delivery to the pick-up place within 10 (ten) minutes from the moment of the courier's actual arrival, taking into account waiting time specified for the corresponding tariff (if applicable).

2.8. The User authorizes Yango to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.9. The time of arrival of the courier at the place of departure indicated by the User in the Request is approximate and can be changed depending on the traffic situation and other external factors. Yango notifies about the change in the arrival time of the courier by sending an information message to the User's mobile phone number or otherwise at the discretion of Yango.

2.10. The User is responsible for the contents of the items transferred for delivery to partners and couriers, and undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components, fireworks, flares and ammunition;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg. In case of ordering a delivery service by foot courier, the size of the transferred items (width, length, height) cannot exceed 50x50x50; the weight of the transferred items cannot exceed 10 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Yango’s partners may set other limits on items to be delivered.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yango’s partner provide delivery services. At the same time, a Yango’s partner may deny delivery services to the User, if the Yango’s partner/ representatives of the Yango’s partner discover any non-deliverable items.

2.11. The Partner or his Representative accepts shipments for delivery according to the number of packages, provided that the package of the shipment is satisfactory, without checking the internal contents by the Partner or his Representative.

2.12. The User agrees that the shipment is considered delivered to the recipient, provided that the package of the shipment is intact (there are no traces of opening the package, damage to the package and other characteristic traces of physical impact).

 

3. Function of cashless payment for delivery and other services

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yango acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango acting as a payment recipient or with Yango involved as another party to settlements or a party to information exchange.

3.2. The User shall choose the relevant form of payment in the Service interface. If the User selects a wire payment, the payment to the partner's address in Cash or otherwise directly to the partner's representative, without additional notification of Yango by changing the payment method in the Service interface (if possible), shall be prohibited. The debit of Yango funds from the Linked Card shall be deemed correct and corresponding to the payment method selected by the User, and no refund shall be made by canceling the debit.

At the same time, if it is impossible to pay by wire for any reason (including, but not limited to, temporary technical unavailability of this function, temporary or permanent impossibility of wire payment using a Linked Card, insufficient funds on the Linked Card), the User undertakes to ensure there is sufficient funds on the Linked Card to repay the arrears on Partner's services as soon as possible, but in any case no later than 30 calendar days from the moment of rendering the relevant service to the User.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.4. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

The User may also indicate the Linked Card in the interface of third-party services supporting integration with the Service and payment participants and providing authorization of the User's payment without transmitting information about the Linked Card to Yango.

The procedure for using the third-party services specified in this Clause shall be governed by the rules stipulated by such third parties. Yango shall not be liable for the User's use of such third-party services and shall not guarantee the correctness and safety of such third-party services.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yango does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.12. When indicating their details pursuant to cl. 3.5 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.13. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.14. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.15. Yango reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated hereof, if Yango thinks fit.

3.16. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yango signed with such third party.

Terms of Use of Yango Delivery

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Delivery FZ-LLC (hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango Delivery service (hereinafter referred to as the Service).

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yango may, at any time amend provisions of the Terms without notice to the User. The current version hereof is available at: https://yango.com/legal/yango_termsofuse_delivery.

1.4. The User shall stop using the Service, if he or she disagrees with any amendments to the Terms. If User continues using the Service, it is considered as provision of his or her express consent to the new terms and conditions.

1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for delivery services or other services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

1.7. For the avoidance of doubt, Yango does not provide delivery services. Nothing in these Terms shall be interpreted in a way that Yango is performing delivery services, or that the User has engaged Yango for such delivery services, or that the third-party partner who is actually providing such services is an agent or subcontractor of Yango. Delivery services is done exclusively by the third-party providers, who provide those services as an individual, standalone service providers, in their own name and for their own account, and shall be obliged to have all necessary licenses and permits and to comply with all other requirements. The Service is aimed at the User to place its request and engage the third-party partner directly, and Yango does not bear any responsibility or liability for the third-party partners or the services they provide, neither to the User not to any other person.

1.8. All conversations the User holds with the support team and partners of the Service can be recorded to control quality and improve services.

1.9. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.10. Yango reserves the right to limit User access to the Service temporarily or permanently without explanation, including a case of violation of these Terms by the User, receipt of an order from an authorized body, causing damage to Yango or to third parties (as well as to prevent such actions), creating danger to others, protecting the rights and legitimate interests of Yango and third parties, receiving repeated complaints about the actions of the User or persons, in respect of which the User places through the Service information about the potential demand for delivery services or other services, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services is provided by partners of the Service. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. When demand for services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yango thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.7. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

The User is considered to have cancelled a service if he or she has not delivered the shipment for delivery to the pick-up place within 10 (ten) minutes from the moment of the courier's actual arrival, taking into account waiting time specified for the corresponding tariff (if applicable).

2.8. The User authorizes Yango to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.9. The time of arrival of the courier at the place of departure indicated by the User in the Request is approximate and can be changed depending on the traffic situation and other external factors. Yango notifies about the change in the arrival time of the courier by sending an information message to the User's mobile phone number or otherwise at the discretion of Yango.

2.10. The User is responsible for the contents of the items transferred for delivery to partners and couriers, and undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components, fireworks, flares and ammunition;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg. In case of ordering a delivery service by foot courier, the size of the transferred items (width, length, height) cannot exceed 50x50x50; the weight of the transferred items cannot exceed 10 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Yango’s partners may set other limits on items to be delivered.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yango’s partner provide delivery services. At the same time, a Yango’s partner may deny delivery services to the User, if the Yango’s partner/ representatives of the Yango’s partner discover any non-deliverable items.

2.11. The Partner or his Representative accepts shipments for delivery according to the number of packages, provided that the package of the shipment is satisfactory, without checking the internal contents by the Partner or his Representative.

2.12. The User agrees that the shipment is considered delivered to the recipient, provided that the package of the shipment is intact (there are no traces of opening the package, damage to the package and other characteristic traces of physical impact).

 

3. Function of cashless payment for delivery and other services

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yango acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango acting as a payment recipient or with Yango involved as another party to settlements or a party to information exchange.

3.2. The User shall choose the relevant form of payment in the Service interface. If the User selects a wire payment, the payment to the partner's address in Cash or otherwise directly to the partner's representative, without additional notification of Yango by changing the payment method in the Service interface (if possible), shall be prohibited. The debit of Yango funds from the Linked Card shall be deemed correct and corresponding to the payment method selected by the User, and no refund shall be made by canceling the debit.

At the same time, if it is impossible to pay by wire for any reason (including, but not limited to, temporary technical unavailability of this function, temporary or permanent impossibility of wire payment using a Linked Card, insufficient funds on the Linked Card), the User undertakes to ensure there is sufficient funds on the Linked Card to repay the arrears on Partner's services as soon as possible, but in any case no later than 30 calendar days from the moment of rendering the relevant service to the User.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.4. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

The User may also indicate the Linked Card in the interface of third-party services supporting integration with the Service and payment participants and providing authorization of the User's payment without transmitting information about the Linked Card to Yango.

The procedure for using the third-party services specified in this Clause shall be governed by the rules stipulated by such third parties. Yango shall not be liable for the User's use of such third-party services and shall not guarantee the correctness and safety of such third-party services.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yango does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

1. Dispositions générales

1.1. Les présentes Conditions (ci-après — « Conditions ») représentent une offre de la société Yango Delivery FZ-LLC (ci-après — « Yango ») à l'utilisateur du réseau Internet (ci-après — « Utilisateur ») concernant l'utilisation du service Yango Delivery (ci-après — « Service »).

1.2. Il est considéré qu'en procédant à l'utilisation du Service ou de ces fonctionnalités séparées, l'Utilisateur accepte les présentes Conditions dans leur intégrité, sans aucune restriction ni réserve. Dans le cas où l'Utilisateur n'accepte pas une des dispositions des Conditions et/ou des Documents réglementaires, l'Utilisateur ne peut pas utiliser le Service.

1.3. Yango a le droit de modifier les dispositions des présentes Conditions à tout moment et sans notification à l'Utilisateur. La version en vigueur des présents Conditions est publiée à : https://yango.com/legal/yango_termsofuse_delivery.

1.4. L'Utilisateur doit cesser d'utiliser le Service s'il n'est pas d'accord avec les modifications apportées aux présentes Conditions. La poursuite de l'utilisation du Service après la modification des Conditions sera considérée comme l'acceptation explicite par l'Utilisateur de leur version modifiée.

1.5. Le Service donne à l'Utilisateur la possibilité de publier, à titre gratuit, l'information relative à la demande potentielle de l'Utilisateur de service de livraison ou d'autres services, ainsi que la possibilité de prendre connaissance des informations relatives aux offres des organisations qui fournissent des services dans le domaine susmentionné et de rechercher de telles offres selon les critères fixés par l'Utilisateur. Toutes les fonctionnalités du Service existant actuellement, ainsi que tout leur développement ou l'adjonction de toutes fonctionnalités nouvelles constituent l'objet des présentes Conditions.

1.6. En fonction de la région de séjour de l'Utilisateur, l'accès à toutes ou à certaines fonctionnalités du Services peuvent être bloqué ou limité. L'accès de l'Utilisateur aux fonctionnalités depuis une certaine région est considéré comme bloqué (limité), si l'Utilisateur ne peut pas s'en servir directement. L'application de tous moyens techniques ou logiciels pour contourner ces limitations est interdite. Les dispositions des présentes Conditions qui régissent les fonctionnalités du Service l'accès auxquelles est bloqué (limité) pour l'Utilisateur ne sont pas applicables jusqu'à ce que l'Utilisateur ne puisse s'en servir directement. Les informations concernant l'accessibilité des fonctionnalités du Services dans une région correspondante sont fournies à l'Utilisateur à la demande de celui-ci adressée à Yango.

1.7. Pour éviter toute ambiguïté, Yango ne fournit pas de service de livraison. Rien dans les présentes Conditions ne doit être interprété comme impliquant que Yango fournit les services de livraison, ou que l'Utilisateur a engagé Yango pour la prestation de tels services de livraison, ou que le partenaire tiers qui fournit effectivement de tels services est un agent ou un sous-traitant de Yango. Les services de livraison sont réalisés exclusivement par des prestataires tiers qui fournissent ces services en tant que prestataires de services indépendants et autonomes, pour leur propre compte et à leurs propres frais, et qui sont tenus de disposer de toutes les licences et autorisations nécessaires et de respecter toutes les autres exigences. Le Service est conçu pour permettre à l'Utilisateur de placer sa demande et d’engager directement un partenaire tiers, et Yango n'engage aucune responsabilité pour les partenaires tiers ou pour les services qu'ils fournissent, que ce soit envers l'Utilisateur ou envers toute autre personne.

1.8. L'Utilisateur accepte que toutes les conversations qu'il a avec le service d'assistance et les partenaires soient enregistrées à des fins de contrôle de la qualité et de développement des services.

1.9. Par l'utilisation du Service, l'Utilisateur donne son accord pour la réception des messages publicitaires. L'Utilisateur a le droit de renonces à la réception des messages publicitaires, en appliquant les fonctionnalités correspondantes du Service ou en suivant les indications du message publicitaire reçu.

1.10. Yango a le droit de limiter temporairement ou définitivement l'utilisation du Service par l'Utilisateur sans motiver sa décision, y compris en cas de violation des présentes Conditions par l'Utilisateur, de réception d'un ordre d'un organisme autorisé, de dommages causés à Yango ou à des tiers (ainsi que pour la prévention de telles dommages), de création de danger pour les autres, de protection des droits et des intérêts légitimes de Yango et de tiers, de réception de plaintes répétées concernant les actions de l'Utilisateur ou de personnes pour lesquelles l'Utilisateur publie des informations sur la demande potentielle de services de livraison et/ou d'autres services par l'intermédiaire du Service, ainsi que de prendre toutes autres mesures concernant l'Utilisateur qui doivent assurer le respect des exigences de la législation ou des droits et des intérêts légitimes des tiers.

 

2. Utilisation du Service. Certaines fonctionnalités du Service

2.1. Le Service est mis à disposition de l'Utilisateur pour l'utilisation personnel non commercial.

2.2. Les informations sur les services de livraison et/ou sur des autres services sont fournies par les partenaires du Service. Pour plus d'informations sur les services proposés, l'Utilisateur peut contacter les partenaires du Service ou fournir ses coordonnées via les fonctionnalités du Service, afin que les partenaires du Service puissent contacter l'Utilisateur eux-mêmes et lui fournir des informations sur les services proposés.

2.3. Yango n'engage pas la responsabilité pour le contenu ou pour l'actualité des informations fournies par les partenaires du Service, y compris pour les informations relatives aux prix des services des partenaires, ainsi que à leur disponibilité à un moment donné. L'interaction de l'Utilisateur avec le partenaire concernant l'acquisition des services est effectuée par l'Utilisateur lui-même (sans participation de Yango), conformément aux règles de la prestation des services définies par les partenaires. Yango n'engage pas la responsabilité pour les opérations financières et pour toutes autres opérations effectuées par l'Utilisateur et par le partenaire, ainsi que pour toutes les conséquences de l'acquisition des services des partenaires par l'Utilisateur.

2.4. L'Utilisateur peut avoir l'accès aux fonctionnalités de l'évaluation des services des Partenaires, ainsi que de la publication des commentaires ou des avis relatifs au Service ou aux services des partenaires. Les notes et les avis des Utilisateurs sont publiés sur le site du Service et peuvent également être accessibles depuis les sites des tiers. Yango se réserve le droit de refuser la publication de tous notes ou avis, ainsi que d'effacer ou de bloquer à tout moment la note/l'avis publiés par l'Utilisateur, à sa convenance et sans aucune explication.

2.5. Au cours des périodes où la demande de services est élevée (y compris les jours fériés, les jours des manifestations publiques et dans d'autres cas), les tarifs pour les services des partenaires peuvent être augmentés. Yango informe de l'augmentation des tarifs par la publication de la notification correspondante sur le site du Service, ou par l'envoi d'un message informationnel au numéro mobile de l'Utilisateur ou par tout autre moyen à la convenance de Yango.

2.6. Si le Service assure la réservation des services de livraison (ci-après — « réservation des services de livraison »), la commande sera disponible pour confirmation par le partenaire du Service à une heure plus proche de celle spécifiée par l'Utilisateur dans la commande (au plus tôt 30 minutes avant le début de la livraison réservée). Le coût des services réservés sera calculé et indiqué dans le Service lors de la commande des services de livraison. Le prix peut changer en fonction des circonstances indiquées sur le site web du service.

2.7. Le partenaire peut facturer des frais pour l'annulation de la commande du service par l'Utilisateur si cette annulation a lieu après l'arrivée du livreur à l'endroit indiqué par l'Utilisateur. Ce montant est calculé de la même façon que le coût de la prestation du service selon le tarif correspondant pour la période du moment de l'arrivée effective du livreur au lieu d'expédition ou du moment de l'arrivée du livreur au lieu d'expédition (selon la dernière éventualité) et jusqu'au moment de la renonciation de l'Utilisateur au service. L'Utilisateur peut annuler la commande du service en envoyant la notification correspondante au partenaire via le Service.

Il est considéré que l'Utilisateur a annulé le service s'il n'a pas remis le bien à livrer au lieu d'enlèvement du bien dans la délai de dix (10) minutes suivant l'arrivée effective du livreur, en tenant compte du temps d'attente spécifié pour le tarif correspondant (si applicable).

2.8. L'Utilisateur autorise Yango à traiter les informations personnelles (y compris les données à caractère personnel) de l'Utilisateur et à partager ces informations personnelles avec les partenaires, ainsi qu'à traiter ces informations personnelles dans le but de fournir à l'Utilisateur les fonctionnalités du Service. Lorsque l'Utilisateur accède au Service, ses informations personnelles sont transmises pour être traitées conformément aux conditions et aux fins définies dans la Politique de confidentialité disponible à l'adresse (https://yango.com/legal/yango_privacy_notice).

2.9. L'heure d'arrivée du représentant du partenaire au lieu d'expédition indiqué par l'Utilisateur dans la Demande est approximative et peut être modifiée en fonction des conditions de circulation et d'autres circonstances externes. Yango informe des changements d'heure d'arrivée d'un représentant du partenaire en envoyant un message d'information sur le numéro de téléphone portable de l'Utilisateur ou par tout autre moyen à la discrétion de Yango.

2.10. L'Utilisateur engage la responsabilité du contenu des envois remis aux partenaires et à leurs représentants et s'engage à ne pas remettre les objets suivants :

  • armes portatives de combat, armes non militaires et armes de service, munitions, pièces détachées et composants, arcs et arbalètes de sport, armes conçues pour émettre des signaux lumineux, fumigènes et sonores, armes électriques, dispositifs à électrochocs et coupures à étincelle, armes blanches, matraques, poings américains, shurikens, fléchettes, boomerangs et autres objets destinés pour frapper, écraser, lancer, poignarder et couper, à l'exception des équipements sportifs, des dispositifs techniques spéciaux et des composants à double utilisation, des feux d'artifice, des fusées et des cartouches de signalisation ;
  • stupéfiants, substances psychotropes, leurs précurseurs et analogues ;
  • substances actives, toxiques, radioactives, explosives, vénéneuses, corrosives, inflammables et autres substances dangereuses, y compris celles qui sont sous pression ;
  • poisons, animaux venimeux, substances vénéneuses, plantes vénéneuses et graines de plantes vénéneuses ;
  • monnaies nationales et étrangères ;
  • publications imprimées, matériaux graphiques, films, photos, matériaux audio et vidéo contenant de la propagande en faveur de changements violents du système constitutionnel, de la destruction de la sécurité nationale, de la guerre, de la supériorité sociale, raciale, nationale, religieuse, de classe et de clan, de la brutalité, de la violence et de la pornographie ;
  • denrées périssables sans emballage spécial ;
  • objets et substances qui, par leur nature ou en raison de leur emballage, peuvent être dangereux pour les personnes, contaminer ou détériorer (endommager) d'autres biens, des personnes ou des objets qui se trouvent à proximité d'eux ;
  • animaux et plantes, matériaux biologiques ;
  • objets nécessitant des véhicules spécialement équipés pour leur transport, y compris denrées alimentaires ;
  • liquides dans des récipients ouverts ;
  • objets encombrants dont la somme des gabarits (sauf cas particuliers) en longueur, largeur (deux diamètres ou axes à la base du rouleau) et hauteur dépasse 150 cm, objets dont la longueur dépasse 150 cm ; le poids des objets remis ne doit pas dépasser 20 kg. Si le service de livraison par un coursier est commandé, les gabarits (largeur, longueur, hauteur) des objets remis ne doivent pas dépasser 50x50x50 cm ; le poids des objets remis ne doit pas dépasser 10 kg ;
  • objets fragiles sans emballage spécial ;
  • tous autres objets dont la circulation est interdite ou limitée dans le pays où le service est fourni.

Les partenaires peuvent imposer des limitations supplémentaires en ce qui concerne les objets destinés à la livraison.

L'Utilisateur est informé des exigences spécifiées ci-dessus et il reconnaît qu'en cas de non-respect desdites exigences, il est seul responsable de toutes les conséquences négatives pouvant survenir lors de la prestation de services par les partenaires. Toutefois, le partenaire ou son représentant a le droit de refuser de fournir le service à l'Utilisateur si la présence des objets dont la livraison n'est pas admise est constatée.

2.11. Le partenaire ou son représentant accepte les objets destinés à la livraison en définissant le nombre de colis sans que le partenaire ou son représentant vérifie le contenu de l'emballage de l'objet, à condition que l'objet soit emballé de manière adéquate.

2.12. L'Utilisateur accepte que l'objet expédié soit considéré comme livré au destinataire à condition que l'emballage de l'objet soit intact (pas de traces d'ouverture, d'endommagement de l'emballage ou d'autres signes caractéristiques d'un impact physique).

 

3. Fonctionnalité de paiement sans espèces

3.1. Le paiement du service de livraison ou des autres services fournis à l'Utilisateur conformément à l'information publiée par lui à l'aide du Service relative à la demande du service correspondant peut être effectué de manière suivante :

3.1.1. Directement au prestataire des services en espèces ou par tous autres moyens prévus par les fonctionnalités du Service (ci-après dénommés dans le texte des présentes Conditions et dans l'interface du Service « Espèces »). Le paiement par le moyen de paiement susmentionné est effectué sans participation de Yango et n'est pas régi par les présentent Conditions.

3.1.2. Au moyen d'un paiement sans espèces, à l'aide d'une Carte bancaire attachée (paragraphe 3.5. des présentes Conditions) ; dans ce cas Yango agit de la part du partenaire correspondant et fait intervenir le processeur de paiement agréé, le processeur de paiement électronique ou tout autre entité participant au règlement assurant l'interaction informatique et technique et est le bénéficiaire du paiement en qualité de l'agent du Partenaire (ci-après — « paiement sans espèces »). Yango ne garantit pas l’absence d'erreurs et de défaut de fonctionnement du Service en ce qui concerne la possibilité du paiement sans espèces, en outre, la société Yango a le droit de faire intervenir les tiers (sous-agents) pour assurer le respect des engagements pris par Yango.

Selon la région de l'Utilisateur, les paiements sans espèces peuvent être effectués sans participation de Yango en qualité du bénéficiaire du paiement ou avec la participation de Yango en qualité de l'autre partie au règlement ou de la partie à l'échange d'informations.

3.2. Le choix du moyen de paiement est effectué par l'Utilisateur dans interface du Service. Si l'Utilisateur choisit le paiement sans espèces, le paiement en espèces ou utilisation d'un autre mode de paiement directement au représentant du partenaire n'est pas autorisé sans notification supplémentaire à Yango faite par voie de modification du mode de paiement à l'aide de l'interface du Service (s'il y a une telle possibilité). Le prélèvement des fonds par Yango sur la Carte bancaire attachée est considéré comme correct et approprié à la méthode de paiement choisie par l'Utilisateur, aucun remboursement n'est effectué à la suite de l'annulation du prélèvement.

Toutefois, dans le cas où il est impossible d'effectuer le paiement sans espèces pour toute raison que ce soit (y compris, mais sans s'y limiter, dans le cas d'inaccessibilité technique temporaire de cette fonctionnalité, d'impossibilité temporaire ou permanente d'effectuer le paiement sans espèces avec une Carte bancaire attachée, insuffisance de fonds sur la Carte bancaire attachée), l'Utilisateur s'engage à garantir la disponibilité de fonds suffisants sur la Carte bancaire attachée pour couvrir le solde restant dû au partenaire dans les meilleurs délais et, en tout état de cause, au plus tard 30 jours civils après la prestation du service concerné à l'Utilisateur.

3.3. Dans le cas du paiement sans espèces, à la convenance de Yango, il est possible d'effectuer une seule transaction pour le montant total correspondant au coût du service, ainsi que plusieurs transactions correspondant aux certaines parties du prix du service. Dans ce cas, le paiement peut être effectué par tout moyen susmentionné au cours de la prestation du service ou après son achèvement.

3.4. La Carte bancaire attachée peut être identifiée dans l'interface du Service par l'Utilisateur qui fournit des données suivantes :

  • Numéro de la carte bancaire
  • Date de validité
  • Cryptogramme visuel

Si les données relatives à la carte bancaire sont exactes et valables, et si l'utilisation de cette carte dans le cadre du Service est possible du point de vue technique, la carte bancaire susmentionnée acquiert le statut de la Carte bancaire attachée et peut être utilisée pour le paiement sans espèces (paragraphe 3.1.2. des présentes Conditions). Toutes les Cartes attachées s'affichent dans l'interface du Service ; par souci de commodité de l'Utilisateur, 4 derniers chiffres du numéro de la Carte attachée sont affichés.

La Carte attachée peut également être spécifiée par l'Utilisateur dans l'interface de services tiers qui supportent l'intégration avec le Service et les participants au paiement et qui assurent l'autorisation du paiement fait par l'Utilisateur sans transmettre d'informations sur la Carte attachée au Service de Yango.

Les modalités de l'utilisation des services des tiers visés dans le présent paragraphe est régie par les règles desdits tiers. Yango n'engage pas la responsabilité pour l'utilisation de ces services tiers par l'Utilisateur et ne garantit pas l'exactitude et la sécurité de ces services des tiers.

3.5. Lors de l'addition d'une Carte attachée, ainsi que dans le cas où la fonctionnalité de paiement sans espèces est choisi par l'Utilisateur pour le paiement d'un service concret, le prélèvement d'un montant correspondant à 1 dollar américain au maximum est effectué dans le but de vérifier l'exactitude et la validité des données de la Carte attachée ; dans le cas de la transaction réussie, le montant indiqué est remboursé à l'Utilisateur. La tentative échouée du prélèvement du montant indiqué signifie l'impossibilité d'adjonction de cette Carte attachée et/ou l'inaccessibilité de la fonctionnalité de paiement sans espèces.

3.6. Lors du paiement sans espèces d'un service, l'Utilisateur a la possibilité d'effectuer, à sa convenance, un paiement sans espèces complémentaire au bénéfice du Partenaire dont le montant est égal à un certain taux du coût du service payé (ci-après dénommé dans le texte des présentes Conditions et dans l'interface du Service « Pourboire »).

3.7. Lors de l'adjonction de la Carte attachée, ainsi qu'à tout moment après son adjonction, l'Utilisateur a la possibilité de fixer ou de modifier le montant du Pourboire par défaut dans l'interface du Service ; le montant du Pourboire pour un service concret peut être modifié par l'Utilisateur dans l'interface du Service après l'achèvement de la prestation de ce service.

3.8. Le Pourboire (montant par défaut ou montant spécialement indiqué par l'Utilisateur pour un service concret) sera prélevé sur la Carte attachée, si, au cours de 30 minutes après l'achèvement de la prestation du service, l'Utilisateur donne une note positive (4 à 5 étoiles) et appuie le bouton « Terminé » ou s'il n'attribue aucune note au service (n'indique pas le nombre d'étoiles) et appuie le bouton « Terminé ».

3.9. Dans le cas où, au cours de 30 minutes après l'achèvement de la prestation du service, l'Utilisateur donne une note négative (1 à 3 étoiles) et appuie le bouton « Terminé », le Pourboire ne sera pas prélevé sur la Carte attachée.

3.10. Dans le cas où, au cours de 30 minutes après la prestation du service, l'Utilisateur appuie le bouton « Terminé », le montant du Pourboire (montant par défaut ou montant indiqué par l'Utilisateur spécialement pour un service concret) sera bloqué sur la Carte attachée pendant 24 heures au cours desquelles l'Utilisateur a la possibilité d’augmenter et de réduire le montant du Pourboire pour le service correspondant. Après l'achèvement de la période indiquée, le prélèvement du Pourboire dont le montant a été fixé par l'Utilisateur (par défaut ou pour le service concret) est effectué.

3.11. Yango n'a pas d'accès aux données des cartes bancaires fournies par l'Utilisateur et n'engage pas la responsabilité pour la sécurité et pour la confidentialité des données transmises lors des paiements sans espèces. Le paiement sans espèces est effectué par l'Utilisateur avec la participation du processeur de paiement agréé, du processeur de paiement électronique ou d'une autre entité participant au règlement et assurant l'interaction informatique et technique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement.

3.12. Lors de l'indication de ses données conformément au paragraphe 3.5. des présentes Conditions et lors de l'utilisation ultérieure de la Carte attachée, l'Utilisateur confirme et garantit l'exactitude et l'exhaustivité des informations fournies relatives à la carte bancaire valable émise à son nom ; le respect par lui des règles des systèmes de paiements internationaux et des exigences de la banque émettrice de la Carte attachée, y compris en ce qui concerne les modalités de la réalisation des paiements sans espèces.

3.13. L'Utilisateur comprend et accepte que toutes les actions effectuées dans le cadre du Service avec l'utilisation du numéro mobile confirmé par lui, y compris en ce qui concerne le paiement sans espèces à l'aide de la Carte bancaire attachée sont réputées d'avoir été effectuées par l'Utilisateur.

3.14. Dans le cas du désaccord de l'Utilisateur avec le fait et/ou avec le montant du paiement sans numéraire et dans le cas des questions liées à l'utilisation de la Carte attachée dans le cadre du Service, l'Utilisateur a le droit de s'adresser à Yango par téléphone dont les numéros sont indiqués par le Service et/ou via l'interface du service assistance clients (formulaire de contact) dans le délai de 14 jours à compter de la date de réalisation du paiement sans espèces ou de la date des autres actions ou événements faisant l'objet de la demande.

Si, suite à la vérification d'une telle demande Yango prend la décision de remboursement intégral ou partiel du montant du paiement sans espèces, ce remboursement est effectué sur le compte bancaire de la carte bancaire qui a été utilisée pour le paiement sans espèces. Le remboursement des fonds est effectué par l'Utilisateur avec la participation du processeur de paiement agréé, du processeur de paiement électronique ou d'une autre entité participant au règlement et assurant l'interaction informatique et technique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement.

3.15. Yango se réserve le droit d'exiger à tout moment la justification par l'Utilisateur des données indiquées par lui dans le cadre du Service, y compris des données de la Carte attachée et de demander pour cela de fournir des pièces justificatives (notamment, des pièces d'identité) dont le défaut de présentation peut, à la convenance de Yango, être considéré comme la présentation des informations inexactes et peut entraîner les conséquences prévues dans les présentes Conditions.

Les dispositions relatives aux conditions et aux modalités de paiement des services de livraison spécifiées dans la présente section ne s'appliquent pas lorsqu'un tiers paie ces services à la place de l'Utilisateur en vertu d'un accord distinct signé par Yango avec ce tiers.

Terms of Use of Yango Delivery

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Delivery FZ-LLC (hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango Delivery service (hereinafter referred to as the Service).

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yango may, at any time amend provisions of the Terms without notice to the User. The current version hereof is available at: https://yango.com/legal/yango_termsofuse_delivery.

1.4. The User shall stop using the Service, if he or she disagrees with any amendments to the Terms. If User continues using the Service, it is considered as provision of his or her express consent to the new terms and conditions.

1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for delivery services or other services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

1.7. For the avoidance of doubt, Yango does not provide delivery services. Nothing in these Terms shall be interpreted in a way that Yango is performing delivery services, or that the User has engaged Yango for such delivery services, or that the third-party partner who is actually providing such services is an agent or subcontractor of Yango. Delivery services is done exclusively by the third-party providers, who provide those services as an individual, standalone service providers, in their own name and for their own account, and shall be obliged to have all necessary licenses and permits and to comply with all other requirements. The Service is aimed at the User to place its request and engage the third-party partner directly, and Yango does not bear any responsibility or liability for the third-party partners or the services they provide, neither to the User not to any other person.

1.8. All conversations the User holds with the support team and partners of the Service can be recorded to control quality and improve services.

1.9. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.10. Yango reserves the right to limit User access to the Service temporarily or permanently without explanation, including a case of violation of these Terms by the User, receipt of an order from an authorized body, causing damage to Yango or to third parties (as well as to prevent such actions), creating danger to others, protecting the rights and legitimate interests of Yango and third parties, receiving repeated complaints about the actions of the User or persons, in respect of which the User places through the Service information about the potential demand for delivery services or other services, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services is provided by partners of the Service. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. When demand for services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yango thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.7. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

The User is considered to have cancelled a service if he or she has not delivered the shipment for delivery to the pick-up place within 10 (ten) minutes from the moment of the courier's actual arrival, taking into account waiting time specified for the corresponding tariff (if applicable).

2.8. The User authorizes Yango to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.9. The time of arrival of the courier at the place of departure indicated by the User in the Request is approximate and can be changed depending on the traffic situation and other external factors. Yango notifies about the change in the arrival time of the courier by sending an information message to the User's mobile phone number or otherwise at the discretion of Yango.

2.10. The User is responsible for the contents of the items transferred for delivery to partners and couriers, and undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components, fireworks, flares and ammunition;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg. In case of ordering a delivery service by foot courier, the size of the transferred items (width, length, height) cannot exceed 50x50x50; the weight of the transferred items cannot exceed 10 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Yango’s partners may set other limits on items to be delivered.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yango’s partner provide delivery services. At the same time, a Yango’s partner may deny delivery services to the User, if the Yango’s partner/ representatives of the Yango’s partner discover any non-deliverable items.

2.11. The Partner or his Representative accepts shipments for delivery according to the number of packages, provided that the package of the shipment is satisfactory, without checking the internal contents by the Partner or his Representative.

2.12. The User agrees that the shipment is considered delivered to the recipient, provided that the package of the shipment is intact (there are no traces of opening the package, damage to the package and other characteristic traces of physical impact).

 

3. Function of cashless payment for delivery and other services

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yango acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango acting as a payment recipient or with Yango involved as another party to settlements or a party to information exchange.

3.2. The User shall choose the relevant form of payment in the Service interface. If the User selects a wire payment, the payment to the partner's address in Cash or otherwise directly to the partner's representative, without additional notification of Yango by changing the payment method in the Service interface (if possible), shall be prohibited. The debit of Yango funds from the Linked Card shall be deemed correct and corresponding to the payment method selected by the User, and no refund shall be made by canceling the debit.

At the same time, if it is impossible to pay by wire for any reason (including, but not limited to, temporary technical unavailability of this function, temporary or permanent impossibility of wire payment using a Linked Card, insufficient funds on the Linked Card), the User undertakes to ensure there is sufficient funds on the Linked Card to repay the arrears on Partner's services as soon as possible, but in any case no later than 30 calendar days from the moment of rendering the relevant service to the User.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.4. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

The User may also indicate the Linked Card in the interface of third-party services supporting integration with the Service and payment participants and providing authorization of the User's payment without transmitting information about the Linked Card to Yango.

The procedure for using the third-party services specified in this Clause shall be governed by the rules stipulated by such third parties. Yango shall not be liable for the User's use of such third-party services and shall not guarantee the correctness and safety of such third-party services.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yango does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.12. When indicating their details pursuant to cl. 3.5 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.13. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.14. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.15. Yango reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated hereof, if Yango thinks fit.

3.16. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yango signed with such third party.

Terms of Use of Yango Delivery

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Delivery FZ-LLC (hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango Delivery service (hereinafter referred to as the Service).

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yango may, at any time amend provisions of the Terms without notice to the User. The current version hereof is available at: https://yango.com/legal/yango_termsofuse_delivery.

1.4. The User shall stop using the Service, if he or she disagrees with any amendments to the Terms. If User continues using the Service, it is considered as provision of his or her express consent to the new terms and conditions.

1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for delivery services or other services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

1.7. For the avoidance of doubt, Yango does not provide delivery services. Nothing in these Terms shall be interpreted in a way that Yango is performing delivery services, or that the User has engaged Yango for such delivery services, or that the third-party partner who is actually providing such services is an agent or subcontractor of Yango. Delivery services is done exclusively by the third-party providers, who provide those services as an individual, standalone service providers, in their own name and for their own account, and shall be obliged to have all necessary licenses and permits and to comply with all other requirements. The Service is aimed at the User to place its request and engage the third-party partner directly, and Yango does not bear any responsibility or liability for the third-party partners or the services they provide, neither to the User not to any other person.

1.8. All conversations the User holds with the support team and partners of the Service can be recorded to control quality and improve services.

1.9. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.10. Yango reserves the right to limit User access to the Service temporarily or permanently without explanation, including a case of violation of these Terms by the User, receipt of an order from an authorized body, causing damage to Yango or to third parties (as well as to prevent such actions), creating danger to others, protecting the rights and legitimate interests of Yango and third parties, receiving repeated complaints about the actions of the User or persons, in respect of which the User places through the Service information about the potential demand for delivery services or other services, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services is provided by partners of the Service. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. When demand for services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yango thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.7. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

The User is considered to have cancelled a service if he or she has not delivered the shipment for delivery to the pick-up place within 10 (ten) minutes from the moment of the courier's actual arrival, taking into account waiting time specified for the corresponding tariff (if applicable).

2.8. The User authorizes Yango to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

3. Function of cashless payment for delivery and other services

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yango acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango acting as a payment recipient or with Yango involved as another party to settlements or a party to information exchange.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yango does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.12. When indicating their details pursuant to cl. 3.5 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.13. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.14. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.15. Yango reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated hereof, if Yango thinks fit.

3.16. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yango signed with such third party.

 

4. Details of Yango

Términos de uso del servicio Yango Delivery

 

1. Disposiciones generales

1.1. Estos Términos (en adelante, los «Términos») constituyen una oferta de Yango Delivery FZ-LLC (en adelante, «Yango») a un usuario de Internet (en adelante, el «Usuario») para utilizar el servicio Yango Delivery (en adelante, el «Servicio»).

1.2. Al comenzar a utilizar el Servicio o sus funciones individuales, se considera que el Usuario ha aceptado estos Términos en su totalidad, sin reservas ni excepciones. Si el Usuario no está de acuerdo con alguna de las disposiciones de los Términos y/o Documentos Reglamentarios, el Usuario no tiene derecho a utilizar el Servicio.

1.3. Yango puede cambiar las disposiciones de estos Términos en cualquier momento sin previo aviso al Usuario. La versión actual de estos Términos se publica en: https://yango.com/legal/yango_termsofuse_delivery.

1.4. El Usuario debe dejar de usar el Servicio si no está de acuerdo con los cambios realizados en los Términos. El uso continuo del Servicio después de cambiar los Términos se considera el consentimiento explícito del Usuario a su nueva versión.

1.5. El Servicio ofrece al Usuario la oportunidad gratuita de publicar información sobre la demanda potencial del Usuario de servicios de entrega u otros servicios, así como la oportunidad de familiarizarse con información sobre las ofertas de organizaciones que brindan servicios en esta área y buscar dichas ofertas de acuerdo con los parámetros especificados por el Usuario. Todas las funciones actualmente existentes del Servicio, así como cualquier desarrollo o adición de nuevas funciones, están sujetas a estos Términos.

1.6. Dependiendo de la región donde se encuentre el Usuario, todas o algunas de las funciones del Servicio pueden no estar accesibles o estar limitadas. Las funciones se consideran inaccesibles (limitadas) para un Usuario de una determinada región si dicho Usuario no puede utilizarlas explícitamente. Está prohibido el uso de cualquier método técnico y de software para eludir estas limitaciones. Las disposiciones de estos Términos que rigen las funciones del Servicio que son inaccesibles (limitadas) para el Usuario no se aplicarán hasta que dichas funciones estén disponibles para el Usuario de forma explícita. La información sobre la accesibilidad de las funciones del Servicio en una determinada región se proporciona al Usuario en respuesta a su solicitud a Yango.

1.7. Para evitar dudas, Yango no proporciona servicios de entrega. Nada en estos Términos se interpretará en el sentido de que Yango proporciona servicios de entrega, o que el Usuario ha contratado a Yango para dichos servicios de entrega, o que el socio externo que realmente brinda dichos servicios es un agente o subcontratista de Yango. Los servicios de entrega se realizan únicamente por proveedores externos que brindan estos servicios como proveedores de servicios independientes, en su propio nombre y por cuenta propia, y deben tener todas las licencias y autorizaciones necesarias y cumplir con todos los demás requisitos. El Servicio está destinado a que el Usuario realice su solicitud e involucre directamente a un socio externo, y Yango no será responsable de ninguna manera por los socios externos o los servicios que brindan, ya sea al Usuario o a cualquier otra persona.

1.8. El Usuario acepta que todas las conversaciones del Usuario con los especialistas del servicio de soporte, así como con los socios, pueden grabarse con el fin de controlar la calidad de los servicios y desarrollarlos.

1.9. Al utilizar el Servicio, el Usuario expresa su conformidad en recibir mensajes publicitarios. El Usuario tiene derecho a negarse a recibir mensajes publicitarios utilizando la funcionalidad correspondiente del Servicio o siguiendo las instrucciones especificadas en el mensaje publicitario recibido.

1.10. Yango tiene derecho a restringir temporal o permanentemente la prestación del Servicio al Usuario sin explicación, incluso en el caso de que el Usuario viole estos Términos, en el caso de recepción de una orden de un organismo autorizado, daño a Yango o a terceros (así como para prevenir tales acciones), peligro para otros, protección de los derechos y legítimos intereses de Yango y de terceros, recepción de quejas repetidas sobre las acciones del Usuario o de las personas con respecto a las cuales el Usuario coloca información a través del Servicio sobre la demanda potencial de servicios de entrega y/u otros servicios, así como a tomar cualquier otra medida con respecto a el Usuario para cumplir con las exigencias de la ley o los derechos e intereses legítimos de terceros.

 

2. Uso del Servicio. Funciones individuales del Servicio

2.1. El Servicio se proporciona al Usuario para uso personal no comercial.

2.2. La información sobre los servicios de entrega y/u otros servicios se proporciona por los socios del Servicio. Para obtener más información sobre los servicios ofrecidos, el Usuario puede ponerse en contacto con los socios del Servicio o proporcionar sus datos de contacto a través de las funciones del Servicio, de modo que los socios del Servicio puedan contactar al Usuario de forma independiente y brindarle información sobre los servicios ofrecidos.

2.3. Yango no es responsable del contenido o relevancia de la información proporcionada por los socios del Servicio, incluida la información sobre el costo de los servicios de los socios, así como su disponibilidad en el momento. La interacción del Usuario con el socio con respecto a la compra de servicios se lleva a cabo de forma independiente (sin la participación de Yango) de acuerdo con las reglas adoptadas por los socios para la prestación de servicios. Yango no es responsable de las transacciones financieras o de otro tipo realizadas por el Usuario y el socio, así como por las consecuencias de la compra de los servicios de los socios por parte del Usuario.

2.4. El Usuario puede tener acceso a las funciones de evaluar los servicios de los Socios, así como publicar comentarios u opiniones sobre el Servicio o los servicios de los socios. Las valoraciones y opiniones de los Usuarios se publican en el sitio web del Servicio y también pueden estar disponibles en sitios web de terceros. Yango se reserva el derecho de negarse a publicar valoraciones y opiniones, así como de eliminar o bloquear las valoraciones/opiniones publicadas por el Usuario en cualquier momento a su sola discreción y sin dar razones.

2.5. Durante los períodos de mayor demanda de los servicios (incluidos los días pre-festivos, los días de eventos masivos y en otros casos), las tarifas de los servicios de los socios se pueden aumentar. Yango informa sobre el aumento de tarifas mediante la publicación de una notificación adecuada en el sitio web del Servicio o mediante el envío de un mensaje informativo al número de teléfono móvil del Usuario o de cualquier otra manera a discreción de Yango.

2.6. Si el Servicio soporta un pedido anticipado de los servicios de entrega (en adelante, «entrega pedida por adelantado»), el pedido estará disponible para su confirmación por parte del socio del Servicio más cerca del tiempo especificado por el Usuario en el pedido (no antes de 30 minutos antes del inicio de la entrega pedida por adelantado). El costo de los servicios pedidos por adelantado se calculará e indicará en el Servicio al pedir los servicios de entrega. El precio puede cambiar dependiendo de las circunstancias especificadas en el sitio web del servicio.

2.7. El socio puede cobrar un pago por el rechazo del servicio por parte del Usuario si dicho rechazo se produjo después de la llegada del repartidor al lugar indicado por el Usuario. El monto de dicho pago se calcula de manera similar al costo del servicio a la tarifa correspondiente por el período de tiempo desde el momento en que el repartidor llega efectivamente al lugar de recepción del envío o desde el momento en que el repartidor llega al lugar de recepción del envío (según lo que suceda último) hasta que el Usuario rechace el servicio. El Usuario puede cancelar el servicio enviando la notificación correspondiente al socio a través del Servicio.

Se considera que el Usuario canceló el servicio si no entregó el envío para entrega en el lugar de recepción dentro de los 10 (diez) minutos desde la llegada real del repartidor, teniendo en cuenta el tiempo de espera indicado para la tarifa correspondiente (si es aplicable).

2.8. El Usuario autoriza a Yango a procesar la información personal (incluidos los datos personales) del Usuario y transferir dicha información personal a los socios, así como a procesar dicha información personal con el fin de proporcionar la funcionalidad del Servicio al Usuario. Cuando el Usuario accede al Servicio, su información personal se transfiere para su procesamiento de acuerdo con los términos y para los fines especificados en la Política de Privacidad disponible en: (https://yango.com/legal/yango_privacy_notice).

2.9. La hora de llegada del representante del socio al lugar de recepción del envío especificado por el Usuario en la Solicitud es aproximada y puede cambiar dependiendo de la situación del tráfico y otros factores externos. Yango informa sobre el cambio en la hora de llegada del representante del socio mediante el envío de un mensaje informativo al número de teléfono móvil del Usuario o de cualquier otra forma a discreción de Yango.

2.10. El Usuario es responsable del contenido de los envíos entregados para su entrega a los socios y sus representantes y se compromete a no entregar los siguientes artículos para la entrega:

  • armas de combate manual, no militares y de servicio, municiones, repuestos y componentes, arcos y ballestas deportivos, armas diseñadas para dar señales de luz, humo y sonido, armas eléctricas, dispositivos de electrochoque y chispeadores, armas blancas, porras, rompecabezas, shurikens, varitas, boomerangs y otros objetos adaptados para golpear, aplastar, lanzar, apuñalar y cortar, con excepción de equipos deportivos, dispositivos técnicos especiales y componentes de doble uso, fuegos artificiales, bengalas y cartuchos;
  • sustancias estupefacientes, psicotrópicas, precursores y sus análogos;
  • sustancias potentes, tóxicas, radiactivas, explosivas, venenosas, cáusticas, inflamables y otras sustancias peligrosas, incluidas las que se encuentran bajo presión;
  • venenos, animales venenosos, sustancias venenosas, plantas venenosas y semillas de plantas venenosas;
  • moneda nacional y extranjera;
  • publicaciones impresas, materiales gráficos, películas, fotografías, materiales de audio y video que contengan propaganda de cambios violentos del sistema constitucional, destrucción de la seguridad nacional, guerra, superioridad social, racial, nacional, religiosa, de clase y de clan, crueldad, violencia y pornografía;
  • alimentos perecederos sin embalaje especial;
  • artículos y sustancias que, por su naturaleza o por su embalaje, puedan suponer un peligro para las personas, contaminar o estropear (dañar) otros bienes, personas u objetos circundantes;
  • animales y plantas, materiales biológicos;
  • artículos que requieren vehículos especialmente equipados para su transporte, incluidos los productos alimenticios;
  • líquidos en recipientes abiertos;
  • artículos de gran tamaño, cuya suma de medidas (salvo casos especialmente estipulados) en longitud, anchura (dos diámetros o ejes en la base del rollo) y altura exceda de 150 cm, artículos largos, cuya longitud sea superior a 150 cm; el peso de los artículos transferidos no puede exceder 20 kg. En el caso de pedido de un servicio de envío urgente por un repartidor a pie, el tamaño de los artículos transferidos (anchura, longitud, alteza) no puede exceder 50x50x50; el peso de los artículos transferidos no puede exceder 10 kg;
  • artículos frágiles sin embalaje especial;
  • cualesquiera otros artículos cuya circulación esté prohibida o restringida en el territorio del país donde se presten los servicios.

Los socios pueden establecer restricciones adicionales para los envíos enviados para entrega.

El usuario es consciente y confirma que en caso de incumplimiento de los requisitos anteriores, él es el único responsable de todas las consecuencias negativas que puedan ocurrir en el proceso de prestación de los servicios a los socios. Al mismo tiempo, el socio o su representante tiene derecho a rechazar la prestación del servicio al Usuario en caso de detección de artículos que no se pueden entregar entre los envíos.

2.11. El Socio o su representante acepta envíos para entrega según el número de lugares, sujeto a un embalaje satisfactorio del envío, sin verificación de los contenidos internos por parte del Socio o su representante.

2.12. El Usuario acepta que el envío se considera entregado al destinatario siempre que el embalaje del envío esté intacto (no hay signos de apertura del embalaje, daños en el embalaje y otros signos característicos de impacto físico).

 

3. Función de pago sin efectivo

3.1. El pago de los servicios de entrega u otros servicios de socios proporcionados al Usuario de acuerdo con la información publicada por él utilizando el Servicio sobre la demanda potencial de los servicios relevantes se puede realizar de las siguientes maneras:

3.1.1. Directamente al proveedor de los servicios en efectivo o de otro modo si dicha funcionalidad está disponible en el Servicio (en adelante en estos Términos y la interfaz del Servicio, «Efectivo»). Este tipo de pago se realiza sin la participación de Yango y no se rige por estos Términos.

3.1.2. Mediante pago sin efectivo de la Tarjeta Bancaria Vinculada (cláusula 3.5. de estos Términos); en este caso, Yango actúa en nombre del Socio relevante con la participación de un operador autorizado a aceptar los pagos o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y es el destinatario del pago como agente del Socio (en adelante, «pago sin efectivo»). Yango no garantiza la ausencia de errores y fallos en el funcionamiento del Servicio en cuanto a la prestación de la oportunidad de pago sin efectivo, y además tiene derecho a contratar a terceros (subagentes) para el cumplimiento de sus obligaciones.

Dependiendo de la región del usuario, los pagos sin efectivo pueden realizarse sin la participación de Yango como beneficiario o con la participación de Yango como la otra parte de los arreglos financieros o el participante en el intercambio de información.

3.2. El Usuario elecciona la forma de pago adecuada el en la interfaz del Servicio. Si el Usuario elige el pago sin efectivo, el pago al socio en Efectivo o de otro modo directamente a la dirección del representante del socio, sin previo aviso a Yango cambiando el método de pago en la interfaz del Servicio (si es posible), no está permitido. El cargo de los fondos de Yango de la Tarjeta Vinculada se reconoce como correcto y correspondiente al método de pago elegido por el Usuario, no se realiza ningún reembolso al cancelar el cargo.

Al mismo tiempo, si es imposible por cualquier motivo realizar un pago sin efectivo (incluyendo, entre otros, indisponibilidad técnica temporal de esta función, imposibilidad temporal o permanente de pago sin efectivo utilizando la Tarjeta Vinculada, fondos insuficientes en la Tarjeta Vinculada), el Usuario se compromete a asegurarse de que existe una cantidad suficiente de fondos en la Tarjeta Vinculada para pagar la deuda por el pago de los servicios del socio lo antes posible, pero en cualquier caso a más tardar 30 días naturales desde la fecha de prestación del correspondiente servicio al Usuario.

3.3. En caso del pago sin efectivo, a discreción de Yango, es posible realizar tanto una transacción por el costo total del servicio como varias transacciones por partes separadas del costo del servicio. Además, el pago sin efectivo puede realizarse por cualquiera de los métodos especificados durante la prestación del servicio o al finalizarlo.

3.4. La Tarjeta Bancaria Vinculada puede ser especificada por el Usuario en la interfaz del Servicio, mientras que el Usuario especifica los siguientes datos:

  • Número de la tarjeta bancaria
  • Válida hasta
  • Código de seguridad

Si los datos de la tarjeta bancaria son correctos, válidos y el uso de esta tarjeta dentro del Servicio es técnicamente posible, la tarjeta bancaria especificada adquiere el estado de Vinculada y puede utilizarse para pagos sin efectivo (cláusula 3.1.2 de estos Términos). Todas las Tarjetas Vinculadas se muestran en la interfaz del Servicio; para comodidad del Usuario, en relación con la Tarjeta Vinculada, se muestran los últimos 4 dígitos del número de la Tarjeta Vinculada.

La Tarjeta Vinculada también puede ser indicada por el Usuario en la interfaz de los servicios de terceros que soportan la integración con el Servicio, participan en arreglos financieros y aseguran la autorización del pago del Usuario sin transferir información sobre la Tarjeta Vinculada a Yango.

El procedimiento para utilizar los servicios de terceros especificados en esta cláusula se rige por las normas de dichos terceros. Yango no es responsable del uso que el Usuario haga de dichos servicios de terceros y no garantiza la exactitud y seguridad de dichos servicios de terceros.

3.5. Al agregar la Tarjeta Vinculada, así como si el Usuario selecciona la función de pago sin efectivo para un servicio específico, el monto se debita dentro del monto equivalente a 1 dólar estadounidense para confirmar la exactitud y vigencia de los datos de la Tarjeta Vinculada; en caso de completar la transacción con éxito, el monto especificado se devuelve al Usuario. Un intento fallido de debitar el monto especificado significa que la Tarjeta Vinculada no se puede agregar y/o la función de pago sin efectivo no está disponible, respectivamente.

3.6. En caso de pago sin efectivo, junto con el pago de los servicios el Usuario tiene la oportunidad, a su propia discreción, de realizar un pago adicional sin efectivo a favor del Socio como un porcentaje del costo del servicio pagado (en adelante en estos Términos y en la interfaz del Servicio, la «Propina»).

3.7. Al agregar una Tarjeta Vinculada, así como en cualquier momento después de agregarla, el Usuario tiene la oportunidad de establecer o cambiar el tamaño de la Propina por defecto a través de la interfaz del Servicio; el Usuario puede cambiar el monto de la Propina para un servicio específico en la interfaz del Servicio después de completar su provisión.

3.8. La Propina (en el monto por defecto o en el monto específicamente indicado por el Usuario para un servicio específico) se debitará de la Tarjeta Vinculada si el Usuario ha indicado una valoración positiva (4-5 estrellas) en la interfaz del Servicio (4-5 estrellas) dentro de los 30 minutos posteriores a la prestación del servicio y ha hecho clic en el botón «Hecho», o no ha indicado una valoración positiva o negativa del servicio (no ha indicado el número de estrellas) y ha hecho clic en el botón «Hecho».

3.9. Si el Usuario, dentro de los 30 minutos posteriores a la prestación del servicio, indicó una valoración negativa (1-3 estrellas) en la interfaz del Servicio e hizo clic en el botón «Hecho», la Propina no se debitará de la Tarjeta Vinculada.

3.10. Si el Usuario no hace clic en el botón «Hecho» dentro de los 30 minutos posteriores a la prestación del servicio, el monto de la Propina (en el monto predeterminado o en el monto específicamente indicado por el Usuario para un servicio específico) será bloqueado en la Tarjeta Vinculada por un período de 24 horas dentro de las cuales el Usuario tiene la oportunidad de cambiar el tamaño de la Propina para este servicio hacia arriba o hacia abajo. Una vez transcurrido el tiempo especificado, la Propina se debita en la cantidad especificada por el Usuario (por defecto o para este servicio específico).

3.11. Yango no tiene acceso a los datos de la tarjeta bancaria especificados por el Usuario y no es responsable de la seguridad y confidencialidad de los datos transmitidos al realizar un pago sin efectivo. El Usuario hace un pago sin efectivo con la participación de un operador autorizado para recibir pagos, o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y este pago sin efectivo se regula por las reglas de los sistemas de pago internacionales, bancos (incluido el banco emisor de la Tarjeta Vinculada) y otros participantes en los arreglos financieros.

3.12. Al especificar sus datos de acuerdo con la cláusula 3.5. de estos Términos y al continuar el uso de la Tarjeta Vinculada, el Usuario confirma y garantiza que proporciona información precisa y completa sobre una tarjeta bancaria válida emitida a su nombre; el cumplimiento de las normas de los sistemas de pago internacionales y los requisitos del banco emisor que emitió la Tarjeta Vinculada, incluso con respecto al procedimiento para realizar pagos sin efectivo.

3.13. El Usuario comprende y acepta que todas las acciones realizadas dentro del Servicio utilizando el número de teléfono móvil confirmado por él, incluido el pago sin efectivo utilizando la Tarjeta Bancaria Vinculada, se consideran realizadas por el Usuario.

3.14. Si el Usuario no está de acuerdo con el hecho y/o monto del pago sin efectivo y otras cuestiones relacionadas con el uso de la Tarjeta Vinculada dentro del Servicio, el Usuario tiene derecho a comunicarse con Yango usando los teléfonos indicados por el Servicio y/o a través de la interfaz de servicio de soporte (retroinformación) dentro de los 14 días a partir de la fecha del pago sin efectivo u otras acciones o eventos que causaron el recurso.

Si, sobre la base de los resultados de la verificación de dicho recurso, Yango decide devolver el monto del pago sin efectivo en su totalidad o en parte, el reembolso especificado se realiza a la cuenta bancaria de la tarjeta bancaria desde la cual se realizó el pago sin efectivo. Los fondos se devuelven con la participación de un operador autorizado para recibir pagos, o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y este pago sin efectivo se regula por las reglas de los sistemas de pago internacionales, bancos (incluido el banco emisor de la Tarjeta Vinculada) y otros participantes en los arreglos financieros.

3.15. Yango se reserva el derecho de exigir al Usuario en cualquier momento que confirme los datos especificados por él dentro del Servicio, incluidos los datos de la Tarjeta Vinculada, y de solicitar a este respecto los documentos justificativos (en particular, los documentos de identidad); no proporcionarlos, a discreción de Yango, podrá equipararse a la prestación de información falsa y acarrear las consecuencias previstas en estos Términos.

Las disposiciones sobre las condiciones y el procedimiento para el pago de los servicios de entrega especificados en esta sección no se aplican cuando un tercero paga por dichos servicios en lugar del Usuario en virtud de un acuerdo por separado firmado por Yango con dicho tercero.

 

4. Ley aplicable y solución de controversias

4.1. Estos Términos de Uso y cualquier obligación no contractual que surja de estos Términos de Uso o estén relacionados con ellos se regirán e interpretarán de acuerdo con las leyes de Inglaterra y Gales sin tener en cuenta las disposiciones sobre conflictos de leyes.

4.2. Cualquier disputa, diferencia, controversia o reclamo que surja de o en conexión con estos Términos de Uso, incluyendo (pero no limitado a) cualquier pregunta relacionada con su existencia, validez, interpretación, desempeño, descarga y recursos aplicables, se remitirá y finalmente resuelto mediante arbitraje conforme a las Reglas de Arbitraje del Centro de Arbitraje Internacional de Dubai, cuyas Reglas se consideran incorporadas por referencia a esta cláusula. El número de árbitros será uno. La sede del arbitraje será Dubai, Emiratos Árabes Unidos. El idioma que se utilizará en el arbitraje será el inglés.

Terms of Use of Yango Delivery

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Delivery FZ-LLC (hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango Delivery service (hereinafter referred to as the Service).

1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.3. Yango may, at any time amend provisions of the Terms without notice to the User. The current version hereof is available at: https://yango.com/legal/yango_termsofuse_delivery.

1.4. The User shall stop using the Service, if he or she disagrees with any amendments to the Terms. If User continues using the Service, it is considered as provision of his or her express consent to the new terms and conditions.

1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for delivery services or other services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

1.7. For the avoidance of doubt, Yango does not provide delivery services. Nothing in these Terms shall be interpreted in a way that Yango is performing delivery services, or that the User has engaged Yango for such delivery services, or that the third-party partner who is actually providing such services is an agent or subcontractor of Yango. Delivery services is done exclusively by the third-party providers, who provide those services as an individual, standalone service providers, in their own name and for their own account, and shall be obliged to have all necessary licenses and permits and to comply with all other requirements. The Service is aimed at the User to place its request and engage the third-party partner directly, and Yango does not bear any responsibility or liability for the third-party partners or the services they provide, neither to the User not to any other person.

1.8. All conversations the User holds with the support team and partners of the Service can be recorded to control quality and improve services.

1.9. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.10. Yango reserves the right to limit User access to the Service temporarily or permanently without explanation, including a case of violation of these Terms by the User, receipt of an order from an authorized body, causing damage to Yango or to third parties (as well as to prevent such actions), creating danger to others, protecting the rights and legitimate interests of Yango and third parties, receiving repeated complaints about the actions of the User or persons, in respect of which the User places through the Service information about the potential demand for delivery services or other services, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services is provided by partners of the Service. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. When demand for services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yango thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.7. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

The User is considered to have cancelled a service if he or she has not delivered the shipment for delivery to the pick-up place within 10 (ten) minutes from the moment of the courier's actual arrival, taking into account waiting time specified for the corresponding tariff (if applicable).

2.8. The User authorizes Yango to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.9. The time of arrival of the courier at the place of departure indicated by the User in the Request is approximate and can be changed depending on the traffic situation and other external factors. Yango notifies about the change in the arrival time of the courier by sending an information message to the User's mobile phone number or otherwise at the discretion of Yango.

2.10. The User is responsible for the contents of the items transferred for delivery to partners and couriers, and undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components, fireworks, flares and ammunition;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg. In case of ordering a delivery service by foot courier, the size of the transferred items (width, length, height) cannot exceed 50x50x50; the weight of the transferred items cannot exceed 10 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Yango’s partners may set other limits on items to be delivered.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yango’s partner provide delivery services. At the same time, a Yango’s partner may deny delivery services to the User, if the Yango’s partner/ representatives of the Yango’s partner discover any non-deliverable items.

2.11. The Partner or his Representative accepts shipments for delivery according to the number of packages, provided that the package of the shipment is satisfactory, without checking the internal contents by the Partner or his Representative.

2.12. The User agrees that the shipment is considered delivered to the recipient, provided that the package of the shipment is intact (there are no traces of opening the package, damage to the package and other characteristic traces of physical impact).

 

3. Function of cashless payment for delivery and other services

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yango acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango acting as a payment recipient or with Yango involved as another party to settlements or a party to information exchange.

3.2. The User shall choose the relevant form of payment in the Service interface. If the User selects a wire payment, the payment to the partner's address in Cash or otherwise directly to the partner's representative, without additional notification of Yango by changing the payment method in the Service interface (if possible), shall be prohibited. The debit of Yango funds from the Linked Card shall be deemed correct and corresponding to the payment method selected by the User, and no refund shall be made by canceling the debit.

At the same time, if it is impossible to pay by wire for any reason (including, but not limited to, temporary technical unavailability of this function, temporary or permanent impossibility of wire payment using a Linked Card, insufficient funds on the Linked Card), the User undertakes to ensure there is sufficient funds on the Linked Card to repay the arrears on Partner's services as soon as possible, but in any case no later than 30 calendar days from the moment of rendering the relevant service to the User.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.4. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

The User may also indicate the Linked Card in the interface of third-party services supporting integration with the Service and payment participants and providing authorization of the User's payment without transmitting information about the Linked Card to Yango.

The procedure for using the third-party services specified in this Clause shall be governed by the rules stipulated by such third parties. Yango shall not be liable for the User's use of such third-party services and shall not guarantee the correctness and safety of such third-party services.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yango does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.12. When indicating their details pursuant to cl. 3.5 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.13. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.14. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.15. Yango reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated hereof, if Yango thinks fit.

3.16. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yango signed with such third party.

Términos de uso del servicio Yango Delivery

 

1. Disposiciones generales

1.1. Estos Términos (en adelante, los «Términos») constituyen una oferta de Yango Delivery FZ-LLC (en adelante, «Yango») a un usuario de Internet (en adelante, el «Usuario») para utilizar el servicio Yango Delivery (en adelante, el «Servicio»).

1.2. Al comenzar a utilizar el Servicio o sus funciones individuales, se considera que el Usuario ha aceptado estos Términos en su totalidad, sin reservas ni excepciones. Si el Usuario no está de acuerdo con alguna de las disposiciones de los Términos y/o Documentos Reglamentarios, el Usuario no tiene derecho a utilizar el Servicio.

1.3. Yango puede cambiar las disposiciones de estos Términos en cualquier momento sin previo aviso al Usuario. La versión actual de estos Términos se publica en: https://yango.com/legal/yango_termsofuse_delivery.

1.4. El Usuario debe dejar de usar el Servicio si no está de acuerdo con los cambios realizados en los Términos. El uso continuo del Servicio después de cambiar los Términos se considera el consentimiento explícito del Usuario a su nueva versión.

1.5. El Servicio ofrece al Usuario la oportunidad gratuita de publicar información sobre la demanda potencial del Usuario de servicios de entrega u otros servicios, así como la oportunidad de familiarizarse con información sobre las ofertas de organizaciones que brindan servicios en esta área y buscar dichas ofertas de acuerdo con los parámetros especificados por el Usuario. Todas las funciones actualmente existentes del Servicio, así como cualquier desarrollo o adición de nuevas funciones, están sujetas a estos Términos.

1.6. Dependiendo de la región donde se encuentre el Usuario, todas o algunas de las funciones del Servicio pueden no estar accesibles o estar limitadas. Las funciones se consideran inaccesibles (limitadas) para un Usuario de una determinada región si dicho Usuario no puede utilizarlas explícitamente. Está prohibido el uso de cualquier método técnico y de software para eludir estas limitaciones. Las disposiciones de estos Términos que rigen las funciones del Servicio que son inaccesibles (limitadas) para el Usuario no se aplicarán hasta que dichas funciones estén disponibles para el Usuario de forma explícita. La información sobre la accesibilidad de las funciones del Servicio en una determinada región se proporciona al Usuario en respuesta a su solicitud a Yango.

1.7. Para evitar dudas, Yango no proporciona servicios de entrega. Nada en estos Términos se interpretará en el sentido de que Yango proporciona servicios de entrega, o que el Usuario ha contratado a Yango para dichos servicios de entrega, o que el socio externo que realmente brinda dichos servicios es un agente o subcontratista de Yango. Los servicios de entrega se realizan únicamente por proveedores externos que brindan estos servicios como proveedores de servicios independientes, en su propio nombre y por cuenta propia, y deben tener todas las licencias y autorizaciones necesarias y cumplir con todos los demás requisitos. El Servicio está destinado a que el Usuario realice su solicitud e involucre directamente a un socio externo, y Yango no será responsable de ninguna manera por los socios externos o los servicios que brindan, ya sea al Usuario o a cualquier otra persona.

1.8. El Usuario acepta que todas las conversaciones del Usuario con los especialistas del servicio de soporte, así como con los socios, pueden grabarse con el fin de controlar la calidad de los servicios y desarrollarlos.

1.9. Al utilizar el Servicio, el Usuario expresa su conformidad en recibir mensajes publicitarios. El Usuario tiene derecho a negarse a recibir mensajes publicitarios utilizando la funcionalidad correspondiente del Servicio o siguiendo las instrucciones especificadas en el mensaje publicitario recibido.

1.10. Yango tiene derecho a restringir temporal o permanentemente la prestación del Servicio al Usuario sin explicación, incluso en el caso de que el Usuario viole estos Términos, en el caso de recepción de una orden de un organismo autorizado, daño a Yango o a terceros (así como para prevenir tales acciones), peligro para otros, protección de los derechos y legítimos intereses de Yango y de terceros, recepción de quejas repetidas sobre las acciones del Usuario o de las personas con respecto a las cuales el Usuario coloca información a través del Servicio sobre la demanda potencial de servicios de entrega y/u otros servicios, así como a tomar cualquier otra medida con respecto a el Usuario para cumplir con las exigencias de la ley o los derechos e intereses legítimos de terceros.

 

2. Uso del Servicio. Funciones individuales del Servicio

2.1. El Servicio se proporciona al Usuario para uso personal no comercial.

2.2. La información sobre los servicios de entrega y/u otros servicios se proporciona por los socios del Servicio. Para obtener más información sobre los servicios ofrecidos, el Usuario puede ponerse en contacto con los socios del Servicio o proporcionar sus datos de contacto a través de las funciones del Servicio, de modo que los socios del Servicio puedan contactar al Usuario de forma independiente y brindarle información sobre los servicios ofrecidos.

2.3. Yango no es responsable del contenido o relevancia de la información proporcionada por los socios del Servicio, incluida la información sobre el costo de los servicios de los socios, así como su disponibilidad en el momento. La interacción del Usuario con el socio con respecto a la compra de servicios se lleva a cabo de forma independiente (sin la participación de Yango) de acuerdo con las reglas adoptadas por los socios para la prestación de servicios. Yango no es responsable de las transacciones financieras o de otro tipo realizadas por el Usuario y el socio, así como por las consecuencias de la compra de los servicios de los socios por parte del Usuario.

2.4. El Usuario puede tener acceso a las funciones de evaluar los servicios de los Socios, así como publicar comentarios u opiniones sobre el Servicio o los servicios de los socios. Las valoraciones y opiniones de los Usuarios se publican en el sitio web del Servicio y también pueden estar disponibles en sitios web de terceros. Yango se reserva el derecho de negarse a publicar valoraciones y opiniones, así como de eliminar o bloquear las valoraciones/opiniones publicadas por el Usuario en cualquier momento a su sola discreción y sin dar razones.

2.5. Durante los períodos de mayor demanda de los servicios (incluidos los días pre-festivos, los días de eventos masivos y en otros casos), las tarifas de los servicios de los socios se pueden aumentar. Yango informa sobre el aumento de tarifas mediante la publicación de una notificación adecuada en el sitio web del Servicio o mediante el envío de un mensaje informativo al número de teléfono móvil del Usuario o de cualquier otra manera a discreción de Yango.

2.6. Si el Servicio soporta un pedido anticipado de los servicios de entrega (en adelante, «entrega pedida por adelantado»), el pedido estará disponible para su confirmación por parte del socio del Servicio más cerca del tiempo especificado por el Usuario en el pedido (no antes de 30 minutos antes del inicio de la entrega pedida por adelantado). El costo de los servicios pedidos por adelantado se calculará e indicará en el Servicio al pedir los servicios de entrega. El precio puede cambiar dependiendo de las circunstancias especificadas en el sitio web del servicio.

2.7. El socio puede cobrar un pago por el rechazo del servicio por parte del Usuario si dicho rechazo se produjo después de la llegada del repartidor al lugar indicado por el Usuario. El monto de dicho pago se calcula de manera similar al costo del servicio a la tarifa correspondiente por el período de tiempo desde el momento en que el repartidor llega efectivamente al lugar de recepción del envío o desde el momento en que el repartidor llega al lugar de recepción del envío (según lo que suceda último) hasta que el Usuario rechace el servicio. El Usuario puede cancelar el servicio enviando la notificación correspondiente al socio a través del Servicio.

Se considera que el Usuario canceló el servicio si no entregó el envío para entrega en el lugar de recepción dentro de los 10 (diez) minutos desde la llegada real del repartidor, teniendo en cuenta el tiempo de espera indicado para la tarifa correspondiente (si es aplicable).

2.8. El Usuario autoriza a Yango a procesar la información personal (incluidos los datos personales) del Usuario y transferir dicha información personal a los socios, así como a procesar dicha información personal con el fin de proporcionar la funcionalidad del Servicio al Usuario. Cuando el Usuario accede al Servicio, su información personal se transfiere para su procesamiento de acuerdo con los términos y para los fines especificados en la Política de Privacidad disponible en: (https://yango.com/legal/yango_privacy_notice).

2.9. La hora de llegada del representante del socio al lugar de recepción del envío especificado por el Usuario en la Solicitud es aproximada y puede cambiar dependiendo de la situación del tráfico y otros factores externos. Yango informa sobre el cambio en la hora de llegada del representante del socio mediante el envío de un mensaje informativo al número de teléfono móvil del Usuario o de cualquier otra forma a discreción de Yango.

2.10. El Usuario es responsable del contenido de los envíos entregados para su entrega a los socios y sus representantes y se compromete a no entregar los siguientes artículos para la entrega:

  • armas de combate manual, no militares y de servicio, municiones, repuestos y componentes, arcos y ballestas deportivos, armas diseñadas para dar señales de luz, humo y sonido, armas eléctricas, dispositivos de electrochoque y chispeadores, armas blancas, porras, rompecabezas, shurikens, varitas, boomerangs y otros objetos adaptados para golpear, aplastar, lanzar, apuñalar y cortar, con excepción de equipos deportivos, dispositivos técnicos especiales y componentes de doble uso, fuegos artificiales, bengalas y cartuchos;
  • sustancias estupefacientes, psicotrópicas, precursores y sus análogos;
  • sustancias potentes, tóxicas, radiactivas, explosivas, venenosas, cáusticas, inflamables y otras sustancias peligrosas, incluidas las que se encuentran bajo presión;
  • venenos, animales venenosos, sustancias venenosas, plantas venenosas y semillas de plantas venenosas;
  • moneda nacional y extranjera;
  • publicaciones impresas, materiales gráficos, películas, fotografías, materiales de audio y video que contengan propaganda de cambios violentos del sistema constitucional, destrucción de la seguridad nacional, guerra, superioridad social, racial, nacional, religiosa, de clase y de clan, crueldad, violencia y pornografía;
  • alimentos perecederos sin embalaje especial;
  • artículos y sustancias que, por su naturaleza o por su embalaje, puedan suponer un peligro para las personas, contaminar o estropear (dañar) otros bienes, personas u objetos circundantes;
  • animales y plantas, materiales biológicos;
  • artículos que requieren vehículos especialmente equipados para su transporte, incluidos los productos alimenticios;
  • líquidos en recipientes abiertos;
  • artículos de gran tamaño, cuya suma de medidas (salvo casos especialmente estipulados) en longitud, anchura (dos diámetros o ejes en la base del rollo) y altura exceda de 150 cm, artículos largos, cuya longitud sea superior a 150 cm; el peso de los artículos transferidos no puede exceder 20 kg. En el caso de pedido de un servicio de envío urgente por un repartidor a pie, el tamaño de los artículos transferidos (anchura, longitud, alteza) no puede exceder 50x50x50; el peso de los artículos transferidos no puede exceder 10 kg;
  • artículos frágiles sin embalaje especial;
  • cualesquiera otros artículos cuya circulación esté prohibida o restringida en el territorio del país donde se presten los servicios.

Los socios pueden establecer restricciones adicionales para los envíos enviados para entrega.

El usuario es consciente y confirma que en caso de incumplimiento de los requisitos anteriores, él es el único responsable de todas las consecuencias negativas que puedan ocurrir en el proceso de prestación de los servicios a los socios. Al mismo tiempo, el socio o su representante tiene derecho a rechazar la prestación del servicio al Usuario en caso de detección de artículos que no se pueden entregar entre los envíos.

2.11. El Socio o su representante acepta envíos para entrega según el número de lugares, sujeto a un embalaje satisfactorio del envío, sin verificación de los contenidos internos por parte del Socio o su representante.

2.12. El Usuario acepta que el envío se considera entregado al destinatario siempre que el embalaje del envío esté intacto (no hay signos de apertura del embalaje, daños en el embalaje y otros signos característicos de impacto físico).

 

3. Función de pago sin efectivo

3.1. El pago de los servicios de entrega u otros servicios de socios proporcionados al Usuario de acuerdo con la información publicada por él utilizando el Servicio sobre la demanda potencial de los servicios relevantes se puede realizar de las siguientes maneras:

3.1.1. Directamente al proveedor de los servicios en efectivo o de otro modo si dicha funcionalidad está disponible en el Servicio (en adelante en estos Términos y la interfaz del Servicio, «Efectivo»). Este tipo de pago se realiza sin la participación de Yango y no se rige por estos Términos.

3.1.2. Mediante pago sin efectivo de la Tarjeta Bancaria Vinculada (cláusula 3.5. de estos Términos); en este caso, Yango actúa en nombre del Socio relevante con la participación de un operador autorizado a aceptar los pagos o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y es el destinatario del pago como agente del Socio (en adelante, «pago sin efectivo»). Yango no garantiza la ausencia de errores y fallos en el funcionamiento del Servicio en cuanto a la prestación de la oportunidad de pago sin efectivo, y además tiene derecho a contratar a terceros (subagentes) para el cumplimiento de sus obligaciones.

Dependiendo de la región del usuario, los pagos sin efectivo pueden realizarse sin la participación de Yango como beneficiario o con la participación de Yango como la otra parte de los arreglos financieros o el participante en el intercambio de información.

3.2. El Usuario elecciona la forma de pago adecuada el en la interfaz del Servicio. Si el Usuario elige el pago sin efectivo, el pago al socio en Efectivo o de otro modo directamente a la dirección del representante del socio, sin previo aviso a Yango cambiando el método de pago en la interfaz del Servicio (si es posible), no está permitido. El cargo de los fondos de Yango de la Tarjeta Vinculada se reconoce como correcto y correspondiente al método de pago elegido por el Usuario, no se realiza ningún reembolso al cancelar el cargo.

Al mismo tiempo, si es imposible por cualquier motivo realizar un pago sin efectivo (incluyendo, entre otros, indisponibilidad técnica temporal de esta función, imposibilidad temporal o permanente de pago sin efectivo utilizando la Tarjeta Vinculada, fondos insuficientes en la Tarjeta Vinculada), el Usuario se compromete a asegurarse de que existe una cantidad suficiente de fondos en la Tarjeta Vinculada para pagar la deuda por el pago de los servicios del socio lo antes posible, pero en cualquier caso a más tardar 30 días naturales desde la fecha de prestación del correspondiente servicio al Usuario.

3.3. En caso del pago sin efectivo, a discreción de Yango, es posible realizar tanto una transacción por el costo total del servicio como varias transacciones por partes separadas del costo del servicio. Además, el pago sin efectivo puede realizarse por cualquiera de los métodos especificados durante la prestación del servicio o al finalizarlo.

3.4. La Tarjeta Bancaria Vinculada puede ser especificada por el Usuario en la interfaz del Servicio, mientras que el Usuario especifica los siguientes datos:

  • Número de la tarjeta bancaria
  • Válida hasta
  • Código de seguridad

Si los datos de la tarjeta bancaria son correctos, válidos y el uso de esta tarjeta dentro del Servicio es técnicamente posible, la tarjeta bancaria especificada adquiere el estado de Vinculada y puede utilizarse para pagos sin efectivo (cláusula 3.1.2 de estos Términos). Todas las Tarjetas Vinculadas se muestran en la interfaz del Servicio; para comodidad del Usuario, en relación con la Tarjeta Vinculada, se muestran los últimos 4 dígitos del número de la Tarjeta Vinculada.

La Tarjeta Vinculada también puede ser indicada por el Usuario en la interfaz de los servicios de terceros que soportan la integración con el Servicio, participan en arreglos financieros y aseguran la autorización del pago del Usuario sin transferir información sobre la Tarjeta Vinculada a Yango.

El procedimiento para utilizar los servicios de terceros especificados en esta cláusula se rige por las normas de dichos terceros. Yango no es responsable del uso que el Usuario haga de dichos servicios de terceros y no garantiza la exactitud y seguridad de dichos servicios de terceros.

3.5. Al agregar la Tarjeta Vinculada, así como si el Usuario selecciona la función de pago sin efectivo para un servicio específico, el monto se debita dentro del monto equivalente a 1 dólar estadounidense para confirmar la exactitud y vigencia de los datos de la Tarjeta Vinculada; en caso de completar la transacción con éxito, el monto especificado se devuelve al Usuario. Un intento fallido de debitar el monto especificado significa que la Tarjeta Vinculada no se puede agregar y/o la función de pago sin efectivo no está disponible, respectivamente.

3.6. En caso de pago sin efectivo, junto con el pago de los servicios el Usuario tiene la oportunidad, a su propia discreción, de realizar un pago adicional sin efectivo a favor del Socio como un porcentaje del costo del servicio pagado (en adelante en estos Términos y en la interfaz del Servicio, la «Propina»).

3.7. Al agregar una Tarjeta Vinculada, así como en cualquier momento después de agregarla, el Usuario tiene la oportunidad de establecer o cambiar el tamaño de la Propina por defecto a través de la interfaz del Servicio; el Usuario puede cambiar el monto de la Propina para un servicio específico en la interfaz del Servicio después de completar su provisión.

3.8. La Propina (en el monto por defecto o en el monto específicamente indicado por el Usuario para un servicio específico) se debitará de la Tarjeta Vinculada si el Usuario ha indicado una valoración positiva (4-5 estrellas) en la interfaz del Servicio (4-5 estrellas) dentro de los 30 minutos posteriores a la prestación del servicio y ha hecho clic en el botón «Hecho», o no ha indicado una valoración positiva o negativa del servicio (no ha indicado el número de estrellas) y ha hecho clic en el botón «Hecho».

3.9. Si el Usuario, dentro de los 30 minutos posteriores a la prestación del servicio, indicó una valoración negativa (1-3 estrellas) en la interfaz del Servicio e hizo clic en el botón «Hecho», la Propina no se debitará de la Tarjeta Vinculada.

3.10. Si el Usuario no hace clic en el botón «Hecho» dentro de los 30 minutos posteriores a la prestación del servicio, el monto de la Propina (en el monto predeterminado o en el monto específicamente indicado por el Usuario para un servicio específico) será bloqueado en la Tarjeta Vinculada por un período de 24 horas dentro de las cuales el Usuario tiene la oportunidad de cambiar el tamaño de la Propina para este servicio hacia arriba o hacia abajo. Una vez transcurrido el tiempo especificado, la Propina se debita en la cantidad especificada por el Usuario (por defecto o para este servicio específico).

3.11. Yango no tiene acceso a los datos de la tarjeta bancaria especificados por el Usuario y no es responsable de la seguridad y confidencialidad de los datos transmitidos al realizar un pago sin efectivo. El Usuario hace un pago sin efectivo con la participación de un operador autorizado para recibir pagos, o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y este pago sin efectivo se regula por las reglas de los sistemas de pago internacionales, bancos (incluido el banco emisor de la Tarjeta Vinculada) y otros participantes en los arreglos financieros.

3.12. Al especificar sus datos de acuerdo con la cláusula 3.5. de estos Términos y al continuar el uso de la Tarjeta Vinculada, el Usuario confirma y garantiza que proporciona información precisa y completa sobre una tarjeta bancaria válida emitida a su nombre; el cumplimiento de las normas de los sistemas de pago internacionales y los requisitos del banco emisor que emitió la Tarjeta Vinculada, incluso con respecto al procedimiento para realizar pagos sin efectivo.

3.13. El Usuario comprende y acepta que todas las acciones realizadas dentro del Servicio utilizando el número de teléfono móvil confirmado por él, incluido el pago sin efectivo utilizando la Tarjeta Bancaria Vinculada, se consideran realizadas por el Usuario.

3.14. Si el Usuario no está de acuerdo con el hecho y/o monto del pago sin efectivo y otras cuestiones relacionadas con el uso de la Tarjeta Vinculada dentro del Servicio, el Usuario tiene derecho a comunicarse con Yango usando los teléfonos indicados por el Servicio y/o a través de la interfaz de servicio de soporte (retroinformación) dentro de los 14 días a partir de la fecha del pago sin efectivo u otras acciones o eventos que causaron el recurso.

Si, sobre la base de los resultados de la verificación de dicho recurso, Yango decide devolver el monto del pago sin efectivo en su totalidad o en parte, el reembolso especificado se realiza a la cuenta bancaria de la tarjeta bancaria desde la cual se realizó el pago sin efectivo. Los fondos se devuelven con la participación de un operador autorizado para recibir pagos, o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y este pago sin efectivo se regula por las reglas de los sistemas de pago internacionales, bancos (incluido el banco emisor de la Tarjeta Vinculada) y otros participantes en los arreglos financieros.

3.15. Yango se reserva el derecho de exigir al Usuario en cualquier momento que confirme los datos especificados por él dentro del Servicio, incluidos los datos de la Tarjeta Vinculada, y de solicitar a este respecto los documentos justificativos (en particular, los documentos de identidad); no proporcionarlos, a discreción de Yango, podrá equipararse a la prestación de información falsa y acarrear las consecuencias previstas en estos Términos.

Las disposiciones sobre las condiciones y el procedimiento para el pago de los servicios de entrega especificados en esta sección no se aplican cuando un tercero paga por dichos servicios en lugar del Usuario en virtud de un acuerdo por separado firmado por Yango con dicho tercero.

 

4. Ley aplicable y solución de controversias

4.1. Estos Términos de Uso y cualquier obligación no contractual que surja de estos Términos de Uso o estén relacionados con ellos se regirán e interpretarán de acuerdo con las leyes de Inglaterra y Gales sin tener en cuenta las disposiciones sobre conflictos de leyes.

4.2. Cualquier disputa, diferencia, controversia o reclamo que surja de o en conexión con estos Términos de Uso, incluyendo (pero no limitado a) cualquier pregunta relacionada con su existencia, validez, interpretación, desempeño, descarga y recursos aplicables, se remitirá y finalmente resuelto mediante arbitraje conforme a las Reglas de Arbitraje del Centro de Arbitraje Internacional de Dubai, cuyas Reglas se consideran incorporadas por referencia a esta cláusula. El número de árbitros será uno. La sede del arbitraje será Dubai, Emiratos Árabes Unidos. El idioma que se utilizará en el arbitraje será el inglés.

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING YANGO DELIVERY SERVICE

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango Delivery LLC (hereinafter referred to as Yango Delivery) to an Internet user (hereinafter referred to as the User) to use Yango Delivery service (hereinafter referred to as the Service) in United Arab Emirates.

1.2. The use of the Service by the User is governed by these Terms and Privacy Notice (https://yango.com/legal/yango_privacy_notice).

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms, the User may not use the Service. Yango Delivery may, at any time without notice to the User, amend provisions hereof, and may, at any time without notice to the User, amend provisions.

1.4. Yango Delivery enables the User to place information on the User’s potential demand for delivery services, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

YOU ACKNOWLEDGE THAT YANGO DELIVERY DOES NOT PROVIDE DELIVERY SERVICES AND THAT ALL DELIVERY SERVICES ARE PROVIDED BY THIRD PARTIES – DELIVERY SERVICE PROVIDERS, WHO ARE NOT EMPLOYED BY YANGO DELIVERY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND DELIVERY SERVICE PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND RELEVANT DELIVERY SERVICE PROVIDER, YANGO DELIVERY IS NOT THE PARTY OF THESE AGREEMENTS.

1.5. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango Delivery.

1.6. All conversations the User holds with the support team and delivery partners of the Service can be recorded to control quality and improve services.

1.7. By using the Service, the User consents to receive promotional messages, including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on delivery services (hereinafter referred to as the Information) is provided by third parties (partners)- the delivery service providers. For more information about the services offered the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide them with information about the services offered.

2.3. Yango Delivery shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango Delivery) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of delivery services. Yango Delivery shall not be held liable for financial, and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users’ ratings and feedback are posted on the Service website and can be available on third-party websites. Yango Delivery reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Yango Delivery reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for delivery services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango Delivery informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Yango Delivery thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.

2.7. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website.

2.8. The Service partner charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's or courier’s arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of service as per tariff for a period of time from when the vehicle or courier actually arrived to the pick-up place or from the time of arrival specified in information the provider submitted to the User regarding the Users’ parcel ordered (whichever comes later) until the User cancelled the service. The User shall cancel a service by sending a relevant notice to the provider via the Service.

2.9. The User authorizes Yango Delivery to process personal information (including personal details) of the User of Yango Delivery, to transfer personal information of the User to Yango Delivery’s partners, and to process personal information for Yango Delivery’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Notice available at: (https://yango.com/legal/yango_privacy_notice).

2.10. If the User orders delivery services from Yango Delivery’s partners, the User undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of United Arab Emirates.

The Yango Delivery’s partners may set other limits on items to be delivered.

The Yango Delivery’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yango Delivery’s partner provide delivery services. At the same time, a Yango Delivery’s partner may deny delivery services to the User, if the Yango Delivery’s partner/ representatives of the Yango Delivery’s partner discover any non-deliverable items.

 

3. Function of cashless payment for delivery services and other services

3.1. The User can pay for delivery or other services provided to the User in accordance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to the delivery service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango Delivery being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Yango Delivery acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved or otherwise (including directly) (hereinafter referred to as cashless payments). In the case of cashless payments Yango Delivery receives payments as a limited payment collection agent of the delivery service provider. Yango Delivery does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango Delivery acting as a payment recipient or with Yango Delivery involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to affect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be affected by any of the above means during the service or when the service is over.

In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked Card and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to 5 AED (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully affected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default number of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango Delivery by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango Delivery decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango Delivery is not a party to settlements made via the Linked Card, Yango Delivery can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Yango Delivery reserves the right to require at any time that the User to confirm the details it specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Yango Delivery thinks fit.

3.13. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yango Delivery signed with such third party.

 

4. Governing law and dispute resolution

4.1. These Terms of Use of Yango Delivery arising out of or in connection with these Terms shall be governed by and construed in accordance with law of England and Wales without regard to the conflict of law provisions.

4.2. Any dispute, difference, controversy, or claim arising out of or in connection with this contract, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge, and applicable remedies, shall be subject to the exclusive jurisdiction of the Courts of the Dubai International Financial Centre (the “DIFC Courts”).

 

5. Amendment, Restatement and Termination

5.1. Each of the Terms and the Privacy Notice may be amended or restated by the Company at any time, provided the User has been notified by the Company in the Application at least five (5) business days before the amendment or restatement should take place (Notification Period). Subject to the provision of this clause 5.1, each of the Terms and the Privacy Notice shall become effective upon publication at https://yango.com/legal/yango_termsofuse and https://yango.com/legal/yango_privacy_notice, respectively. If the User continues to use the Service any time after the Notification Period, the User shall be deemed as bound by the relevant amended or restated version of the Terms and/or the Privacy Notice.

5.2. The Company may terminate the Service, these Terms and/or the Privacy Notice at its convenience any time, provided the User has been notified by the Company through the Application at least five (5) business days before the proposed termination date.
