1. General Provisions
1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of RideTechnology Global FZ-LLC (hereinafter referred to as Company) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service) in Bolivia.
1.2. The Company may, after prior notice and consent from the User, amend provisions hereof, under the same conditions, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The Company can provide the User with a translation of this Terms from English into other languages. However, in the event of a conflict between the Terms in English and its translation, only the English version of the Terms shall be legally binding.
1.3. The User can withdraw from these Terms at any time by deleting the Program from the memory of the User’s mobile device.
1.4. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if available in the country via Services) of available transportation providers, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.
YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.
1.5. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.
1.6. For the avoidance of doubt, the Company does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.
1.7. All conversations the User holds with the support team and drivers of transportation providers - partners of the Service can be recorded to control quality and improve services.
1.8. By using the Service, the User consents to receive promotional messages including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.
2. Use of the Service. Certain Functions of the Service
2.1. The Service is provided to the User for personal non-commercial use, free of charge, for an indefinite time period.
2.2. Information on passenger and baggage transportation services or other services (hereinafter referred to as the Information) is provided by third parties (partners)- transportation providers. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Company's partner, and other information), the User may contact the partners of the Service - transportation providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.
2.3. The Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service - transportation providers, including information on the cost and current availability of the transportation providers’ benefits. The User shall independently (without the participation of the Company) discuss the acquisition of services with the transportation providers in accordance with the partners’ rules on the provision of services. The Company shall not be held liable for financial and any other transactions effected by the User and the transportation providers and for any consequences of the acquisition of the transportation providers’ services by the User.
2.4. The User may access functions of rating the services of the Service partners - transportation providers and commenting / leaving feedback on the Service and/or services of the transportation providers. Users ratings and feedback are posted on the Service website and can be available on third-party websites. The Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason. Through the functionality of the Service, the User may also access the aggregated information about the ratings made by the Driver, which is calculated based on the average of the last 40 rides’ ratings. 2.5. The Company reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.
2.6. When demand for transportation or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. The Company informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as the Company thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.
2.7. Passenger and baggage transportation services as per tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.
2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.
2.9. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.
2.10. The User authorizes the Company to process personal information (including personal details) of the User of Service (Yango), to transfer personal information of the User to Company’s partners (transportation providers), and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, his/her personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy available at: (https://yango.com/legal/yango_privacy_notice).
2.11. If the User orders delivery services from the Company’s partners, he or she undertakes not to hand over for the delivery the following items:
- hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
- narcotic drugs, psychotropic substances, precursors and their analogs;
- nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
- poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
- the national currency and foreign currency;
- printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
- perishable food without special package;
- items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
- animals and plants, biological materials;
- items requiring specially equipped vehicles to be transported, including foodstuff;
- liquids in open containers;
- space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
- fragile items without special packaging;
- any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.
The Company’s partners may set other limits on items to be delivered.
The Company’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.
The Driver, acting as a representative of the Company’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.
The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Company’s partner provide delivery services. At the same time, a Company’s partner may deny delivery services to the User, if the Company’s partner/ representatives of the Company’s partner discover any non-deliverable items.
3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services
3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:
3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services (if such function is available in the User’s country).
3.1.2. If the non-cash payment is available via Services in the User’s country, the User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). The Company does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.
Depending on the User's region, cashless payments can be made without Company acting as a payment recipient or with the Company involved as another party to settlements or a party to information exchange.
The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.
For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.
In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.
3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:
- Bank card number
- Valid through
- Verification code
If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.
3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.
3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.
3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".
3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.
3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).
3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.
3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.
3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.
3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact the Company by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.
If, following the inspection caused by such a request, the Company decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If the Company is not a party to settlements made via the Linked Card, the Company can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.
3.12. The Company reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if the Company thinks fit.
3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract the Company signed with such third party.
4. Governing law and dispute resolution
4.1. These Terms of Use and any non-contractual obligations arising out of or in connection with these Terms of Use shall be governed by and construed in accordance with the laws of England and Wales without regard to the conflict of law provisions.
4.2. Any dispute, difference, controversy or claim arising out of or in connection with this these Terms of Use, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of arbitration shall be Dubai, United Arab Emirates. The language to be used in the arbitration shall be English.

The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.
2.10. The User authorizes the Company to process personal information (including personal details) of the User of Service (Yango), to transfer personal information of the User to Company’s partners (transportation providers), and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, his/her personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy available at: (https://yango.com/legal/yango_privacy_notice).
2.11. If the User orders delivery services from the Company’s partners, he or she undertakes not to hand over for the delivery the following items:
- hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
- narcotic drugs, psychotropic substances, precursors and their analogs;
- nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
- poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
- the national currency and foreign currency;
- printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
- perishable food without special package;
- items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
- animals and plants, biological materials;
- items requiring specially equipped vehicles to be transported, including foodstuff;
- liquids in open containers;
- space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
- fragile items without special packaging;
- any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.
The Company’s partners may set other limits on items to be delivered.
The Company’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.
The Driver, acting as a representative of the Company’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.
The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Company’s partner provide delivery services. At the same time, a Company’s partner may deny delivery services to the User, if the Company’s partner/ representatives of the Company’s partner discover any non-deliverable items.
3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services
3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:
3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services (if such function is available in the User’s country).
3.1.2. If the non-cash payment is available via Services in the User’s country, the User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). The Company does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.
Depending on the User's region, cashless payments can be made without Company acting as a payment recipient or with the Company involved as another party to settlements or a party to information exchange.
The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.
For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.
In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.
3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:
- Bank card number
- Valid through
- Verification code
If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.
3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.
3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.
3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".
3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.
3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).
3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.
3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.
3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.
3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact the Company by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.
If, following the inspection caused by such a request, the Company decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If the Company is not a party to settlements made via the Linked Card, the Company can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.
3.12. The Company reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if the Company thinks fit.
3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract the Company signed with such third party.
4. Governing law and dispute resolution
4.1. These Terms of Use and any non-contractual obligations arising out of or in connection with these Terms of Use shall be governed by and construed in accordance with the laws of England and Wales without regard to the conflict of law provisions.
4.2. Any dispute, difference, controversy or claim arising out of or in connection with this these Terms of Use, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of arbitration shall be Dubai, United Arab Emirates. The language to be used in the arbitration shall be English.

Terms of Use of Yango
1. General Provisions
1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of RideTechnology Global FZ-LLC (hereinafter referred to as Company) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service) in Angola.
1.2. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of regulatory documents - regulatory documents – License to Use Search Engine and Privacy Policy (hereinafter referred to as Regulatory Documents), in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service. Rules of Referral Programme for users are posted at https://yango.com/legal/an.
1.3. The Company may, after prior notice and consent from the User, amend provisions hereof, and may, under the same conditions, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The Company can provide the User with a translation of these Terms from English into other languages. However, in the event of a conflict between the Terms in English and its translation, only the English version of the Terms shall be legally binding.
1.4. The User can withdraw from these Terms at any time by deleting the Program from the memory of the User’s mobile device.
1.5. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if available in the country via Services) of available transportation providers, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.
YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.
1.6. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.
1.7. For the avoidance of doubt, the Company does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.
1.8. All conversations the User holds with the support team and drivers of transportation providers - partners of the Service can be recorded to control quality and improve services.
1.9. By using the Service, the User consents to receive promotional messages including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.
2. Use of the Service. Certain Functions of the Service
2.1. The Service is provided to the User for personal non-commercial use, free of charge, for an indefinite time period.
2.2. Information on passenger and baggage transportation services or other services (hereinafter referred to as the Information) is provided by third parties (partners)- transportation providers. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Company's partner, and other information), the User may contact the partners of the Service - transportation providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.
2.3. The Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service - transportation providers, including information on the cost and current availability of the transportation providers’ benefits. The User shall independently (without the participation of the Company) discuss the acquisition of services with the transportation providers in accordance with the partners’ rules on the provision of services. The Company shall not be held liable for financial and any other transactions effected by the User and the transportation providers and for any consequences of the acquisition of the transportation providers’ services by the User.
2.4. The User may access functions of rating the services of the Service partners - transportation providers and commenting / leaving feedback on the Service and/or services of the transportation providers. Users ratings and feedback are posted on the Service website and can be available on third-party websites. The Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason. Through the functionality of the Service, the User may also access the aggregated information about the ratings made by the Driver, which is calculated based on the average of the last 40 rides’ ratings. 2.5. The Company reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.
2.6. When demand for transportation or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. The Company informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as the Company thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.
2.7. Passenger and baggage transportation services as per tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.
2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.
2.9. If the Service supports the feature allowing the User to increase (by 50% max.) or decrease (by 20% max.) the price of certain Service tariffs and to make orders with such altered price the order will be available for the Service partner who will either confirm or decline the order at his own discretion. To suggest an altered price as specified above the User will have to set it in the mobile application before placing the order.
2.10. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.
2.11. The User authorizes the Company to process personal information (including personal details) of the User of Service (Yango), to transfer personal information of the User to Company’s partners (transportation providers), and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, his/her personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).
2.12. If the User orders delivery services from the Company’s partners, he or she undertakes not to hand over for the delivery the following items:
- hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
- narcotic drugs, psychotropic substances, precursors and their analogs;
- nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
- poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
- the national currency and foreign currency;
- printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
- perishable food without special package;
- items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
- animals and plants, biological materials;
- items requiring specially equipped vehicles to be transported, including foodstuff;
- liquids in open containers;
- space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
- fragile items without special packaging;
- any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.
The Company’s partners may set other limits on items to be delivered.
The Company’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.
The Driver, acting as a representative of the Company’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.
The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Company’s partner provide delivery services. At the same time, a Company’s partner may deny delivery services to the User, if the Company’s partner/ representatives of the Company’s partner discover any non-deliverable items.
3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services
3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:
3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services (if such function is available in the User’s country).
3.1.2. If the non-cash payment is available via Services in the User’s country, the User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). 1.3. A Empresa pode, após aviso prévio e consentimento do Utilizador, alterar as disposições do presente instrumento, e a pode, nas mesmas condições, alterar as disposições dos Documentos Regulamentares. 1.4. O Utilizador pode rescindir os presentes Termos a qualquer momento, eliminando o Programa da memória do dispositivo móvel do Utilizador.
1.5. O Serviço permite que o Utilizador coloque informação, sem encargos, sobre a procura potencial do Utilizador por serviços de transporte de passageiros e bagagens ou outros serviços, incluindo serviços de entrega (se disponíveis no país através dos Serviços) de fornecedores de transporte disponíveis, veja ofertas de organizações de prestação de serviços nos referidos campos, e pesquisar tais ofertas utilizando os parâmetros definidos pelo Utilizador. Todas as funções actualmente disponíveis do Serviço, juntamente com quaisquer desenvolvimentos e/ou funções recém-adicionadas, estão sujeitas aos presentes Termos.
RECONHECE QUE A EMPRESA NÃO FORNECE SERVIÇOS DE TRANSPORTE OU FUNCIONA COMO TRANSPORTADOR E QUE TODOS TAIS SERVIÇOS DE TRANSPORTE SÃO FORNECIDOS POR TERCEIROS – PRESTADORES DE TRANSPORTE, QUE NÃO SÃO EMPREGADOS PELA EMPRESA OU QUALQUER DAS SUAS AFILIADAS. AS RELAÇÕES ENTRE SI E OS PRESTADORES DE TRANSPORTE NA AQUISIÇÃO DE SERVIÇOS SÃO REGULADAS POR ACORDOS RESPECTIVOS ENTRE SI E O PRESTADOR DE TRANSPORTE, A EMPRESA NÃO É PARTE DESSES ACORDOS.
1.6. Dependendo da região do Utilizador, qualquer ou todas as funções do Serviço podem ser inacessíveis ou limitadas. As funções são consideradas inacessíveis (limitadas) para o Utilizador de uma determinada região, se tal Utilizador não puder usá-las explicitamente. É proibido aplicar quaisquer métodos técnicos e baseados em software para contornar essas limitações. As disposições aqui contidas que regem as funções do Serviço inacessíveis (limitadas) para o Utilizador serão aplicadas até que tais funções se tornem explicitamente acessíveis para o Utilizador. As informações sobre a acessibilidade das funções do Serviço numa determinada região serão fornecidas ao Utilizador mediante solicitação enviada à Empresa.
1.7. Para evitar dúvidas, a Empresa não presta serviços de transporte de passageiros e bagagens ou outros serviços, incluindo serviços de entrega e serviços de help desk.
1.8. Todas as conversas que o Utilizador mantém com a equipa de apoio e motoristas dos transportadores – parceiros do Serviço podem ser gravadas para controlo de qualidade e melhoria dos serviços.
1.9. Ao usar o Serviço, o Utilizador consente em receber mensagens promocionais, incluindo emails e mensagens. O Utilizador pode cancelar a assinatura de mensagens promocionais usando funções respectivas do Serviço ou seguindo as instruções especificadas numa mensagem promocional recebida.
2. Uso do Serviço. Determinadas Funções do Serviço
2.1. O Serviço é fornecido ao Utilizador para uso pessoal não comercial, livre de encargos, por tempo indeterminado.
2.2. As informações sobre serviços de transporte de passageiros e bagagens ou outros serviços (doravante designados Informações) são fornecidas por terceiros (parceiros) - fornecedores de transporte. A lista de parceiros está disponível em https://yango.com/partners. Para mais informações sobre os serviços oferecidos (incluindo disponibilidade de ponto de acesso Wi-Fi na cabina, foto/vídeo vigilância na cabina pelo parceiro da Empresa, e outras informações), o Utilizador poderá entrar em contacto com os parceiros do Serviço - transportadores ou fornecer os seus dados de contacto através das funções do Serviço para que os parceiros do Serviço contactem o Utilizador de forma independente e forneçam informações sobre os serviços oferecidos.
2.3. A Empresa não se responsabiliza pelo conteúdo e/ou relevância das informações fornecidas pelos parceiros do Serviço - transportadores, incluindo informações sobre o custo e a disponibilidade actual dos benefícios dos transportadores. O Utilizador deverá discutir de forma independente (sem a participação da Empresa) a aquisição de serviços com os transportadores de acordo com as regras dos parceiros sobre a prestação de serviços. A Empresa não se responsabiliza por transacções financeiras e outras efectuadas pelo Utilizador e pelos transportadores e por quaisquer consequências da aquisição dos serviços dos transportadores pelo Utilizador.
2.4. O Utilizador poderá aceder às funções de avaliação dos serviços dos parceiros do Serviço - transportadores e comentar/deixar feedback sobre o Serviço e/ou serviços dos transportadores. As avaliações e comentários dos utilizadores são publicados no website do Serviço e podem estar disponíveis em websites de terceiros. A Empresa reserva-se o direito de recusar a publicar quaisquer avaliações/comentários e excluir/bloquear, a qualquer momento, qualquer avaliação/comentários que o Utilizador publicou, a seu critério e sem dar qualquer motivo.
2.5. A Empresa reserva-se o direito, a seu próprio critério, de limitar o acesso do utilizador ao Serviço (ou a determinadas funções do Serviço, se tecnologicamente viável) usando a conta do Utilizador ou bloqueando toda a conta do Utilizador após múltiplas violações deste, ou tomar quaisquer outras medidas contra o Utilizador para respeitar requisitos legais ou direitos de terceiros e interesses legítimos.
2.6. Quando a procura por transporte ou outros serviços é maior (incluindo dias antes de feriados, dias de eventos de massa e outros casos), as tarifas dos parceiros de serviço podem ser aumentadas. A Empresa informa sobre tarifas mais altas publicando o aviso respectivo no website do Serviço https://yango.com ou de outra forma que a Empresa considere adequada, entre outras, enviando uma mensagem informativa para o número de telemóvel do Utilizador ou via aplicação móvel.
2.7. Os serviços de transporte de passageiros e bagagens de acordo com as tarifas disponíveis no Serviço são prestados por diferentes tipos de veículos. Os veículos são classificados automaticamente com base nos dados de desempenho do veículo fornecidos pelos parceiros do Serviço.
2.8. Se o Serviço permitir o pedido de viagens com antecedência (doravante designadas, "pré-pedidos de viagem") em determinadas tarifas do Serviço, o pedido estará disponível para o parceiro do Serviço confirmar próximo do horário especificado pelo Utilizador no pedido (não antes de 30 minutos do início da viagem com pré-pedido). O custo da viagem com pré-pedido será calculado e indicado no Serviço quando a viagem for solicitada. O preço pode mudar devidas às circunstâncias listadas no website do Serviço https://yango.com.
2.9. Se o Serviço oferecer suporte ao recurso que permite ao Utilizador aumentar (em 50% no máximo) ou diminuir (em 20% no máximo) o preço de determinadas tarifas do Serviço e fazer pedidos com esse preço alterado, o pedido estará disponível para o Parceiro do Serviço que confirmará ou recusará o pedido a seu próprio critério. Para sugerir um preço alterado conforme especificado acima, o Utilizador deverá defini-lo no aplicativo móvel antes de fazer o pedido.
2.10. Um transportador cobra taxas por uma viagem cancelada pelo Utilizador, se tal cancelamento ocorreu após a chegada do veículo ao local indicado pelo Utilizador. O valor dessas taxas é calculado da mesma forma que o custo da viagem/serviço de acordo com a tarifa por um período de tempo a partir da chegada do veículo ao local de recolha ou da hora de chegada especificada nas informações fornecidas pelo transportador ao Utilizador relativamente ao transporte solicitado pelo pedido do Utilizador/Utilizadores (o que ocorrer depois) até o Utilizador cancelar a viagem/serviço. O Utilizador deverá cancelar uma viagem/serviço enviando o aviso respectivo ao transportador através do Serviço. Considera-se que o Utilizador que não entrar num veículo servido pelo transportador no prazo de 10 (dez) minutos tendo em conta o tempo de espera gratuito especificado no respectivo tarifário é considerado como tendo cancelado uma viagem/serviço, salvo estipulação em contrário por regras ou acordos do transportador respectivo entre o Utilizador e um representante (motorista) do transportador. A taxa de cancelamento para viagens do aeroporto para a cidade é calculada de acordo com o descrito acima, mais uma taxa adicional cobrada para viagem fora da cidade de acordo com a tarifa.
2.11. O Utilizador autoriza a Empresa a processar informações pessoais (incluindo dados pessoais) do Utilizador do Serviço (Yango), transferir informações pessoais do Utilizador para parceiros da Empresa (transportadores) e processar informações pessoais para parceiros da Empresa para fornecer serviços ao Utilizador no Serviço. Quando o Utilizador recorre ao Serviço, as suas informações pessoais são transmitidas à para serem processadas nos termos e para os fins determinados na Política de Privacidade da disponível em: (https://yango.com/legal/yango_privacy_notice).
2.12. Se o Utilizador solicitar serviços de entrega a parceiros da Empresa, compromete-se a não entregar para as viagens os seguintes artigos:
- armas de combate portátil, não militares e de serviço, munições, peças sobresselentes e componentes, arcos e bestas desportivas, armas projectadas para luz, fumo e sinais sonoros, armas eléctricas, dispositivos de electrochoque e ignição de faíscas, armas brancas, bastões, soqueiras, shurikens, galhos, bumerangues e outros itens modificados para golpear, esmagar, arremessar, perfurar e cortar, excepto para equipamentos desportivos, dispositivos e componentes técnicos especiais de dupla utilização;
- estupefacientes, substâncias psicotrópicas, precursores e os seus análogos;
- materiais nucleares, substâncias radioactivas, superpotentes, cáusticas, explosivas e inflamáveis, agentes de fogo, substâncias pirotécnicas e artigos relacionados e outras substâncias perigosas;
- venenos, animais venenosos, substâncias venenosas, plantas venenosas e sementes de plantas venenosas;
- a moeda nacional e a moeda estrangeira;
- publicações impressas, materiais gráficos, filmes, fotos, materiais de áudio e vídeo contendo propaganda ou promoção de mudanças violentas da ordem constitucional, destruição da segurança nacional, guerra, superioridade social, racial, nacional, religiosa, de classe e clã, crueldade, violência e pornografia;
- alimentos perecíveis sem embalagem especial;
- artigos e substâncias que, pela sua natureza ou devido à sua embalagem, podem constituir um perigo para o público, podem contaminar ou danificar (destruir) outras cargas, pessoas circundantes ou artigos;
- animais e plantas, materiais biológicos;
- artigos que exijam o transporte de veículos especialmente equipados, incluindo alimentos;
- líquidos em recipientes abertos;
- artigos de consumo de espaço, cujo comprimento total, largura (dois diâmetros ou eixos na base do rolo) e dimensões de altura (sujeitas a isenções especiais) excedam 150 cm; artigos longos acima de 150 cm; o peso dos artigos transferidos não pode exceder 20 kg;
- artigos frágeis sem embalagem especial;
- quaisquer outros artigos cuja distribuição seja proibida ou limitada no território do país de prestação do serviço de entrega.
Os parceiros da Empresa podem estabelecer outros limites de artigos a serem entregues.
Os parceiros da Empresa não prestam quaisquer serviços postais e não aceitam envios postais (correspondência endereçada, encomendas postais, contentores, publicações impressas nas embalagens respectivas.
O Motorista, actuando como representante do parceiro da Empresa, pode preparar o documento de remessa com o Utilizador ou pode entrar em acordo para não concluir o documento de remessa.
O Utilizador tem conhecimento e confirma que, caso não cumpra os requisitos acima para artigos a serem entregues, o Utilizador é o único responsável por todos os efeitos negativos que possam ocorrer enquanto o parceiro da Empresa prestar serviços de entrega. Ao mesmo tempo, o parceiro de uma Empresa pode recusar serviços de entrega ao Utilizador, se o parceiro/representantes da Empresa do parceiro da Empresa descobrir quaisquer artigos não passíveis de entrega.
3. Função de Pagamento Sem Dinheiro para Serviços de Transporte de Passageiros e Bagagens e outros serviços
3.1. O Utilizador pode pagar pelos serviços de transporte de passageiros e bagagens fornecidos ao Utilizador de acordo com as informações sobre a procura potencial para o serviço respectivo que o Utilizador publicou através do Serviço:
3.1.1. Directamente a um transportador (entre outros, em dinheiro ou por qualquer outro meio estipulado pelo referido transportador, se houver, doravante designado nos presentes Termos e na interface do Serviço como Dinheiro). O referido pagamento será feito sem a participação da Empresa e não será regido pelos presentes Termos. A referida forma de pagamento pode ser restrita aos serviços de entrega (se tal função estiver disponível no país do Utilizador).
3.1.2. Se o pagamento sem numerário estiver disponível através dos Serviços no país do Utilizador, o Utilizador poderá aceder à função de pagamento sem numerário com um Cartão Bancário Associado (cl. 3.2 do presente instrumento); neste caso, a Empresa actua em nome do transportador respectivo ou de outra forma (inclusive directamente) com um processador de pagamento autorizado, processador de dinheiro electrónico ou qualquer outra parte nos acordos envolvidos que recebe pagamentos como agente do transportador ou de outra forma ( inclusive directamente) (doravante designados pagamentos sem numerário). A Empresa não garante que a operação do Serviço seja livre de erros e falhas para permitir pagamentos sem numerário.
Dependendo da região do utilizador, os pagamentos sem numerário podem ser efectuados sem que a Empresa actue como destinatário do pagamento ou com a Empresa envolvida como outra parte nos acordos ou na troca de informações.
O Utilizador deverá escolher a forma de pagamento respectiva na interface do Serviço. A este respeito, se for impossível efectuar pagamentos sem numerário por qualquer motivo (incluindo, mas não limitado a inacessibilidade técnica temporária desta função, impossibilidade temporária ou constante de fazer pagamentos sem numerário usando o Cartão Associado, fundos insuficientes no Cartão Associado, o Utilizador compromete-se a pagar em Dinheiro.
Para pagamentos sem numerário, é possível realizar uma transacção do custo total do transporte de passageiros e bagagem ou outro serviço e várias transacções de determinadas partes do custo do serviço. Os pagamentos sem numerário podem ser efectuados por qualquer um dos meios acima durante a viagem/serviço ou quando a viagem/serviço terminar.
No caso de pagamentos sem numerário, o Utilizador pode, juntamente com o pagamento do transporte de passageiros e bagagem ou outro serviço, efetuar um pagamento sem numerário adicional ao transportador como uma percentagem do custo do transporte pago de passageiros e bagagem ou outro serviço (doravante designadas nos presentes Termos e na interface do Serviço como Gorjetas) como considerar adequado.
3.2. O Utilizador deverá especificar o Cartão Bancário Associado na interface do Serviço, indicando os seguintes dados:
- Número do cartão bancário
- Válido até
- Código de verificação
Se os dados do cartão bancário forem verdadeiros, válidos e for tecnicamente viável a utilização deste cartão no Serviço, o referido cartão bancário torna-se o Cartão Associado e pode ser utilizado para pagamentos sem numerário (cl. 3.1.2 do presente instrumento). Todos os Cartões Associados são exibidos na interface de Serviço; para conveniência do Utilizador, a interface exibe os 4 últimos dígitos do número do Cartão Associado.
3.3. Quando um Cartão Associado é adicionado e quando o Utilizador escolhe a função de pagamento sem numerário para uma determinada viagem/serviço, o valor limitado a 5 RUB (ou qualquer outro valor na moeda da região do Utilizador) será cobrado para confirmar que os dados do Cartão Associado são verdadeiros e válidos; se a transacção for efectuada com sucesso, o referido valor será reembolsado ao Utilizador. A não cobrança do referido valor significa a impossibilidade de adicionar este Cartão Associado e/ou a indisponibilidade da função de pagamento sem numerário, respectivamente.
3.4. Ao adicionar o Cartão Associado e a qualquer momento após a sua adição, o Utilizador pode definir e/ou alterar o montante padrão de Gorjetas através da interface do Serviço; o Utilizador pode alterar o montante de Gorjetas para uma determinada viagem/serviço na interface do Serviço, quando a viagem/serviço terminar.
3.5. As Gorjetas (no montante padrão ou no montante indicado especificamente pelo Utilizador para uma determinada viagem/serviço) serão cobradas do Cartão Associado, se o Utilizador, até 30 minutos após o término da viagem/serviço, atribuir uma classificação alta à viagem (4–5 estrelas) na interface do serviço e clicar em "Concluído" ou atribui uma classificação nem alta nem baixa à viagem/serviço (não especifica o número de estrelas) e clicar em "Concluído".
3.6. Se dentro de 30 minutos após o final da viagem/serviço o Utilizador atribuir uma classificação baixa à viagem/serviço (1–3 estrelas) na interface do Serviço e clicar em "Concluído", nenhuma gorjeta será cobrada do Cartão Associado.
3.7. Se dentro de 30 minutos após o final da viagem/serviço o Utilizador não clicar em "Concluído", o montante das Gorjetas (no montante padrão ou no montante indicado especificamente pelo Utilizador para determinada viagem/serviço) será bloqueada no Cartão Associado por 24 horas, durante o qual o Utilizador pode aumentar ou diminuir o montante das Gorjetas para esta viagem/serviço. Terminado o referido tempo, as Gorjetas serão cobradas no valor especificado pelo Utilizador (por defeito ou especificamente para esta viagem/serviço).
3.8. Os pagamentos sem numerário do Utilizador devem ser efectuados com um processador de pagamento autorizado ou processador de dinheiro electrónico envolvido e devem ser regidos por regras de sistemas de pagamento internacionais, bancos (incluindo o banco que emitiu o Cartão associado) e outras partes nas liquidações.
3.9. Ao indicar os seus detalhes de acordo com cl. 3.2 do presente instrumento e ainda utilizando o Cartão Associado, o Utilizador confirma e garante que indicou informações de confiança e completas sobre o cartão bancário válido emitido em seu nome; cumpre as regras dos sistemas de pagamentos internacionais e os requisitos do banco emissor do Cartão Associado, entre outros, em relação ao procedimento de pagamentos sem numerário.
3.10. O Utilizador compreende e acorda que todas as acções realizadas no Serviço usando o número de telemóvel confirmado pelo Utilizador, entre outros, pagamentos sem numerário com o uso do Cartão Bancário Associado, são consideradas realizadas pelo Utilizador.
3.11. Caso o Utilizador não concorde com o facto e/ou o montante dos pagamentos sem numerário e tenha outras dúvidas sobre como utilizar o Cartão Associado no Serviço, poderá entrar em contacto com a Empresa pelos números de telefone especificados pelo Serviço e/ou através da interface de help desk (feedback) no prazo de 14 dias a partir da data de pagamentos sem numerário ou quaisquer outras acções ou eventos que motivaram o pedido.
Se, após a inspecção causada por tal pedido, a Empresa decidir reembolsar o montante do pagamento sem numerário, no todo ou em parte, o referido montante será reembolsado na conta bancária do cartão bancário com o qual o pagamento sem numerário foi efectuado. O reembolso deve ser efectuado com um processador de pagamento autorizado ou processador de dinheiro electrónico envolvido e regido por regras de sistemas de pagamento internacionais, bancos (incluindo o banco que emitiu o Cartão Associado) e outras partes nas liquidações. Se a Empresa não for parte das liquidações efectuadas por meio do Cartão Associado, a Empresa pode actuar como um órgão que transfere os pedidos dos utilizadores acima para transportadores, despachantes ou qualquer outra pessoa que receba pagamentos nas transacções acima com o Cartão Associado.
3.12. A Empresa reserva-se o direito de exigir a qualquer momento que o Utilizador confirme os dados que especificou no Serviço, incluindo os dados do Cartão Associado, e solicitar documentos comprovativos a este respeito (em particular, documentos de identidade); o não fornecimento desses documentos pode ser qualificado como fornecimento de informações não confiáveis e ter implicações estipuladas na cl. 2.5 do presente instrumento, se a Empresa considerar conveniente.
3.13. As disposições sobre os termos e procedimentos de pagamento de transporte de passageiros e bagagem ou outros serviços, incluindo serviços de entrega, especificados nesta Secção não se aplicarão quando um terceiro pagar por tal transporte ou outros serviços em vez do Utilizador ao abrigo de um contrato separado que a Empresa celebrou com tal terceiro.
4. Lei aplicável e resolução de litígios
4.1. Estes Termos de Uso e quaisquer obrigações não contratuais decorrentes ou relacionadas a estes Termos de Uso serão regidos e interpretados de acordo com as leis da Inglaterra e do País de Gales, sem levar em conta o conflito de disposições legais.
4.2. Qualquer disputa, diferença, controvérsia ou reclamação decorrente de ou em conexão com estes Termos de Uso, incluindo (mas não limitado a) qualquer questão relativa à sua existência, validade, interpretação, desempenho, quitação e soluções aplicáveis, será referida e finalmente resolvido por arbitragem de acordo com as Regras de Arbitragem do Centro Internacional de Arbitragem de Dubai, cujas Regras são consideradas incorporadas por referência nesta cláusula. O número de árbitros será um. A sede da arbitragem será Dubai, Emirados Árabes Unidos. O idioma a ser utilizado na arbitragem será o inglês.

1. General Provisions
1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of RideTechnology Global FZ-LLC (hereinafter referred to as Company) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service) in Colombia.
1.2. The User consents to processing of his or her personal data for the purposes of providing the Service, identification and authorization of the User, improving our application, user experience, and service, ensuring security of our systems and user’s data, ensuring safety of our users, providing support to our Users. The Company may, after prior notice and consent from the User, amend provisions hereof, under the same conditions, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. TThe Company can provide the User with a translation of this Terms from English into other languages. However, in the event of a conflict between the Terms in English and its translation, only the English version of the Terms shall be legally binding.
1.3. The User can withdraw from these Terms at any time by deleting the Program from the memory of the User’s mobile device.
1.4. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if available in the country via Services) of available transportation providers, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.
YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.
1.5. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.
1.6. For the avoidance of doubt, the Company does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.
1.7. All conversations the User holds with the support team and drivers of transportation providers - partners of the Service can be recorded to control quality and improve services.
1.8. By using the Service, the User consents to receive promotional messages including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.
2. Use of the Service. Certain Functions of the Service
2.1. The Service is provided to the User for personal non-commercial use, free of charge, for an indefinite time period.
2.2. Information on passenger and baggage transportation services or other services (hereinafter referred to as the Information) is provided by third parties (partners)- transportation providers. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Company's partner, and other information), the User may contact the partners of the Service - transportation providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.
2.3. The Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service - transportation providers, including information on the cost and current availability of the transportation providers’ benefits. The User shall independently (without the participation of the Company) discuss the acquisition of services with the transportation providers in accordance with the partners’ rules on the provision of services. The Company shall not be held liable for financial and any other transactions effected by the User and the transportation providers and for any consequences of the acquisition of the transportation providers’ services by the User.
2.4. The User may access functions of rating the services of the Service partners - transportation providers and commenting / leaving feedback on the Service and/or services of the transportation providers. Users ratings and feedback are posted on the Service website and can be available on third-party websites. The Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason. Through the functionality of the Service, the User may also access the aggregated information about the ratings made by the Driver, which is calculated based on the average of the last 40 rides’ ratings. 2.5. The Company reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.
2.6. When demand for transportation or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. The Company informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as the Company thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.
2.7. Passenger and baggage transportation services as per tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.
2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.
2.9. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.
2.10. The User authorizes the Company to process personal information (including personal details) of the User of Service (Yango), to transfer personal information of the User to Company’s partners (transportation providers), and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, his/her personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy available at: (https://yango.com/legal/yango_privacy_notice).
2.11. If the User orders delivery services from the Company’s partners, he or she undertakes not to hand over for the delivery the following items:
- hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
- narcotic drugs, psychotropic substances, precursors and their analogs;
- nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
- poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
- the national currency and foreign currency;
- printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
- perishable food without special package;
- items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
- animals and plants, biological materials;
- items requiring specially equipped vehicles to be transported, including foodstuff;
- liquids in open containers;
- space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
- fragile items without special packaging;
- any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.
The Company’s partners may set other limits on items to be delivered.
The Company’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.
The Driver, acting as a representative of the Company’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.
The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Company’s partner provide delivery services. At the same time, a Company’s partner may deny delivery services to the User, if the Company’s partner/ representatives of the Company’s partner discover any non-deliverable items.
3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services
3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:
3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services (if such function is available in the User’s country).
3.1.2. If the non-cash payment is available via Services in the User’s country, the User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). The Company does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.
Depending on the User's region, cashless payments can be made without Company acting as a payment recipient or with the Company involved as another party to settlements or a party to information exchange.
The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.
For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.
In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.
3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:
- Bank card number
- Valid through
- Verification code
If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.
3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.
3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.
3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".
3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.
3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).
3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.
3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.
3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.
3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact the Company by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.
If, following the inspection caused by such a request, the Company decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If the Company is not a party to settlements made via the Linked Card, the Company can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.
3.12. The Company reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if the Company thinks fit.
3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract the Company signed with such third party.
4. Governing law and dispute resolution
4.1. These Terms of Use and any non-contractual obligations arising out of or in connection with these Terms of Use shall be governed by and construed in accordance with the laws of England and Wales without regard to the conflict of law provisions.
4.2. Any dispute, difference, controversy or claim arising out of or in connection with this these Terms of Use, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of arbitration shall be Dubai, United Arab Emirates. The language to be used in the arbitration shall be English.

1. Disposiciones Generales
1.1. Estos Términos (en lo sucesivo, los Términos) constituyen una oferta de RideTechnology Global FZ-LLC (en lo sucesivo, la Sociedad) a un usuario de Internet (en lo sucesivo, el Usuario) para utilizar el servicio Yango (en lo sucesivo, el Servicio) en Colombia.
1.2. La Sociedad puede, previa notificación y consentimiento del Usuario, modificar las disposiciones del presente, en las mismas condiciones, modificar las disposiciones de los Documentos Reglamentarios. La versión actual del presente está disponible en: https://yango.com/legal/yango_termsofuse. La Sociedad puede proporcionar una traducción de estos Términos del inglés a otros idiomas al Usuario. Sin embargo, en caso de conflicto entre los Términos en inglés y su traducción, solo la versión en inglés de los Términos será legalmente vinculante.
1.3. El Usuario puede rescindir estos Términos en cualquier momento eliminando el Programa de la memoria del dispositivo móvil del Usuario.
1.4. El Servicio permite al Usuario colocar información, sin cargo, sobre la demanda potencial del Usuario de servicios de transporte de pasajeros y equipaje u otros servicios, incluidos los servicios de entrega (si están disponibles en el país a través de los Servicios) de los proveedores de transporte disponibles, buscar ofertas de organizaciones que prestan servicios en dichos campos, y buscar dichas ofertas utilizando los parámetros establecidos por el Usuario. Todas las funciones actualmente disponibles del Servicio junto con cualquier desarrollo y (o) función recién agregada están sujetas a estos Términos.
USTED RECONOCE QUE LA SOCIEDAD NO PROPORCIONA SERVICIOS DE TRANSPORTE NI FUNCIONA COMO TRANSPORTISTA Y QUE DICHOS SERVICIOS DE TRANSPORTE SON PROPORCIONADOS POR TERCEROS – PROVEEDORES DE TRANSPORTE QUE NO SON EMPLEADOS POR LA SOCIEDAD NI POR NINGUNO DE SUS AFILIADOS. LAS RELACIONES ENTRE USTED Y LOS PROVEEDORES DE TRANSPORTE SOBRE LA ADQUISICIÓN DE SERVICIOS ESTÁN REGULADOS POR ACUERDOS RELEVANTES ENTRE USTED Y EL PROVEEDOR DE TRANSPORTE, LA SOCIEDAD NO ES PARTE DE ESTOS ACUERDOS.
1.5. Dependiendo de la región del Usuario, algunas o todas las funciones del Servicio pueden ser inaccesibles o limitadas. Las funciones se consideran inaccesibles (limitadas) para el Usuario de una determinada región si dicho Usuario no puede usarlas explícitamente. Está prohibido aplicar cualquier método técnico y basado en software para eludir estas limitaciones. Las disposiciones de los presentes Términos que rigen las funciones del Servicio inaccesibles (limitadas) para el Usuario se aplicarán hasta que dichas funciones sean explícitamente accesibles para el Usuario. La información sobre la accesibilidad de las funciones del Servicio en una determinada región se proporcionará al Usuario cuando su solicitud se envíe a la Sociedad.
1.6. Para evitar dudas, la Sociedad no brinda servicios de transporte de pasajeros y equipaje u otros servicios, incluidos los servicios de entrega y servicios de asistencia al usuario.
1.7. Todas las conversaciones que el Usuario mantenga con el equipo de soporte y los conductores de los proveedores de transporte - socios del Servicio pueden ser grabadas para controlar la calidad y mejorar los servicios.
1.8. Al utilizar el Servicio, el Usuario acepta recibir mensajes promocionales, incluidos correos electrónicos y mensajes. El Usuario puede darse de baja de los mensajes promocionales utilizando las funciones relevantes del Servicio o siguiendo las instrucciones especificadas en un mensaje promocional recibido.
2. Uso del Servicio. Ciertas Funciones del Servicio
2.1. El Servicio se proporciona al Usuario para uso personal no comercial, de forma gratuita, por tiempo indefinido.
2.2. La información sobre los servicios de transporte de pasajeros y equipaje u otros servicios (en adelante, la Información) se proporciona por terceros (socios) - proveedores de transporte. La lista de socios está disponible en https://yango.com/partners. Para obtener más información sobre los servicios ofrecidos (incluida la disponibilidad del punto de acceso Wi-Fi en la cabina, la vigilancia fotográfica / video en la cabina por parte del socio de la Sociedad y otra información), el Usuario puede comunicarse con los socios del Servicio - proveedores de transporte o proporcionar sus datos de contacto a través de las funciones del Servicio para que los socios del Servicio se comuniquen con el Usuario de forma independiente y le proporcionen información sobre los servicios ofrecidos.
2.3. La Sociedad no será responsable por el contenido y (o) la relevancia de la información proporcionada por los socios del Servicio - proveedores de transporte, incluida la información sobre el costo y la disponibilidad actual de los beneficios de los proveedores de transporte. El Usuario discutirá, de forma independiente (sin la participación de la Sociedad) la adquisición de servicios con los proveedores de transporte de acuerdo con las reglas de los socios sobre la prestación de servicios. La Sociedad no será responsable de las transacciones financieras y de otro tipo realizadas por el Usuario y los proveedores de transporte y por las consecuencias de la adquisición de los servicios de los proveedores de transporte por parte del Usuario.
2.4. El Usuario puede acceder a las funciones de calificar los servicios de los socios del Servicio - proveedores de transporte y comentar / dejar comentarios sobre el Servicio y (o) los servicios de los proveedores de transporte. Las calificaciones y comentarios de los Usuarios se publican en el sitio web del Servicio y pueden estar disponibles en sitios web de terceros. La Sociedad se reserva el derecho de negarse a publicar calificaciones / comentarios y eliminar / bloquear, en cualquier momento, cualquier calificación / comentario que el Usuario haya publicado a su discreción y sin dar razón alguna.
2.5. La Sociedad se reserva el derecho, a su propia discreción, de limitar el acceso del usuario al Servicio (o a ciertas funciones del Servicio, si es tecnológicamente factible) usando la cuenta del Usuario o bloquear la cuenta completa del Usuario a causa de múltiples violaciones de los presentes Términos o tomar cualquier otra medida contra el Usuario para respetar exigencias legislativas o derechos e intereses legítimos de terceros.
2.6. Cuando la demanda de transporte u otros servicios sea mayor (incluidos los días antes de las vacaciones, días de actos multitudinarios y otros casos), las tarifas de los socios del Servicio se pueden aumentar. La Sociedad informa sobre tarifas más altas mediante la publicación del aviso correspondiente en el sitio web del Servicio https://yango.com o de otra manera que la Sociedad considere adecuada, entre otras cosas, mediante el envío de un mensaje de información al número de teléfono móvil del Usuario o a través de la aplicación móvil.
2.7. Los servicios de transporte de pasajeros y equipaje según las tarifas disponibles en el Servicio se prestan en diferentes tipos de vehículos. Los vehículos se clasifican automáticamente en función de los datos de rendimiento de los vehículos proporcionados por los socios del Servicio.
2.8. Si el Servicio admite el pedido de viajes por adelantado (en adelante, "viajes reservados") en determinadas tarifas del Servicio, el pedido estará disponible para que el socio del Servicio lo confirme cerca de la hora especificada por el Usuario en el pedido (no antes de 30 minutos antes de que esté programado el inicio del viaje reservado). El costo del viaje reservado se calculará e indicará en el Servicio cuando se ordene el viaje. El precio puede cambiar en las circunstancias enumeradas en el sitio web del Servicio https://yango.com.
2.9. Un proveedor de transporte cobra tarifas por un viaje cancelado por el Usuario si dicha cancelación se produce después de la llegada del vehículo al lugar designado por el Usuario. El monto de dichas tarifas se calcula de la misma manera que el costo del viaje/servicio según la tarifa por un período de tiempo desde que el vehículo llegó al lugar de recogida realmente o desde la hora de llegada especificada en la información que presentó el proveedor de transporte al Usuario respecto del transporte del paquete solicitado por el Usuario/los Usuarios (lo que suceda más tarde) hasta que el Usuario cancele el viaje/servicio. El Usuario deberá cancelar un viaje/servicio mediante el envío de un aviso pertinente al proveedor de transporte a través del Servicio. Se considera que un Usuario que no ha abordado un vehículo servido por el proveedor de transporte dentro de diez (10) minutos teniendo en cuenta el tiempo de espera sin cargo especificado en una tarifa respectiva ha cancelado un viaje/servicio, a menos que se estipule lo contrario en las reglas o acuerdos correspondientes del proveedor de transporte entre el Usuario y un representante (conductor) del proveedor de transporte. La tarifa de cancelación para los traslados del aeropuerto a la ciudad se calcula como se describe anteriormente más una tarifa adicional cobrada por el viaje fuera de la ciudad según la tarifa.
2.10. El Usuario autoriza a la Sociedad a procesar información personal (incluidos los datos personales) del Usuario del Servicio (Yango), a transferir información personal del Usuario a los socios de la Sociedad (proveedores de transporte) y a procesar información personal para que los socios de la Sociedad brinden servicios a el Usuario en el Servicio. Cuando el Usuario recurre al Servicio, su información personal se transmite para ser procesada en virtud de los términos y para los fines determinados en la Política de Privacidad disponible en: (https://yango.com/legal/yango_privacy_notice).
2.11. Si el Usuario solicita servicios de entrega a los socios de la Sociedad, se compromete a no entregar los siguientes elementos para la entrega:
- armas de mano de combate, no militares y de servicio, municiones, repuestos y componentes, arcos y ballestas deportivos, armas diseñadas para señales de luz, humo y sonido, armas eléctricas, dispositivos de electrochoque y descargadores de chispas, armas blancas, cachiporras, puños de hierro, shurikens, ramitas, bumeranes y otros artículos ajustados para golpear, aplastar, lanzar, perforar y cortar, excepto equipos deportivos, dispositivos y componentes técnicos especiales de doble uso;
- estupefacientes, sustancias psicotrópicas, precursores y sus análogos;
- materiales nucleares, sustancias radiactivas, superpotentes, cáusticas, explosivas e inflamables, agentes de combustión, sustancias pirotécnicas y artículos relacionados, y otras sustancias peligrosas;
- venenos, animales venenosos, sustancias venenosas, plantas venenosas y semillas de plantas venenosas;
- moneda nacional y moneda extranjera;
- publicaciones impresas, materiales gráficos, películas, fotografías, audio y videos que contengan propaganda o promoción de cambios violentos del orden constitucional, destrucción de la seguridad nacional, guerra, superioridad social, racial, nacional, religiosa, de clase y de clan, crueldad, violencia y pornografía;
- alimentos perecederos sin paquete especial;
- artículos y sustancias que, por su naturaleza o por su embalaje, puedan ser un peligro para el público, puedan contaminar o dañar (destruir) otras cargas, personas circundantes u objetos;
- animales y plantas, materiales biológicos;
- artículos que requieran vehículos especialmente equipados para su transporte, incluidos los productos alimenticios;
- líquidos en recipientes abiertos;
- artículos que comen espacio, cuyas dimensiones totales de largo, ancho (dos diámetros o ejes en la base del rollo) y altura (sujeto a exenciones especiales) superan los 150 cm; artículos largos de más de 150 cm; el peso de los artículos transferidos no puede exceder los 20 kg;
- artículos frágiles sin embalaje especial;
- cualquier otro artículo, cuya distribución esté prohibida o limitada en el territorio del país de prestación del servicio de entrega.
Los socios de la Sociedad pueden establecer otros límites en los artículos a entregar.
Los socios de la Sociedad no brindan ningún servicio postal y no aceptan envíos postales (correspondencia postal con dirección, paquetes postales, contenedores, publicaciones impresas en el embalaje correspondiente) para la entrega.
El Conductor, actuando como representante del socio de la Sociedad, puede preparar el documento de envío con el Usuario o pueden llegar a un acuerdo para no celebrar el documento de envío.
El Usuario es consciente y confirma que, si no cumple con los requisitos anteriores para los artículos que se entregarán, el Usuario es el único responsable de todos los efectos negativos que puedan ocurrir mientras el socio de la Sociedad proporciona los servicios de entrega. Al mismo tiempo, un socio de la Sociedad puede denegar los servicios de entrega al Usuario si el socio de la Sociedad o los representantes del socio de la Sociedad descubren artículos que no se pueden entregar.
3. Función de Pago sin Efectivo para Servicios de Transporte de Pasajeros y Equipaje y otros servicios
3.1. El Usuario puede pagar los servicios de transporte de pasajeros y equipaje prestados al Usuario de acuerdo con la información sobre la demanda potencial del servicio relevante que el Usuario publicó a través del Servicio:
3.1.1. Directamente a un proveedor de transporte (entre otros, en efectivo o por cualquier otro medio estipulado por dicho proveedor de transporte, en su caso, en lo sucesivo denominado como Efectivo en estos Términos y la interfaz del Servicio). Dicho pago se realizará sin que la Sociedad esté involucrada y no se regirá por estos Términos. Dicho método de pago puede estar restringido para los servicios de entrega (si dicha función está disponible en el país del Usuario).
3.1.2. Si el pago sin efectivo está disponible a través de los Servicios en el país del Usuario, el Usuario puede acceder a la función de pago sin efectivo mediante una Tarjeta Bancaria Vinculada (la cláusula 3.2 del presente documento); en este caso, la Sociedad actúa en nombre del proveedor de transporte correspondiente o de otra manera (incluso directamente) con un procesador de pagos autorizado, un procesador de dinero electrónico o cualquier otra parte de las liquidaciones involucradas y recibe pagos como agente del proveedor de transporte o de otra manera (incluso directamente) (en adelante, pagos sin efectivo). La Sociedad no garantiza que la operación del Servicio esté libre de errores y fallas en vista de permitir pagos sin efectivo.
Dependiendo de la región del Usuario, los pagos sin efectivo se pueden realizar sin que la Sociedad actúe como receptora del pago o con la Sociedad involucrada como otra parte en las liquidaciones o en el intercambio de información.
El Usuario deberá elegir la forma de pago correspondiente en la interfaz del Servicio. En este sentido, si es imposible realizar pagos sin efectivo por cualquier motivo (incluidos, entre otros, la inaccesibilidad técnica temporal de esta función, la imposibilidad temporal o constante de realizar pagos sin efectivo utilizando la Tarjeta Vinculada, fondos insuficientes en la Tarjeta Vinculada), el Usuario se obliga a pagar en Efectivo.
Para pagos sin efectivo, es posible efectuar tanto una transacción por el costo total del transporte de pasajeros y equipaje u otro servicio como varias transacciones por ciertas partes del costo del servicio. Los pagos sin efectivo pueden efectuarse por cualquiera de los medios anteriores durante el viaje/servicio o cuando finaliza el viaje/servicio.
En caso de pagos sin efectivo, el Usuario puede, junto con el pago del transporte de pasajeros y equipaje u otro servicio, realizar un pago adicional sin efectivo al proveedor de transporte como un porcentaje del costo del transporte de pasajeros y equipaje pagado u otro servicio (en lo sucesivo denominado como Propinas en estos Términos y la interfaz del Servicio) según lo consideren oportuno.
3.2. El Usuario deberá especificar la Tarjeta Bancaria Vinculada en la interfaz del Servicio indicando los siguientes datos:
- Número de tarjeta bancaria
- Válida hasta
- Código de verificación
Si los datos de la tarjeta bancaria son verdaderos, válidos y es técnicamente factible utilizar esta tarjeta en el Servicio, dicha tarjeta bancaria se convierte en la Vinculada y puede utilizarse para pagos sin efectivo (cl. 3.1.2 del presente documento). Todas las Tarjetas Vinculadas se muestran en la interfaz del Servicio; para comodidad del Usuario, la interfaz muestra los últimos 4 dígitos del número de la Tarjeta Vinculada.
3.3. Cuando se agrega una Tarjeta Vinculada y cuando el Usuario elige la función de pago sin efectivo para un determinado viaje/servicio, se cargará la cantidad limitada a 5 rublos rusos (o cualquier otra cantidad en la moneda de la región del Usuario) para confirmar que los detalles de la Tarjeta Vinculada son verdaderas y válidas; si la transacción se realiza con éxito, dicha cantidad será reembolsada al Usuario. La falta de carga de dicha cantidad implica la imposibilidad de añadir esta Tarjeta Vinculada y (o) la indisponibilidad de la función de pago sin efectivo respectivamente.
3.4. Al agregar la Tarjeta Vinculada y en cualquier momento después de agregarla, el Usuario puede establecer y (o) cambiar la cantidad predeterminada de Propinas a través de la interfaz del Servicio; el Usuario puede cambiar la cantidad de las Propinas para un determinado viaje/servicio en la interfaz del Servicio cuando finaliza el viaje/servicio.
3.5. Las Propinas (en la cantidad predeterminada o en la cantidad específicamente indicada por el Usuario para un determinado viaje/servicio) se cargarán de la Tarjeta Vinculada si el Usuario, dentro de los 30 minutos posteriores a la finalización del viaje/servicio, asigna una calificación alta a el viaje (4–5 estrellas) en la interfaz del Servicio y hace clic en "Listo" o no asigna una calificación alta ni baja al viaje/servicio (no especifica el número de estrellas) y hace clic en "Listo".
3.6. Si dentro de los 30 minutos posteriores a la finalización del viaje/servicio el Usuario asigna una calificación baja al viaje/servicio (1–3 estrellas) en la interfaz del Servicio y hace clic en "Listo", no se cobrarán Propinas de la Tarjeta Vinculada.
3.7. Si dentro de los 30 minutos posteriores a la finalización del viaje/servicio el Usuario no hizo clic en "Listo", la cantidad de las Propinas (en la cantidad predeterminada o en la cantidad específicamente indicada por el Usuario para un determinado viaje/servicio) se bloqueará en la Tarjeta Vinculada por 24 horas, durante las cuales el Usuario podrá aumentar o reducir la cantidad de las Propinas para este viaje/servicio. Transcurrido dicho tiempo, las Propinas se cobrarán en la cantidad especificada por el Usuario (por defecto o específicamente para este viaje/servicio).
3.8. Los pagos sin efectivo del Usuario se realizarán con un procesador de pagos autorizado o un procesador de dinero electrónico involucrado y se regirán por las reglas de los sistemas de pago internacionales, bancos (incluido el banco que emitió la Tarjeta Vinculada) y otras partes en las liquidaciones.
3.9. Al indicar sus datos de conformidad con la cláusula 3.2 del presente documento y además utilizando la Tarjeta Vinculada, el Usuario confirma y garantiza que indicó la información fidedigna y completa sobre la tarjeta bancaria válida emitida a su nombre; dichos datos cumplen con las normas de los sistemas de pago internacionales y los requisitos del banco que emitió la Tarjeta Vinculada, entre otros, en relación con el procedimiento de pagos sin efectivo.
3.10. El Usuario comprende y acepta que todas las acciones realizadas en el Servicio utilizando el número de teléfono móvil confirmado por el Usuario, entre otras cosas, los pagos sin efectivo con el uso de la Tarjeta Bancaria Vinculada, se considerarán realizadas por el Usuario.
3.11. Si el Usuario no está de acuerdo con el hecho y (o) la cantidad de los pagos sin efectivo y tiene otras preguntas sobre cómo usar la Tarjeta Vinculada en el Servicio, puede comunicarse con la Sociedad a través de los números de teléfono especificados por el Servicio y (o) a través de la interfaz del servicio de asistencia (feedback) dentro de los 14 días a partir de la fecha de los pagos sin efectivo o cualquier otra acción o evento que motivó la solicitud.
Si, tras la inspección provocada por dicha solicitud, la Sociedad decide devolver la cantidad del pago sin efectivo, en su totalidad o en parte, dicha cantidad se devolverá a la cuenta bancaria de la tarjeta bancaria con la que se realizó el pago sin efectivo. El reembolso se realizará con un procesador de pagos autorizado o un procesador de dinero electrónico involucrado y se regirán por las reglas de los sistemas de pago internacionales, bancos (incluido el banco que emitió la Tarjeta Vinculada) y otras partes en las liquidaciones. Si la Sociedad no es parte de las liquidaciones realizadas a través de la Tarjeta Vinculada, la Sociedad puede actuar como un organismo que transfiere las solicitudes de los usuarios anteriores a los proveedores de transporte, oficinas de despacho o cualquier otra persona que sea receptora de los pagos en virtud de las transacciones anteriores con la Tarjeta Vinculada.
3.12. La Sociedad se reserva el derecho de exigir, en cualquier momento, que el Usuario confirme los detalles que especificó en el Servicio, incluidos los detalles de la Tarjeta Vinculada, y solicitar los documentos acreditativos al respecto (en particular, documentos de identidad); el hecho de no proporcionar estos documentos puede calificar como el suministro de información no confiable y tener las implicaciones estipuladas por la cláusula 2.5 del presente documento si la Sociedad lo considera conveniente.
3.13. Las disposiciones sobre los términos y procedimiento de pago del transporte de pasajeros y equipaje u otros servicios, incluidos los servicios de entrega, especificados en esta Sección, no se aplicarán cuando un tercero pague por dicho transporte u otros servicios en lugar del Usuario bajo un contrato separado que la Sociedad firmó con dicho tercero.
4. Ley aplicable y solución de controversias
4.1. Estos Términos de Uso y cualquier obligación no contractual que surja de estos Términos de Uso o estén relacionados con ellos se regirán e interpretarán de acuerdo con las leyes de Inglaterra y Gales sin tener en cuenta las disposiciones sobre conflictos de leyes.
4.2. Cualquier disputa, diferencia, controversia o reclamo que surja de o en conexión con estos Términos de Uso, incluyendo (pero no limitado a) cualquier pregunta relacionada con su existencia, validez, interpretación, desempeño, descarga y recursos aplicables, se remitirá y finalmente resuelto mediante arbitraje conforme a las Reglas de Arbitraje del Centro de Arbitraje Internacional de Dubai, cuyas Reglas se consideran incorporadas por referencia a esta cláusula. El número de árbitros será uno. La sede del arbitraje será Dubai, Emiratos Árabes Unidos. El idioma que se utilizará en el arbitraje será el inglés.
