1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of MLU Europe B.V. (hereinafter referred to as Company) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service) in Angola.

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of regulatory documents - regulatory documents – License to Use Search Engine and Privacy Policy (hereinafter referred to as Regulatory Documents), in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.Rules of Referral Programme for users are posted at https://yango.com/legal/an.

1.4. The Company may, after prior notice and consent from the User, amend provisions hereof, and may, under the same conditions, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The Company can provide the User with a translation of this Terms from English into other languages. However, in the event of a conflict between the Terms in English and its translation, only the English version of the Terms shall be legally binding.

1.5. The User can withdraw from these Terms at any time by deleting the Program from the memory of the User’s mobile device.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if available in the country via Services) of available transportation providers, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.

1.8. For the avoidance of doubt, the Company does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.

1.9. All conversations the User holds with the support team and drivers of transportation providers - partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use, free of charge, for an indefinite time period.

2.2. Information on passenger and baggage transportation services or other services (hereinafter referred to as the Information) is provided by third parties (partners)- transportation providers. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Company's partner, and other information), the User may contact the partners of the Service - transportation providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. The Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service - transportation providers, including information on the cost and current availability of the transportation providers’ benefits. The User shall independently (without the participation of the Company) discuss the acquisition of services with the transportation providers in accordance with the partners’ rules on the provision of services. The Company shall not be held liable for financial and any other transactions effected by the User and the transportation providers and for any consequences of the acquisition of the transportation providers’ services by the User.

2.4. The User may access functions of rating the services of the Service partners - transportation providers and commenting / leaving feedback on the Service and/or services of the transportation providers. Users ratings and feedback are posted on the Service website and can be available on third-party websites. The Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. The Company reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for transportation or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. The Company informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as the Company thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.

2.7. Passenger and baggage transportation services as per tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.

2.9. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.10. The User authorizes the Company to process personal information (including personal details) of the User of Service (Yango), to transfer personal information of the User to Company’s partners (transportation providers), and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, his/her personal information is transmitted to to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.11. If the User orders delivery services from the Company’s partners, he or she undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of countryof delivery service provision.

The Company’s partners may set other limits on items to be delivered.

The Company’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.

The Driver, acting as a representative of the Company’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Company’s partner provide delivery services. At the same time, a Company’s partner may deny delivery services to the User, if the Company’s partner/ representatives of the Company’s partner discover any non-deliverable items.

 

3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services (if such function is available in the User’s country).

3.1.2. If the non-cash payment is available via Services in the User’s country, the User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). The Company does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Company acting as a payment recipient or with the Company involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportationor other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact the Company by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, the Company decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If the Company is not a party to settlements made via the Linked Card, the Company can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. The Company reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if the Company thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract the Company signed with such third party.

 

4. Governing law and dispute resolution

4.1. These Terms of Use of Yango arising out of or in connection with these Terms shall be governed by and construed in accordance with law of the Netherlands, without regard to its conflict of law provisions.

4.2. Any disputes arising out or in connection with these Terms of Use of Yango shall be decided by the competent court in The Netherlands, unless mandatory conflict of laws provisions provide otherwise.

1. Disposições Gerais

1.1. Os Presentes Termos (doravante designados Termos) constituem uma oferta da MLU Europe B.V. (doravante designada Empresa) a um utilizador da Internet (doravante designado Utilizador) para utilizar o serviço da Yango (doravante designado Serviço) em Angola.

1.3. Ao começar a usar o Serviço/as suas determinadas funções, considera-se que o Utilizador aceitou os presentes Termos e as disposições dos documentos regulamentares - documentos regulamentares - Licença de uso do mecanismo de pesquisae Política de privacidade (doravante designados Documentos regulamentares), na íntegra, sem reservas e excepções. Se o Utilizador discordar de quaisquer disposições dos Termos e/ou Documentos regulamentares, o Utilizador não poderá usar o Serviço.As regras do Programa de referência para usuários são publicadas em https://yango.com/legal/an.

1.4. A Empresa pode, após aviso prévio e consentimento do Utilizador, alterar as disposições do presente instrumento, e a pode, nas mesmas condições, alterar as disposições dos Documentos Regulamentares. A versão actual do presente instrumento está disponível em: https://yango.com/legal/yango_termsofuse. A Empresa pode fornecer ao Utilizador uma tradução destes Termos do inglês para outros idiomas. No entanto, em caso de conflito entre os Termos em inglês e a sua tradução, apenas a versão em inglês dos Termos será juridicamente vinculativa.

1.5. O Utilizador pode rescindir os presentes Termos a qualquer momento, eliminando o Programa da memória do dispositivo móvel do Utilizador.

1.6. O Serviço permite que o Utilizador coloque informação, sem encargos, sobre a procura potencial do Utilizador por serviços de transporte de passageiros e bagagens ou outros serviços, incluindo serviços de entrega (se disponíveis no país através dos Serviços) de fornecedores de transporte disponíveis, veja ofertas de organizações de prestação de serviços nos referidos campos, e pesquisar tais ofertas utilizando os parâmetros definidos pelo Utilizador. Todas as funções actualmente disponíveis do Serviço, juntamente com quaisquer desenvolvimentos e/ou funções recém-adicionadas, estão sujeitas aos presentes Termos.

RECONHECE QUE A EMPRESA NÃO FORNECE SERVIÇOS DE TRANSPORTE OU FUNCIONA COMO TRANSPORTADOR E QUE TODOS TAIS SERVIÇOS DE TRANSPORTE SÃO FORNECIDOS POR TERCEIROS – PRESTADORES DE TRANSPORTE, QUE NÃO SÃO EMPREGADOS PELA EMPRESA OU QUALQUER DAS SUAS AFILIADAS. AS RELAÇÕES ENTRE SI E OS PRESTADORES DE TRANSPORTE NA AQUISIÇÃO DE SERVIÇOS SÃO REGULADAS POR ACORDOS RESPECTIVOS ENTRE SI E O PRESTADOR DE TRANSPORTE, A EMPRESA NÃO É PARTE DESSES ACORDOS.

1.7. Dependendo da região do Utilizador, qualquer ou todas as funções do Serviço podem ser inacessíveis ou limitadas. As funções são consideradas inacessíveis (limitadas) para o Utilizador de uma determinada região, se tal Utilizador não puder usá-las explicitamente. É proibido aplicar quaisquer métodos técnicos e baseados em software para contornar essas limitações. As disposições aqui contidas que regem as funções do Serviço inacessíveis (limitadas) para o Utilizador serão aplicadas até que tais funções se tornem explicitamente acessíveis para o Utilizador. As informações sobre a acessibilidade das funções do Serviço numa determinada região serão fornecidas ao Utilizador mediante solicitação enviada à Empresa.

1.8. Para evitar dúvidas, a Empresa não presta serviços de transporte de passageiros e bagagens ou outros serviços, incluindo serviços de entrega e serviços de help desk.

1.9. Todas as conversas que o Utilizador mantém com a equipa de apoio e motoristas dos transportadores – parceiros do Serviço podem ser gravadas para controlo de qualidade e melhoria dos serviços.

1.10. Ao usar o Serviço, o Utilizador consente em receber mensagens promocionais, incluindo emails e mensagens. O Utilizador pode cancelar a assinatura de mensagens promocionais usando funções respectivas do Serviço ou seguindo as instruções especificadas numa mensagem promocional recebida.

 

2. Uso do Serviço. Determinadas Funções do Serviço

2.1. O Serviço é fornecido ao Utilizador para uso pessoal não comercial, livre de encargos, por tempo indeterminado.

2.2. As informações sobre serviços de transporte de passageiros e bagagens ou outros serviços (doravante designados Informações) são fornecidas por terceiros (parceiros) - fornecedores de transporte. A lista de parceiros está disponível em https://yango.com/partners. Para mais informações sobre os serviços oferecidos (incluindo disponibilidade de ponto de acesso Wi-Fi na cabina, foto/vídeo vigilância na cabina pelo parceiro da Empresa, e outras informações), o Utilizador poderá entrar em contacto com os parceiros do Serviço - transportadores ou fornecer os seus dados de contacto através das funções do Serviço para que os parceiros do Serviço contactem o Utilizador de forma independente e forneçam informações sobre os serviços oferecidos.

2.3. A Empresa não se responsabiliza pelo conteúdo e/ou relevância das informações fornecidas pelos parceiros do Serviço - transportadores, incluindo informações sobre o custo e a disponibilidade actual dos benefícios dos transportadores. O Utilizador deverá discutir de forma independente (sem a participação da Empresa) a aquisição de serviços com os transportadores de acordo com as regras dos parceiros sobre a prestação de serviços. A Empresa não se responsabiliza por transacções financeiras e outras efectuadas pelo Utilizador e pelos transportadores e por quaisquer consequências da aquisição dos serviços dos transportadores pelo Utilizador.

2.4. O Utilizador poderá aceder às funções de avaliação dos serviços dos parceiros do Serviço - transportadores e comentar/deixar feedback sobre o Serviço e/ou serviços dos transportadores. As avaliações e comentários dos utilizadores são publicados no website do Serviço e podem estar disponíveis em websites de terceiros. A Empresa reserva-se o direito de recusar a publicar quaisquer avaliações/comentários e excluir/bloquear, a qualquer momento, qualquer avaliação/comentários que o Utilizador publicou, a seu critério e sem dar qualquer motivo.

2.5. A Empresa reserva-se o direito, a seu próprio critério, de limitar o acesso do utilizador ao Serviço (ou a determinadas funções do Serviço, se tecnologicamente viável) usando a conta do Utilizador ou bloqueando toda a conta do Utilizador após múltiplas violações deste, ou tomar quaisquer outras medidas contra o Utilizador para respeitar requisitos legais ou direitos de terceiros e interesses legítimos.

2.6. Quando a procura por transporte ou outros serviços é maior (incluindo dias antes de feriados, dias de eventos de massa e outros casos), as tarifas dos parceiros de serviço podem ser aumentadas. A Empresa informa sobre tarifas mais altas publicando o aviso respectivo no website do Serviço https://yango.com ou de outra forma que a Empresa considere adequada, entre outras, enviando uma mensagem informativa para o número de telemóvel do Utilizador ou via aplicação móvel.

2.7. Os serviços de transporte de passageiros e bagagens de acordo com as tarifas disponíveis no Serviço são prestados por diferentes tipos de veículos. Os veículos são classificados automaticamente com base nos dados de desempenho do veículo fornecidos pelos parceiros do Serviço.

2.8. Se o Serviço permitir o pedido de viagens com antecedência (doravante designadas, "pré-pedidos de viagem") em determinadas tarifas do Serviço, o pedido estará disponível para o parceiro do Serviço confirmar próximo do horário especificado pelo Utilizador no pedido (não antes de 30 minutos do início da viagem com pré-pedido). O custo da viagem com pré-pedido será calculado e indicado no Serviço quando a viagem for solicitada. O preço pode mudar devidas às circunstâncias listadas no website do Serviço https://yango.com.

2.9. Um transportador cobra taxas por uma viagem cancelada pelo Utilizador, se tal cancelamento ocorreu após a chegada do veículo ao local indicado pelo Utilizador. O valor dessas taxas é calculado da mesma forma que o custo da viagem/serviço de acordo com a tarifa por um período de tempo a partir da chegada do veículo ao local de recolha ou da hora de chegada especificada nas informações fornecidas pelo transportador ao Utilizador relativamente ao transporte solicitado pelo pedido do Utilizador/Utilizadores (o que ocorrer depois) até o Utilizador cancelar a viagem/serviço. O Utilizador deverá cancelar uma viagem/serviço enviando o aviso respectivo ao transportador através do Serviço. Considera-se que o Utilizador que não entrar num veículo servido pelo transportador no prazo de 10 (dez) minutos tendo em conta o tempo de espera gratuito especificado no respectivo tarifário é considerado como tendo cancelado uma viagem/serviço, salvo estipulação em contrário por regras ou acordos do transportador respectivo entre o Utilizador e um representante (motorista) do transportador. A taxa de cancelamento para viagens do aeroporto para a cidade é calculada de acordo com o descrito acima, mais uma taxa adicional cobrada para viagem fora da cidade de acordo com a tarifa.

2.10. O Utilizador autoriza a Empresa a processar informações pessoais (incluindo dados pessoais) do Utilizador do Serviço (Yango), transferir informações pessoais do Utilizador para parceiros da Empresa (transportadores) e processar informações pessoais para parceiros da Empresa para fornecer serviços ao Utilizador no Serviço. Quando o Utilizador recorre ao Serviço, as suas informações pessoais são transmitidas à para serem processadas nos termos e para os fins determinados na Política de Privacidade da disponível em: (https://yango.com/legal/yango_privacy_notice).

2.11. Se o Utilizador solicitar serviços de entrega a parceiros da Empresa, compromete-se a não entregar para as viagens os seguintes artigos:

  • armas de combate portátil, não militares e de serviço, munições, peças sobresselentes e componentes, arcos e bestas desportivas, armas projectadas para luz, fumo e sinais sonoros, armas eléctricas, dispositivos de electrochoque e ignição de faíscas, armas brancas, bastões, soqueiras, shurikens, galhos, bumerangues e outros itens modificados para golpear, esmagar, arremessar, perfurar e cortar, excepto para equipamentos desportivos, dispositivos e componentes técnicos especiais de dupla utilização;
  • estupefacientes, substâncias psicotrópicas, precursores e os seus análogos;
  • materiais nucleares, substâncias radioactivas, superpotentes, cáusticas, explosivas e inflamáveis, agentes de fogo, substâncias pirotécnicas e artigos relacionados e outras substâncias perigosas;
  • venenos, animais venenosos, substâncias venenosas, plantas venenosas e sementes de plantas venenosas;
  • a moeda nacional e a moeda estrangeira;
  • publicações impressas, materiais gráficos, filmes, fotos, materiais de áudio e vídeo contendo propaganda ou promoção de mudanças violentas da ordem constitucional, destruição da segurança nacional, guerra, superioridade social, racial, nacional, religiosa, de classe e clã, crueldade, violência e pornografia;
  • alimentos perecíveis sem embalagem especial;
  • artigos e substâncias que, pela sua natureza ou devido à sua embalagem, podem constituir um perigo para o público, podem contaminar ou danificar (destruir) outras cargas, pessoas circundantes ou artigos;
  • animais e plantas, materiais biológicos;
  • artigos que exijam o transporte de veículos especialmente equipados, incluindo alimentos;
  • líquidos em recipientes abertos;
  • artigos de consumo de espaço, cujo comprimento total, largura (dois diâmetros ou eixos na base do rolo) e dimensões de altura (sujeitas a isenções especiais) excedam 150 cm; artigos longos acima de 150 cm; o peso dos artigos transferidos não pode exceder 20 kg;
  • artigos frágeis sem embalagem especial;
  • quaisquer outros artigos cuja distribuição seja proibida ou limitada no território do país de prestação do serviço de entrega.

Os parceiros da Empresa podem estabelecer outros limites de artigos a serem entregues.

Os parceiros da Empresa não prestam quaisquer serviços postais e não aceitam envios postais (correspondência endereçada, encomendas postais, contentores, publicações impressas nas embalagens respectivas.

O Motorista, actuando como representante do parceiro da Empresa, pode preparar o documento de remessa com o Utilizador ou pode entrar em acordo para não concluir o documento de remessa.

O Utilizador tem conhecimento e confirma que, caso não cumpra os requisitos acima para artigos a serem entregues, o Utilizador é o único responsável por todos os efeitos negativos que possam ocorrer enquanto o parceiro da Empresa prestar serviços de entrega. Ao mesmo tempo, o parceiro de uma Empresa pode recusar serviços de entrega ao Utilizador, se o parceiro/representantes da Empresa do parceiro da Empresa descobrir quaisquer artigos não passíveis de entrega.

 

3. Função de Pagamento Sem Dinheiro para Serviços de Transporte de Passageiros e Bagagens e outros serviços

3.1. O Utilizador pode pagar pelos serviços de transporte de passageiros e bagagens fornecidos ao Utilizador de acordo com as informações sobre a procura potencial para o serviço respectivo que o Utilizador publicou através do Serviço:

3.1.1. Directamente a um transportador (entre outros, em dinheiro ou por qualquer outro meio estipulado pelo referido transportador, se houver, doravante designado nos presentes Termos e na interface do Serviço como Dinheiro). O referido pagamento será feito sem a participação da Empresa e não será regido pelos presentes Termos. A referida forma de pagamento pode ser restrita aos serviços de entrega (se tal função estiver disponível no país do Utilizador).

3.1.2. Se o pagamento sem numerário estiver disponível através dos Serviços no país do Utilizador, o Utilizador poderá aceder à função de pagamento sem numerário com um Cartão Bancário Associado (cl. 3.2 do presente instrumento); neste caso, a Empresa actua em nome do transportador respectivo ou de outra forma (inclusive directamente) com um processador de pagamento autorizado, processador de dinheiro electrónico ou qualquer outra parte nos acordos envolvidos que recebe pagamentos como agente do transportador ou de outra forma ( inclusive directamente) (doravante designados pagamentos sem numerário). A Empresa não garante que a operação do Serviço seja livre de erros e falhas para permitir pagamentos sem numerário.

Dependendo da região do utilizador, os pagamentos sem numerário podem ser efectuados sem que a Empresa actue como destinatário do pagamento ou com a Empresa envolvida como outra parte nos acordos ou na troca de informações.

O Utilizador deverá escolher a forma de pagamento respectiva na interface do Serviço. A este respeito, se for impossível efectuar pagamentos sem numerário por qualquer motivo (incluindo, mas não limitado a inacessibilidade técnica temporária desta função, impossibilidade temporária ou constante de fazer pagamentos sem numerário usando o Cartão Associado, fundos insuficientes no Cartão Associado, o Utilizador compromete-se a pagar em Dinheiro.

Para pagamentos sem numerário, é possível realizar uma transacção do custo total do transporte de passageiros e bagagem ou outro serviço e várias transacções de determinadas partes do custo do serviço. Os pagamentos sem numerário podem ser efectuados por qualquer um dos meios acima durante a viagem/serviço ou quando a viagem/serviço terminar.

No caso de pagamentos sem numerário, o Utilizador pode, juntamente com o pagamento do transporte de passageiros e bagagem ou outro serviço, efetuar um pagamento sem numerário adicional ao transportador como uma percentagem do custo do transporte pago de passageiros e bagagem ou outro serviço (doravante designadas nos presentes Termos e na interface do Serviço como Gorjetas) como considerar adequado.

3.2. O Utilizador deverá especificar o Cartão Bancário Associado na interface do Serviço, indicando os seguintes dados:

  • Número do cartão bancário
  • Válido até
  • Código de verificação

Se os dados do cartão bancário forem verdadeiros, válidos e for tecnicamente viável a utilização deste cartão no Serviço, o referido cartão bancário torna-se o Cartão Associado e pode ser utilizado para pagamentos sem numerário (cl. 3.1.2 do presente instrumento). Todos os Cartões Associados são exibidos na interface de Serviço; para conveniência do Utilizador, a interface exibe os 4 últimos dígitos do número do Cartão Associado.

3.3. Quando um Cartão Associado é adicionado e quando o Utilizador escolhe a função de pagamento sem numerário para uma determinada viagem/serviço, o valor limitado a 5 RUB (ou qualquer outro valor na moeda da região do Utilizador) será cobrado para confirmar que os dados do Cartão Associado são verdadeiros e válidos; se a transacção for efectuada com sucesso, o referido valor será reembolsado ao Utilizador. A não cobrança do referido valor significa a impossibilidade de adicionar este Cartão Associado e/ou a indisponibilidade da função de pagamento sem numerário, respectivamente.

3.4. Ao adicionar o Cartão Associado e a qualquer momento após a sua adição, o Utilizador pode definir e/ou alterar o montante padrão de Gorjetas através da interface do Serviço; o Utilizador pode alterar o montante de Gorjetas para uma determinada viagem/serviço na interface do Serviço, quando a viagem/serviço terminar.

3.5. As Gorjetas (no montante padrão ou no montante indicado especificamente pelo Utilizador para uma determinada viagem/serviço) serão cobradas do Cartão Associado, se o Utilizador, até 30 minutos após o término da viagem/serviço, atribuir uma classificação alta à viagem (4–5 estrelas) na interface do serviço e clicar em "Concluído" ou atribui uma classificação nem alta nem baixa à viagem/serviço (não especifica o número de estrelas) e clicar em "Concluído".

3.6. Se dentro de 30 minutos após o final da viagem/serviço o Utilizador atribuir uma classificação baixa à viagem/serviço (1–3 estrelas) na interface do Serviço e clicar em "Concluído", nenhuma gorjeta será cobrada do Cartão Associado.

3.7. Se dentro de 30 minutos após o final da viagem/serviço o Utilizador não clicar em "Concluído", o montante das Gorjetas (no montante padrão ou no montante indicado especificamente pelo Utilizador para determinada viagem/serviço) será bloqueada no Cartão Associado por 24 horas, durante o qual o Utilizador pode aumentar ou diminuir o montante das Gorjetas para esta viagem/serviço. Terminado o referido tempo, as Gorjetas serão cobradas no valor especificado pelo Utilizador (por defeito ou especificamente para esta viagem/serviço).

3.8. Os pagamentos sem numerário do Utilizador devem ser efectuados com um processador de pagamento autorizado ou processador de dinheiro electrónico envolvido e devem ser regidos por regras de sistemas de pagamento internacionais, bancos (incluindo o banco que emitiu o Cartão associado) e outras partes nas liquidações.

3.9. Ao indicar os seus detalhes de acordo com cl. 3.2 do presente instrumento e ainda utilizando o Cartão Associado, o Utilizador confirma e garante que indicou informações de confiança ​​e completas sobre o cartão bancário válido emitido em seu nome; cumpre as regras dos sistemas de pagamentos internacionais e os requisitos do banco emissor do Cartão Associado, entre outros, em relação ao procedimento de pagamentos sem numerário.

3.10. O Utilizador compreende e acorda que todas as acções realizadas no Serviço usando o número de telemóvel confirmado pelo Utilizador, entre outros, pagamentos sem numerário com o uso do Cartão Bancário Associado, são consideradas realizadas pelo Utilizador.

3.11. Caso o Utilizador não concorde com o facto e/ou o montante dos pagamentos sem numerário e tenha outras dúvidas sobre como utilizar o Cartão Associado no Serviço, poderá entrar em contacto com a Empresa pelos números de telefone especificados pelo Serviço e/ou através da interface de help desk (feedback) no prazo de 14 dias a partir da data de pagamentos sem numerário ou quaisquer outras acções ou eventos que motivaram o pedido.

Se, após a inspecção causada por tal pedido, a Empresa decidir reembolsar o montante do pagamento sem numerário, no todo ou em parte, o referido montante será reembolsado na conta bancária do cartão bancário com o qual o pagamento sem numerário foi efectuado. O reembolso deve ser efectuado com um processador de pagamento autorizado ou processador de dinheiro electrónico envolvido e regido por regras de sistemas de pagamento internacionais, bancos (incluindo o banco que emitiu o Cartão Associado) e outras partes nas liquidações. Se a Empresa não for parte das liquidações efectuadas por meio do Cartão Associado, a Empresa pode actuar como um órgão que transfere os pedidos dos utilizadores acima para transportadores, despachantes ou qualquer outra pessoa que receba pagamentos nas transacções acima com o Cartão Associado.

3.12. A Empresa reserva-se o direito de exigir a qualquer momento que o Utilizador confirme os dados que especificou no Serviço, incluindo os dados do Cartão Associado, e solicitar documentos comprovativos a este respeito (em particular, documentos de identidade); o não fornecimento desses documentos pode ser qualificado como fornecimento de informações não confiáveis ​​e ter implicações estipuladas na cl. 2.5 do presente instrumento, se a Empresa considerar conveniente.

3.13. As disposições sobre os termos e procedimentos de pagamento de transporte de passageiros e bagagem ou outros serviços, incluindo serviços de entrega, especificados nesta Secção não se aplicarão quando um terceiro pagar por tal transporte ou outros serviços em vez do Utilizador ao abrigo de um contrato separado que a Empresa celebrou com tal terceiro.

 

4. Lei aplicável e resolução de litígios

4.1. Os Presentes Termos de Uso da Yango decorrentes ou em conexão com os presentes Termos serão regidos e interpretados de acordo com a lei da Holanda, sem ter em consideração o seu conflito com disposições da lei.

4.2. Quaisquer litígios decorrentes ou relacionados com os presentes Termos de Uso da Yango serão decididas pelo tribunal competente na Holanda, a menos que as disposições obrigatórias de conflito de leis determinem o contrário.

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of MLU Africa B.V. (hereinafter referred to as MLU Africa) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service).

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms , the User may not use the Service.Rules of Referral Programme for users are posted at https://yango.com/legal/gh.

1.4. MLU Africa may, at any time without notice to the User, amend provisions hereof, and may, at any time without notice to the User, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms MLU Africa made as prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to MLU Africa.

1.8. For the avoidance of doubt, MLU Africa does not provide passenger and baggage transportation services and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Rightholder's partner, and other information), the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. MLU Africa shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of MLU Africa) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. MLU Africa shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. MLU Africa reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. MLU Africa reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for transportation services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. MLU Africa informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as MLU Africa thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Passenger and baggage transportation services as per Economy, Comfort, Business, and other tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User ordered (whichever comes later) until the User cancelled the trip. The User shall cancel a trip by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.9. The User authorizes MLU Africa to process personal information (including personal details) of the User of MLU Africa, to transfer personal information of the User to MLU Africa’s partners, and to process personal information for MLU Africa’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

3. Function of Cashless Payment for Passenger and Baggage Transportation Services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without MLU Africa being involved and shall not be governed by these Terms.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, MLU Africa acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). MLU Africa does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without MLU Africa acting as a payment recipient or with MLU Africa involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip or when the trip is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip in the Service interface, when the trip is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be charged from the Linked Card, if the User, within 30 minutes after the trip is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip is over the User assigns a low rating to the trip (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact MLU Africa by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, MLU Africa decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If MLU Africa is not a party to settlements made via the Linked Card, MLU Africa can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. MLU Africa reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if MLU Africa thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation services specified in this Section shall not apply, when a third party pays for such transportation services instead of the User under a separate contract MLU Africa signed with such third party.

4. Terms and restrictions of marketing benefits and campaigns

The terms and restrictions presented in connection with advertisements and campaigns of Yango are always applied to such advertisements and campaigns. Additionally, to each advertisement or campaign are applied the terms and restrictions concerning it, presented in address https://yango.com/legal/gh.

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Ridetech International B.V. (hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service or Yango) in Cote d’ Ivoire and Democratic Republic of Congo.

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.4. Company may, at any time without notice to the User, amend provisions hereof, and may, at any time without notice to the User, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Company made as prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (“Request”), look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Company.

1.8. For the avoidance of doubt, Company does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.

YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.

1.9. All conversations the User holds with the support team and drivers of partners (transportation providers) of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages, inclusing email and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use free of charge.

2.2. Information on passenger and baggage transportation services or other services, including delivery services (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Rightholder's partner, and other information), the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Company) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Company shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ (transportation providers’) services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Company reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for transportation or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Company informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as Company thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.

2.7. Passenger and baggage transportation services as per Economy, Comfort, Business, and other tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.

2.9. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed in the Request. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.10. The User authorizes Company to process personal information (including personal details) of the User of Company, to transfer personal information of the User to Company’s partners, and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.11. If the User orders delivery services from Ridetech International’s partners, he or she undertakes not to hand over for the delivery the following items:

hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;

narcotic drugs, psychotropic substances, precursors and their analogs;

nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;

poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;

the national currency and foreign currency;

printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;

perishable foodwithout special package;

items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;

animals and plants, biological materials;

items requiring specially equipped vehicles to be transported, including foodstuff;

liquids in open containers;

space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;

fragile items without special packaging;

any other items, which distribution is prohibited or limited in the territory of countryof delivery service provision.

The Company’s partners may set other limits on items to be delivered.

The Company’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.

The Driver, acting as a representative of the Company’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Company’s partner provide delivery services. At the same time, a Company’s partner may deny delivery services to the User, if the Company’s partner/ representatives of the Company’s partner discover any non-deliverable items.

2.12. The "Share" option may be available to the User, under which the Service has the right to accept a Request for a trip from another User during the trip and carry out transportation of two Users within their Requests simultaneously in one vehicle. When the User places a Request using the "Share" option, the User confirms his agreement with the terms and restrictions within the specified option, including:

- during the trip, the Service has the right to accept the Request of another User, in connection with

which it is possible to a) change the route of the trip in order to fulfill the second Request, b) increase the previously calculated travel time;

- within the framework of a single Request using the "Share" option, only one passenger can make a trip. This means that when two Requests are executed simultaneously within the "Share" option, no

more than two passengers can be in the vehicle;

- the route of the trip when making Requests is determined in accordance with the algorithms of the Service or at the discretion of the Service.

Service partners may impose additional restrictions, including on the dimensions of passengers' luggage.

The partners of the Service have the right to refuse the User a trip if the User does not comply with the established requirements.

 

3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services, including delivery services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services.

3.1.2. If available at the Service in User’s region. the User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). Company does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Company acting as a payment recipient or with Company involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to Euro 1,1 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Company by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Company decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Company is not a party to settlements made via the Linked Card, Company can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Company reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Company thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract signed with such third party

 

4. Governing law and dispute resolution

4.1. These Terms of Use of Yango arising out of or in connection with these Terms shall be governed by and construed in accordance with law of the Netherlands, without regard to its conflict of law provisions.

4.2. Any disputes arising out or in connection with these Terms of Use of Yango shall be decided by the competent court in The Netherlands, unless mandatory conflict of laws provisions provide otherwise.

Conditions d'usage du service Yango

 

1. Dispositions générales

1.1. Les présentes Conditions (ci-après — Conditions) représentent un offre de la société Ridetech International B.V. (ci-après — la Société) à l'utilisateur du réseau Internet (ci-après — Utilisateur) concernant l'usage du service Yango (ci-après — « Service ») en Côte d’Ivoire, République démocratique Congo (R.D.C.).

1.3. Il est considéré qu'en procédant à l'usage du Service / de ces fonctionnalités séparées, l'Utilisateur accepte les présentes Conditions, ainsi que les conditions des Documents réglementaires dans leur intégrité, sans aucune restriction ni réserve. Dans le cas où l'Utilisateur n'accepte pas l’une quelconque des dispositions des Conditions et/ou des Documents réglementaires, l'Utilisateur ne peut pas utiliser le Service.

1.4. La Société a le droit de modifier les dispositions des présentes Conditions à tout moment et sans notification à l'Utilisateur et la a le droit de modifier les dispositions des Documents réglementaires à tout moment et sans notification à l'Utilisateur. La version en vigueur des présents Conditions est publiée à : https://yango.com/legal/yango_termsofuse. Le risque de non prise de connaissance de la nouvelle version des Conditions et des Documents réglementaires est subi par l'Utilisateur. L'usage du Service après la modification des Conditions ou des Documents réglementaires est considéré comme l'accord de l'Utilisateur avec leurs nouvelles versions.

1.5. Dans le cas où La Société a apporté des modifications quelconques aux présentes Conditions, conformément au paragraphe 1.4. des présentes Conditions, que l'Utilisateur n'accepte pas, il est tenu d'arrêter l'usage du Service.

1.6. Le Service donne à l'Utilisateur la possibilité de publier, à titre gratuit, l'information relative à la demande potentielle de l'Utilisateur de service de transport des passagers et des bagages (« Demande »), ainsi que la possibilité de prendre connaissance des informations relatives aux offres des organisations qui fournissent des services dans les domaines susmentionnés et de rechercher de telles offres selon les critères fixés par l'Utilisateur. Toutes les fonctionnalités du Service existant actuellement, ainsi que tout leur développement ou l'adjonction de toutes nouvelles fonctionnalités constituent l'objet des présentes Conditions.

1.7. En fonction de la région de l'Utilisateur, l'accès à toutes ou à certaines fonctionnalités du Service peut être bloqué ou limité. L'accès de l'Utilisateur aux fonctionnalités depuis une certaine région est considéré comme bloqué (limité) pour, si l'Utilisateur ne peut pas s'en servir directement. L'application de tous moyens techniques ou logiciels pour contourner ces limitations est interdite. Les dispositions des présentes Conditions qui régissent les fonctionnalités du Service l'accès auxquelles est bloqué (limité) pour l'Utilisateur ne sont pas applicables jusqu'à ce que l'Utilisateur ne puisse s'en servir directement. Les informations concernant l'accessibilité des fonctionnalités du Services dans une région correspondante sont fournies à l'Utilisateur à la demande de celui-ci adressée à La Société.

1.8. Pour éviter tout doute, la Société ne fournit pas de services de transport des passagers et des bagages, ainsi que des services de dispatching et d'information.

VOUS RECONNAISSEZ QUE LA SOCIETE NE FOURNIT PAS DE SERVICES DE TRANSPORT OU NE FONCTIONNE PAS EN TANT QUE TRANSPORTEUR ET QUE TOUS CES SERVICES DE TRANSPORT SONT FOURNIS PAR DES TIERS — FOURNISSEURS DE SERVICES DE TRANSPORT, QUI NE SONT PAS EMPLOYÉS PAR LA SOCIETE OU L’UNE DE SES AFFILIES. LES RELATIONS ENTRE VOUS ET LES FOURNISSEURS DE SERVICES DE TRANSPORT EN CE QUI CONCERNE L’ACQUISITION DE SERVICES SONT RÉGIES PAR DES ACCORDS PERTINENTS ENTRE VOUS ET LE FOURNISSEUR DE SERVICES DE TRANSPORT, LA SOCIETE N’EST PAS PARTIE À CES ACCORDS.

1.9. Toutes les conversations de l’Utilisateur avec les spécialistes du service clientèle ainsi qu’avec les chauffeurs des partenaires du Service peuvent être enregistrées à des fins de contrôle de la qualité et de perfectionnement des services.

1.10. Par l'usage du Service, l'Utilisateur donne son accord pour la réception des messages publicitaires, y compris les e-mails et messages. L'Utilisateur a le droit de renoncer à la réception des messages publicitaires, en appliquant les fonctionnalités correspondantes du Service ou en suivant les indications du message publicitaire reçu.

 

2. Usage du Service. Certaines fonctionnalités du Service

2.1. Le Service est mis à disposition de l'Utilisateur pour l'usage personnel non commercial.

2.2. Les informations relatives aux services de transport des passagers et des bagages (ci-après — Informations) sont fournies par les tiers (les partenaires)— les fournisseurs de services de transport. La liste des partenaires est accessible depuis l'adresse https://yango.com/partners . Pour les informations détaillées relatives aux services fournis (y compris les informations relatives à la possibilité de connexion par wi-fi dans la voiture, à la réalisation par le partenaire du détenteur de droits de la vidéoprotection dans la voiture et autres informations) l'Utilisateur peut soit s'adresser aux partenaires du Service — les fournisseurs de services de transport, soit fournir ses cordonnées via une fonctionnalité du Service pour que les partenaires du Service puissent eux-mêmes contacter l'Utilisateur et lui fournir les informations relatives aux services offerts.

2.3. La Société n'engage pas la responsabilité pour le contenu et/ou pour l'actualité des informations fournies par les partenaires du Service, y compris pour les informations relatives aux prix des services des partenaires, ainsi que à leur disponibilité à un moment donné. L'interaction de l'Utilisateur avec les partenaires concernant l'acquisition des services est effectuée par l'Utilisateur lui-même (sans participation de La Société ), conformément aux règles de la prestation des services définies par les partenaires. La Société n'engage pas la responsabilité pour les opérations financières et pour toutes autres opérations effectué par l'Utilisateur et par les partenaires, ainsi que pour toutes les conséquences de l'acquisition des services des partenaires par l'Utilisateur.

2.4. L'Utilisateur peut avoir l'accès aux fonctionnalités de l'évaluation des services des Partenaires, ainsi que de la publication des commentaires/avis relatifs au Services et /ou aux services des partenaires. Les notes et les avis des utilisateurs sont publiés sur le site du Service et peuvent également être accessibles depuis les sites des tiers. La Société se réserve le droit de refuser la publication de tous notes/avis, ainsi que d'effacer/bloquer à tout moment la note/l'avis publiés par l'Utilisateur, à sa convenance et sans aucune explication.

2.5. La Société se réserve le droit de limiter, à sa convenance, l'accès de l'Utilisateur au Service (ou à de certaines fonctionnalités du Service, si cela est possible du point de vue technique) depuis son compte personnel ou de bloquer le compte personnel de l'Utilisateur pour les violations répétées des présentes Conditions ou appliquer d'autres mesures à l'Utilisateur dans le but du respect de la législation et des droits et intérêts légitimes des tiers.

2.6. Au cours des périodes où la demande de services de taxi est élevé (y compris les jours fériés, les jours des manifestations publiques et dans les autres cas), les tarifs des partenaires du Service peuvent être augmentés. La Société informe de l'augmentation des tarifs par la publication de la notification correspondante sur le site du Service https://yango.com ou par tout autre moyen à la convenance de La Société , y compris par l'envoi d'un message informationnel au numéro mobile ou dans l'application mobile de l'Utilisateur.

2.7. Les services de transport des passagers et des bagages selon les tarifs Économe, Confort, Affaires et selon les autres tarifs proposés par le Service sont fournis par les voitures de classes différentes. La répartition des voitures entre les classes est réalisée automatiquement en fonction des renseignements relatifs aux caractéristiques de la voiture fournis par les partenaires du Service.

2.8. Si le Service permet de commander des trajets à l'avance (ci-après, « trajets précommandés ») pour certains tarifs du Service, la commande sera disponible pour que le partenaire du Service la confirme près de l'heure spécifiée par l'Utilisateur dans la commande (pas moins de 30 minutes avant le début du trajet précommandé). Le coût du trajet précommandé sera calculé et indiqué dans le Service lors de la commande du trajet. Le prix peut changer dans les circonstances indiquées sur le site Web du Service https://yango.com.

2.9. Le fournisseur de services de transport fournisseur de services de transport facture la renonciation de l'Utilisateur à un trajet lorsque cette renonciation a eu lieu après l'arrivée de la voiture à l'endroit indiqué par l'Utilisateur. Ce montant est calculé de la même façon que le coût du trajet/service selon le tarif horaire du moment de l'arrivée de la voiture à l'endroit de départ ou du moment de l'arrivée indiqué dans les informations présentées à l'Utilisateur par le fournisseur de services de transport fournisseur de services de transport dans le cadre du service de transport commandé par l'Utilisateur/les Utilisateurs (selon la dernière éventualité) et au moment de la renonciation de l'Utilisateur au trajet/service. L'Utilisateur renonce au trajet/service, en envoyant une notification correspondante au fournisseur de services de transport fournisseur de services de transport via le Service. Il est considéré que l'Utilisateur qui n'a pas embarqué dans la voiture fournie par le fournisseur de services de transport fournisseur de services de transport au cours de dix (10) minutes, compte tenu du temps de l'attente non remboursable indiqué pour le tarif correspondant, a renoncé au trajet/service, sauf autres règles du fournisseur de services de transport fournisseur de services de transport correspondants ou sauf autres accords entre l'Utilisateur et le représentant (le conducteur) du fournisseur de services de transport fournisseur de services de transport. Le montant facturé dans le cas de la renonciation de l'Utilisateur au trajet de l'aéroport est calculé de la même façon qu'il est indiqué ci-dessus, avec la facturation du supplément pour le trajet hors de la ville, conformément au tarif.

2.10. L'Utilisateur donne son accord à La Société pour le traitement des informations personnelles (y compris des données personnels) de l'Utilisateur par La Société , pour le transfert des informations personnelles de l'Utilisateur par La Société aux partenaires de La Société , ainsi que pour le traitement des informations personnelles par les partenaires de La Société dans le but de la prestation des services à l'Utilisateur dans le cadre du Service. Lors de l'usage du Service par l'Utilisateur, les informations personnelles de l'Utilisateur sont transmises à la pour le traitement dans les conditions et dans les buts définis dans la Politique de confidentialité de la qui est accessible depuis l'adresse suivante : (https://yango.com/legal/yango_privacy_notice).

2.11. Si l’Utilisateur commande des services de livraison aux partenaires de La Société , il s’engage à ne pas remettre les objets suivants pour la livraison:

armes portatives de combat, à usage non militaire et celles de service, munitions, pièces détachées et composants, arcs et arbalètes de sport, armes conçues pour les signaux lumineux, fumigènes et sonores, armes électriques, dispositifs à électrochocs et à étincelles, armes tranchantes froides, matraques, poings américains, shurikens, verges, boomerangs et autres objets ajustés pour frapper, écraser, lancer, percer et couper à l’exception des équipements sportifs, des dispositifs techniques spéciaux à double usage et des composants;

stupéfiants, substances psychotropes, précurseurs et leurs analogues;

matières nucléaires, substances radioactives, remèdes actifs, substances agressives, explosives et inflammables, dispositifs d’allumage, substances pyrotechniques et articles connexes, et autres substances dangereuses;

poisons, animaux vénéneux, substances toxiques, plantes vénéneuses et semences de plantes vénéneuses;

fonds en devises nationales ou étrangères;

publications imprimées, matériels graphiques, films, photos, matériels audio et vidéo qui contiennent la propagande ou la promotion des changements violents du régime constitutionnel, de la destruction de la sécurité nationale, de la guerre, de la supériorité sociale, raciale, nationale, religieuse, de classe ou de clan, de la cruauté, de la violence ou de la pornographie;

denrées périssables sans emballage spécial;

objets et substances qui peuvent par leur nature ou en raison de l’emballage constituer un danger pour le public, contaminer ou endommager (détruire) d’autres charges, des gens entourant ou des objets;

animaux et végétaux, matériels biologiques;

objets qui doivent être transportés par des véhicules spécialement équipés, y compris les denrées alimentaires;

liquides dans des conteneurs ouverts;

convois exceptionnels dont la longueur, la largeur (deux diamètres ou axes à la base du rouleau) et l’hauteur totales (sous réserve d’exemptions spéciales) dépassent 150 cm; objets longs de plus de 150 cm; le poids des objets transférés ne doit pas dépasser 20 kg;

objets fragiles sans emballage spécial;

tout autre objet dont la distribution est interdite ou restreinte sur le territoire du pays de la prestation des services de livraison.

Les partenaires de la Société peuvent fixer d’autres restrictions sur les objets à livrer.

Les partenaires de la Société ne fournissent aucun service postal et n’acceptent aucun envoi postal (correspondance par lettre adressée, colis postaux, conteneurs, publications imprimées dans des emballages appropriés) pour la livraison.

En tant que représentant d’un partenaire de La Société , le Chauffeur peut préparer un bordereau d’expédition avec l’Utilisateur ou ils peuvent signer un accord pour n’établir aucun bordereau d’expédition.

L’Utilisateur est informé et reconnaît que, s’il ne satisfait pas aux exigences ci-dessus concernant les objets à livrer, l’Utilisateur est le seul responsable de tous les effets négatifs qui peuvent survenir pendant que le partenaire de La Société fournit des services de livraison. Dans le même temps, tout partenaire de La Société peut refuser de rendre les services de livraison à l’Utilisateur si le partenaire de La Société /les représentants du partenaire de La Société découvrent tout objet non livrable.

2.12. L'option « Partager » peut être disponible pour l'Utilisateur, selon laquelle le Service a le droit d'accepter une Commande du trajet d'un autre Utilisateur pendant le trajet et d'effectuer le transport de deux Utilisateurs dans le cadre de leurs Commandes simultanément dans un même véhicule. Lorsque l'Utilisateur place une Commande en utilisant l'option « Partager », l'Utilisateur confirme son accord avec les termes et restrictions de l'option spécifiée, y compris :

- le Service a le droit d'accepter la Commande d'un autre Utilisateur pendant le trajet, suite à laquelle il est possible de a) changer l'itinéraire du trajet afin d’effectuer la deuxième Commande, b) augmenter le temps du trajet précédemment calculé ;

- dans le cadre d'une commande unique utilisant l'option « Partager », un seul passager peut faire un trajet. Cela signifie que lorsque deux Commandes sont exécutées simultanément dans l'option « Partager », non plus de deux passagers peuvent se trouver dans le véhicule ;

- l'itinéraire du trajet lors de la présentation des Commandes est déterminé conformément aux algorithmes de la Service ou à la discrétion du Service.

Les partenaires du service peuvent imposer des restrictions supplémentaires, notamment sur les dimensions des bagages des passagers.

Les partenaires du Service ont le droit de refuser un voyage à l'Utilisateur si l'Utilisateur ne respecte pas les exigences établies.

 

3. Fonctionnalité de paiement du service de transport des passagers des bagages sans espèces

3.1. Le paiement du service de transport des passagers et des bagages fourni à l'Utilisateur conformément à l'information publiée par lui à l'aide du Service relative à la demande du service correspondant peut être effectué par l'Utilisateur de manière suivante :

3.1.1. Directement au fournisseur de services de transport fournisseur de services de transport (y compris en espèces ou par tous autres moyens définis par ledit fournisseur de services de transportfournisseur de services de transport (lorsqu'ils sont prévus), ci-après dans le texte des présentes Conditions et dans l'interface du Service — les Espèces). Le paiement par le moyen de paiement susmentionné est effectué sans participation de la Société et n'est pas régi par les présentes Conditions. Ledit mode de paiement peut être restreint pour les services de livraison (si cette fonction est disponible dans le pays de l’Utilisateur).

3.1.2. Si la fonctionnalité de paiement sans espèces via les Services est disponible dans le pays de l’Utilisateur, l’Utilisateur peut avoir accès à la fonctionnalité de paiement sans espèces avec une Carte bancaire attachée (paragraphe 3.2. des présentes Conditions) ; dans ce cas la Société agit de la part du fournisseur de services de transport fournisseur de services de transport correspondant ou sur une autre base (y compris directement) et fait intervenir le processeur de paiement agréé, le processeur de paiement électronique ou tout autre entité participant au règlement et est le bénéficiaire du paiement en qualité de l'agent du fournisseur de services de transport fournisseur de services de transport ou en toute autre qualité (y compris directement) (ci-après — le paiement sans espèces). La Société ne garantit pas l’absence d'erreurs et de défaut de fonctionnement du Service en ce qui concerne la possibilité du paiement sans espèces.

En fonction de la région de l'Utilisateur, le paiement sans espèces peut être effectué sans participation de La Société en qualité du bénéficiaire du paiement, ou avec intervention de La Société en qualité de l'entité tierce participant au règlement ou en qualité du participant de l'interaction informationnelle.

Le choix du moyen de paiement est effectué par l'Utilisateur dans l’interface du Service. Toutefois, dans le cas où il est impossible d'effectuer le paiement sans espèces pour toute raison que ce soit (y compris, mais sans s'y limiter, dans le cas d'inaccessibilité technique temporaire de cette fonctionnalité, d'impossibilité temporaire ou permanente d'effectuer le paiement sans espèces avec une Carte bancaire attachée, provision insuffisante sur la Carte bancaire attachée), l'Utilisateur s'engage à effectuer le paiement en Espèces.

Dans le cas du paiement sans espèces, il est possible d'effectuer une seule transaction pour le montant total correspondant au coût du service de transport des passagers et des bagages, ainsi que plusieurs transactions correspondant aux certaines parties du prix du service. Dans ce cas, le paiement peut être effectué par tout moyen susmentionné au cours du trajet/services ou après son achèvement.

Lors du paiement sans espèces, l'Utilisateur a la possibilité d'effectuer, à sa convenance, outre le paiement du service de transport des passagers et des bagages ou autre service, un paiement sans espèces complémentaire au bénéfice du service de taxi dont le montant est égal à un certain taux du coût du service de transport des passagers et des bagages payé (ci-après dans le texte des présentes Conditions et dans l'interface du Service — « Pourboire »).

3.2. La Carte bancaire attachée est identifiée dans l'interface du Service par l'Utilisateur qui fournit des données suivantes :

Si les données relatives à la carte bancaire sont exactes et valables, et si l'usage de cette carte dans le cadre du Service est possible du point de vue technique, la carte bancaire susmentionnée acquiert le statut de la Carte bancaire attaché et peut être utilisée pour le paiement sans espèces (paragraphe 3.1.2. des présentes Conditions). Toutes les Cartes attachées s'affichent dans l'interface du Service ; par souci de commodité de l'Utilisateur, 4 derniers chiffres du numéro de la Carte attachée sont affichés.

3.3. Lors de l'addition d'une Carte attachée, ainsi que dans le cas où la fonctionnalité de paiement sans espèces est choisi par l'Utilisateur pour un trajet/service, le prélèvement d'un montant limité à Euro 1,1 (ou d'un autre montant en devise de la région de l'Utilisateur) est effectué dans le but de vérifier l'exactitude et la validité des données de la Carte attachée ; dans le cas de la transaction réussie, le montant indiqué est remboursé à l'Utilisateur. La tentative échouée du prélèvement du montant indiqué signifie l'impossibilité d'adjonction de cette Carte attachée et/ou l'inaccessibilité de la fonctionnalité de paiement sans espèces.

3.4. Lors de l'adjonction de la Carte attachée, ainsi qu'à tout moment après son adjonction, l'Utilisateur a la possibilité de fixer et/ou de modifier le montant du Pourboire par défaut dans l'interface du Service; le montant du Pourboire pour un trajet/service concret peut être modifié par l’Utilisateur dans l’interface du Service après l’achèvement de ce trajet/service.

3.5. Le Pourboire (montant par défaut ou montant spécialement indiqué par l'Utilisateur pour un trajet/serviceconcret) sera prélevé sur la Carte attachée, si, au cours de 30 minutes après l'achèvement du trajet/service, l'Utilisateur donne une note positive au trajet (4 à 5 étoiles) et appuie le bouton « Terminé » ou s'il n'attribue aucune note au trajet/service (n'indique pas le nombre d'étoiles) et appuie le bouton « Terminé ».

3.6. Dans le cas où, au cours de 30 minutes après l'achèvement du trajet/service, l'Utilisateur donne une note négative au trajet (1 à 3 étoiles) et appuie le bouton « Terminé », le Pourboire ne sera pas prélevé sur la Carte attachée.

3.7. Dans le cas où, au cours de 30 minutes après l'achèvement du trajet, l'Utilisateur appuie le bouton « Terminé », le montant du Pourboire (montant par défaut ou montant indiqué par l'Utilisateur spécialement pour un trajet/service concret) sera bloqué sur la Carte attachée pendant 24 heures au cours desquelles l'Utilisateur a la possibilité de augmenter et de réduire le montant du Pourboire pour le trajet/service correspondant. Après l’achèvement de la période indiquée, le prélèvement du Pourboire est effectué dont le montant a été fixé par l’Utilisateur (par défaut ou pour le trajet/service concret).

3.8. Le paiement sans espèces est effectué par l'Utilisateur avec la participation du processeur de paiement agréé ou du processeur de paiement électronique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement.

3.9. Lors de l'indication de ses données conformément au paragraphe 3.2. des présentes Conditions et lors de l'usage ultérieur de la Carte attachée, l'Utilisateur confirme et garantit l'exactitude et l'exhaustivité des informations fournies relatives à la carte bancaire valable émise à son nom ; le respect par lui des règles des systèmes de paiements internationaux et des exigences de la banque émettrice de la Carte attachée, y compris en ce qui concerne les modalités de la réalisation des paiements sans espèces.

3.10. L'Utilisateur comprend et accepte que toutes les actions effectuées dans le cadre du Service avec l'utilisation du numéro mobile confirmé par lui, y compris en ce qui concerne le paiement sans espèces à l'aide de la Carte bancaire attachée sont réputées d'avoir été effectuées par l'Utilisateur.

3.11. Dans le cas du désaccord de l'Utilisateur avec le fait et/ou avec le montant du paiement sans numéraire et dans le cas des questions liées à l'usage de la Carte attachée dans le cadre du Service, l'Utilisateur a le droit de s'adresser à La Société par téléphone dont les numéros sont indiqués par le Service et/ou via l'interface du service assistance clients (formulaire de contact) dans le délai de 14 jours à compter de la date de réalisation du paiement sans espèces ou de la date des autres actions ou événements faisant l'objet de la demande.

Si, suite à la vérification d'une telle demande La Société prend la décision de remboursement intégral ou partiel du montant du paiement sans espèces, ce remboursement est effectué sur le compte bancaire de la carte bancaire qui a été utilisée pour le paiement sans espèces. Le remboursement des fonds est effectué avec la participation du processeur de paiement agréé ou du processeur de paiement électronique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement. Dans les cas où La Société ne participe pas aux règlements à l'aide de la Carte attachée, La Société peut intervenir en qualité de l'entité qui transmet les messages de l'Utilisateur concernant les questions susmentionnées aux services de transport, aux postes de dispatching ou à d'autres personnes qui sont bénéficiaires du paiement au titre des opérations susmentionnées liées à la Carte attachée.

3.12. La Société se réserve le droit d'exiger à tout moment la justification par l'Utilisateur des données indiquées par lui dans le cadre du Service, y compris des données de la Carte attachée et de demander pour cela de fournir des pièces justificatives (notamment, des pièces d'identité) dont le défaut de présentation peut, à la convenance de La Société , être considéré comme la présentation des informations inexactes et peut entrainer les conséquences prévues au paragraphe 2.5. des présentes Conditions.

3.13. Les dispositions indiquées à la présente section et relatives aux conditions et aux modalités du paiement du service de transport des passagers et des bagages ne sont pas applicables dans le cas où le paiement de ce service est effectué au nom de l'Utilisateur par une tierce partie en vertu d'un contrat spécial passé entre la Société et la tierce partie susmentionnée.

 

4. La législation applicable et le règlement des litiges

4.1. Les présentes Conditions d’utilisation de Yango et toutes les relations découlant de ou liées aux présentes Conditions sont régies et interprétées conformément à la législation des Pays-Bas sans application des dispositions sur les conflits de lois.

4.2. Tout litige découlant de ou en relation avec les présentes Conditions d’utilisation de Yango sera réglé par le tribunal compétent des Pays-Bas, sauf que les dispositions obligatoires sur les conflits de lois prévoient le contraire.

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Ridetech International B.V. (hereinafter referred to as Service Provider) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service).

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions.

1.4. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Service Provider made as prescribed by cl. 6 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Service Provider.

1.8. For the avoidance of doubt, Service Provider does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services or other services, including delivery services (hereinafter referred to as the Information) is provided by partners of the Service. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Service Provider's partner, and other information), the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Service Provider shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Service Provider) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Service Provider shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Service Provider reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Service Provider reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for taxi or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Service Provider informs of higher tariffs by posting the relevant notice on the Service website or otherwise as Service Provider thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Passenger and baggage transportation services as per Economy, Comfort, Business, and other tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.

2.9. A taxi provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the taxi provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the taxi provider via the Service. A User that has not boarded a vehicle served by the taxi provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant taxi provider's rules or agreements between the User and a representative (driver) of the taxi provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.10. The User authorizes Service Provider to process personal information (including personal details) of the User , to transfer personal information of the User to Service Provider ’s partners, and to process personal information for partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.11. If the User orders delivery services from Service Provider’s partners, he or she undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Service Provider’s partners may set other limits on items to be delivered.

The Service Provider’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.

The Driver, acting as a representative of the Service Provider’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Service Provider ’s partner provide delivery services. At the same time, a Service Provider’s partner may deny delivery services to the User, if the Service Provider ’s partner/ representatives of the Service Provider’s partner discover any non-deliverable items.

3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services, including delivery services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a taxi provider (inter alia, by cash or by any other means stipulated by the said taxi provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Service Providerbeing involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Service Provider acts in the name of the relevant taxi provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the taxi provider or otherwise (including directly) (hereinafter referred to as cashless payments). Service Provider does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Service Provider acting as a payment recipient or with Service Provider involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the taxi provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to Euro 1,1 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Service Provider by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Service Provider decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Service Provider is not a party to settlements made via the Linked Card, Service Provider can act as a body that transfers above user requests to taxi providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Service Provider reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Service Provider thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract Service Provider signed with such third party.

4. Terms and restrictions of marketing benefits and campaigns

The terms and restrictions presented in connection with advertisements and campaigns of Yango are always applied to such advertisements and campaigns. Additionally, to each advertisement or campaign are applied the terms and restrictions concerning it, presented in address https://yango.com/legal/fi.

5. "Joint Account" function

5.1 The User has the possibility to create a joint account in the Yango application, i.e. the possibility to use the service from a joint account with several users and to pay for the transport of passengers and luggage or other services with the debit card of the user who created the joint account.

5.2. to create a joint account, the user must specify the following information:

  • User phone number;
  • Email address;
  • Telephone numbers of joint account members (additional users);
  • Stored bank card details.

The user may specify other information if necessary.

5.3. under the "Joint Account" function, the user is given the opportunity to create the following joint accounts:

5.3.1. family account;

5.3.2. business account.

5.4. a family account can have up to four (4) users.

5.5. a business account may have up to 20 (twenty) users. Additional functions and services may be offered to the user for a fee.

5.6.in order to use the" Joint Account " function, account members whose phone numbers have been assigned by the user in accordance with Section 5.2 of these Terms (additional users) shall install the Yango application.

5.7. when a member (additional user) is placing an order for a passenger and baggage transport service, the member must indicate in the service that the use of the service (payment method) will be made by means of the "Joint Account" function.

5.8. the User undertakes to familiarise the members of the joint account with the terms of use of the "Joint Account" function and to obtain the consent of the participants to receive technical and other messages required to use the "Joint Account" function.

5.9. the user accepts and is responsible for all costs of additional user travel. Additional users refer to members whose phone numbers are assigned by the user to the Joint Account.

6. Service Provider may, at any time without notice to the User, amend provisions hereof, and may, at any time without notice to the User, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

Terms of Use of Yango

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Ridetech International B.V.(hereinafter referred to as Yango) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service).

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms the User may not use the Service. Rules of Referral Programme for users for Norway are posted at https://yango.com/legal/no_referral.

1.4. Yango may, at any time without notice to the User, amend provisions hereof, and may, at any time amend provisions of the Regulatory Documents with notifying the User by posting the relevant notice in the “Yango” mobile application. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Yango made as prescribed by cl. 1.4 hereof.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if such services are available in your country/region), look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

1.8. For the avoidance of doubt, Yango does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.

1.9. All conversations the User holds with the support team and drivers of partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

1.11. By using our services (including using our app or creating a user account), you are confirming that you are 18 years or older and have the required legal capacity to enter into binding contracts. You may not authorise third parties to use your user account, and you may not allow persons under the age of 18 to receive transportation, logistics, delivery or vendor services from Third Party Providers unless they are accompanied by you.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on passenger and baggage transportation services or other services, including delivery services (hereinafter referred to as the Information) is provided by partners of the Service. The list of partners is available at online. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Yango's partner, and other information), the User may contact the partners of the Service or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. Yango shall not be held liable for the content and/or relevance of information provided by the partners of the Service, including information on the cost and current availability of the partners’ benefits. The User shall independently (without the participation of Yango) discuss the acquisition of services with the partners in accordance with the partners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the partners and for any consequences of the acquisition of the partners’ services by the User.

2.4. The User may access functions of rating the services of the Service partners and commenting / leaving feedback on the Service and/or services of the Service partners. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Yango reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Yango reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for taxi or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Yango informs of higher tariffs by posting the relevant notice on the Service website website or otherwise as Yango thinks fit, inter alia, by sending an information message to the User’s mobile phone number.

2.7. Passenger and baggage transportation services as per Economy, Electric, and other tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website website.

2.9. A taxi provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the taxi provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the taxi provider via the Service. A User that has not boarded a vehicle served by the taxi provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant taxi provider's rules or agreements between the User and a representative (driver) of the taxi provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.10. The User authorizes Yango to process personal information (including personal details) of the User of Yango, to transfer personal information of the User to Yango’s partners, and to process personal information for Yango’s partners to provide services to the User in the Service. When the User turns to the Service, their personal information is transmitted to to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.11. If the User orders delivery services from Yango’s partners (if such services are available in the country/region), he or she undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable food without special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of country of delivery service provision.

The Yango’s partners may set other limits on items to be delivered.

The Yango’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.

The Driver, acting as a representative of the Yango’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Yango’s partner provide delivery services. At the same time, a Yango‘s partner may deny delivery services to the User, if the Yango’s partner/ representatives of the Yango’s partner discover any non-deliverable items.

 

3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services, including delivery services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a taxi provider (inter alia, by cash or by any other means stipulated by the said taxi provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Yango being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services.

3.1.2. The User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Yango acts in the name of the relevant taxi provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the taxi provider or otherwise (including directly) (hereinafter referred to as cashless payments). Yango does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation or other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.

The User selects the appropriate form of payment in the Service interface. If the User chooses a non-cash form of payment, payment to the Taxi Service in Cash or otherwise directly to the Driver's address, without additional notification toby changing the payment method in the Service interface (if there is an appropriate opportunity), is not allowed. Debiting of funds from the Linked card is recognized as correct and corresponding to the payment method chosen by the User, no refund is made by canceling the debiting.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the taxi provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to NOK 1 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Yango by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Yango decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Yango is not a party to settlements made via the Linked Card, Yango can transfer user’s requests to taxi providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Yango reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Yango thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract Yango signed with such third party.

3.14. Governing law

These Terms and any non-contractual obligations arising out of or in connection with the Terms shall be governed by and construed in accordance with law of the Netherlands.

1.3. Ved å begynne å bruke tjenesten / dens individuelle funksjoner, anses brukeren for å ha akseptert disse vilkårene i sin helhet, uten forbehold eller unntak. Yango har rett til å endre bestemmelsene i disse vilkårene når som helst kan du endre bestemmelsene i forskriftsdokumentene med å varsle brukeren ved å legge ut den relevante varselet i "Yango" mobilapplikasjonen, og har rett til å endre vilkårene i regelverket når som helst uten å varsle brukeren. Den nåværende versjonen av disse vilkårene er tilgjengelig

online. Brukeren bærer risikoen for ikke å bli kjent med den nye versjonen av vilkårene og forskriftsdokumentene. Fortsatt bruk av tjenesten etter endring av vilkårene eller forskriftsdokumentene anses å være i samsvar med deres nye utgave.

1.5. Hvis Yango har gjort noen endringer i disse vilkårene, på den måten som er angitt i punkt 1.4. av disse vilkårene, som brukeren ikke er enig med, er han forpliktet til å slutte å bruke tjenesten.

1.6. Tjenesten gir brukeren muligheten til å legge ut gratis informasjon om brukerens potensielle etterspørsel etter tjenester for transport av passasjerer og bagasje eller andre tjenester, inkludert leveringstjenester (hvis slike tjenester er tilgjengelige i ditt land / din region), samt muligheten til å bli kjent med informasjon om tilbudene fra organisasjoner som tilbyr tjenester i disse områdene og søker etter slike tilbud for de gitte tilpassede parametrene. Alle de nåværende funksjonene til tjenesten, samt enhver utvikling av dem og (eller) tillegg av nye, er gjenstand for disse vilkårene.

1.7. Avhengig av regionen til brukeren, kan alle eller noen av funksjonene til tjenesten være utilgjengelige eller begrensede. Funksjonene anses å være utilgjengelige (begrensede) for en bruker fra en bestemt region hvis en slik bruker ikke eksplisitt kan bruke dem. Bruk av tekniske eller programvaremetoder for å omgå disse begrensningene er forbudt. Bestemmelsene i disse vilkårene som regulerer funksjonene til tjenesten som ikke er tilgjengelige (begrensede) for brukeren, gjelder til slike funksjoner å bli eksplisitt tilgjengelige for brukeren. Informasjon om tilgjengeligheten av tjenestens funksjoner i en bestemt region blir gitt til brukeren etter forespørsel sendt til Yango.

1.8. For å unngå tvil tilbyr Yango ingen passasjerer, bagasje eller andre tjenester, inkludert leveringstjenester eller henvisningstjenester.

1.9. Alle forhandlinger som brukeren fører med støttetjenesten og driverne til tjenestepartnerne kan registreres for å kontrollere kvaliteten og forbedre tjenestene.

1.10. Ved å bruke tjenesten godtar brukeren å motta reklamemeldinger. Brukeren har rett til å nekte å motta reklamemeldinger ved å bruke passende funksjonalitet i tjenesten eller ved å følge instruksjonene spesifisert i den mottatte reklamemeldingen.

1.11. Ved å bruke våre tjenester (herunder bruk av appen vår eller å opprette en brukerkonto), bekrefter du at du er minst 18 år gammel og myndig til å inngå bindende avtaler. Du kan ikke autorisere tredjeparter til å bruke din brukerkonto, og du kan ikke tillate personer under 18 år å motta transport- eller logistikktjenester fra tredjepartsleverandører med mindre de er i følge med deg.

 

2. Bruk av tjenesten. Separate funksjoner i tjenesten

2.1. Tjenesten leveres til brukeren for personlig ikke-kommersiell bruk.

2.2. Informasjon om tjenester for transport av passasjerer og bagasje eller andre tjenester, inkludert leveringstjenester (heretter kalt "informasjonen"), blir gitt av tjenestepartnerne. En liste over partnere er tilgjengelig online . For mer informasjon om tjenestene som tilbys (inkludert informasjon om tilgjengeligheten av Wi-Fi-tilgangspunkt i kabinen, partnerens implementeringav foto- / videofiksering i kabinen og annen informasjon) brukeren kan enten henvise til tjenestepartnerne eller ved å bruke tjenestefunksjonalitet, gi deres kontaktinformasjon, hvor partnerne i tjenesten vil være i stand til å uavhengig kontakte brukeren og gi ham informasjon om tjenestene som tilbys.

2.3. Yango er ikke ansvarlig for innholdet og (eller) relevansen av informasjon gitt av tjenestepartnere, inkludert informasjon om kostnadene for partnertjenester, samt deres tilgjengeligheten for øyeblikket. Interaksjonen mellom brukeren og partnere ved kjøp av tjenester utføres av brukeren uavhengig (uten deltakelse av Yango) i samsvar med reglene for levering av tjenester som er vedtatt av partnerne. Yango er ikke ansvarlig for økonomiske og andre transaksjoner som er utført av brukeren og partnere, samt for eventuelle konsekvenser av brukerens anskaffelse av tjenestene fra partnere.

2.4. Brukeren kan ha tilgang til funksjonene for å evaluere tjenestene til tjenestepartnerne, samt legge ut kommentarer / anmeldelser om tjenesten og (eller) tjenestene til partnerne tiltjenesten. Brukervurderinger og anmeldelser er lagt ut på tjenestens nettsted, og kan også være tilgjengelig på tredjeparts nettsteder. Yango forbeholder seg retten til å nekte å legge ut evalueringer / anmeldelser, samt når som helst å fjerne / blokkere plassering av evalueringer / anmeldelser, etter eget skjønn og uten å oppgi noen grunn.

2.5. Yango forbeholder seg retten til, etter eget skjønn, å begrense brukerens tilgang til tjenesten (eller til visse funksjoner i tjenesten, hvis det er teknisk mulig) ved å bruke kontoen hans eller helt blokkere brukerens konto i tilfelle av gjentatt brudd på disse vilkårene, eller gjelde andre tiltak for brukeren for å overholde kravene i loven eller rettighetene og legitime interessene til tredjeparter.

2.6. I perioder med økt etterspørsel etter drosjetjenester eller andre tjenester (inkludert på dager før ferien, på dager med offentlige arrangementer og i andre tilfeller), kan prisene til partnerne i tjenesten økes. Yango informerer om økningen i tariffer ved å legge ut et varsel på tjenestens nettsted eller på annen måte etter Yangos skjønn, inkludert å sende brukeren en informasjonsmelding til mobiltelefonnummeret.

2.7. Tjenester for transport av passasjerer og bagasje til “Økonom”, “Elektromobil” og andre priser som presenteres på tjenesten utføres av forskjellige bilklasser. Tildelingen av en bil til en bestemt klasse utføres automatisk på grunnlag av data om bilens egenskaper som leveres av partnerne til tjenesten.

2.8. Hvis tjenesten støtter forhåndsbestilling av turer (heretter kalt "forhåndsbestilte turer") til bestemte priser for tjenesten, vil bestillingen være tilgjengelig for bekreftelse av tjenestepartneren nærmere den tid som er angitt av brukeren i bestillingen (tidligst 30 minutter før starten på den forhåndsbestilte turen). Kostnaden for en forhåndsbestilt tur vil bli beregnet og angitt i tjenesten når du bestiller en tur. Prisen kan endres under de omstendighetene som er spesifisert på tjenestens nettsted nettsted .

2.9. Drosjetjenesten tar et gebyr for brukerens nektelse av å reise, hvis et slikt avslag skjedde etter at bilen ble levert til stedet som ble utpekt av brukeren. Beløpet for et slikt gebyr beregnes på samme måte som kostnaden for turen / tjenesten i tariffen for tiden fra det øyeblikket bilen faktisk ble levert til leveringsstedet eller fra innsendingsøyeblikket spesifisert i informasjonen gitt til brukeren fra drosjetjenesteni forhold til pakketransporttjenesten bestilt av brukeren / brukerne (avhengig av om hva kom senere), til brukeren nekter å reise / motta en tjeneste. Brukeren kansellerer turen / tjenesten ved å sende et passende varsel til drosjetjenesten gjennom tjenesten. En bruker som ikke går om bord i en bil som betjenes av en drosjetjeneste innen 10 (ti) minutter, med tanke på den gratis ventetiden som er spesifisert i den tilsvarende taksten, anses å ha nektet turen / tjenesten, med mindre annet er bestemt i reglene for den tilsvarende drosjetjenesten, eller etter avtaler mellom brukeren og representanten (sjåføren) for drosjetjenesten. Gebyret for brukerens avslag på å reise fra flyplassen beregnes på den måten som er angitt ovenfor, med innkreving av et tilleggsgebyr for å kjøre bil ut av byen i henhold til tariffen.

2.10. Brukeren gir Yango samtykke til behandling av personlig informasjon (inkludert personopplysninger) til brukeren av Yango, til Yangos overføring av brukerens personlige informasjon til Yango-partnere, samt til behandling av personlig informasjon til Yango-partnere for formål å gi brukeren tjenester innen tjenesten. Når brukeren bruker tjenesten, overføres brukerens personlige informasjon til, for behandling på vilkårene og for de formål som er spesifisert i personvernregler, tilgjengelig for gjennomgang på: (https://yango.com/legal/yango_privacy_notice).

2.11. Hvis brukeren bestiller leveringstjenester fra Yango-partnere (hvis slike tjenester er tilgjengelige i landet/regionen), forplikter han seg til ikke å overføre følgende varer for levering:

  • krigsvåpen, skytevåpen,håndvåpen, sivile våpen og tjenestevåpen, ammunisjon, reservedeler og komponenter til dem, buer og armbrønner for sport, våpen designet for å levere lys-, røyk- og lydsignaler, elektriske våpen, elektrosjokkutstyr og gnistgap, kniver og blankvåpen, morgenstjerner, knokejern, kastestjerner, bumeranger og andre gjenstander tilpassede for støtknusing, skjæring, kasting, stikkvåpen, med unntak av sportsutstyr, spesielle tekniske midler for dobbelt bruk og tilbehør til dem;
  • narkotiske stoffer, psykotrope stoffer, forløpere og deres analoger;
  • kjernefysiske materialer, radioaktive, sterke, kaustiske, eksplosive og brennbare stoffer, eksplosiver, pyrotekniske stoffer og produkter med deres bruk og andre farlige stoffer;
  • gift, giftige dyr, giftige stoffer, giftige planter og frø av giftige planter;
  • nasjonal valuta og utenlandsk valuta;
  • trykte publikasjoner, visuelt materiale, film-, foto-, lyd- og videomateriale som inneholder propaganda eller agitasjon for voldelig endring av den konstitusjonelle ordenen, som undergraver statens sikkerhet, sosial, nasjonal, religiøs, krig-, rase-, klasse- og stammeoverlegenhet, grusomhet, vold og pornografi;
  • forgjengelige matvarer uten spesiell emballasje;
  • gjenstander og stoffer som av natur eller på grunn av emballasjen kan utgjøre en fare for mennesker, forurense eller ødelegge (skade) andre varer, mennesker eller gjenstander rundt dem;
  • dyr og planter, biologiske materialer;
  • gjenstander som krever spesialutstyrte kjøretøyer for transport, inkludert matvarer;
  • væsker i åpne beholdere;
  • brede laster, hvor summen av målene (bortsett fra spesiallagde tilfeller) i lengde, bredde (to diametre eller akser i bunnen av rullen) og høyden overstiger 150 cm, lange gjenstander, hvis lengde er mer enn 150 cm; vekten av de overførte varene kan ikke overstige 20 kg;
  • skjøre gjenstander uten spesiell emballasje;
  • andre gjenstander, hvis distribusjon er forbudt eller begrenset på leveringstjenestens territorium.

Yango-partnere kan ha andre begrensninger på fraktvarer.

Yango-partnere tilbyr ikke posttjenester og godtar ikke postforsendelser for levering (adressert korrespondanse, postpakker, konteinere, trykte publikasjoner i passende emballasje).

Sjåføren, som opptrer som representant for Yango-partneren, kan utarbeide et konnossement som skal leveres til brukeren, eller de kan bli enige om ikke å signere konnossementet.

Brukeren er klar over og bekrefter at i tilfelle av manglende overholdelse av kravene ovenfor for varene som overføres for levering, er han eneansvarlig og alle negative konsekvenser som kan oppstå i ferd med å levere leveringstjenester fra Yango-partnere. I dette tilfellet har Yango-partneren rett til å nekte brukeren å levere leveringstjenesten hvis Yango-partneren / representantene for Yango-partneren oppdager varer som ikke kan leveres.

 

3. Funksjon av ikke-kontant betaling for tjenester av transport av passasjerer og bagasje og andre tjenester, inkludert leveringstjenester

3.1. Betaling av tjenester for transport av passasjerer og bagasje levert til brukeren i samsvar med informasjonen som er lagt ut av ham ved hjelp av tjenesten om den potensielle etterspørselen etter den tilsvarende tjenesten, kan gjøres av brukeren:

3.1.1. Direkte til drosjetjenesten (inkludert i kontanter eller på andre måter levert av den angitte drosjetjenesten, hvis noen, heretter referert til som disse vilkårene og i tjenestegrensesnittet kalt "kontanter"). Den spesifiserte betalingstypen utføres uten deltagelse av Yango og er ikke underlagt fra disse vilkårene. Den spesifiserte betalingstypen kan bare være tilgjengelig for leveringstjenester.

3.1.2. Brukeren kan ha tilgang til funksjonen ikke-kontant betaling fra det tilknyttede bankkortet (klausul 3.2 i disse vilkårene); i dette tilfellet handler Yango på vegne av den aktuelle drosjetjenesten eller på annen måte (inkludert direkte), med involvering av en autorisert betalingsoperatør, elektronisk pengeoperatør eller annen oppgjørsdeltaker, og er betalingsmottaker som agent for drosjetjenesten, eller på annen måte (inkludert direkte) (heretter kalt "ikke-kontant betaling"). Yango garanterer ikke fravær av feil og svikt i driften av tjenesten i forhold til tilbudet om muligheten for ikke-kontant betaling.

Avhengig av brukerregionen, kan ikke-kontant betaling utføres uten Yango som betalingsmottaker, eller med involvering av Yango som en annen deltaker i oppgjør eller en deltaker i informasjonsinteraksjon.

Valget av riktig betalingsmåte foretas av brukeren i grensesnittet til tjenesten. I dette tilfellet, hvis det av en eller annen grunn er umulig å foreta ikke-kontante betalinger (inkludert, men ikke begrenset til, den midlertidige tekniske utilgjengeligheten av denne funksjonen, den midlertidige eller permanente manglende evne til ikke-kontant betaling med det tilknyttede kortet, mangel på midler på det tilknyttede kortet) brukeren er forpliktet til å betale kontant.

Med ikke-kontant betaling er det mulig å utføre både en transaksjon for full kostnad for tjenesten for transport av passasjerer og bagasje eller andre tjenester, samt flere transaksjoner for separate deler av kostnaden for tjenesten. Samtidig kan ikke-kontant betaling gjøres på en av de angitte måtene under turen / levering av tjenesten, eller når den er fullført.

Valget av riktig betalingsmåte foretas av brukeren i grensesnittet til tjenesten. Hvis brukeren velger en ikke-kontant betalingsmåte, er ikke betaling til drosjetjenesten i kontanter eller på annen måte direkte til sjåføren, uten ytterligere varsel til Yango, ved å endre betalingsmåten i tjenestegrensesnittet (hvis mulig). Uttak av midler fra Yango fra det tilknyttede kortet anerkjennes som riktig og tilsvarer betalingsmåten valgt av brukeren; refusjon ved å kansellere uttaket gjøres ikke.

Ved ikke-kontant betaling, i tillegg til å betale for passasjer- og bagasjetransporttjenesten eller annen tjeneste, har brukeren muligheten til, etter eget skjønn, å foreta en ekstra ikke-kontant betaling til fordel for drosjetjenesten i prosent av kostnaden for den betalte passasjer- og bagasjetransporttjenesten eller annen tjeneste (heretter referert til i vilkårene og tjenestegrensesnittet som "tips").

3.2. Det tilknyttede bankkortet er angitt av brukeren i grensesnittet til tjenesten, mens brukeren spesifiserer følgende data:

  • bankkort nummer;
  • langsiktige tiltak;
  • sikkerhetskode.

Hvis bankkortopplysningene er korrekte og gyldige og bruken av dette kortet i tjenesten er teknisk mulig, får det spesifiserte bankkortet den tilknyttede statusen og kan brukes til ikke-kontant betaling (punkt 3.1.2 i disse vilkårene). Alle tilknyttede kort vises i tjenestegrensesnittet; for å gjøre det lettere for brukeren, vises de siste 4 sifrene i det tilknyttede kortnummeret i forhold til det tilknyttede kortet.

3.3. Når du legger til det tilknyttede kortet, samt hvis brukeren velger funksjonen ikke-kontant betaling for en bestemt tur / tjeneste, belastes et beløp innen 1 norsk krone (NOK) (eller et annet beløp i valutaen til brukerens region), som er nødvendig for å bekrefte nøyaktigheten og gyldigheten av dataene for det tilknyttede kortet; i tilfelle av vellykket gjennomføring av transaksjonen, blir det angitte beløpet returnert til brukeren. Et mislykket forsøk på å avskrive det angitte beløpet betyr umuligheten av å legge til henholdsvis dette tilknyttede kortet og (eller) utilgjengeligheten av den kontantløse betalingsfunksjonen.

3.4. Når du legger til det tilknyttede kortet, så vel som når som helst etter at det er lagt til, har brukeren muligheten til å angi og (eller) endre standard tipsstørrelse gjennom tjenestegrensesnittet; mengden tips for en bestemt tur / tjeneste kan endres av brukeren i tjenestegrensesnittet etter at turen / tjenesten er fullført.

3.5. Tips (i standardbeløpet eller i det beløpet som spesifikt er spesifisert av brukeren for en bestemt tur / tjeneste) vil bli belastet fra det tilknyttede kortet hvis brukeren har angitt en positiv turvurdering (4-5 stjerner) i tjenestegrensesnittet innen 30 minutter etter å ha fullført turen / tjenesten og klikket på "Fullfør"-knappen eller ikke indikert verken en positiv eller negativ vurdering for turen / tjenesten (angav ikke antall stjerner) og klikket på "Fullfør"-knappen.

3.6. Hvis brukeren innen 30 minutter etter slutten av turen / levering av tjenesten, angav i grensesnittet til tjenesten en negativ vurdering for turen / tjenesten (1-3 stjerner) og klikket på "Fullfør"-knappen, tips blir ikke belastet fra det tilknyttede kortet.

3.7. Hvis brukeren ikke klikker på "Fullfør"-knappen innen 30 minutter etter slutten av turen / tjenesten, vil mengden tips (i standardbeløpet eller i det beløpet som er spesifisert spesifikt av brukeren for en bestemt tur / tjeneste) bli være sperret på det tilknyttede kortet i en periode på 24 timer, der brukeren er i stand til å endre størrelsen tips av turen / tjenestene - større eller mindre. Etter at den angitte tiden har gått, belastes tips til det beløpet som er angitt av brukeren (som standard eller for denne spesielle turen / tjenesten).

3.8. Ikke-kontant betaling av brukeren utføres med deltagelse av en autorisert operatør for å akseptere betalinger eller en operatør av elektroniske penger og er underlagt reglene i internasjonale betalingssystemer, banker (inkludert den utstedende banken til det tilknyttede kortet) og annet oppgjørsdeltakere.

3.9. Når han spesifiserer sine data i samsvar med punkt 3.2 i disse vilkårene og videre bruk av det tilknyttede kortet, bekrefter og garanterer brukeren at han har gitt nøyaktig og fullstendig informasjon om et gyldig bankkort utstedt i hans navn; overholdelse av reglene for internasjonale betalingssystemer og kravene til den utstedende banken som utstedte det tilknyttede kortet, inkludert med hensyn til prosedyren for gjennomføring av ikke-kontante betalinger.

3.10. Brukeren forstår og godtar at alle handlinger som utføres i tjenesten ved bruk av mobiltelefonnummeret som er bekreftet av ham, inkludert ikke-kontant betaling med det tilknyttede bankkortet, anses å være som begått av brukeren.

3.11. Hvis brukeren er uenig i faktum og (eller) mengden ikke-kontant betaling og andre problemer knyttet til bruken av det tilknyttede kortet i tjenesten, har brukeren rett til å kontakte Yango på telefonnumrene som er angitt av tjenesten og (eller) via støttegrensesnittet (tilbakemelding) innen 14 dager fra datoen for ikke-kontant betaling eller andre handlinger eller hendelser som forårsaket forespørselen.

Hvis Yango bestemmer seg for å returnere beløpet for ikke-kontant betaling helt eller delvis, basert på resultatene av verifisering av en slik forespørsel, blir den spesifiserte returnering gjort til bankkontoen av bankkortet som ikke-kontant betaling ble gjort for. Fremgangsmåten for tilbakebetaling av midler utføres med deltagelse av en autorisert operatør for å akseptere betalinger eller en operatør av elektroniske penger og er underlagt reglene i internasjonale betalingssystemer, banker (inkludert den utstedende banken til det tilknyttede kortet) og andre deltakere i oppgjøret. I tilfeller der Yango ikke er part i oppgjør med det tilknyttede kortet, Yango kan overføre brukerens forespørsler opptre som en person som overfører brukernes forespørsler om ovennevnte spørsmål til drosjetjenester, utsendere eller en annen person som er mottaker av betaling for ovennevnte operasjoner med det tilknyttede kortet.

3.12. Yango forbeholder seg retten til når som helst å kreve fra brukeren bekreftelse av dataene som er spesifisert av ham i tjenesten, inkludert dataene fra det tilknyttede kortet, og i denne forbindelse å be om støttedokumenter (spesielt identifikasjonsdokumenter), manglende oppgave som, etter eget skjønn, Yango kan sidestilles med å gi falsk informasjon og medføre konsekvensene angitt i punkt 2.5 i disse vilkårene.

3.13. Bestemmelsene spesifisert i dette avsnittet om vilkår og framgangsmåte for betaling for transport av passasjerer og bagasje eller andre tjenester, inkludert leveringstjenester, gjelder ikke dersom betaling for slik transport eller andre tjenester blir gjort for brukeren av en tredjepart på vilkårene i en egen avtale inngått av Yango med en slik tredjepart.

3.14. Gjeldende lov

Disse vilkårene og eventuelle ikke-kontraktsmessige forpliktelser som oppstår fra eller som følge av vilkårene skal styres av og tolkes i samsvar med lovgivningen i Nederland.

Hvis du har krav på tjenesten, kan du kontakte oss på support@yango.com. Hvis vi ikke finner en tilfredsstillende løsning, kan du, underlagt vilkårene, bruke den online tvisteløsningsfasiliteten til EU-kommisjonen http://ec.europa.eu/odri forhold til kravet ditt.

 

5. Vilkår og begrensninger for markedsføringsfordeler og kampanjer

Vilkårene og begrensningene som presenteres i forbindelse med annonser og kampanjer fra Yango, brukes alltid på slike annonser og kampanjer. I tillegg til hver annonse eller kampanje blir vilkårene og begrensningene knyttet til den presentert på adressen https://yango.com/legal/no.

Terms of Use of Yango

 

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of MLU Europe B.V. (hereinafter referred to as Company) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service) in Senegal.

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of regulatory documents -License to Use Search Engine and Privacy Policy (hereinafter referred to as Regulatory Documents), in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service. Rules of Referral Programme for users are posted at https://yango.com/legal/se.

1.4. The Company may, after prior notice and consent from the User, amend provisions hereof, and may, under the same conditions, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_termsofuse. The Company can provide the User with a translation of this Terms from English into other languages. However, in the event of a conflict between the Terms in English and its translation, only the English version of the Terms shall be legally binding.

1.5. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms made as prescribed by cl. 1.4 hereof. In accordance to article 31 of Law 2021-25 on prices and consumer protection, the User is informed that he has a period of seven (07) days from the date of subscription to the Service to exercise his right of withdrawal, without penalty, charge and without any reason by request to the Company. The request must be sent before the expiration of the withdrawal period. The User who has exercised his right of withdrawal from a contract for the provision of services which performance has begun shall pay the Company an amount corresponding to the service provided and proportionate to the total price of the service.

Without prejudice to the provisions of the above clause hereto, the User can withdraw from these Terms at any time by deleting the Program from the memory of the User’s mobile device.

1.6. The Service enables the User to place information, free of charge, on the User’s potential demand for passenger and baggage transportation services or other services, including delivery services (if available in the country via Services) of available transportation providers, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.

1.7. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.

1.8. For the avoidance of doubt, the Company does not provide passenger and baggage transportation services or other services, including delivery services, and help desk services.

1.9. All conversations the User holds with the support team and drivers of transportation providers - partners of the Service can be recorded to control quality and improve services.

1.10. By using the Service, the User consents to receive promotional messages including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

 

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use, free of charge

2.2. Information on passenger and baggage transportation services or other services (hereinafter referred to as the Information) is provided by third parties (partners)- transportation providers. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the Company's partner, and other information), the User may contact the partners of the Service - transportation providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide their with information about the services offered.

2.3. The Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service - transportation providers, including information on the cost and current availability of the transportation providers’ benefits. The User shall independently (without the participation of the Company) discuss the acquisition of services with the transportation providers in accordance with the partners’ rules on the provision of services. The Company shall not be held liable for financial and any other transactions effected by the User and the transportation providers and for any consequences of the acquisition of the transportation providers’ services by the User.

2.4. The User may access functions of rating the services of the Service partners - transportation providers and commenting / leaving feedback on the Service and/or services of the transportation providers. Users ratings and feedback are posted on the Service website and can be available on third-party websites. The Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. The Company reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for transportation or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. The Company informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as the Company thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.

2.7. Passenger and baggage transportation services as per tariffs available in the Service are rendered by different types of vehicles. Vehicles are ranked automatically based on vehicle performance data provided by the partners of the Service.

2.8. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.

2.9. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.10. The User authorizes the Company to process personal information (including personal details) of the User of Service (Yango), to transfer personal information of the User to Company’s partners (transportation providers), and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, his/her personal information is transmitted to to be processed under the terms and for the purposes determined in the Privacy Policy of available at: (https://yango.com/legal/yango_privacy_notice).

2.11. If the User orders delivery services from the Company’s partners, he or she undertakes not to hand over for the delivery the following items:

  • hand-held combat, non-military and service weapons, ammunition, spare parts and components, sports bows and crossbows, weapons designed for light, smoke and sound signals, electric weapons, electroshock devices and spark dischargers, cold bladed weapons, bludgeons, knuckle-dusters, shurikens, twigs, boomerangs and other adjusted items for striking, smashing, throwing, piercing, and cutting except for sporting equipment, special technical dual-use devices and components;
  • narcotic drugs, psychotropic substances, precursors and their analogs;
  • nuclear materials, radioactive, superpotent, caustic, explosive and flammable substances, firing agents, pyrotechnic substances and related items, and other hazardous substances;
  • poisons, poisonous animals, poisonous substances, poisonous plants and seeds of poisonous plants;
  • the national currency and foreign currency;
  • printed publications, graphic materials, film, photo, audio and video materials containing propaganda for or promotion of violent changes of the constitutional order, destruction of national security, war, social, racial, national, religious, class and clan superiority, cruelty, violence, and pornography;
  • perishable foodwithout special package;
  • items and substances that, by their nature or due to packaging, can be a danger to the public, can contaminate or damage (destruct) other loads, surrounding people, or items;
  • animals and plants, biological materials;
  • items requiring specially equipped vehicles to be transported, including foodstuff;
  • liquids in open containers;
  • space eating items, which total length, width (two diameters or axes at the roll base) and height dimensions (subject to special exemptions) exceed 150 cm; long items over 150 cm; the weight of transferred items may not exceed 20 kg;
  • fragile items without special packaging;
  • any other items, which distribution is prohibited or limited in the territory of countryof delivery service provision.

The Company’s partners may set other limits on items to be delivered.

The Company’s partners do not provide any postal services and do not accept postal items (addressed letter correspondence, postal parcels, containers, printed publications in relevant packaging) for delivery.

The Driver, acting as a representative of the Company’s partner, can prepare the consignment document with the User or they can come into the agreement not to conclude the consignment document.

The User is aware of and confirms that, if he or she fails to meet the above requirements to items to be delivered, the User is solely responsible for all the negative effects that may occur while the Company’s partner provide delivery services. At the same time, a Company’s partner may deny delivery services to the User, if the Company’s partner/ representatives of the Company’s partner discover any non-deliverable items.

 

3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services

3.1. The User can pay for passenger and baggage transportation services provided to the User in compliance with the information on potential demand for the relevant service the User posted via the Service:

3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as Cash). The said payment shall be made without Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services (if such function is available in the User’s country).

3.1.2. If the non-cash payment is available via Services in the User’s country, the User can access the function of cashless payment by a Linked Bank Card (cl. 3.2 hereof); in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved and receives payments as an agent of the transportation provider or otherwise (including directly) (hereinafter referred to as cashless payments). The Company does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Company acting as a payment recipient or with the Company involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card, insufficient funds in the Linked Card), the User undertakes to pay by Cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportationor other service and several transactions for certain parts of the cost of the service. Cashless payments can be effected by any of the above means during the trip/service or when the trip/service is over.

In case of cashless payments, the User can, along with payment for passenger and baggage transportation or other service, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. The User shall specify the Linked Bank Card in the Service interface indicating the following details:

  • Bank card number
  • Valid through
  • Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes the Linked one and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to RUB 5 (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully effected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default amount of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Bank Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact the Company by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, the Company decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If the Company is not a party to settlements made via the Linked Card, the Company can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. The Company reserves the right to require at any time that the User confirm the details they specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if the Company thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract the Company signed with such third party.

 

4. Governing law and dispute resolution

4.1. These Terms of Use of Yango arising out of or in connection with these Terms shall be governed by and construed in accordance with law of the Netherlands, without regard to its conflict of law provisions.

4.2. Any disputes arising out or in connection with these Terms of Use of Yango shall be decided by the competent court in The Netherlands, unless mandatory conflict of laws provisions provide otherwise.

Conditions d'utilisation du service Yango

 

1. Dispositions générales

1.1. Les présentes Conditions (ci-après — les Conditions) représentent un offre de la société MLU Europe B.V. (ci-après — la Société) à l'utilisateur du réseau Internet (ci-après — l’Utilisateur) concernant l’utilisation du service Yango (ci-après — le Service) au Sénégal.

1.3. Il est considéré qu'en procédant à l’utilisation du Services/de ces fonctionnalités séparées, l'Utilisateur accepte les présentes Conditions, ainsi que les conditions des Documents réglementaires (La licence d'utilisation du moteur de recherche deet La Politique de confidentialité) dans leur intégrité, sans aucune restriction ni réserve. Dans le cas où l'Utilisateur n'accepte par une quelconque des dispositions des Conditions et/ou des Documents réglementaires, l'Utilisateur ne peut pas utiliser le Service.Les règles du Programme de parrainage pour les utilisateurs sont affichées à l'adresse https://yango.com/legal/se.

1.4. La Société a le droit de modifier les dispositions des présentes Conditions à tout moment après notification préalable et accord de l'Utilisateur et la a le droit de modifier les dispositions des Documents réglementaires dans des conditions équivalentes. La version en vigueur des présents Conditions est publiée à : https://yango.com/legal/yango_termsofuse/. La Société peut fournir à l'Utilisateur une traduction de ces Conditions de l’anglais vers d’autres langues. Pourtant, en cas de conflit entre les Conditions en anglais et sa traduction, c'est la version des Conditions en anglais qui fera foi.

1.5. L'Utilisateur cessera d'utiliser le Service, s’il n’est pas d’accord avec les modifications apportées aux présentes Conditions, conformément au paragraphe 1.4 des présentes. Conformément à l’article 31 de la loi 2021-25 sur les prix et la protection des consommateurs, l’Utilisateur est informé qu’il dispose d’un délai de sept (07) jours à compter de la date de souscription au pour exercer son droit de rétractation, sans pénalité, asns frais et sans motif par demande à la Société. La demande doit être envoyée avant l’expiration du délai de rétractation. L’Utilisateur qui a exercé son droit de rétractation d’un contrat de prestation de services dont l’exécution a commencé devra verser à la Société un montant correspondant au service fourni et proportionnel au prix total du service.

Sans préjudice des dispositions de la clause ci-dessus, l’Utilisateur peut renoncer à tout moment aux présentes Conditions en supprimant le Logiciel de la mémoire de son appareil mobile.

1.6. Le Service donne à l'Utilisateur la possibilité de publier, à titre gratuit, l'information relative à la demande potentielle de l'Utilisateur de service de transport des passagers et du bagage ou autres services, y compris les services de livraison (si disponible dans le pays via Services) fornis par les fournisseurs de services de transport disponibles, ainsi que la possibilité de prendre connaissance des informations relatives aux offres des organisations qui fournissent des services dans le domaine susmentionné et de rechercher de telles offres selon les critères définies par l'Utilisateur. Toutes les fonctionnalités du Service existant actuellement, ainsi que tout leur développement ou l'adjonction de toutes fonctionnalités nouvelles constituent l'objet des présentes Conditions.

VOUS RECONNAISSEZ QUE LA SOCIETE NE FOURNIT PAS DE SERVICES DE TRANSPORT OU NE FONCTIONNE PAS EN TANT QUE TRANSPORTEUR ET QUE TOUS CES SERVICES DE TRANSPORT SONT FOURNIS PAR DES TIERS — FOURNISSEURS DE SERVICES DE TRANSPORT, QUI NE SONT PAS EMPLOYÉS PAR LA SOCIETE OU L’UNE DE SES AFFILIES. LES RELATIONS ENTRE VOUS ET LES FOURNISSEURS DE SERVICES DE TRANSPORT EN CE QUI CONCERNE L’ACQUISITION DE SERVICES SONT RÉGIES PAR DES ACCORDS PERTINENTS ENTRE VOUS ET LE FOURNISSEUR DE SERVICES DE TRANSPORT, LA SOCIETE N’EST PAS PARTIE À CES ACCORDS.

1.7. En fonction de la région de l'Utilisateur, l'accès à toutes ou à certaines fonctionnalités du Services peuvent être bloqué ou limité. L'accès de l'Utilisateur aux fonctionnalités depuis une certaine région est considéré comme bloqué (limité) pour, si l'Utilisateur ne peut pas s'en servir directement. L'application de tous moyens techniques ou logiciels pour contourner ces limitations est interdite. Les dispositions des présentes Conditions qui régissent les fonctionnalités du Service l'accès auxquelles est bloqué (limité) pour l'Utilisateur ne sont pas applicables jusqu'à ce que l'Utilisateur ne puisse s'en servir directement. Les informations concernant l'accessibilité des fonctionnalités du Services dans une région correspondante sont fournies à l'Utilisateur à la demande de celui-ci adressée à la Société.

1.8. Pour éviter tout doute, la Société ne fournit pas de services de transport des passagers et des bagages ou autres services, y compris des services de livraison, ni de services d’assistance.

1.9. Toutes les conversations de l’Utilisateur avec les spécialistes du service clientèle ainsi qu’avec les chauffeurs des partenaires qui fournissent des services de transport peuvent être enregistrés à des fins de contrôle de la qualité et de perfectionnement des services.

1.10. Par l’utilisation du Service, l'Utilisateur donne son accord pour la réception des messages publicitaires, y compris les e-mails et messages. L'Utilisateur a le droit de renoncer à la réception des messages publicitaires, en appliquant les fonctionnalités correspondantes du Services ou en suivant les indications du message publicitaire reçu.

 

2. Usage du Service. Certaines fonctionnalités du Service

2.1. Le Service est mis à disposition de l'Utilisateur à titre gratuit pour l’utilisation personnel non commercial, pour une durée indéterminée.

2.2. Les informations relatives aux services de transport des passagers et des bagages (ci‑après — les Informations) sont fournies par les tiers (les partenaires)— les fournisseurs de services de transport. La liste des partenaires est disponible sur https://yango.com/partners. Pour les informations détaillées relatives aux services offerts (y compris les informations relatives à la possibilité de connexion par wi-fi dans le véhicule, à la réalisation d’enregistrements photo/vidéo à l’intérieur du véhicule par les partenaire de la Société s et autres informations) l'Utilisateur peut soit s'adresser aux partenaires du Service — les fournisseurs de services de transport, soit fournir ses cordonnées via une fonctionnalité du Service pour que les partenaires du Service puissent eux-mêmes contacter l'Utilisateur et lui fournir les informations relatives aux services offerts.

2.3. La Société n'engage pas la responsabilité pour le contenu et/ou pour l'actualité des informations fournies par les partenaires du Service — les fournisseurs de services de transport, y compris pour les informations relatives aux prix des services des partenaires, ainsi que à leur bénéfices disponibles à un moment donné. L'interaction de l'Utilisateur avec les partenaires concernant l'acquisition des services est effectuée par l'Utilisateur lui-même (sans participation de la Société), conformément aux règles de la prestation des services définies par les partenaires. La Société n'engage pas la responsabilité pour les opérations financières et pour toutes autres opérations effectuées par l'Utilisateur et par les fournisseurs de services de transport, ainsi que pour toutes les conséquences de l'acquisition des services des les fournisseurs de services de transport par l'Utilisateur.

2.4. L'Utilisateur peut avoir l'accès aux fonctionnalités de l'évaluation des services des Partenaires, ainsi que de la publication des commentaires/avis relatifs au Services et /ou aux les fournisseurs de services de transport . Les notes et les avis des utilisateurs sont publiés sur le site du Service et peuvent également être accessibles depuis les sites des tiers. La Société se réserve le droit de refuser la publication de tous notes/avis, ainsi que d'effacer/bloquer à tout moment la note/l'avis publiés par l'Utilisateur, à sa convenance et sans aucune explication.

2.5. La Société se réserve le droit de limiter, à sa convenance, l'accès de l'Utilisateur au Service (ou à de certaines fonctionnalités du Service, si cela est possible du point de vue technique) depuis son compte personnel ou de bloquer le compte personnel de l'Utilisateur en entier pour les violations répétées des présentes Conditions ou applique d'autres mesures à l'Utilisateur dans le but du respect de la législation et des droits et intérêts légitimes des tiers.

2.6. Au cours des périodes où la demande de services de taxi est élevé (y compris avant les jours fériés, les jours des manifestations publiques et dans les autres cas), les tarifs des partenaires du Service peuvent être augmentés. La Société informe de l'augmentation des tarifs par la publication de la notification correspondante sur le site du Service https://yango.com ou par tout autre moyen à la convenance de la Société, y compris par l'envoi d'un message informationnel au numéro mobile ou dans l'application mobile de l'Utilisateur.

2.7. Les services de transport des passagers et des bagages selon les tarifs disponibles dans le Service sont fournis par les voitures de classes différentes. La répartition des voitures entre les classes est réalisée automatiquement en fonction des renseignements relatifs aux caractéristiques de la voiture fournis par les partenaires du Service.

2.8 Si la fonsction de la commande de trajets à l'avance (ci-après — les Trajets précommandés) est disponible dans le Service selon certains tarifs du Service, la commande sera disponible au partenaire du Service pour qu’il confirme près de l’heure spécifiée par l'Utilisateur dans la commande (au plus tôt 30 minutes avant le début du trajet précommandé). Le coût du trajet pré-commandé sera calculé et indiqué dans le Service lorsque le trajet est commandé. Le prix peut changer dans les circonstances énumérées sur le site du Service https://yango.com.

2.9. Le fournisseur de services de transport fournisseur de services de transportfacture la renonciation de l'Utilisateur à un trajet lorsque cette renonciation a eu lieu après l'arrivée de la voiture à l'endroit indiqué par l'Utilisateur. Ce montant est calculé de la même façon que le coût du trajet/service selon le tarif horaire du moment de l'arrivée de la voiture à l'endroit de départ ou du moment de l'arrivée indiqué dans les informations présentées à l'Utilisateur par le fournisseur de services de transport fournisseur de services de transportdans le cadre du service de transport commandé par l'Utilisateur/les Utilisateurs (selon la dernière éventualité) et au moment de la renonciation de l'Utilisateur au trajet/service. L'Utilisateur renonce au trajet/service, en envoyant une notification correspondante au fournisseur de services de transport fournisseur de services de transportvia le Service. Il est considéré que l'Utilisateur qui n'a pas embarqué dans la voiture fournie par le fournisseur de services de transport fournisseur de services de transportau cours de dix (10) minutes, compte tenu du temps de l'attente non remboursable indiqué pour le tarif correspondant, a renoncé au trajet/service, sauf autres règles du fournisseur de services de transport fournisseur de services de transportcorrespondants ou sauf autres accords entre l'Utilisateur et le représentant (le conducteur) du fournisseur de services de transportfournisseur de services de transport. Le montant facturé dans le cas de la renonciation de l'Utilisateur au trajet de l'aéroport est calculé de la même façon qu'il est indiqué ci-dessus, avec la facturation du supplément pour le trajet hors de la ville, conformément au tarif.

2.10. L'Utilisateur donne son accord à la Société pour le traitement des informations personnelles (y compris des données personnels) de l'Utilisateur su Service (Yango) par la Société, pour le transfert des informations personnelles de l'Utilisateur par la Société aux partenaires de la Société, ainsi que pour le traitement des informations personnelles par les partenaires de la Société dans le but de la prestation des services à l'Utilisateur dans le cadre du Service. Lors de l’utilisation du Service par l'Utilisateur, les informations personnelles de l'Utilisateur sont transmises à la SARL pour le traitement dans les conditions et dans les buts définis dans la Politique de confidentialité de la qui est disponible sur : (https://yango.com/legal/yango_privacy_notice).

2.11. Si l’Utilisateur commande des services de livraison aux partenaires de la Société, il s’engage à ne pas remettre les objets suivants pour la livraison :

  • armes portatives de combat, à usage non militaire et celles de service, munitions, pièces détachées et composants, arcs et arbalètes de sport, armes conçues pour les signaux lumineux, fumigènes et sonores, armes électriques, dispositifs à électrochocs et à étincelles, armes tranchantes froides, matraques, poings américains, shurikens, verges, boomerangs et autres objets ajustés pour frapper, écraser, lancer, percer et couper à l’exception des équipements sportifs, des dispositifs techniques spéciaux à double usage et des composants;
  • stupéfiants, substances psychotropes, précurseurs et leurs analogues;
  • matières nucléaires, substances radioactives, remèdes actifs, substances agressives, explosives et inflammables, agents d’allumage, substances pyrotechniques et articles connexes, et autres substances dangereuses;
  • poisons, animaux vénéneux, substances toxiques, plantes vénéneuses et semences de plantes vénéneuses;
  • fonds en devises nationales ou étrangères;
  • publications imprimées, matériels graphiques, films, photos, matériels audio et vidéo qui contiennent la propagande ou la promotion des changements violents du régime constitutionnel, de la destruction de la sécurité nationale, de la guerre, de la supériorité sociale, raciale, nationale, religieuse, de la supériorité de classe ou de clan, de la cruauté, de la violence ou de la pornographie;
  • denrées périssables sans emballage spécial;
  • objets et substances qui peuvent par leur nature ou en raison de l’emballage constituer un danger pour le public, contaminer ou endommager (détruire) d’autres charges, des gens entourant ou des objets;
  • animaux et végétaux, matériels biologiques;
  • objets qui doivent être transportés par des véhicules spécialement équipés, y compris les denrées alimentaires;
  • liquides dans des conteneurs ouverts;
  • convois exceptionnels dont la longueur, la largeur (deux diamètres ou axes à la base du rouleau) et l’hauteur totales (sous réserve d’exemptions spéciales) dépassent 150 cm; objets longs de plus de 150 cm; le poids des objets transférés ne doit pas dépasser 20 kg;
  • objets fragiles sans emballage spécial;
  • tout autre objet dont la distribution est interdite ou restreinte sur le territoire du pays de la prestation des services de livraison.

Les partenaires de la Société peuvent fixer d’autres restrictions sur les objets à livrer.

Les partenaires de la Société ne fournissent aucun service postal et n’acceptent aucun envoi postal (correspondance par lettre adressée, colis postaux, conteneurs, publications imprimées dans des emballages appropriés) pour la livraison.

En tant que représentant d’un partenaire de la Société, le Chauffeur peut préparer un bordereau d’expédition avec l’Utilisateur ou ils peuvent parvenir à un accord de n’établir aucun bordereau d’expédition.

L’Utilisateur est informé et reconnaît que, s’il ne satisfait pas aux exigences ci-dessus concernant les objets à livrer, l’Utilisateur est le seul responsable de tous les effets négatifs qui peuvent survenir pendant que le partenaire de la Société fournit des services de livraison. Dans le même temps, tout partenaire de la Société peut refuser de rendre les services de livraison à l’Utilisateur si le partenaire de la Société /les représentants du partenaire de la Société découvrent tout objet non livrable.

 

3. Fonctionnalité de paiement du service de transport des passagers des bagages sans espèces

3.1. Le paiement du service de transport des passagers et des bagages fourni à l'Utilisateur conformément à l'information publiée par lui à l'aide du Service relative à la demande du service correspondant peut être effectué par l'Utilisateur de manière suivante :

3.1.1. Directement au fournisseur de services de transport fournisseur de services de transport(y compris en espèces ou par tous autres moyens définis par ledit fournisseur de services de transportfournisseur de services de transport (lorsqu'ils sont prévus), ci-après dans le texte des présentes Conditions et dans l'interface du Service — les Espèces). Le paiement par le moyen de paiement susmentionné est effectué sans participation de la Société et n'est pas régi par les présentes Conditions. Ledit mode de paiement peut être restreint pour les services de livraison (si cette fonction est disponible dans le pays de l’Utilisateur).

3.1.2. Si la fonctionnalité de paiement sans espèces via les Services est disponible dans le pays de l’Utilisateur, l’Utilisateur peut avoir accès à la fonctionnalité de paiement sans espèces avec une Carte bancaire attachée (paragraphe 3.2. des présentes Conditions) ; dans ce cas la Société agit de la part du fournisseur de services de transport fournisseur de services de transport correspondant ou sur une autre base (y compris directement) et fait intervenir le processeur de paiement agréé, le processeur de paiement électronique ou tout autre entité participant au règlement et est le bénéficiaire du paiement en qualité de l'agent du fournisseur de services de transport fournisseur de services de transport ou en toute autre qualité (y compris directement) (ci-après — le paiement sans espèces). La Société ne garantit pas l’absence d'erreurs et de défaut de fonctionnement du Service en ce qui concerne la possibilité du paiement sans espèces.

En fonction de la région de l'Utilisateur, le paiement sans espèces peut être effectué sans participation de la Société en qualité du bénéficiaire du paiement, ou avec intervention de la Société en qualité de l'entité tierce participant au règlement ou en qualité du participant de l'interaction informationnelle.

Le choix du moyen de paiement est effectué par l'Utilisateur dans interface du Service. Toutefois, dans le cas où il est impossible d'effectuer le paiement sans espèces pour toute raison que ce soit (y compris, mais sans s'y limiter, dans le cas d'inaccessibilité technique temporaire de cette fonctionnalité, d'impossibilité temporaire ou permanente d'effectuer le paiement sans espèces avec une Carte bancaire attachée, insuffisance de fonds sur la Carte bancaire attachée), l'Utilisateur s'engage à effectuer le paiement en Espèces.

Dans le cas du paiement sans espèces, il est possible d'effectuer une seule transaction pour le montant total correspondant au coût du service de transport des passagers et des bagages, ainsi que plusieurs transactions correspondant aux certaines parties du prix du service. Dans ce cas, le paiement peut être effectué par tout moyen susmentionné au cours du trajet/service ou après son achèvement.

Lors du paiement sans espèces, l'Utilisateur a la possibilité d'effectuer, à sa convenance, outre le paiement du service de transport des passagers et des bagages, un paiement sans espèces complémentaire au bénéfice du fournisseur de services de transport dont le montant est égal à un certain taux du coût du service de transport des passagers et des bagages payé (ci-après dans le texte des présentes Conditions et dans l'interface du Service — le Pourboire).

3.2. La Carte bancaire attachée est identifiée dans l'interface du Service par l'Utilisateur qui fournit des données suivantes :

  • Numéro de la carte bancaire
  • Date de validité
  • Code de vérification

Si les données relatives à la carte bancaire sont exactes et valables, et si l’utilisation de cette carte dans le cadre du Service est possible du point de vue technique, la carte bancaire susmentionnée acquiert le statut de la Carte bancaire attaché et peut être utilisée pour le paiement sans espèces (paragraphe 3.1.2. des présentes Conditions). Toutes les Cartes attachées s'affichent dans l'interface du Service ; par souci de commodité de l'Utilisateur, 4 derniers chiffres du numéro de la Carte attachée sont affichés.

3.3. Lors de l'addition d'une Carte attachée, ainsi que dans le cas où la fonctionnalité de paiement sans espèces est choisi par l'Utilisateur pour un trajet/service particulier, le prélèvement d'un montant plafonné à 5 roubles russes (ou d'un autre montant en devise de la région de l'Utilisateur) est effectué dans le but de vérifier l'exactitude et la validité des données de la Carte attachée ; dans le cas de la transaction réussie, le montant indiqué est remboursé à l'Utilisateur. La tentative échouée du prélèvement du montant indiqué signifie l'impossibilité d'adjonction de cette Carte attachée et/ou l'inaccessibilité de la fonctionnalité de paiement sans espèces.

3.4. Lors de l'adjonction de la Carte attachée, ainsi qu'à tout moment après son adjonction, l'Utilisateur a la possibilité de fixer et/ou de modifier le montant du Pourboire par défaut dans l'interface du Service ; le montant du Pourboire pour un trajet/service concret peut être modifié par l'Utilisateur dans l'interface du Service après l'achèvement de ce trajet/service.

3.5. Le Pourboire (montant par défaut ou montant spécialement indiqué par l'Utilisateur pour un trajet/service particulier) sera prélevé sur la Carte attachée, si, au cours de 30 minutes après l'achèvement du trajet/service, l'Utilisateur donne une note positive au trajet (4 à 5 étoiles) et appuie le bouton « Terminé » ou s'il n'attribue aucune note au trajet/service (n'indique pas le nombre d'étoiles) et appuie le bouton « Terminé ».

3.6. Dans le cas où, au cours de 30 minutes après l'achèvement du trajet/service, l’Utilisateur donne une note négative au trajet/service (1 à 3 étoiles) et appuie le bouton « Terminé », le Pourboire ne sera pas prélevé sur la Carte attachée.

3.7. Dans le cas où, au cours de 30 minutes après l’achèvement du trajet/service, l'Utilisateur appuie le bouton « Terminé », le montant du Pourboire (montant par défaut ou montant indiqué par l'Utilisateur spécialement pour un trajet/service particulier ) sera bloqué sur la Carte attachée pendant 24 heures au cours desquelles l’Utilisateur a la possibilité de augmenter et de réduire le montant du Pourboire pour le trajet/service correspondant. Après l'achèvement de la période indiquée, le prélèvement du Pourboire est effectué dont le montant a été fixé par l'Utilisateur (par défaut ou pour le trajet/service concret).

3.8. Le paiement sans espèces est effectué par l'Utilisateur avec la participation du processeur de paiement agréé ou du processeur de paiement électronique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement.

3.9. Lors de l'indication de ses données conformément au paragraphe 3.2. des présentes Conditions et lors de l’utilisation ultérieur de la Carte attachée, l'Utilisateur confirme et garantit l'exactitude et l'exhaustivité des informations fournies relatives à la carte bancaire valable émise à son nom ; le respect par lui des règles des systèmes de paiements internationaux et des exigences de la banque émettrice de la Carte attachée, y compris en ce qui concerne les modalités de la réalisation des paiements sans espèces.

3.10. L'Utilisateur comprend et accepte que toutes les actions effectuées dans le cadre du Service avec l'utilisation du numéro mobile confirmé par lui, y compris en ce qui concerne le paiement sans espèces à l'aide de la Carte bancaire attachée sont réputées d'avoir été effectuées par l'Utilisateur.

3.11. Dans le cas du désaccord de l'Utilisateur avec le fait et/ou avec le montant du paiement sans espèces et dans le cas des questions liées à l’utilisation de la Carte attachée dans le cadre du Service, l'Utilisateur a le droit de s'adresser à la Société par téléphone dont les numéros sont indiquée par le Service et/ou via l'interface du service assistance clients (formulaire de contact) dans le délai de 14 jours à compter de la date de réalisation du paiement sans espèces ou de la date des autres actions ou événements faisant l'objet de la demande.

Si, suite à la vérification d'une telle demande la Société prend la décision de remboursement intégral ou partiel du montant du paiement sans espèces, ce remboursement est effectué sur le compte bancaire de la carte bancaire qui a été utilisée pour le paiement sans espèces. Le remboursement des fonds est effectué avec la participation du processeur de paiement agréé ou du processeur de paiement électronique et est régi par les règles des systèmes de paiements internationaux, par les règles des banques (y compris de la banque émettrice de la Carte attachée) et des autres entités participant au règlement. Dans les cas où la Société ne participe pas aux règlements à l'aide de la Carte attachée, la Société peut intervenir en qualité de l'entité qui transmet les messages de l'Utilisateur concernant les questions susmentionnées aux fournisseurs de services de transport , aux bureaux d'expédition ou à d'autres personnes qui sont bénéficiaires du paiement au titre des opérations susmentionnées liées à la Carte attachée.

3.12. La Société se réserve le droit d'exiger à tout moment la justification par l'Utilisateur des données indiquées par lui dans le cadre du Service, y compris des données de la Carte attachée et de demander pour cela de fournir des pièces justificatives (notamment, des pièces d'identité) dont le défaut de présentation peut, à la convenance de la Société , être considéré comme la présentation des informations inexactes et peut entrainer les conséquences prévues au paragraphe 2.5. des présentes Conditions.

3.13. Les dispositions indiquées à la présente section et relatives aux conditions et aux modalités du paiement du service de transport des passagers et des bagages, y compris les services de livraison, ne sont pas applicables dans le cas où le paiement de ce service serait effectué au nom de l'Utilisateur par une tierce partie en vertu d'un contrat spécial passé entre la Société et la tierce partie susmentionnée.

 

4. La législation applicable et le règlement des litiges

4.1. Les présentes Conditions d’utilisation de Yango et toutes les relations découlant de ou liées aux présentes Conditions sont régies et interprétées conformément à la législation des Pays-Bas sans application des dispositions sur les conflits de lois.

4.2. Tout litige découlant de ou en relation avec les présentes Conditions d’utilisation de Yango sera réglé par le tribunal compétent des Pays-Bas, sauf que les dispositions obligatoires sur les conflits de lois prévoient le contraire.
