Terms of Use of Yango Delivery

1. General Provisions.

1.1. These Terms (hereinafter referred to as the "Terms") constitute an offer by Yango Delivery FZ-LLC (hereinafter referred to as "Yango") to an Internet user (hereinafter referred to as the "User") to use the Delivery functionality (hereinafter referred to as the "Service") in the Yango App.

1.2. By using the Service or any of its features, the User acknowledges having read, understood, and fully accepted these Terms. If the User does not agree with any of the provisions set forth in these Terms, they must refrain from using the Service.

1.3. Yango reserves the right to modify the provisions of these Terms at any time and without prior notice to the User. It is the User’s responsibility to periodically review these Terms to stay informed of any changes. The most updated version of the Terms is always available at: https://yango.com/legal/yango_termsofuse_delivery.

1.4. The User must cease using the Service if they do not agree with the changes made to the Terms. Continued use of the Service after changes to the Terms will be deemed the User’s explicit consent to the new version.

1.5. The Service provides the User with the ability to publish information about their demand for delivery services or other related services free of charge. Additionally, it offers the opportunity to access and explore offers from various organizations operating in this sector (Service Partner), enabling the search for such offers based on parameters defined by the User. All existing functionalities of the Service, as well as any future developments or additions of new functionalities, are governed by these Terms.

1.6. The functionalities of the Service may vary depending on the User's geographic region. Not all features may be available, or they may be subject to restrictions in certain regions. A feature is considered inaccessible or restricted for a User in a specific region if the User does not have the explicit capability to use it. The use of techniques or software designed to circumvent such regional restrictions is expressly prohibited. Provisions of these Terms related to Service features that are inaccessible or restricted will not apply until such features are explicitly made available to the User in their region. Yango will provide information on the availability of Service features in response to User inquiries regarding their specific region.

1.7. YANGO EXCLUSIVELY PROVIDES INFORMATION TECHNOLOGY SERVICES. YANGO DOES NOT OFFER DELIVERY SERVICES. NOTHING CONTAINED IN THESE TERMS SHALL BE INTERPRETED AS YANGO PROVIDING SUCH SERVICES OR AS ESTABLISHING A DELIVERY SERVICE CONTRACT BETWEEN YANGO AND THE USER. DELIVERY SERVICES ARE PROVIDED EXCLUSIVELY BY INDEPENDENT THIRD PARTIES – SERVICE PARTNERS, WHO OPERATE AS AUTONOMOUS SERVICE PROVIDERS IN THEIR OWN NAME AND UNDER THEIR OWN RESPONSIBILITY. THE SERVICE IS DESIGNED TO FACILITATE THE USER IN CONTACTING AND DIRECTLY CONTRACTING THESE SERVICE PROVIDERS. YANGO ASSUMES NO RESPONSIBILITY FOR THE ACTS OR SERVICES PROVIDED BY SUCH PROVIDERS, WHETHER TOWARDS THE USER OR THIRD PARTIES.

1.8. The User agrees that all conversations with Service support specialists, as well as with Partners or their representatives, may be recorded for the purpose of quality control and service improvement.

1.9. By using the Service, the User agrees to receive advertising messages. The User has the right to opt out of receiving advertising messages by using the corresponding functionality within the Service or by following the instructions specified in the received advertising message.

1.10. Yango reserves the right to temporarily or permanently restrict the User’s access to the Service without providing an explanation. This restriction may be applied in cases such as the User’s non-compliance with the Terms; receipt of an order from an authorized body; User actions that result or may result in harm to Yango or third parties; situations that pose a danger to other users; or the need to protect the legitimate rights and interests of Yango and third parties. Additionally, Yango may restrict access to the Service if it receives repeated complaints related to the use of the application by the User or by third parties for whom the User requests the service.

2. Terms of Service Use.

2.1. The Service is provided to the User for personal non-commercial use.

2.2. The information regarding delivery services and/or other related services is provided exclusively by the Service Partners. The User may obtain additional details about the services offered by directly contacting the Service Partners or by providing their contact information through the functionalities of the Service, allowing the Service Partners to independently contact the User and provide the requested information about the services offered.

2.3. Yango assumes no responsibility for the content or relevance of the information provided by the Service Partners, including details about the cost of their services and their availability. Interactions and transactions between the User and the Service Partners related to the acquisition of services are conducted independently, without Yango’s involvement, and must be governed by the regulations and conditions established by each Partner for the provision of their services. Yango is not responsible for financial or any other type of transactions carried out between the User and the Partner, nor for the consequences arising from the acquisition of services offered by the Partners.

2.4. The User may access certain functionalities of the Service that allow them to evaluate the services offered by the Partners and provide comments or opinions regarding the Service or the Partners’ services. These ratings and opinions may be published both on the Service’s website and on third-party websites. Yango reserves the right, at its sole discretion and without the need for justification, to refrain from publishing, delete, or block the ratings and opinions submitted by the User at any time.

2.5. During periods of high demand for services, including days leading up to holidays, days of mass events, and other similar circumstances, the rates for services offered by the Partners may increase. Yango will notify Users of any rate increases through a visible notification in the app, a publication on the Service’s website, a message sent to the User’s mobile phone number, or by any other means at Yango’s discretion.

2.6. If the Service supports ordering delivery services in advance (hereinafter, "pre-ordered delivery"), the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered delivery is scheduled to start). The cost of the pre-ordered services will be calculated and indicated in the Service when the delivery services are ordered. The price may change in circumstances listed on the Service website https://yango.com.

2.7. To cancel the service, the User must send the corresponding notification to the Partner through the Service, using the specific functionality provided for this purpose.

The Partner may charge a cancellation fee in the following cases:

• If the User cancels the service after the Partner’s representative has arrived at the location indicated by the User for package pickup (Point A).
• If the User fails to hand over the package to the Partner’s representative at Point A within ten (10) minutes of the representative’s arrival at Point A, in which case it will be considered that the User has canceled the service.

The amount of the cancellation fee in both cases will be calculated based on the rate published on the Service’s website: https://yango.com.

2.8. The User authorizes Yango to process their personal information (including personal details), to transfer such information to Yango’s Partners, and to process it on behalf of Yango’s Partners for the purpose of providing services to the User through the Service. When the User utilizes the Service, their personal information is transmitted and processed in accordance with the terms and purposes outlined in the Privacy Policy, available at: (https://yango.com/legal/yango_privacy_notice).

2.9. The time of arrival of the courier at the place of departure indicated by the User in the Request is approximate and can be changed depending on the traffic situation and other external factors. Yango notifies about the change in the arrival time of the courier by sending an information message to the User's mobile phone number or otherwise at the discretion of Yango.

2.10. The User is solely responsible for the contents of the items transferred for delivery to Partners, and undertakes not to hand over for the delivery the following items:

• any weapons, ammunition, parts, dual-use devices, fireworks, and flares;
• narcotic drugs, psychotropic substances, precursors and their analogs;
• nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
• poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
• any money, including national and foreign currency;
• printed publications or graphic materials containing any prohibited content, such as promotion of harm to public order, national security, violence, discrimination, etc;
• perishable food without special package;
• items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
• animals and plants, biological materials;
• items requiring specially equipped vehicles to be transported;
• liquids in open containers;
• space-consuming items, where the total dimensions of length, width (two diameters or axes at the base of a roll), and height exceed 150 cm (subject to special exemptions); long items over 150 cm; and items weighing more than 20 kg. When ordering a delivery service via Cargo functionality, the size of the items to be transferred (width, length, height) will depend on the vehicle size and can be reviewed when selecting the specific vehicle option.
• fragile items without special packaging;
• any items whose circulation is prohibited, restricted, or requires special permissions under applicable laws in the delivery territory, as well as items and substances that may pose a danger to public safety, contaminate or damage other packages, or harm individuals or property.

Service Partners may impose additional restrictions on the contents of parcels intended for delivery. The Partners accept items for delivery according to the number of packages, without checking the internal contents.

The User acknowledges and agrees that, in the event of non-compliance with the above requirements, they will assume full responsibility for any negative consequences that may arise. Additionally, the Partners reserve the right to refuse, suspend, or terminate delivery services at any stage if the User breaches these requirements. In such cases, no compensation, refunds, or restitution will be provided, and the Partners will not assume custody or responsibility for parcels that violate these terms.

In the event that prohibited or restricted items are submitted for delivery, Yango and the Partners bear no liability for resulting consequences, including financial losses, penalties, legal proceedings, or other adverse outcomes.

2.11. SERVICE PARTNERS DO NOT PROVIDE POSTAL SERVICES AND DO NOT ACCEPT POSTAL SHIPMENTS (POSTAL CORRESPONDENCE WITH AN ADDRESS, POSTAL PACKAGES, CONTAINERS, OR PRINTED PUBLICATIONS IN CORRESPONDING PACKAGING) FOR DELIVERY.

2.12. THIS SERVICE IS NOT SUITABLE AND SHOULD BE AVOIDED FOR REQUESTS INVOLVING THE DELIVERY OF ITEMS VALUED AT MORE THAN 700 BOB PER REQUEST. By placing a service request through the App, the User declares that the value of the items to be delivered in the request does not exceed 700 BOB. In the event of damage to or loss of the items, and provided it is proven that such damage occurred while under the Partner’s handling, the maximum compensation the Partner may offer will be up to 700 BOB. To initiate the compensation process, the User must provide proof of the package’s contents and evidence of the damage caused by the Partner. Once compensation has been provided by the Partner, the User waives any right to further claims or legal actions against the Partner or Yango, considering the matter fully resolved.

2.13. The Service Partner’s representative will accept packages for delivery only if the outer packaging is in satisfactory condition, without inspecting or assuming responsibility for the package's internal contents. The User is solely responsible for ensuring that the packaging is appropriate for the content.

2.14. The User acknowledges that delivery is deemed successful when the recipient receives the shipment with the outer packaging in satisfactory condition, meaning no signs of tampering, visible damage, or apparent physical alterations to the packaging.

2.15. The User may prepare the delivery document together with the Service Partner’s representative or, at their own responsibility, agree with the representative not to formalize such a document.

2.16. Failure to comply with the requirements of this section makes the User fully liable for any consequences, including but not limited to financial losses, delivery delays, confiscation, penalties, or other adverse outcomes. The User will be fully responsible for all costs, expenses, fines, or liabilities arising from non-compliance with these Terms or applicable laws. The User further agrees to indemnify and hold harmless Yango and the Partners against any claims, damages, costs, liabilities, or legal actions resulting from the User’s breach of this section, including but not limited to third-party claims and government enforcement actions.

3. Payment Terms

3.1. The User can pay for delivery or other services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a service provider (inter alia, by cash or by any other means stipulated by the said provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.5 hereof); in this case, Yango acts in the name of the relevant service provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the provider or otherwise (including directly) (hereinafter referred to as cashless payments).

Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Yango acting as a payment recipient or with Yango involved as another party to settlements or a party to information exchange.

3.2. The User shall choose the relevant form of payment in the Service interface. If the User selects a wire payment, the payment to the Partner's address in Cash or otherwise directly to the Partner's representative, without additional notification of Yango by changing the payment method in the Service interface (if possible), shall be prohibited. The debit of Yango funds from the Linked Card shall be deemed correct and corresponding to the payment method selected by the User, and no refund shall be made by canceling the debit.

At the same time, if it is impossible to pay by wire for any reason (including, but not limited to, temporary technical unavailability of this function, temporary or permanent impossibility of wire payment using a Linked Card, insufficient funds on the Linked Card), the User undertakes to ensure there is sufficient funds on the Linked Card to repay the arrears on Partner's services as soon as possible, but in any case no later than 30 calendar days from the moment of rendering the relevant service to the User.

3.3. For cashless payments, it is possible to effect both one transaction for the entire cost of delivery or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the service or when the service is over.

3.4. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

• Bank card number
• Valid through
• Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

The User may also indicate the Linked Card in the interface of third-party services supporting integration with the Service and payment participants and providing authorization of the User's payment without transmitting information about the Linked Card to Yango.

The procedure for using the third-party services specified in this Clause shall be governed by the rules stipulated by such third parties. Yango shall not be liable for the User's use of such third-party services and shall not guarantee the correctness and safety of such third-party services. Yango acts solely as an intermediary for services provided by independent third parties, such as payment processing. If the User does not agree with the terms and conditions of these third parties, they must refrain from using their services.

3.5. When a Linked Card is added and when the User chooses the function of cashless payment for a certain service, the amount limited to amount equivalent to 1 US dollar (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.6. In case of cashless payments, the User can, along with payment for delivery or other service, make an additional cashless payment to the service provider as a percentage of the cost of the paid delivery or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.7. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.8. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.9. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.10. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.11. Yango does not have access to the bank card data specified by the User and is not responsible for the safety and confidentiality of the transmitted data during non-cash payment. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.12. When indicating their details pursuant to cl. 3.5 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.13. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.14. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can act as a body that transfers above user requests to providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.15. Yango reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated hereof, if Yango thinks fit.

3.16. In any case, the User acting as a consumer releases the Company from liability for the unauthorized use of payment methods owned by third parties, as well as for any incorrect or outdated payment information provided by the User or consumer.

3.17. The provisions on the terms and procedure of payment for delivery services, specified in this Section shall not apply, when a third party pays for such services instead of the User under a separate contract Yango signed with such third party.

4. The 'Assistant' Functionality – Parcel Payment at Destination

4.1. The User may be provided with access to the "Assistant" feature on the Service, where this feature is available and enabled for specific regions at Yango's discretion. The "Assistant" option allows the User to request the Partner, as part of the delivery services provided, to advance the cost of the Parcel at the time of pick-up, under the User's promise that the amount will be coverred to the Partner by the Recipient upon delivery of the Parcel.

When the "Assistant" option is selected, the Request will only be offered to the Partners that have agreed to perform services including "Assistant" option under the terms set out below.

4.2. Upon the User selecting the "Assistant" option, the User expressly agrees to the following:

4.2.1. The User must select the "Assistant" option when creating the Request through the Service. In the form that will be enabled, the User must clearly and accurately specify the amount that the Recipient must pay for the Parcel upon delivery. This amount may not exceed 200 BOB (hereinafter referred to as the "Parcel Cost"), as the Partner will not advance an amount beyond this limit.

If, upon arrival at the pickup location, it is found that the Parcel Cost requested for delivery under the "Assistant" option exceeds the 200 BOB limit, the Partner shall be entitled to refuse to proceed with the service. In such a case, the service will be considered canceled by the User and will be subject to the applicable cancellation fees, unless the User expressly agrees to continue with the service without the "Assistant" option.

4.2.2. The User agrees not to use the "Assistant" option if the Parcel contains items not eligible for return or exchange under applicable law.

4.2.3. By accepting the Request with the "Assistant" option, the Partner, represented by a courier (hereinafter, the “Courier”), agrees to advance the Parcel Cost at the time of pickup from the User, under the User’s promise that the Recipient will cover this amount to the Courier upon delivery. This advance is provided solely to facilitate the delivery process, avoiding the need for a return trip, which, if required, would be subject to an additional charge in accordance with the applicable tariffs.

4.2.4. Once the cost of the Parcel equivalent to the advance made by the Partner is collected from the Recipient, the advance made by the Partner shall be considered fully settled, and no further amounts shall be owed between the User and the Partner in respect of that advance.

4.2.5. The delivery of the Parcel under the "Assistant" option is subject to the Recipient's full payment of the Parcel Cost at the time of delivery, as well as the payment of the corresponding delivery tariff.

If the Recipient fails to provide the Parcel Cost to the Courier, does not pay the corresponding delivery fee, or if the delivery fails for any other reason, the Parcel will be returned to the User. In such a case, the User must return to the Courier the total Parcel Cost advanced by the Courier and pay all applicable delivery fees, including, but not limited to, return fees and any applicable cancellation charges.

4.2.6.If the User believes that the delivery failure is due to an error by Yango or the Partner, the User may submit a claim for compensation of proven actual damages directly resulting from such error, within the limits of the Parcel Cost, through the Support available in the Service. However, the User's obligation to reimburse the Partner remains in effect, regardless of any claims submitted.

4.2.7. Should the User fail to reimburse the Partner, Yango reserves the right to:

a. Suspend the User's access to the Service or specific services until reimbursement is made; and/or

b. Deduct the amount owed from the User’s Linked Card, provided sufficient funds are available.

4.2.8. The User acknowledges and agrees that the purchase transaction related to the Parcel is carried out exclusively between the User and the Recipient. Neither the Partner (or the Courier) nor Yango is a party to this purchase transaction, nor do they acquire ownership, interest, or rights over the Parcel at any time. The Partner's role is strictly limited to providing delivery services, while Yango's role is solely limited to providing technological services. Yango does not participate in, manage, or guarantee any payment or reimbursement between the User, Partner, or Recipient, and Yango bears no responsibility for any financial obligations arising from the use of the"Assistant" feature.

4.2.9. The User must comply with all applicable local laws, providing the Recipient with all necessary primary documents related to the Parcel, including, but not limited to, receipts, invoices, or other documents required by applicable regulations. Furthermore, the User shall be solely responsible for remitting all applicable taxes, duties, levies, or charges associated with the sale, provision, or delivery of the Parcel from the User to the Recipient. The User agrees to indemnify, defend, and hold harmless Yango and the Partner from any claims, penalties, fines, damages, losses, costs, expenses (including reasonable legal fees), or liabilities of any kind arising directly or indirectly from the User’s failure to meet these legal, tax, or regulatory obligations.

5. Disclaimer of Liability

5.1. The use of the Service by the User shall be solely and exclusively the responsibility of the User.

5.2. The quality and service levels provided by the Partners are solely and exclusively the responsibility of the Partners in their capacity as providers.

5.3. The User understands and agrees that in the event of any dissatisfaction with the provision of delivery, and/or related services provided by the Partners, any request, complaint, or claim must be directed solely and exclusively to the corresponding Partner.

5.4. In any case, the User expressly understands and agrees to all the conditions established in these Terms, and therefore commits to indemnify and hold harmless Yango from any claim or extrajudicial or judicial request seeking the recognition and payment of indemnities and/or damages.

6. Applicable Law and Dispute Resolution

6.1. These Terms of Use and any non-contractual obligations arising out of or related to them shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.

6.2. Any dispute, difference, controversy, or claim arising out of or in connection with these Terms of Use, including (but not limited to) any question regarding their existence, validity, interpretation, performance, discharge, and applicable remedies, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre, which rules are deemed incorporated by reference into this clause. The number of arbitrators shall be one. The seat of arbitration shall be Dubai, United Arab Emirates. The language to be used in the arbitration shall be English.

Términos de uso de Yango Delivery

1. Disposiciones generales.

1.1. Estos Términos (en adelante, los «Términos») constituyen una oferta de Yango Delivery FZ-LLC (en adelante, «Yango») a un usuario de Internet (en adelante, el «Usuario») para utilizar la funcionalidad de Delivery (en adelante, el «Servicio») en la App de Yango.

1.2. Al hacer uso del Servicio o cualquiera de sus funcionalidades, el Usuario reconoce haber leído, entendido y aceptado íntegramente los presentes Términos. En caso de no estar de acuerdo con alguna de las disposiciones establecidas en estos Términos, el Usuario deberá abstenerse de utilizar el Servicio.

1.3. Yango se reserva el derecho de modificar las disposiciones de estos Términos en cualquier momento y sin previo aviso al Usuario. Es responsabilidad del Usuario revisar periódicamente estos Términos para estar informado de cualquier cambio. 1.4. El Usuario debe dejar de usar el Servicio si no está de acuerdo con los cambios realizados en los Términos. El uso continuo del Servicio después de cambiar los Términos se considera el consentimiento explícito del Usuario a su nueva versión.

1.5. El Servicio proporciona al Usuario la posibilidad de publicar información sobre su demanda de servicios de entrega u otros servicios relacionados de manera gratuita. Además, ofrece la oportunidad de acceder y explorar ofertas de diversas organizaciones que operan en este sector (Socio del Servicio o Socio), permitiendo la búsqueda de tales ofertas según los parámetros definidos por el Usuario. Todas las funcionalidades existentes del Servicio, así como cualquier desarrollo futuro o adiciones de nuevas funcionalidades, están regidas por estos Términos.

1.6. Las funcionalidades del Servicio pueden variar según la región geográfica del Usuario. No todas las funciones podrán estar disponibles o podrían estar sujetas a restricciones en ciertas regiones. Una función se considera inaccesible o limitada para un Usuario en una región específica si dicho Usuario no tiene la capacidad explícita de utilizarla. Queda expresamente prohibido el uso de técnicas o software destinados a eludir dichas restricciones regionales. Las disposiciones de estos Términos relacionadas con las funciones del Servicio que son inaccesibles o limitadas no serán aplicables hasta que dichas funciones estén explícitamente disponibles para el Usuario en su región. Yango proporcionará información sobre la disponibilidad de las funciones del Servicio en respuesta a las solicitudes del Usuario respecto a su región específica.

1.7. YANGO BRINDA EXCLUSIVAMENTE LOS SERVICIOS DE TECNOLOGIA DE INFORMACION. YANGO NO OFRECE SERVICIOS DE ENTREGA NI DE TRANSPORTE. NADA CONTENIDO EN ESTOS TÉRMINOS DEBERÁ INTERPRETARSE COMO QUE YANGO PROPORCIONA TALES SERVICIOS, NI QUE EXISTA UN CONTRATO DE SERVICIO DE ENTREGA ENTRE YANGO Y EL USUARIO. LOS SERVICIOS DE ENTREGA SON PRESTADOS ÚNICAMENTE POR TERCEROS INDEPENDIENTES – LOS SOCIOS DE SERVICIO, QUE OPERAN COMO PROVEEDORES DE SERVICIOS AUTÓNOMOS EN SU PROPIO NOMBRE Y BAJO SU PROPIA RESPONSABILIDAD. ESTOS PROVEEDORES HAN AFIRMADO POSEER TODAS LAS LICENCIAS Y AUTORIZACIONES REQUERIDAS Y CUMPLIR CON TODOS LOS REQUISITOS APLICABLES PARA LA PRESTACIÓN DE SUS SERVICIOS. EL SERVICIO DE YANGO ESTÁ DISEÑADO PARA FACILITAR QUE EL USUARIO PUEDA CONTACTAR Y CONTRATAR DIRECTAMENTE A ESTOS PROVEEDORES DE SERVICIOS. YANGO NO ASUME RESPONSABILIDAD ALGUNA POR LOS ACTOS O SERVICIOS PROPORCIONADOS POR DICHOS PROVEEDORES, YA SEA HACIA EL USUARIO O HACIA TERCEROS.

1.8. El Usuario acepta que todas las conversaciones del Usuario con los especialistas de soporte del Servicio, así como con los Socios o sus representantes, pueden grabarse con el fin de controlar la calidad de los servicios y desarrollarlos.

1.9. Al utilizar el Servicio, el Usuario expresa su conformidad en recibir mensajes publicitarios. El Usuario tiene derecho a negarse a recibir mensajes publicitarios utilizando la funcionalidad correspondiente del Servicio o siguiendo las instrucciones especificadas en el mensaje publicitario recibido.

1.10. Yango se reserva el derecho de restringir temporal o permanentemente el acceso al Servicio del Usuario, sin necesidad de proporcionar explicaciones. Esta restricción puede aplicarse en casos tales como el incumplimiento de los Términos por parte del Usuario; la recepción de una orden de un organismo autorizado; acciones del Usuario que resulten o puedan resultar en daños a Yango o a terceros; situaciones que representen un peligro para otros usuarios; o la necesidad de proteger los derechos e intereses legítimos de Yango y de terceros. Adicionalmente, Yango podrá restringir el acceso al servicio si recibe quejas repetidas relacionadas con el uso del aplicativo por parte del Usuario o de terceros para quienes el Usuario solicite el servicio.

2. Términos de Uso del Servicio.

2.1. El Servicio se proporciona al Usuario para uso personal no comercial.

2.2. La información relativa a los servicios de entrega y/o a otros servicios relacionados es proporcionada exclusivamente por los Socios del Servicio. El Usuario podrá obtener detalles adicionales sobre los servicios ofrecidos contactando directamente a los Socios del Servicio o proporcionando sus datos de contacto mediante las funcionalidades del Servicio, a fin de que los Socios del Servicio puedan, de forma autónoma, establecer contacto con el Usuario y proporcionarle la información solicitada sobre los servicios que se ofrecen.

2.3. Yango no asume responsabilidad alguna por el contenido o la pertinencia de la información proporcionada por los Socios del Servicio, incluidos los detalles sobre el costo de sus servicios y su disponibilidad. Las interacciones y transacciones entre el Usuario y los Socios del Servicio relacionadas con la adquisición de servicios se realizan de manera independiente, sin la intervención de Yango, y deben regirse por las normativas y condiciones establecidas por cada Socio para la prestación de sus servicios. Yango no es responsable de las transacciones financieras ni de cualquier otra naturaleza realizadas entre el Usuario y el Socio, ni de las consecuencias derivadas de la adquisición de los servicios ofrecidos por los Socios.

2.4. El Usuario podrá acceder a ciertas funcionalidades del Servicio que le permitan evaluar los servicios ofrecidos por los Socios y emitir comentarios u opiniones respecto al Servicio o a los servicios de los Socios. Estas valoraciones y opiniones podrán ser publicadas tanto en el sitio web del Servicio como en sitios web de terceros. Yango se reserva el derecho, a su entera discreción y sin necesidad de justificación, de no publicar, eliminar o bloquear las valoraciones y opiniones emitidas por el Usuario en cualquier momento.

2.5. Durante períodos de alta demanda de los servicios, incluyendo días previos a festividades, días de eventos masivos y en otras circunstancias similares, las tarifas de los servicios ofrecidos por los Socios pueden incrementarse. Yango informará sobre cualquier aumento de tarifas una notificación visible en el aplicativo, la publicación en el sitio web del Servicio o enviando un mensaje al número de teléfono móvil del Usuario, o por cualquier otro medio a discreción de Yango.

2.6. Si el Servicio soporta un pedido anticipado de los servicios de entrega (en adelante, «entrega pedida por adelantado»), el pedido estará disponible para su confirmación por parte del Socio del Servicio más cerca del tiempo especificado por el Usuario en el pedido (no antes de 30 minutos antes del inicio de la entrega pedida por adelantado). El costo de los servicios pedidos por adelantado se calculará e indicará en el Servicio al pedir los servicios de entrega. El precio puede cambiar dependiendo de las circunstancias especificadas en el sitio web del Servicio https://yango.com.

2.7. Para cancelar el servicio, el Usuario deberá enviar la notificación correspondiente al Socio a través del Servicio, utilizando la funcionalidad específica habilitada para tal fin.

• El Socio podrá cobrar un pago por cancelación en los siguientes casos:
• Si el Usuario cancela el servicio después de que el representante del Socio haya llegado al lugar indicado por el Usuario para la recogida del paquete (Punto A).

Si el Usuario no entrega el paquete al representante del Socio en el Punto A dentro de los diez (10) minutos siguientes a la llegada del representante al Punto A, en cuyo caso se considerará que el Usuario ha cancelado el servicio.

El monto del pago por cancelación en ambos casos se calculará de acuerdo con la tarifa publicada en el sitio web del Servicio: https://yango.com.

2.8. El Usuario autoriza a Yango a procesar información personal (incluidos los datos personales) del Usuario), a transferir información personal del Usuario a los Socios del Servicio y a procesar información personal para que los Socios del Servicio brinden servicios a el Usuario en el Servicio. Cuando el Usuario recurre al Servicio, su información personal se transmite para ser procesada en virtud de los términos y para los fines determinados en la Política de Privacidad disponible en: (https://yango.com/legal/yango_privacy_notice).

2.9. La hora de llegada del representante del Socio al Punto A es aproximada y puede variar en función de las condiciones del tráfico y otros factores externos. Yango informará sobre cualquier cambio en la hora de llegada del representante del Socio mediante una notificación en la App, un mensaje informativo al número de teléfono móvil del Usuario, o por cualquier otro medio a discreción de Yango.

2.10. El Usuario es el único responsable del contenido de los paquetes entregados a los representantes de los Socios y se compromete a no incluir los siguientes artículos en dichos paquetes:

• сualquier arma, munición, partes, dispositivos de doble uso, fuegos artificiales y bengalas; sustancias estupefacientes, psicotrópicas, precursores y sus análogos;
• materiales nucleares, sustancias radiactivas, superpotentes, cáusticas, explosivas e inflamables, agentes de ignición, sustancias pirotécnicas y artículos relacionados, y otras sustancias peligrosas;
• venenos, animales venenosos, sustancias venenosas, plantas venenosas y semillas de plantas venenosas;
• moneda nacional y extranjera;
• publicaciones impresas, materiales gráficos, películas, fotografías, materiales de audio y video que contengan propaganda de cambios violentos del sistema constitucional, destrucción de la seguridad nacional, guerra, superioridad social, racial, nacional, religiosa, de clase y de clan, crueldad, violencia y pornografía;
• alimentos perecederos sin embalaje especial;
• artículos y sustancias que, por su naturaleza o por su embalaje, puedan suponer un peligro para las personas, contaminar o estropear (dañar) otros bienes, personas u objetos circundantes;
• animales y plantas, materiales biológicos;
• artículos que requieren vehículos especialmente equipados para su transporte;
• líquidos en recipientes abiertos;
• artículos de gran tamaño, cuya suma de medidas (salvo casos especialmente estipulados) en longitud, anchura (dos diámetros o ejes en la base del rollo) y altura exceda de 150 cm, artículos largos, cuya longitud sea superior a 150 cm; el peso de los artículos transferidos no puede exceder 20 kg. Las dimensiones permitidas para la opción de envío en Cargo pueden ser consultadas en la App al seleccionar esta opción;
• artículos frágiles sin embalaje especial;
• cualquier artículo cuya circulación esté prohibida, restringida o requiera permisos especiales según las leyes aplicables en el territorio de entrega, así como artículos y sustancias que puedan representar un peligro para la seguridad pública, contaminar o dañar otros paquetes, o causar daño a personas o bienes.

Los Socios pueden establecer restricciones adicionales sobre el contenido de los paquetes destinados a la entrega. Los Socios aceptan artículos para su entrega según la cantidad de paquetes, sin verificar el contenido interno.

El Usuario reconoce y acepta que, en caso de incumplir los requisitos mencionados anteriormente, asumirá toda la responsabilidad por cualquier consecuencia negativa que pudiera surgir. Además, los Socios se reservan el derecho de rechazar, suspender o finalizar los servicios de entrega en cualquier etapa si el Usuario incumple dichos requisitos. En tales casos, no se proporcionará ninguna compensación, reembolso o restitución, y los Socios no asumirán custodia ni responsabilidad alguna por los paquetes que violen estos términos.

En caso de que se entreguen artículos prohibidos o restringidos para su envío, ni Yango ni los Socios asumirán responsabilidad alguna por las consecuencias derivadas, incluyendo pérdidas financieras, multas, procedimientos legales u otros resultados adversos.

2.11. LOS SOCIOS DEL SERVICIO NO BRINDAN NINGÚN SERVICIO POSTAL Y NO ACEPTAN ENVÍOS POSTALES (CORRESPONDENCIA POSTAL CON DIRECCIÓN, PAQUETES POSTALES, CONTENEDORES, PUBLICACIONES IMPRESAS EN EL EMBALAJE CORRESPONDIENTE) PARA LA ENTREGA.

2.12. ESTE SERVICIO NO ES APTO Y DEBE EVITARSE PARA SOLICITUDES DE ENVÍOS DE ARTÍCULOS CUYO VALOR SUPERE LOS 700 BOB POR SOLICITUD. Al realizar una solicitud de servicios a través de la App, el Usuario declara que el valor de los artículos a entregar en dicha solicitud no excede los 700 BOB. En caso de daño o pérdida de los artículos, y siempre que se demuestre que dicho daño ocurrió bajo el manejo del Socio, la indemnización máxima que el Socio podrá ofrecer será de hasta 700 BOB. Para iniciar el proceso de indemnización, el Usuario deberá presentar pruebas del contenido del paquete, así como del daño ocasionado por parte del Socio. Una vez efectuada la indemnización por el Socio, el Usuario renuncia a cualquier derecho a reclamos o acciones legales adicionales contra el Socio o Yango, considerando el caso completamente resuelto.

2.13. El representante del Socio recibirá los paquetes para entrega únicamente si el embalaje exterior se presenta en condiciones satisfactorias, sin verificar ni asumir responsabilidad sobre el contenido interno del paquete. El Usuario será el único responsable de asegurar que el embalaje sea adecuado en función del contenido.

2.14. El Usuario reconoce que la entrega se considera exitosa cuando el destinatario recibe el envío con el embalaje exterior en condiciones satisfactorias, es decir, sin signos de apertura, daños visibles o alteraciones físicas aparentes en el empaque.

2.15. El Usuario podrá preparar el documento de envío junto con el representante del Socio del Servicio o, bajo su propia responsabilidad, llegar a un acuerdo con el representante para no formalizar dicho documento.

2.16. El incumplimiento de los requisitos de esta sección hace al Usuario totalmente responsable de cualquier consecuencia, incluyendo, pero no limitado a, pérdidas financieras, retrasos en la entrega, confiscaciones, multas u otros resultados adversos. El Usuario asumirá la responsabilidad total por todos los costos, gastos, multas o responsabilidades que surjan del incumplimiento de estos Términos o de las leyes aplicables. Asimismo, el Usuario acepta indemnizar y eximir de responsabilidad a Yango y a los Socios por cualquier reclamo, daño, costo, responsabilidad o acción legal resultante del incumplimiento de esta sección, incluyendo, pero no limitado a, reclamos de terceros y acciones de cumplimiento gubernamental.

3. Condiciones de Pago.

3.1. El pago de los servicios de entrega u otros servicios de Socios proporcionados al Usuario de acuerdo con la información publicada por él utilizando el Servicio sobre la demanda potencial de los servicios relevantes se puede realizar de las siguientes maneras:

3.1.1. Directamente a los Socios en efectivo o de otro modo si dicha funcionalidad está disponible en el Servicio (en adelante en estos Términos y la interfaz del Servicio, «Efectivo»). Este tipo de pago se realiza sin la participación de Yango y no se rige por estos Términos.

3.1.2. Mediante pago sin efectivo de la Tarjeta Bancaria Vinculada (cláusula 3.5. de estos Términos); en este caso, Yango actúa en nombre del Socio relevante con la participación de un operador autorizado a aceptar los pagos o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y es el destinatario del pago como agente del Socio (en adelante, «pago sin efectivo»).

Yango no garantiza la ausencia de errores y fallos en el funcionamiento del Servicio en cuanto a la prestación de la oportunidad de pago sin efectivo, y además tiene derecho a contratar a terceros (subagentes) para el cumplimiento de sus obligaciones.

Dependiendo de la región del Usuario, los pagos sin efectivo pueden realizarse sin la participación de Yango como beneficiario o con la participación de Yango como la otra parte de los arreglos financieros o el participante en el intercambio de información.

3.2. El Usuario selecciona la forma de pago adecuada en la interfaz del Servicio. Si el Usuario elige el pago sin efectivo, no está permitido realizar el pago al Socio en efectivo o de cualquier otra manera directamente al representante del Socio sin previo aviso a Yango y sin cambiar el método de pago en la interfaz del Servicio (si esta opción está disponible). El cargo realizado a la Tarjeta Vinculada para cubrir los servicios prestados por el Socio se considerará correcto y conforme al método de pago elegido por el Usuario, y no se realizará ningún reembolso una vez procesado el cargo.

Asimismo, si por cualquier motivo no es posible realizar un pago sin efectivo (incluyendo, entre otros, la indisponibilidad técnica temporal de esta función, la imposibilidad temporal o permanente de realizar el pago sin efectivo mediante la Tarjeta Vinculada, o fondos insuficientes en la misma), el Usuario se compromete a asegurar que haya fondos suficientes en la Tarjeta Vinculada para cubrir la deuda por el pago de los servicios del Socio lo antes posible, y en cualquier caso, en un plazo máximo de 30 días naturales a partir de la fecha en que se prestó el servicio correspondiente al Usuario.

3.3. En caso del pago sin efectivo, a discreción de Yango, es posible realizar tanto una transacción por el costo total del servicio como varias transacciones por partes separadas del costo del servicio. Además, el pago sin efectivo puede realizarse por cualquiera de los métodos especificados durante la prestación del servicio o al finalizarlo.

3.4. La Tarjeta Bancaria Vinculada puede ser especificada por el Usuario en la interfaz del Servicio, mientras que el Usuario especifica los siguientes datos:

• Número de la tarjeta bancaria
• Fecha de vencimiento
• Código de seguridad

Si los datos de la tarjeta bancaria son correctos, válidos y el uso de esta tarjeta dentro del Servicio es técnicamente posible, la tarjeta bancaria especificada adquiere el estado de Vinculada y puede utilizarse para pagos sin efectivo (cláusula 3.1.2 de estos Términos). Todas las Tarjetas Vinculadas se muestran en la interfaz del Servicio; para comodidad del Usuario, en relación con la Tarjeta Vinculada, se muestran los últimos 4 dígitos del número de la Tarjeta Vinculada.

La Tarjeta Vinculada también puede ser indicada por el Usuario en la interfaz de los servicios de terceros que soportan la integración con el Servicio, participan en arreglos financieros y aseguran la autorización del pago del Usuario sin transferir información sobre la Tarjeta Vinculada a Yango.

El procedimiento para utilizar los servicios de terceros especificados en esta cláusula se regirá exclusivamente por las normas y políticas establecidas por dichos terceros. Yango no asume responsabilidad alguna por el uso que el Usuario haga de estos servicios, ni garantiza su exactitud o seguridad. Yango actúa únicamente como intermediario para los servicios proporcionados por terceros independientes, como el procesamiento de pagos. Si el Usuario no está de acuerdo con los términos y condiciones de dichos terceros, deberá abstenerse de utilizar sus servicios.

3.5. Al agregar la Tarjeta Vinculada o al seleccionar la opción de pago sin efectivo para un servicio específico, se debitará un monto equivalente a 1 dólar estadounidense en la moneda nacional para confirmar la validez y exactitud de los datos de la Tarjeta Vinculada. En caso de que la transacción se complete con éxito, el monto especificado será devuelto al Usuario. Si el intento de débito resulta fallido, esto indicará que la Tarjeta Vinculada no puede ser agregada y/o que la función de pago sin efectivo no está disponible.

3.6. En caso de pago sin efectivo, junto con el pago de los servicios el Usuario tiene la oportunidad, a su propia discreción, de realizar un pago adicional sin efectivo a favor del Socio como un porcentaje del costo del servicio pagado (en adelante en estos Términos y en la interfaz del Servicio, la «Propina»).

3.7. Al agregar una Tarjeta Vinculada, y en cualquier momento posterior, el Usuario puede establecer o ajustar el monto de la Propina por defecto a través de la interfaz del Servicio. Además, el Usuario puede modificar la Propina para un servicio específico en la interfaz del Servicio después de la prestación del mismo.

3.8. La Propina (en el monto por defecto o en el monto específicamente indicado por el Usuario para un servicio específico) se debitará de la Tarjeta Vinculada si el Usuario ha indicado una valoración positiva (4-5 estrellas) en la interfaz del Servicio (4-5 estrellas) dentro de los 30 minutos posteriores a la prestación del servicio y ha hecho clic en el botón «Listo», o no ha indicado una valoración positiva o negativa del servicio (no ha indicado el número de estrellas) y ha hecho clic en el botón «Listo».

3.9. Si el Usuario, dentro de los 30 minutos posteriores a la prestación del servicio, indicó una valoración negativa (1-3 estrellas) en la interfaz del Servicio e hizo clic en el botón «Hecho», la Propina no se debitará de la Tarjeta Vinculada.

3.10. Si el Usuario no hace clic en el botón «Hecho» dentro de los 30 minutos posteriores a la prestación del servicio, el monto de la Propina (en el monto predeterminado o en el monto específicamente indicado por el Usuario para un servicio específico) será bloqueado en la Tarjeta Vinculada por un período de 24 horas dentro de las cuales el Usuario tiene la oportunidad de cambiar el tamaño de la Propina para este servicio hacia arriba o hacia abajo. Una vez transcurrido el tiempo especificado, la Propina se debita en la cantidad especificada por el Usuario (por defecto o para este servicio específico).

3.11. Yango no tiene acceso a los datos de la tarjeta bancaria especificados por el Usuario y no es responsable de la seguridad y confidencialidad de los datos transmitidos al realizar un pago sin efectivo. El Usuario hace un pago sin efectivo con la participación de un operador autorizado para recibir pagos, o un operador de dinero electrónico, u otros participantes en los arreglos financieros, interacción de tecnología e información, y este pago sin efectivo se regula por las reglas de los sistemas de pago internacionales, bancos (incluido el banco emisor de la Tarjeta Vinculada) y otros participantes en los arreglos financieros.

3.12. Al especificar sus datos de acuerdo con la cláusula 3.5. de estos Términos y al continuar el uso de la Tarjeta Vinculada, el Usuario confirma y garantiza que proporciona información precisa y completa sobre una tarjeta bancaria válida emitida a su nombre; el cumplimiento de las normas de los sistemas de pago internacionales y los requisitos del banco emisor que emitió la Tarjeta Vinculada, incluso con respecto al procedimiento para realizar pagos sin efectivo.

3.13. El Usuario comprende y acepta que todas las acciones realizadas dentro del Servicio utilizando el número de teléfono móvil confirmado por él, incluido el pago sin efectivo utilizando la Tarjeta Bancaria Vinculada, se consideran realizadas por el Usuario.

3.14. Si el Usuario no está de acuerdo con el hecho y/o monto del pago sin efectivo y otras cuestiones relacionadas con el uso de la Tarjeta Vinculada dentro del Servicio, el Usuario tiene derecho a comunicarse con Yango usando los contactos indicados por el Servicio y/o a través de la interfaz del servicio de asistencia (feedback) dentro de los 14 días a partir de la fecha de los pagos sin efectivo o cualquier otra acción o evento que motivó la solicitud.

Si, tras la inspección provocada por dicha solicitud, Yango decide devolver la cantidad del pago sin efectivo, en su totalidad o en parte, dicha cantidad se devolverá a la cuenta bancaria de la tarjeta bancaria con la que se realizó el pago sin efectivo. El reembolso se realizará con un procesador de pagos autorizado o un procesador de dinero electrónico involucrado y se regirán por las reglas de los sistemas de pago internacionales, bancos (incluido el banco que emitió la Tarjeta Vinculada) y otras partes en las liquidaciones. Si Yango no es parte de las liquidaciones realizadas a través de la Tarjeta Vinculada, Yango puede actuar como un organismo que transfiere las solicitudes de los usuarios anteriores a los proveedores de transporte, oficinas de despacho o cualquier otra persona que sea receptora de los pagos en virtud de las transacciones anteriores con la Tarjeta Vinculada.

3.15. Yango se reserva el derecho de exigir, en cualquier momento, que el Usuario confirme los detalles que especificó en el Servicio, incluidos los detalles de la Tarjeta Vinculada, y solicitar los documentos acreditativos al respecto (en particular, documentos de identidad); el hecho de no proporcionar estos documentos puede calificar como el suministro de información no confiable y tener las implicaciones estipuladas por la cláusula 1.10 del presente documento si Yango lo considera conveniente.

3.16. De cualquier manera el Usuario actuando en calidad de consumidor exime de responsabilidad a la Sociedad por el uso no autorizado de medios de pago utilizados cuya titularidad pertenezca a terceros; así como por cualquier información de pago errónea o desactualizada que como usuario o consumidor proporcione.

3.17. Las disposiciones sobre los términos y el procedimiento de pago de los servicios de entrega especificados en esta Sección no serán aplicables cuando un tercero pague por dichos servicios en lugar del Usuario, en virtud de un contrato separado que Yango haya firmado con dicho tercero.

4. La funcionalidad de "Recado" - Pago en Destino

4.1. El Usuario podrá acceder a la función "Encargo" dentro del Servicio, siempre que dicha función esté disponible y habilitada para determinados usuarios o regiones, a discreción exclusiva de Yango.La opción "Recado" permite al Usuario solicitar al Socio, como parte de los servicios de entrega proporcionados, que adelante el costo del paquete en el momento de la recogida, bajo la promesa del Usuario de que dicho monto será devuelto al Socio por el Destinatario al momento de la entrega del paquete.

En caso de seleccionar la opción "Recado", únicamente serán asignadas aquellas Solicitudes a Socios que ofrezcan servicios de entrega que incluyan esta opción, conforme a los términos y condiciones establecidos en el presente documento.

4.2. Al seleccionar la opción**"Recado"**, el Usuario acepta expresamente los siguientes términos:

4.2.1. El Usuario deberá seleccionar la opción "Recado" al momento de generar la Solicitud a través del Servicio. En el formulario que se habilitará, el Usuario tendra que especificar, de manera clara y precisa, el monto que el Destinatario deberá abonar por el Paquete al recibirlo. Dicho monto no podrá exceder los 200 BOB (en adelante, el "Costo del Paquete"), ya que el Socio no adelantará un monto que supere este límite.

Si, al llegar al punto de recogida, se constata que el Costo del Paquete solicitado para entrega bajo la opción "Recado" excede el límite de 200 BOB, el Socio estará facultado para rechazar la continuación del servicio. En tal caso, el servicio se considerará cancelado por el Usuario y estará sujeto a las tarifas de cancelación aplicables, salvo que el Usuario acepte expresamente continuar con el servicio sin la opción "Recado" .

4.2.2. El Usuario acepta no utilizar la opción "Recado" si el Paquete contiene artículos no elegibles para devolución o cambio según la legislación aplicable.

4.2.3. Al aceptar la Solicitud con la opción de "Recado" el Socio, representado por un mensajero (en adelante, el “Mensajero”), acepta adelantar el Costo del Paquete al momento de recogerlo del Usuario, bajo la promesa del Usuario de que el Destinatario devolverá este monto al Mensajero al momento de la entrega. Este adelanto se proporciona únicamente para facilitar el proceso de entrega, evitando la necesidad de un viaje de regreso, el cual de proceder, estaría sujeto a un cargo adicional según las tarifas vigentes.

4.2.4. Una vez que el Costo del Paquete adelantado por el Mensajero haya sido recuperado del Destinatario, se considerarán plenamente satisfechas las obligaciones del Usuario en relación con la promesa especificada en la cláusula 4.2.3., sin que surjan obligaciones adicionales entre el Usuario y el Socio respecto a dicho adelanto.

4.2.5. La entrega del Paquete con la opción de "Recado" está sujeta al pago completo del Costo de Paquete, por parte del Destinatario en el momento de la entrega, asi como el pago de la tarifa correspondiente por la entrega efectuada.

Si el Destinatario no entrega el Costo del Paquete al Mensajero, no paga la tarifa correspondiente por la entrega o si la entrega falla por cualquier otra razón, el Paquete será devuelto al Usuario. En tal caso, el Usuario deberá devolver al Mensajero el total del Costo del Paquete adelantado por el Mensajero y pagar todas las tarifas de entrega aplicables, incluidas, entre otras, las tarifas de devolución y cualquier cargo de cancelación correspondiente.

4.2.6. Si el Usuario considera que la falla en la entrega se debe a un error de Yango o del Socio, puede presentar una reclamación para la compensación de los daños reales comprobados que resulten directamente de dicho error, dentro de los límites del Costo del Paquete, a través del Soporte disponible en el Servicio. Sin embargo, la obligación del Usuario de reembolsar al Socio permanece vigente, independientemente de cualquier reclamación presentada.

4.2.7. En caso de que el Usuario no reembolse al Mensajero tras la devolución del Paquete, Yango se reserva el derecho de:

a. Suspender el acceso del Usuario al Servicio o a servicios específicos hasta que se efectúe el reembolso; y/o

b. Deducir el monto adeudado de la tarjeta vinculada al Usuario, siempre que existan fondos suficientes.

4.2.8. El Usuario reconoce y acepta que la transacción de compra relacionada con el Paquete se lleva a cabo exclusivamente entre el Usuario y el Destinatario. Ni el Socio (o el Mensajero) ni Yango forman parte de dicha transacción de compra, ni adquieren en ningún momento propiedad, interés o derechos sobre el paquete. El rol del Socio se limita estrictamente a la prestación de los servicios de entrega, mientras que el rol de Yango se limita exclusivamente a la provisión de servicios tecnológicos. Yango no participa, gestiona ni garantiza ningún pago o reembolso entre el Usuario, el Mensajero o el destinatario, y no asume responsabilidad alguna por las obligaciones financieras derivadas del uso de la función de "Recado".

4.2.9. El Usuario deberá cumplir con todas las leyes locales aplicables, proporcionando al destinatario todos los documentos primarios necesarios relacionados con el paquete, incluyendo, entre otros, recibos, facturas u otros documentos exigidos por la normativa vigente. Además, el Usuario será el único responsable de remitir todos los impuestos, aranceles, gravámenes o cargos aplicables asociados con la venta, provisión o entrega del paquete desde el Usuario hacia el destinatario. El Usuario se compromete a indemnizar, defender y mantener indemnes a Yango y al Socio frente a cualquier reclamación, sanción, multa, daño, pérdida, costo, gasto (incluidos honorarios legales razonables) o responsabilidad de cualquier tipo que surja directa o indirectamente del incumplimiento por parte del Usuario de estas obligaciones legales, fiscales o regulatorias.

5. Exoneración de Responsabilidad

5.1 El uso que de el Usuario al Servicio, serán responsabilidad única y exclusivamente del Usuario.

5.2 La calidad y niveles de servicio proporcionados por los Socios son responsabilidad única y exclusivamente de estos en calidad de proveedores.

5.3 El Usuario comprende y acepta que, en caso de cualquier insatisfacción con la prestación de los servicios de entrega y/o servicios relacionados proporcionados por los Socios, cualquier solicitud, queja o reclamación deberá dirigirse única y exclusivamente al Socio correspondiente.

5.4 En todo caso el Usuario comprende y acepta expresamente todas y cada una de las condiciones establecidas enestos Terminos, razón por la cual se compromete y obliga a mantener indemne a Yango, ante cualquier reclamación, o requerimiento de orden extra judicial o judicial que pretenda el reconocimiento y pago de indemnizaciones y/o perjucios.

6. Ley aplicable y solución de controversias

6.1. Estos Términos de Uso y cualquier obligación no contractual que surja de estos Términos de Uso o estén relacionados con ellos se regirán e interpretarán de acuerdo con las leyes de Inglaterra y Gales sin tener en cuenta las disposiciones sobre conflictos de leyes.

6.2. Cualquier disputa, diferencia, controversia o reclamo que surja de o en conexión con estos Términos de Uso, incluyendo (pero no limitado a) cualquier pregunta relacionada con su existencia, validez, interpretación, desempeño, descarga y recursos aplicables, se remitirá y finalmente resuelto mediante arbitraje conforme a las Reglas de Arbitraje del Centro de Arbitraje Internacional de Dubai, cuyas Reglas se consideran incorporadas por referencia a esta cláusula. El número de árbitros será uno. La sede del arbitraje será Dubai, Emiratos Árabes Unidos. El idioma que se utilizará en el arbitraje será el inglés.
