By choosing the “Buy with delivery” function, the Buyer understands and agrees that the terms of delivery, including payment and data processing are governed by the terms and conditions of Yango Delivery available at: https://yango.com/legal/yango_termsofuse_delivery.

1. General terms and conditions
1.1. These terms and conditions (the “Terms”) constitute an offer by Yango Delivery FZ-LLC (“Yango”) to an Internet user (the “User”) for the use of Yango Sell&Buy, the electronic catalog of property listings and other offers (the “Products”) in the Ivory Coast (the “Service”).
1.2. Use of the Service by the User is governed by these Terms. All currently available features of the Service, as well as any developments and/or new features added, are subject to these Terms.
1.3 By starting to use the Service or any of its functions, the User is deemed to have accepted the present Terms, the license agreement available at https://yango.com/legal/yango_mobile_agreement and other documents relating to the Service, if any (the “Regulatory Documents”), in their entirety, without any reservations or exceptions. If the User does not agree with any of the provisions of the Terms and/or the Regulatory Documents, the User may not use the Service.
1.4. The service is provided free of charge to Users.
1.5. The Service enables the User to :
- Consult advertisements posted by Users (the “Advertisement”) and search for these Advertisements using parameters defined by the User;
- Place information on the User's potential offer to sell Products in the available categories ;
- Communicate with Users who have placed Ads and who are potentially interested in concluding a sales contract (the “Contract”);
- Leave comments, as well as replies to comments concerning certain Sellers' Products.
The Users who offer the Products in the Advertisements are hereinafter referred to as the “Sellers”, and the Users who wish to purchase the Products by concluding the Transaction with the Sellers via the Services are hereinafter referred to as the “Buyers”.
1.6. The User's ad search requests are processed by the Service's automatic algorithms in order to provide relevant information in the search results. Users use the information published in the advertisements to enter into contracts with other Users at their own risk, without any direct or indirect involvement or control by the Services or its representatives.
1.7. For the avoidance of doubt, the Service does not act as a party, agent, intermediary, buyer arranger, seller, employer, intermediary, representative of a User, beneficiary or other interested person in connection with Contracts negotiated or entered into between Users, nor does it provide payment processing, delivery, agency or help desk services.
YOU ACKNOWLEDGE THAT THE SERVICE DOES NOT PROVIDE AGENCY, INTERMEDIARY, PAYMENT PROCESSING, DELIVERY OR TRANSPORTATION SERVICES, NOR DOES IT ACT AS A PARTY TO A TRANSACTION, AGENT OR INTERMEDIARY, AND THAT TRANSACTIONS ARE ENTERED INTO WITH THIRD PARTIES AT YOUR DISCRETION, RISK AND EXPENSE. THE RELATIONSHIP BETWEEN YOU AND ANY OTHER PARTY TO A TRANSACTION IS GOVERNED BY THE RELEVANT AGREEMENTS BETWEEN YOU AND SUCH OTHER PARTY. THE YANGO SELL&BUY SERVICE IS NOT A PARTY TO TRANSACTIONS AND IS NOT RESPONSIBLE FOR THE OUTCOME OF TRANSACTIONS ENTERED INTO WITH THIRD PARTIES THROUGH THE SERVICE.
1.8. During the period of testing, updating or technical development of the Service, all or part of the functions of the Service may be inaccessible or restricted. Functions are considered restricted for the User if he/she cannot explicitly use them. It is forbidden to apply technical or software methods to circumvent these limitations. The provisions herein governing the functionalities of the Service restricted to the User shall apply until such functionalities become explicitly accessible to the User. Information on the accessibility of Service functions in a certain region will be provided to the User upon request to the Service.
2. User data
2.1. The information provided by the User to the Service and/or to other Users must be reliable, up to date and must not violate the law or the rights of third parties. Users are required to update this information in their Service profile if necessary.
2.2. The Service cannot guarantee that all information published by Users in the Service is true or correct. Users should exercise caution when entering into contracts.
2.3. The Service is not responsible for the illegal actions of third parties in relation to information that a User has independently published in the Service and made available to other Users.
2.4. The Service may request data from the User in order to confirm his/her identity or to verify information provided to the Service.
3. Personal data
3.1. The User publishes his personal data on his public account (the “Profile”) or Advertisements so that other Users can contact him or obtain the most complete information about the Products offered in the Advertisement, so that the User independently discloses the personal data to an indefinite number of people.
3.2. The User consents to the processing of his/her personal data by the Service. When the User accesses the Service, his/her personal data is processed under the conditions and for the purposes described in the Privacy Notice available at the following address: (https://yango.com/legal/yango_privacy_notice ).
4. Advertising content
4.1. The purpose for which Sellers publish information in the Service is to establish contact with a potential Buyer who is interested in concluding a Contract concerning the Product in the Advertisement. Advertisements may be published in the product categories available on the Service. The choice of category is the responsibility of the Seller. The Service may, at its discretion, move the Product to a more relevant category.
4.2. The price of the products offered in the advertisements, as well as the final price of the product agreed in the agreement and the agreed terms and methods of payment, are left to the discretion and responsibility of the Users. The Service is not responsible for the fairness, accuracy or market suitability of such prices, terms and methods of payment.
4.3. For further information on the products offered (including their origin, quality, size, color, weight, technical specification, current availability, title and any other relevant information) and on the seller, the buyer may contact the seller or provide the seller's contact details through the Service's functions so that the seller can independently contact the buyer and provide information on the products offered.
4.4. The texts, images and videos that Users publish in advertisements, the public part of their profile and comments constitute User content (the “User Content”). Placement of User Content is permitted for informational purposes only.
4.5. The Service does not act as a creator and distributor of User Content. Users create, modify, publish and make available to an unlimited number of people and delete User Content (including personal data) independently, without the participation or consent of the Service.
4.6. The User warrants that the User Content fully complies with applicable laws and the Terms and does not infringe the rights of third parties, including their intellectual property rights.
4.7. The Service may pre-screen User content to ensure that it complies with the Terms and may refuse to publish such content at its sole discretion. Due diligence does not relieve the seller of full responsibility for the User's content, in accordance with article 4.6.
4.8. The Service is not responsible for the content and/or relevance of the information relating to the Product, nor for the details of the Transaction provided by the Sellers in the Advertisements or for any information exchanged between the Buyers and the Seller as described in the Conditions. The User must discuss independently (without the involvement of the Service) the sale or acquisition of the Product with other Users. The Service is not responsible for financial and other transactions carried out by Users and for the consequences of the sale or acquisition of Products via the Service.
4.9. The Service has the right to retain archived copies of User Content.
4.10. The Service has the right to take all necessary measures concerning the User's content on the basis of requests from authorized authorities or holders of intellectual property rights or means of individualization in the cases and in accordance with the procedures established by the legislation of the Ivory Coast.
4.11. The User grants the Service and Yango's affiliates the right to use the User Content and the intellectual property or means of individualization contained therein, during the term of validity of the exclusive rights to the corresponding intellectual property or means of individualization, by any means, under a free, non-exclusive license and for worldwide use.
The Service has the right to display User Content and the Intellectual Property or means of individualization included therein in advertisements for the Service and Yango affiliates.
At the same time, the Service is not obliged to provide reports on the use of User Content and the Intellectual Property and means of individualization contained therein in accordance with the Terms.
Notwithstanding the preceding paragraph, Users retain a right of access to their personal data in accordance with applicable law and the Privacy Notice.
4.12. The Service may ask Users to disclose data relating to Contracts entered into on a voluntary basis for internal statistical purposes and in cases where such disclosure is required by the provisions of applicable legislation in Côte d'Ivoire.
4.13. The User may access the functions for rating Sellers and commenting on Products/Businesses. The Service reserves the right to refuse to publish ratings/comments and to delete/block, at any time, any rating/comment published by the User, at its own discretion and without giving any reason. Thanks to the Service's functionalities, the Seller can also access aggregated information concerning ratings made by Users, which are calculated on the basis of the average of recent ratings. Ratings and comments are provided by Users at their discretion to express their subjective opinion and evaluate communication or Contracts with other Users. The Service is not responsible for their credibility or content.
5. Communication with Users
5.1. Authorized Users may write to other Users to request or receive information about the Products or Market conditions. Messages and calls may not be used for any other purpose, including transferring communication between Users to other messaging or communication channels by sending links to other sites, resources and services on the Internet.
5.2. The User undertakes only to send messages and calls to other Users for the purposes set out in the Terms of Use and to comply with the provisions of applicable legislation on the protection of personal data.
5.3. The Service does not have access to Users' correspondence and is not responsible for its content.
6. Service communications
6.1. Service notifications (the “Service Notifications”) are part of the functionality of the Service. Notifications about unread notifications are displayed in the Service's mobile application, a counter is displayed on the application's home page. Service notifications may also include a request for confirmation of registration to the Service, notification of restricted access to a profile or ads, Service alerts related to the User's actions in the Service, notification of changes to Service features, terms of use or new Service features. The User may not unsubscribe from Service notifications.
6.2. Service notifications may be sent via your profile's notification center, on your device in the form of push notifications, as well as in messages on the Service. The User may unsubscribe from Service messages by using the relevant functions of the Service.
7. Use of the Service
7.1. By using the Service and its features, the User agrees to act in good faith and to comply strictly with all applicable legal regulations in Côte d'Ivoire and the Terms of Service and, among other things, warrants that it has, and shall have, full authority and competence to perform the use of the Service, offer the Products, post the User Content of the Products and enter into the Business, and that it legally holds all rights, licenses, consents, permits and other titles, required by applicable law to use the Service and enter into the Business in connection with the respective Products.
7.2. The User must not :
- offer for sale Products whose sale is restricted or prohibited in Côte d'Ivoire;
- publish deliberately false information in the Profile, in Advertisements or in feedbacks;
- provide deliberately false information to other Users of the Service;
- contact Users for purposes other than those related to the potential Operation;
- use information from advertisements and communications with other Users for purposes not covered by the Terms;
- collect contacts from other Users for unfair purposes, including, but not limited to, spam and irrelevant calls on matters unrelated to advertisements published on the Service;
- copy information contained in advertisements using automatic means ;
- commit actions that provoke violence, hatred or a disrespectful attitude, contain threats or insults, justify or incite illegal or unfair actions, do not respect moral standards or commercial practices, including the use of obscene and coarse language or the distribution of obscene images or any other type of unacceptable video or audio recordings.
- use the Service, the Service's functionalities or the information published in the Advertisements for purposes not provided for in the Terms ;
- take any action likely to interfere with the normal operation of the Service.
- commit any other action prohibited by the Terms or by the legislation applicable in Côte d'Ivoire.
7.3. Users accept and agree that it is forbidden to offer the following products in advertisements and other features of the service to Users:
1) Drugs and related products: Laboratory reagents, Medical equipment (glucometer, blood pressure monitor, etc.), Medical samples, Baby milk, Feeding bottles, Teats, Steroids, Food supplements, Aphrodisiacs, Growth hormone, Product to develop certain body parts.
2) Lightening cosmetics or hygiene products :
a. Creams, soaps, gels, serums, capsules containing mercury and its derivatives
b. Creams, soaps, gels, serums, capsules containing more than 2% hydroquinone
c. Creams, soaps, gels, serums, capsules containing corticosteroids and corticosteroids
d. Creams, soaps, gels, serums, capsules containing retinol derivatives (vitamin A)
3) Drugs (narcotics) and illicit substances
4) Tobacco and similar products
a. Nicotine-based products
b. Cigarettes
c. E-cigarettes
5) Dangerous products
a. Explosives / fireworks
b. Combustibles and certain fuels
c. Toxic substances
d. Radioactive products
6) Ready-to-use products
a. Coins
b. Reptile skin
7) Products for security forces
a. Signal blockers
b. Camouflage clothing/articles
c. Military uniforms
d. Tear gas
e. Police shields
f. Defensive weapons (knives, Tasers, assault bombs)
g. Gas masks
8) Products likely to be used to commit crimes
a. Weapons and toys similar to real weapons
b. Lock-picking devices
9) Products subject to special regulations
a. Metallurgical ores, precious stones, industrial precious metals
b. Slot machines and all types of gambling machines
c. Pesticides
10) Garbage
11) Counterfeit e-books and software
12) Branded products
7.4. The User is fully responsible for and will only offer for sale Products that have the marking, phytosanitary, veterinary and other documents applicable to certain Products, marking, certificates etc. proving their compliance with consumer protections and other applicable regulations of the laws of the Ivory Coast.
7.5. The User shall provide Buyers with all information required to ensure the sale of certain Products in Côte d'Ivoire.
7.6. The User is aware and confirms that, should he fail to comply with the above requirements, he shall be solely responsible for any adverse effects.
7.7. Safe deal option.
In case you region supports “Safe Deal” option, you may use this option for arranging for delivering and payment for the Products on the following terms:Delivery of the Products shall be ordered via Yango Delivery and performed by the Yango partners. The price of the Products will be reserved on the Buyer’ Yango Pay account. When the Products are delivered to the Buyer, the Buyer will be able to perform the verification of the Products. The Seller will receive the price of the Products after the Buyer’s confirmation that he accepts the delivered Products for purchase. If the Products do not fit or are damaged, the Buyer may return it to the courier, the money for the purchase and delivery will be returned to the User’s Yango Pay account.All terms of delivery and payment conditions via Yango Delivery and Yango Pay not specifically addressed in these Terms shall continue to be regulated by the Terms of Use of Yango Delivery https://yango.com/legal/yango_termsofuse_delivery and Yango Pay https://yandex.com/legal/yangopay_ewallet_civ , respectively. In the event of a discrepancy between these Terms and the Terms of Use of Yango Delivery and Yango Pay, respectively, in connection with the Safe Deal feature functionality the relevant provisions of these Terms shall prevail.The User accepts and agrees that the “Safe Deal” is a name of the service feature integrating the payment and delivery arrangements via Yango Delivery and Yango Pay services, and not representation or guarantee on behalf of Yango of the safety of the deal agreed between the Seller and the Buyer.
8. Penalties for breach of the terms of use of the Service
8.1. If the violation of the Terms is identified on the basis of the User's complaints or in the results of the Service's checks, the Service has the right to take the following measures with respect to the User who has committed the violation: restrict access to the User's Profile or to certain features of the Service, including temporarily, for example, restricting access to messaging via the Service, restricting the display of that User's ads in search results, hiding the display of ads on the map, rejecting or blocking ads, restricting access to the Service from certain IP addresses and telephone numbers.
8.2. Access to the profile may be restricted, inter alia, in the event of complaints from other Users concerning such a profile, identification of actions leading to spam, repeated or malicious violations of the terms of service (including the publication in advertisements of information that does not correspond to reality), hacking of the profile, publication of false reviews, the liquidation of the legal entity represented by the User, as well as in the event that the service identifies signs of fraud in the User's behavior, the imposition of additional services and conditions, not included in the initial product offering, or if the User has registered a new profile in the service in place of the previously blocked profile.
8.3. If the User completely eliminates the violations of the conditions, the Service may, at its discretion, restore access to the Profile.
8.4. The Service reserves the right to carry out random checks of Users' compliance with the Terms at any time and at its own discretion, including by automated methods.
8.5. The Service is not liable for any losses caused to Users in connection with the action listed in this section of the Terms.
8.6. The User acknowledges that in the event of violation of applicable laws or the rights of third parties when using the Service, the User may be subject to administrative, criminal or civil liability.
9. Safety recommendations for Users
9.1. Without prejudice to the provisions of Article 1.7 hereof, the Service provides the following recommendations to enhance the safety of Users when using the Service:
- ensure that the User has made the correct request ;
- refrain from transferring the prepayment, especially during the first transaction with the seller;
- avoid opening third-party links sent by other Users;
- ensure data security. Avoid sending passport, family, home address, financial, tax or other sensitive data to other Users;
- do not share credit card data: do not give anyone a card's CVV/CVC code, expiry date or bank SMS code.
- when selling a computer or mobile device, log out of all accounts, disassociate all profiles and reset the device to factory settings;
- check the product carefully to ensure that it has not been replaced by a similar product that is damaged or does not work
- carefully check cash payments made following conclusion of the Offer+.
- to hold meetings with Sellers and Buyers during the day in safe public places;
- take a picture of the Product and videotape its operation when you send or accept Products via delivery services.
9.2. The provisions of this “Safety Recommendations” section are of an informative nature, should not be considered as legal advice and should not be relied upon by the User as a complete measure guaranteeing the safety of the operation.
10. Modifications
10.1. Yango may, at any time and without notice, modify the provisions hereof, and may, at any time and without notice, modify the provisions of the Regulatory Documents. The current version hereof is available at the following address: https://yango.com/legal/yango_sb_termsofuse. The User takes the risk of not consulting a new version of the conditions and regulatory documents. Continued use of the Service after the conditions or regulatory documents have been modified shall constitute acceptance of the new version.
10.2. The User must cease to use the Service if he/she does not agree with the modifications made to the present conditions in accordance with article 10.1 hereof.
11. Applicable law and settlement of disputes
11.1. The Terms of Use and any non-contractual obligations arising out of or in connection with the Terms of Use shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
11.2. Any dispute, difference, controversy or claim arising out of or in connection with these Terms of Use, including (but not limited to) any question regarding their existence, validity, interpretation, performance, discharge and applicable remedies, shall be submitted to and finally resolved by arbitration in accordance with the Arbitration Rules of the Dubai International Arbitration Centre, which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of the arbitration shall be Dubai, United Arab Emirates. The language used in the arbitration shall be English.

1. Dispositions générales
1.1. Les présentes conditions (les «Conditions») constituent une offre de RideTechnology Global FZ-LLC («Yango») faite à un internaute (l'«Utilisateur») pour l'utilisation de Yango Sell&Buy, le catalogue électronique d'annonces de biens et d'autres offres (les «Produits») en Côte d'Ivoire (le «Service»).
1.2. L'utilisation du Service par l'Utilisateur est régie par les présentes Conditions. Toutes les fonctions actuellement disponibles du Service, ainsi que tout développement et/ou nouvelles fonctions ajoutées sont soumises aux présentes Conditions.
1.3. En commençant à utiliser le service ou certaines de ses fonctions, l'Utilisateur est réputé avoir accepté les présentes Conditions, l'accord de licence disponible à l'adresse https://yango.com/legal/yango_mobile_agreement et d'autres documents relatifs au service, le cas échéant (les «documents réglementaires»), dans leur intégralité, sans aucune réserve ni exception. Si l'Utilisateur n'est pas d'accord avec l'une des dispositions des conditions et/ou des documents réglementaires, il ne peut pas utiliser le service.
1.4. Le service est fourni gratuitement aux Utilisateurs.
1.5. Le Service permet à l'Utilisateur de :
- Consulter les annonces déposées par les Utilisateurs (l'«Annonce») et rechercher ces Annonces à l'aide des paramètres définis par l'Utilisateur ;
- Placer des informations sur l'offre potentielle de l'Utilisateur pour vendre les Produits dans les catégories disponibles ;
- Communiquer avec les Utilisateurs qui ont placé les annonces et qui sont potentiellement intéressés par la conclusion d’un contrat de vente (le «Contrat») ;
- Laisser des commentaires, ainsi que des réponses aux commentaires concernant certains Produits des Vendeurs.
Les Utilisateurs qui proposent les Produits dans les Annonces sont ci-après dénommés les «Vendeurs», les Utilisateurs qui souhaitent se procurer les Produits en concluant l'Opération avec les Vendeurs via les Services sont ci-après dénommés les «Acheteurs».
1.6. Les demandes de recherche d'annonces de l'Utilisateur sont traitées par les algorithmes automatiques du Service afin de fournir des informations pertinentes dans les résultats de recherche. Les Utilisateurs utilisent les informations publiées dans les annonces pour conclure des contrats avec d'autres Utilisateurs à leurs propres risques, sans participation ni contrôle direct ou indirect de la part des Services ou de ses représentants.
1.7. Pour éviter toute ambiguïté, le Service n'agit pas en tant que partie, agent, intermédiaire, organisateur acheteur, vendeur, employeur, intermédiaire, représentant d'un Utilisateur, bénéficiaire ou autre personne intéressée en relation avec les Contrats négociés ou conclus entre les Utilisateurs, ni ne fournit de services de traitement des paiements, de livraison, d'agence ou de service d'assistance.
VOUS RECONNAISSEZ QUE LE SERVICE NE FOURNIT PAS DE SERVICES D'AGENCE, D'INTERMÉDIAIRE, DE TRAITEMENT DES PAIEMENTS, DE LIVRAISON OU DE TRANSPORT, ET QU'IL N'AGIT PAS EN TANT QUE PARTIE À UNE TRANSACTION, AGENT OU INTERMÉDIAIRE, ET QUE LES TRANSACTIONS SONT CONCLUES AVEC DES TIERS À VOTRE DISCRÉTION, À VOS RISQUES ET À VOS FRAIS. LES RELATIONS ENTRE VOUS ET UNE AUTRE PARTIE À UNE TRANSACTION SONT RÉGIES PAR LES ACCORDS PERTINENTS ENTRE VOUS ET CETTE AUTRE PARTIE. LE SERVICE YANGO SELL&BUY N'EST PAS PARTIE AUX TRANSACTIONS ET N'EST PAS RESPONSABLE DU RÉSULTAT DES TRANSACTIONS CONCLUES AVEC LES TIERS PAR L'INTERMÉDIAIRE DU SERVICE.
1.8. Pendant la période de test, de mise à jour ou de développement technique du Service, tout ou partie des fonctions du Service peuvent être inaccessibles ou limitées. Les fonctions sont considérées comme restreintes pour l'Utilisateur si celui-ci ne peut pas les utiliser explicitement. Il est interdit d'appliquer des méthodes techniques et logicielles pour contourner ces limitations. Les dispositions des présentes régissant les fonctionnalités du Service restreint à l'Utilisateur s'appliqueront jusqu'à ce que ces fonctionnalités deviennent explicitement accessibles à l'Utilisateur. Des informations sur l'accessibilité des fonctions du Service dans une certaine région seront fournies à l'Utilisateur sur demande adressée au service.
2. Données de l'Utilisateur
2.1. Les informations fournies par l'Utilisateur sur lui-même au Service et/ou aux autres Utilisateurs doivent être fiables, à jour et ne doivent pas violer la loi et les droits des tiers. Les Utilisateurs sont tenus de les mettre à jour dans leur profil du Service si nécessaire.
2.2. Le Service ne peut garantir que toutes les informations publiées par les Utilisateurs dans le Service sont véridiques ou correctes. Les Utilisateurs doivent être prudents lorsqu'ils concluent des contrats.
2.3. Le Service n'est pas responsable des actions illégales de tiers en relation avec les informations qu'un Utilisateur a publiées de manière indépendante dans le Service et mises à la disposition d'autres Utilisateurs.
2.4. Le Service peut demander des données à l'Utilisateur afin de confirmer son identité ou de vérifier les informations fournies au Service.
3. Données à caractère personnel
3.1. L'Utilisateur publie ses données personnelles sur son compte public (le «Profil») ou des Annonces afin que d'autres Utilisateurs puissent le contacter ou obtenir les informations les plus complètes sur les Produits proposés dans l'Annonce, de sorte que l'Utilisateur divulgue indépendamment les données personnelles à un nombre indéfini de personnes.
3.2. L'Utilisateur consent au traitement de ses données personnelles par le Service. Lorsque l'Utilisateur accède au Service, ses données personnelles sont traitées dans les conditions et pour les finalités décrites dans l'Avis de confidentialité disponible à l'adresse suivante : (https://yango.com/legal/yango_privacy_notice ).
4. Contenu des annonces
4.1. L'objectif pour lequel les Vendeurs publient des informations dans le Service est d'établir un contact avec un Acheteur potentiel qui est intéressé par la conclusion d'un Contrat concernant le Produit dans l'Annonce. Les Annonces peuvent être publiées dans les catégories de produits disponibles dans le Service. Le choix de la catégorie relève de la responsabilité du Vendeur. Le Service peut, à sa discrétion, déplacer le produit dans une catégorie plus pertinente.
4.2. Le prix des produits proposés dans les annonces ainsi que le prix final du produit convenu dans l'accord et les conditions et méthodes de paiement convenues sont laissés à l'appréciation et à la responsabilité des Utilisateurs. Le Service n'est pas responsable de la justesse, de l'exactitude ou de l'adéquation au marché de ces prix, conditions et méthodes de paiement.
4.3. Pour plus d'informations sur les produits proposés (y compris leur origine, leur qualité, leur taille, leur couleur, leur poids, leur spécification technique, leur disponibilité actuelle, leur titre de propriété et toute autre information pertinente) et sur le vendeur, l'acheteur peut contacter le vendeur ou lui fournir ses coordonnées par le biais des fonctions du Service afin qu'il puisse contacter l'acheteur de manière indépendante et lui fournir des informations sur les produits proposés.
4.4. Les textes, images et vidéos que les Utilisateurs publient dans les annonces, la partie publique de leur profil et les commentaires constituent le contenu de l'Utilisateur (le «contenu de l'Utilisateur»). Le placement du contenu de l'Utilisateur est autorisé uniquement à des fins d'information.
4.5. Le Sservice n'agit pas en tant que créateur et distributeur du contenu de l'Utilisateur. Les Utilisateurs créent, modifient, publient et mettent à la disposition d'un nombre illimité de personnes et suppriment le contenu de l'Utilisateur (y compris les données personnelles) de manière indépendante, sans la participation ou le consentement du Service.
4.6. L'Utilisateur garantit que le contenu de l'Utilisateur est pleinement conforme aux lois applicables et aux conditions et qu'il ne viole pas les droits de tiers, y compris leurs droits de propriété intellectuelle.
4.7. Le Service peut procéder à un contrôle préalable du contenu de l'Utilisateur pour s'assurer qu'il est conforme aux conditions et refuser de publier ce contenu à sa seule discrétion. Le contrôle préalable n'exonère pas le vendeur de l'entière responsabilité du contenu de l'Utilisateur, conformément à l'article 4.6.
4.8. Le Service n'est pas responsable du contenu et/ou de la pertinence des informations relatives au Produit, ni des détails de l'Opération fournis par les Vendeurs dans les Annonces ou de toute information échangée entre les Acheteurs et le Vendeur tel que décrit dans les Conditions. L'Utilisateur doit discuter de manière indépendante (sans la participation du Service) de la vente ou de l'acquisition du produit avec les autres Utilisateurs. Le Service n'est pas responsable des transactions financières et autres effectuées par les Utilisateurs et des conséquences de la vente ou de l'acquisition des Produits via le Service.
4.9. Le Service a le droit de conserver des copies archivées du contenu de l'Utilisateur.
4.10. Le Service a le droit de prendre toutes les mesures nécessaires concernant le contenu de l'Utilisateur sur la base des demandes des autorités autorisées ou des titulaires de droits de propriété intellectuelle ou de moyens d'individualisation dans les cas et conformément aux procédures établies par la législation de la Côte d'Ivoire.
4.11. L'Utilisateur accorde au Service et aux affiliés de Yango le droit d'utiliser le contenu de l'Utilisateur et la propriété intellectuelle ou les moyens d'individualisation qu'il contient, pendant la durée de validité des droits exclusifs sur la propriété intellectuelle ou les moyens d'individualisation correspondants, par tous moyens, sous licence gratuite, non exclusive et pour une utilisation mondiale.
Le Service a le droit d'afficher le contenu de l'Utilisateur et la propriété intellectuelle ou les moyens d'individualisation qui y sont inclus, dans des publicités pour le Service et les affiliés de Yango.
En même temps, le Service n'est pas obligé de fournir des rapports sur l'utilisation du contenu de l'Utilisateur et de la propriété intellectuelle et des moyens d'individualisation qu'il contient conformément aux Conditions.
Nonobstant le paragraphe précédent, les Utilisateurs conservent un droit d'accès à leurs données personnelles conformément à la loi applicable et à l’Avis de confidentialité.
4.12. Le Service peut demander aux Utilisateurs de divulguer les données relatives aux Contrats conclus sur une base volontaire à des fins statistiques internes et dans les cas où une telle divulgation est requise par les dispositions de la législation applicable en Côte d'Ivoire.
4.13. L'Utilisateur peut accéder aux fonctions d'évaluation des Vendeurs et de commentaires sur les Produits/Affaires. Le Service se réserve le droit de refuser de publier des évaluations / commentaires et de supprimer / bloquer, à tout moment, toute évaluation / commentaire publié par l'Utilisateur, à sa propre discrétion et sans donner de raison. Grâce aux fonctionnalités du Service, le Vendeur peut également accéder aux informations agrégées concernant les évaluations faites par les Utilisateurs, qui sont calculées sur la base de la moyenne des évaluations récentes. Les évaluations et les commentaires sont fournis par les Utilisateurs à leur discrétion pour exprimer leur opinion subjective et évaluer la communication ou les Contrats avec les autres Utilisateurs. Le Service n'est pas responsable de leur crédibilité ni de leur contenu.
5. Communication avec les Utilisateurs
5.1. Les Utilisateurs autorisés peuvent écrire à d'autres Utilisateurs pour demander ou recevoir des informations sur les Produits ou les conditions du Marché. Il est interdit d'utiliser les messages et les appels à d'autres fins, y compris pour transférer la communication entre les Utilisateurs vers d'autres messageries ou d'autres canaux de communication en envoyant des liens vers d'autres sites, ressources et services sur Internet.
5.2. L'Utilisateur s’engage à n’adresser aux autres Utilisateurs que des messages et des appels aux fins prévues dans les Conditions d'utilisation et à respecter les dispositions de la législation applicable en matière de protection des données à caractère personnel.
5.3. Le Service n'a pas accès à la correspondance des Utilisateurs et n'est pas responsable de son contenu.
6. Les communications du Service
6.1. Les notifications du Service (les «notifications du Service») font partie de la fonctionnalité du Service. Les notifications sur les notifications non lues sont affichées dans l'application mobile du Service, un compteur est affiché sur la page d'accueil de l'application. Les notifications du Service peuvent également inclure une demande de confirmation d'inscription au Service, une notification d'accès restreint à un profil ou à des annonces, des alertes de Service liées aux actions de l'Utilisateur dans le Service, une notification de modification des fonctionnalités du Service, des conditions d'utilisation ou des nouvelles caractéristiques du Service. L'Utilisateur ne peut pas se désinscrire des notifications du Service.
6.2. Les notifications de Service peuvent être envoyés via le centre de notification de votre profil, sur votre appareil sous forme de notifications push, ainsi que dans des messages sur le Service. L'Utilisateur peut se désabonner des messages de Service en utilisant les fonctions pertinentes du Service.
7. Utilisation du Service
7.1. En utilisant le Service et ses fonctionnalités, l'Utilisateur accepte d'agir de bonne foi et de se conformer strictement à toutes les réglementations légales applicables en Côte d'Ivoire et aux Conditions du Service et, entre autres, garantit qu'il a, et aura, toute l'autorité et la compétence pour exécuter l'utilisation du Service, offrir les Produits, poster le contenu Utilisateur des Produits et conclure les Affaires, et qu'il détient légalement tous les droits, licences, consentements, permis et autres titres, requis par la législation applicable pour utiliser le Service et conclure les Affaires en relation avec les Produits respectifs.
7.2. L'Utilisateur ne doit pas :
- proposer à la vente des Produits dont la vente est limitée ou interdite en Côte d'Ivoire ;
- publier des informations délibérément fausses dans le Profil, dans les Annonces et dans les feedbacks;
- fournir des informations délibérément fausses aux autres Utilisateurs du Service ;
- contacter les Utilisateurs à des fins autres que celles liées à l'Opération potentielle ;
- utiliser les informations provenant des annonces et des communications avec d'autres Utilisateurs à des fins non prévues par les conditions ;
- collecter les contacts d'autres Utilisateurs à des fins déloyales, y compris, mais sans s'y limiter, les spams et les appels non pertinents sur des questions sans rapport avec les annonces publiées sur le Service ;
- copier les informations contenues dans les annonces à l'aide de moyens automatiques ;
- commettre des actions qui provoquent la violence, la haine ou une attitude irrespectueuse, contiennent des menaces ou des insultes, justifient des actions illégales ou déloyales, incitent à les commettre, ne respectent pas les normes morales ou les pratiques commerciales, y compris l'utilisation d'un langage obscène et grossier ou la distribution d'images obscènes ou de tout autre type d'enregistrements vidéo ou audio inacceptables
- utiliser le Service, les fonctionnalités du Service ou les informations publiées dans les Annonces à des fins non prévues par les Conditions ;
- entreprendre des actions susceptibles d'interférer avec le fonctionnement normal du Service.
- commettre toute autre action interdite par les Conditions ou par la législation applicable en Côte d'Ivoire.
7.3. Les Utilisateurs acceptent et conviennent qu’il est interdit de proposer les produits suivants dans les annonces et autres fonctionnalités du service aux Utilisateurs :
1) Médicaments et produits connexes : Réactifs de laboratoire, Matériel médical (glucomètre, tensiomètre, etc.), Échantillons médicaux, Lait pour bébé, Biberons, Tétines, Stéroïdes, Compléments alimentaires, Aphrodisiaques, Hormone de croissance, Produit pour développer certaines parties du corps.
2) Produits cosmétiques ou d'hygiène éclaircissants :
a. Crèmes, savons, gels, sérums, gélules contenant du mercure et ses dérivés
b. Crème, savon, gel, sérum, gélules contenant plus de 2% d'hydroquinone
c. Crème, savon, gel, sérum, gélules contenant des corticostéroïdes et des corticostéroïdes
d. Crème, savon, gel, sérum, gélules contenant des dérivés du rétinol (vitamine A)
3) Drogues (stupéfiants) et substances illicites
4) Tabac et produits similaires
a. Produits à base de nicotine
b. Cigarettes
c. E-cigarettes

7.4. L'Utilisateur est entièrement responsable et n'offrira à la vente que les Produits qui ont le marquage, les documents phytosanitaires, vétérinaires et autres applicables à certains Produits, le marquage, les certificats etc. prouvant leur conformité avec les protections des consommateurs et autres réglementations applicables des lois de la Côte d'Ivoire.
7.5. L'Utilisateur fournira aux Acheteurs toutes les informations obligatoires pour assurer la vente de certains produits en Côte d'Ivoire.
7.6. L'Utilisateur est conscient et confirme que, s'il ne respecte pas les exigences ci-dessus, il est seul responsable de tous les effets négatifs. (в этом пункте неправильная нумерация, там 7.4. а должно быть 7.6.)
7.7. Option “Transaction sécurisée”.
Si l'option "Transaction sécurisée" est disponible dans votre région, vous pouvez l’utiliser pour organiser la livraison et le paiement des Produits selon les conditions suivantes:La livraison des Produits sera commandée via Yango Delivery et effectuée par les partenaires Yango. Le prix des Produits sera réservé sur le compte Yango Pay de l'Acheteur. Lorsque les Produits sont livrées à l'Acheteur, l'Acheteur pourra effectuer la vérification des Produits. Le Vendeur recevra le prix des Produits après la confirmation par l'Acheteur qu'il accepte d'acheter les Produits livrées. Si les Produits ne lui conviennent pas ou sont endommagées, l'Acheteur peut les retourner au coursier, l'argent pour l'achat et la livraison sera retourné sur le compte Yango Pay de l'Utilisateur. Toutes les conditions de livraison et de paiement via Yango Delivery et Yango Pay non abordées dans les présentes Conditions continueront d'être régies par les Conditions d'utilisation de Yango Delivery https://yango.com/legal/yango_termsofuse_delivery / et de Yango Pay https://yandex.com/legal/yangopay_ewallet_civ, respectivement. En cas de divergence entre les présentes Conditions et les Conditions d'utilisation de Yango Delivery et de Yango Pay, respectivement, en relation avec la fonctionnalité de Transaction sécurisée, les dispositions pertinentes des présentes Conditions prévaudront. L'Utilisateur accepte et convient que la "Transaction sécurisée" est un nom de la fonctionnalité de service intégrant les modalités de paiement et de livraison via les services Yango Delivery et Yango Pay, et non une représentation ou une garantie au nom de Yango de la sécurité de la transaction convenue entre le Vendeur et l'Acheteur.
8. Sanctions en cas de violation des conditions d'utilisation du Service
8.1. Si la violation des Conditions est identifiée sur la base des plaintes de l'Utilisateur ou dans les résultats des contrôles du Service, le Service a le droit de prendre les mesures suivantes à l'égard de l'Utilisateur ayant commis la violation : restreindre l'accès au Profil de l'Utilisateur ou à certaines fonctionnalités du Service, y compris temporairement, par exemple, restreindre l'accès à la messagerie via le Service, restreindre l'affichage des annonces de cet Utilisateur dans les résultats de recherche, masquer l'affichage des annonces sur la carte, rejeter ou bloquer les annonces, restreindre l'accès au Service à partir de certaines adresses IP et de certains numéros de téléphone.
8.2. L'accès au profil peut être restreint, entre autres, en cas de plaintes d'autres Utilisateurs concernant un tel profil, d'identification d'actions conduisant à des spams, de violations répétées ou malveillantes des conditions du service (y compris la publication dans les annonces d'informations qui ne correspondent pas à la réalité), de piratage du profil, de publication de fausses critiques, la liquidation de l'entité juridique représentée par l'Utilisateur, ainsi que dans le cas où le service identifie des signes de fraude dans le comportement de l'Utilisateur, l'imposition de services et de conditions supplémentaires, non inclus dans l'offre initiale du produit, ou si l'Utilisateur a enregistré un nouveau profil dans le service à la place du profil précédemment bloqué.
8.3. Si l'Utilisateur élimine complètement les violations des conditions, le Service peut, à sa discrétion, rétablir l'accès au profil.
8.4. Le Service se réserve le droit d'effectuer un contrôle aléatoire du respect des Conditions par les Utilisateurs à tout moment et à sa propre discrétion, y compris par le biais de méthodes automatisées.
8.5. Le Service n'est pas responsable des pertes éventuelles causées aux Utilisateurs en relation avec la mesure énumérée dans cette section des Conditions.
8.6. L'Utilisateur reconnaît qu'en cas de violation des lois applicables ou des droits de tiers lors de l'utilisation du service, l'Utilisateur peut être soumis à une responsabilité administrative, pénale ou civile.
9. Recommandations de sécurité pour les Utilisateurs
9.1. Sans préjudice des dispositions de l'article 1.7 des présentes, le Service fournit les recommandations suivantes visant à renforcer la sécurité des Utilisateurs lors de l'utilisation du Service :
- s'assurer que l'Utilisateur a introduit la demande correcte ;
- s'abstenir de transférer le prépaiement, en particulier lors de la première transaction avec le vendeur ;
- éviter d'ouvrir les liens de tiers envoyés par d'autres Utilisateurs ;
- de veiller à la sécurité des données. Éviter d'envoyer à d'autres Utilisateurs des informations relatives au passeport, à la famille, à l'adresse du domicile, aux finances, aux impôts ou à toute autre donnée sensible ;
- ne pas partager les données relatives aux cartes bancaires : ne communiquer à personne le code CVV/CVC d'une carte, sa date d'expiration, le code du SMS de la banque.
- lors de la vente d'un ordinateur ou d'un appareil mobile, de se déconnecter de tous les comptes, de dissocier tous les profils et de réinitialiser l'appareil aux paramètres d'usine ;
- de vérifier soigneusement le produit, de s'assurer qu'il n'est pas remplacé par un produit analogue endommagé ou qui ne fonctionne pas
- de vérifier soigneusement les paiements en espèces effectués à la suite de la conclusion de l'Offre+.
- de tenir les réunions avec les Vendeurs et les Acheteurs pendant la journée dans des lieux publics sûrs ;
- de prendre une photo du Produit et d'enregistrer sur vidéo son fonctionnement lorsque vous envoyez ou acceptez les Produits via les services de livraison.
9.2. Les dispositions de la présente section «Recommandations de sécurité» sont de nature informative, ne doivent pas être considérées comme des conseils juridiques et l'Utilisateur ne doit pas s'y fier comme à une mesure complète garantissant la sécurité de l'opération.
10. Modifications
10.1. Yango peut, à tout moment et sans préavis, modifier les dispositions des présentes, et peut, à tout moment et sans préavis, modifier les dispositions des Documents Réglementaires. La version actuelle des présentes est disponible à l'adresse suivante : https://yango.com/legal/yango_sb_termsofuse. L'Utilisateur prend le risque de ne pas consulter une nouvelle version des conditions et des documents réglementaires. La poursuite de l'utilisation du Service après la modification des conditions ou des documents réglementaires vaudra acceptation de la nouvelle version.
10.2. L'Utilisateur doit cesser d'utiliser le Service s'il n'est pas d'accord avec les modifications apportées aux présentes conditions conformément à l'article 10.1 des présentes.
11. Droit applicable et règlement des litiges
11.1. Les conditions d'utilisation et toute obligation non contractuelle découlant des conditions d'utilisation ou en rapport avec celles-ci sont régies et interprétées conformément aux lois de l'Angleterre et du Pays de Galles, sans tenir compte des dispositions relatives aux conflits de lois.
11.2. Tout litige, différence, controverse ou réclamation découlant des présentes conditions d'utilisation ou en rapport avec celles-ci, y compris (mais sans s'y limiter) toute question concernant leur existence, leur validité, leur interprétation, leur exécution, leur décharge et les recours applicables, sera soumis et définitivement résolu par arbitrage conformément au règlement d'arbitrage du Centre d'arbitrage international de Dubaï, lequel règlement est réputé être incorporé par référence dans la présente clause. Le nombre d'arbitres est fixé à un. Le siège de l'arbitrage sera Dubaï, Émirats arabes unis. La langue utilisée dans l'arbitrage est l'anglais.

1. General terms and conditions
1.1. These terms and conditions (the “Terms”) constitute an offer by RideTechnology Global FZ-LLC (“Yango”) to an Internet user (the “User”) for the use of Yango Sell&Buy, the electronic catalogue of property listings and other offers (the “Products”) in Zambia (the “Service”).
1.2. Use of the Service by the User is governed by these Terms. All currently available features of the Service, as well as any developments and/or new features added, are subject to these Terms.
1.3. By starting to use the Service or any of its functions, the User is deemed to have accepted the present Terms, the license agreement available at https://yango.com/legal/yango_mobile_agreement and other documents relating to the Service, if any (the “Regulatory Documents”), in their entirety, without any reservations or exceptions. If the User does not agree with any of the provisions of the Terms and/or the Regulatory Documents, the User may not use the Service.
1.4. The service is provided free of charge to Users.
1.5. The Service enables the User to :
- Consult advertisements posted by Users (the “Advertisement”) and search for these Advertisements using parameters defined by the User;
- Place information on the User's potential offer to sell Products in the available categories;
- Communicate with Users who have placed Ads and who are potentially interested in concluding a sales contract (the “Contract”);
- Leave comments, as well as replies to comments concerning certain Sellers' Products.
1.6. The Users who offer the Products in the Advertisements are hereinafter referred to as the “Sellers”, and the Users who wish to purchase the Products by concluding the Transaction with the Sellers via the Services are hereinafter referred to as the “Buyers”.
1.7. The User's ad search requests are processed by the Service's automatic algorithms in order to provide relevant information in the search results. Users use the information published in the advertisements to enter into contracts with other Users at their own risk, without any direct or indirect involvement or control by the Services or its representatives.
1.8. For the avoidance of doubt, the Service does not act as a party, agent, intermediary, buyer arranger, seller, employer, intermediary, representative of a User, beneficiary or other interested person in connection with Contracts negotiated or entered into between Users, nor does it provide payment processing, delivery, agency or help desk services.
YOU ACKNOWLEDGE THAT THE SERVICE DOES NOT PROVIDE AGENCY, INTERMEDIARY, PAYMENT PROCESSING, DELIVERY OR TRANSPORTATION SERVICES, NOR DOES IT ACT AS A PARTY TO A TRANSACTION, AGENT OR INTERMEDIARY, AND THAT TRANSACTIONS ARE ENTERED INTO WITH THIRD PARTIES AT YOUR DISCRETION, RISK AND EXPENSE. THE RELATIONSHIP BETWEEN YOU AND ANY OTHER PARTY TO A TRANSACTION IS GOVERNED BY THE RELEVANT AGREEMENTS BETWEEN YOU AND SUCH OTHER PARTY. THE YANGO SELL&BUY SERVICE IS NOT A PARTY TO TRANSACTIONS AND IS NOT RESPONSIBLE FOR THE OUTCOME OF TRANSACTIONS ENTERED INTO WITH THIRD PARTIES THROUGH THE SERVICE.
1.9. During the period of testing, updating or technical development of the Service, all or part of the functions of the Service may be inaccessible or restricted. Functions are considered restricted for the User if he/she cannot explicitly use them. It is forbidden to apply technical or software methods to circumvent these limitations. The provisions herein governing the functionalities of the Service restricted to the User shall apply until such functionalities become explicitly accessible to the User. Information on the accessibility of Service functions in a certain region will be provided to the User upon request to the Service.
2. User data
2.1. The information provided by the User to the Service and/or to other Users must be reliable, up to date and must not violate the law or the rights of third parties. Users are required to update this information in their Service profile if necessary.
2.2. The Service cannot guarantee that all information published by Users in the Service is true or correct. Users should exercise caution when entering into contracts.
2.3. The Service is not responsible for the illegal actions of third parties in relation to information that a User has independently published in the Service and made available to other Users.
2.4. The Service may request data from the User in order to confirm their identity or to verify information provided to the Service.
3. Personal data
3.1 The User publishes their personal data on their public account (the “Profile”) or Advertisements so that other Users can contact their or obtain the most complete information about the Products offered in the Advertisement, so that the User independently discloses the personal data to an indefinite number of people.
3.2 When the User accesses the Service, their personal data is processed under the conditions and for the purposes described in the Privacy Notice available at the following address: (https://yango.com/legal/yango_privacy_notice).
4. Advertising content
4.1. The purpose for which Sellers publish information in the Service is to establish contact with a potential Buyer who is interested in concluding a Contract concerning the Product in the Advertisement. Advertisements may be published in the product categories available on the Service. The choice of category is the responsibility of the Seller. The Service may, at its discretion, move the Product to a more relevant category.
4.2. The price of the products offered in the advertisements, as well as the final price of the product agreed in the agreement and the agreed terms and methods of payment, are left to the discretion and responsibility of the Users. The Service is not responsible for the fairness, accuracy or market suitability of such prices, terms and methods of payment.
4.3. For further information on the products offered (including their origin, quality, size, colour, weight, technical specification, current availability, title and any other relevant information) and on the seller, the buyer may contact the seller or provide the seller's contact details through the Service's functions so that the seller can independently contact the buyer and provide information on the products offered.
4.4. The texts, images and videos that Users publish in advertisements, the public part of their profile and comments constitute User content (the “User Content”). Placement of User Content is permitted for informational purposes only.
4.5. The Service does not act as a creator and distributor of User Content. Users create, modify, publish and make available to an unlimited number of people and delete User Content (including personal data) independently, without the participation or consent of the Service.
4.6. The User warrants that the User Content fully complies with applicable laws and the Terms and does not infringe the rights of third parties, including their intellectual property rights.
4.7. The Service may pre-screen User content to ensure that it complies with the Terms and may refuse to publish such content at its sole discretion. Due diligence does not relieve the seller of full responsibility for the User's content, in accordance with article 4.6.
4.8. The Service is not responsible for the content and/or relevance of the information relating to the Product, nor for the details of the Transaction provided by the Sellers in the Advertisements or for any information exchanged between the Buyers and the Seller as described in the Conditions. The User must discuss independently (without the involvement of the Service) the sale or acquisition of the Product with other Users. The Service is not responsible for financial and other transactions carried out by Users and for the consequences of the sale or acquisition of Products via the Service.
4.9. The Service has the right to retain archived copies of User Content.
4.10. The Service has the right to take all necessary measures concerning the User's content on the basis of requests from authorized authorities or holders of intellectual property rights or means of individualization in the cases and in accordance with the procedures established by the legislation of the Ivory Coast.
4.11. The User grants the Service and Yango's affiliates the right to use the User Content and the intellectual property or means of individualization contained therein, during the term of validity of the exclusive rights to the corresponding intellectual property or means of individualization, by any means, under a free, non-exclusive license and for worldwide use.
4.12. The Service has the right to display User Content and the Intellectual Property or means of individualization included therein in advertisements for the Service and Yango affiliates.
4.13. At the same time, the Service is not obliged to provide reports on the use of User Content and the Intellectual Property and means of individualization contained therein in accordance with the Terms.
4.14. Notwithstanding the preceding paragraph, Users retain a right of access to their personal data in accordance with applicable law and the Privacy Notice.
4.15. The Service may ask Users to disclose data relating to Contracts entered into on a voluntary basis for internal statistical purposes and in cases where such disclosure is required by the provisions of applicable legislation in Zambia.
4.16. The User may access the functions for rating Sellers and commenting on Products/Businesses. The Service reserves the right to refuse to publish ratings/comments and to delete/block, at any time, any rating/comment published by the User, at its own discretion and without giving any reason. Thanks to the Service's functionalities, the Seller can also access aggregated information concerning ratings made by Users, which are calculated on the basis of the average of recent ratings. Ratings and comments are provided by Users at their discretion to express their subjective opinion and evaluate communication or Contracts with other Users. The Service is not responsible for their credibility or content.
5. Communication with Users
5.1. Authorized Users may write to other Users to request or receive information about the Products or Market conditions. Messages and calls may not be used for any other purpose, including transferring communication between Users to other messaging or communication channels by sending links to other sites, resources and services on the Internet.
5.2. The User undertakes only to send messages and calls to other Users for the purposes set out in the Terms of Use and to comply with the provisions of applicable legislation on the protection of personal data.
5.3. The Service does not have access to Users' correspondence and is not responsible for its content.
6. Service communications
6.1. Service notifications (the “Service Notifications”) are part of the functionality of the Service. Notifications about unread notifications are displayed in the Service's mobile application, a counter is displayed on the application's home page. Service notifications may also include a request for confirmation of registration to the Service, notification of restricted access to a profile or ads, Service alerts related to the User's actions in the Service, notification of changes to Service features, terms of use or new Service features. The User may not unsubscribe from Service notifications.
6.2. Service notifications may be sent via your profile's notification centre, on your device in the form of push notifications, as well as in messages on the Service. The User may unsubscribe from Service messages by using the relevant functions of the Service.
7. Use of the Service
7.1. By using the Service and its features, the User agrees to act in good faith and to comply strictly with all applicable legal regulations in Côte d'Ivoire and the Terms of Service and, among other things, warrants that it has, and shall have, full authority and competence to perform the use of the Service, offer the Products, post the User Content of the Products and enter into the Business, and that it legally holds all rights, licenses, consents, permits and other titles, required by applicable law to use the Service and enter into the Business in connection with the respective Products.
7.2. The User must not:
- offer for sale Products whose sale is restricted or prohibited in Zambia;
- publish deliberately false information in the Profile, in Advertisements or in feedbacks;
- provide deliberately false information to other Users of the Service;
- contact Users for purposes other than those related to the potential Operation;
- use information from advertisements and communications with other Users for purposes not covered by the Terms;
- collect contacts from other Users for unfair purposes, including, but not limited to, spam and irrelevant calls on matters unrelated to advertisements published on the Service;
- copy information contained in advertisements using automatic means ;
- commit actions that provoke violence, hatred or a disrespectful attitude, contain threats or insults, justify or incite illegal or unfair actions, do not respect moral standards or commercial practices, including the use of obscene and coarse language or the distribution of obscene images or any other type of unacceptable video or audio recordings.
- use the Service, the Service's functionalities or the information published in the Advertisements for purposes not provided for in the Terms ;
- take any action likely to interfere with the normal operation of the Service.
- commit any other action prohibited by the Terms or by the legislation applicable in Zambia.
7.3. Users accept and agree that it is forbidden to offer the following products in advertisements and other features of the service to the Users:
1) Drugs and related products including Laboratory reagents, Medical equipment (glucometer, blood pressure monitor, etc.), Medical samples, Baby milk, Feeding bottles, Teats, Steroids, Food supplements, Aphrodisiacs, Growth hormone, Product to develop certain body parts.
2) Lightening cosmetics or hygiene products, and specifically:
a) Creams, soaps, gels, serums, capsules containing mercury and its derivatives
b) Creams, soaps, gels, serums, capsules containing more than 2% hydroquinone
c) Creams, soaps, gels, serums, capsules containing corticosteroids and corticosteroids
d) Creams, soaps, gels, serums, capsules containing retinol derivatives (vitamin A)
3) Drugs (narcotics), illicit and psychotropic substances of any kind.
4) (Unless duly authorised and/or licensed) Tobacco and other similar products, and specifically:
a) Nicotine-based products and apparatus
b) Cigarettes
c) E-cigarettes and/or vapes
5) (Unless duly authorised and/or licensed) Alcoholic beverages, and specifically:
a) Beers and other brewed alcoholic beverages (both local and international, with the exception of local brews expressly prohibited by law such as kachasu, kachipembe, kapuli, lukutu, or any other similar local brew).
b) Wine.
c) Whisky and other malt based alcohols.
d) Vodka, Gin and other spirits.
e) Liqueurs.
6) Dangerous products
a) Explosives / fireworks
b) Combustibles and certain fuels
c) Toxic substances
d) Radioactive products
7) (Unless with the appropriate license or permit) Trophies, game animals and protected animals (as prescribed) and their by-products, which includes but is not limited to:
a) Ivory, horns, tooths, husks, bones, claws, of a game animal or protected animal.
b) Hoofs, skin, hair, eggs, feathers or any other durable part of a game animal or protected animal.
c) the meat and skins of any game animals and protected animals.
8) Products for the Security or Defence Forces which include but are not limited to:
a) Signal blockers
b) Camouflage clothing/articles
c) Military uniforms
d) Missiles (heat-seeking, guided or otherwise), rocket-launchers (RPGs), lasers weapons.
e) Tear gas, smoke bombs, hand grenades and other similar explosives.
f) Police riot shields.
g) Defensive weapons including pocket knives, tasers, and pepper spray.
h) Gas masks, infrared masks (or goggles) and other military masks.
9) Products likely to be used to commit crimes
a) Firearms of all kinds.
b) Swords and katanas, military knives and other sharp-edged weapons or tools not intended for domestic use.
c) Lock-picking devices.
10) Miscellaneous products subject to special regulations, including but not limited to:
a) Metallurgical ores, minerals, precious stones, industrial precious metals.
b) Slot machines and all types of gambling machines.
c) (Unless with the appropriate authorisation or permit) Pesticides and toxic substances.
11) Pornographic, illicit, or sexually suggestive material, specifically:
a) Videos and/or clips
b) Pictures, sketches, cartoons or caricatures.
12) Counterfeit goods and services including:
a) Books, e-books, and other literary works,
b) Music, paintings and other artwork,
c) Industrial designs, patented goods or services, geographical indications and trademarks,
d) Software, operating licenses and other computer based products requiring licenses or annual subscriptions,
13) (Unless with the appropriate licence or authorisation) Specialised services that require licenses and authorisations whether regulated by a recognised professional body within the country, regionally, globally or otherwise, and including but not limited to:
a) Accounting, tax, audit and other similar services,
b) Legal services,
c) Banking and financial services,
d) Real estate services and other services that require special licenses and authorisations.
14) Branded products without the appropriate authority or license to distribute, retail or otherwise resell the same.
15) All other products that legally require special licenses or authorisations, which have not been specifically provided for herein.
7.4. The User is fully responsible for and will only offer for sale Products that have the marking, phytosanitary, veterinary and other documents applicable to certain Products, marking, certificates etc. proving their compliance with consumer protections and other applicable regulations of the laws of Zambia.
7.5. The User shall provide Buyers with all information required to ensure the sale of certain Products in Zambia.
7.6. The User is aware and confirms that, should they fail to comply with the above requirements, they shall be solely responsible for any adverse effects.
8. Penalties for breach of the terms of use of the Service
8.1. If the violation of the Terms is identified on the basis of the User's complaints or in the results of the Service's checks, the Service has the right to take the following measures with respect to the User who has committed the violation: (i) restrict access to the User's Profile or to certain features of the Service, including temporarily, for example, restricting access to messaging via the Service, (ii) restricting the display of that User's ads in search results, (iii) hiding the display of ads on the map, (iv) rejecting or blocking ads, (v) restricting access to the Service from certain IP addresses and telephone numbers.
8.2. Access to the profile may be restricted, inter alia, in the event of complaints from other Users concerning such a profile, identification of actions leading to spam, repeated or malicious violations of the terms of service (including the publication in advertisements of information that does not correspond to reality), hacking of the profile, publication of false reviews, the liquidation of the legal entity represented by the User, as well as in the event that the service identifies signs of fraud in the User's behaviour, the imposition of additional services and conditions, not included in the initial product offering, or if the User has registered a new profile in the service in place of the previously blocked profile.
8.3. If the User completely eliminates the violations of the conditions, the Service may, at its discretion, restore access to the Profile.
8.4. The Service reserves the right to carry out random checks of Users' compliance with the Terms at any time and at its own discretion, including by automated methods.
8.5. The Service is not liable for any losses caused to Users in connection with the action listed in this section of the Terms.
8.6. The User acknowledges that in the event of violation of applicable laws or the rights of third parties when using the Service, the User may be subject to administrative, criminal or civil liability.
9. Safety recommendations for Users
9.1. Without prejudice to the provisions of Article 1.7 hereof, the Service provides the following recommendations to enhance the safety of Users when using the Service:
- ensure that the User has made the correct request ;
- refrain from transferring the prepayment, especially during the first transaction with the seller;
- avoid opening third-party links sent by other Users;
- ensure data security. Avoid sending passport, family, home address, financial, tax or other sensitive data to other Users;
- do not share credit card data: do not give anyone a card's CVV/CVC code, expiry date or bank SMS code.
- when selling a computer or mobile device, log out of all accounts, disassociate all profiles and reset the device to factory settings;
- check the product carefully to ensure that it has not been replaced by a similar product that is damaged or does not work
- carefully check cash payments made following conclusion of the Offer+.
- to hold meetings with Sellers and Buyers during the day in safe public places;
- take a picture of the Product and videotape its operation when you send or accept Products via delivery services.
9.2. The provisions of this “Safety Recommendations” section are of an informative nature, should not be considered as legal advice and should not be relied upon by the User as a complete measure guaranteeing the safety of the operation.
10. Modifications
10.1. Yango may, at any time and without notice, modify the provisions hereof, and may, at any time and without notice, modify the provisions of the Regulatory Documents. The current version hereof is available at the following address: https://yango.com/legal/yango_sb_termsofuse.
10.2. The User takes the risk of not consulting a new version of the conditions and regulatory documents. Continued use of the Service after the conditions or regulatory documents have been modified shall constitute acceptance of the new version.
10.3. The User must cease to use the Service if he/she does not agree with the modifications made to the present conditions in accordance with article 10.1 hereof.
11. Applicable law and settlement of disputes
11.1. The Terms of Use and any non-contractual obligations arising out of or in connection with the Terms of Use shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
11.2. Any dispute, difference, controversy or claim arising out of or in connection with these Terms of Use, including (but not limited to) any question regarding their existence, validity, interpretation, performance, discharge and applicable remedies, shall be submitted to and finally resolved by arbitration in accordance with the Arbitration Rules of the Dubai International Arbitration Centre, which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of the arbitration shall be Dubai, United Arab Emirates. The language used in the arbitration shall be English.

1. General terms and conditions
1.1. These terms and conditions (the “Terms”) constitute an offer by Ride Technology Global FZ LLC (“Yango”) to an Internet user (the “User”) for the use of Yango Sell & Buy, the electronic catalogue of property listings and other offers (the “Products”) in Ghana (the “Service”).
1.2. Use of the Service by the User is governed by these Terms. All currently available features of the Service, as well as any developments and/or new features added, are subject to these Terms.
1.3 By starting to use the Service or any of its functions, the User is deemed to have accepted the present Terms, the license agreement available at https://yango.com/legal/yango_mobile_agreement and other documents relating to the Service, if any (the “Regulatory Documents”), in their entirety, without any reservations or exceptions. If the User does not agree with any of the provisions of the Terms and/or the Regulatory Documents, the User may not use the Service.
1.4. The service is provided free of charge to Users.
1.5. The Service enables the User to:
- Consult advertisements posted by Users (the “Advertisement”) and search for these Advertisements using parameters defined by the User;
- Place information on the User's potential offer to sell Products in the available categories ;
- Communicate with Users who have placed Ads and who are potentially interested in concluding a sales contract (the “Contract”);
- Leave comments, as well as replies to comments concerning certain Sellers' Products.
The Users who offer the Products in the Advertisements are hereinafter referred to as the “Sellers”, and the Users who wish to purchase the Products by concluding the Transaction with the Sellers via the Services are hereinafter referred to as the “Buyers”.
1.6. The User's ad search requests are processed by the Service's automatic algorithms in order to provide relevant information in the search results. Users use the information published in the advertisements to enter into contracts with other Users at their own risk, without any direct or indirect involvement or control by the Services or its representatives.
1.7. For the avoidance of doubt, the Service does not act as a party, agent, intermediary, buyer arranger, seller, employer, intermediary, representative of a User, beneficiary or other interested person in connection with Contracts negotiated or entered into between Users, nor does it provide payment processing, delivery, agency or help desk services.
YOU ACKNOWLEDGE THAT THE SERVICE DOES NOT PROVIDE AGENCY, INTERMEDIARY, PAYMENT PROCESSING, DELIVERY OR TRANSPORTATION SERVICES, NOR DOES IT ACT AS A PARTY TO A TRANSACTION, AGENT OR INTERMEDIARY, AND THAT TRANSACTIONS ARE ENTERED INTO WITH THIRD PARTIES AT YOUR DISCRETION, RISK AND EXPENSE. THE RELATIONSHIP BETWEEN YOU AND ANY OTHER PARTY TO A TRANSACTION IS GOVERNED BY THE RELEVANT AGREEMENTS BETWEEN YOU AND SUCH OTHER PARTY. 1.8. During the period of testing, updating or technical development of the Service, all or part of the functions of the Service may be inaccessible or restricted. Functions are considered restricted for the User if he/she cannot explicitly use them. It is forbidden to apply technical or software methods to circumvent these limitations. The provisions herein governing the functionalities of the Service restricted to the User shall apply until such functionalities become explicitly accessible to the User. Information on the accessibility of Service functions in a certain region will be provided to the User upon request to the Service.
2. User data
2.1. The information provided by the User to the Service and/or to other Users must be reliable, up to date and must not violate the law or the rights of third parties. Users are required to update this information in their Service profile if necessary.
2.2. The Service cannot guarantee that all information published by Users in the Service is true or correct. Users should exercise caution when entering into contracts.
2.3. The Service is not responsible for the illegal actions of third parties in relation to information that a User has independently published in the Service and made available to other Users.
2.4. The Service may request data from the User in order to confirm his/her identity or to verify information provided to the Service.
3. Personal data
3.1. The User publishes his personal data on his public account (the “Profile”) or Advertisements so that other Users can contact him or obtain the most complete information about the Products offered in the Advertisement, so that the User independently discloses the personal data to an indefinite number of people.
3.2. The User consents to the processing of his/her personal data by the Service. When the User accesses the Service, his/her personal data is processed under the conditions and for the purposes described in the Privacy Notice available at the following address: (https://yango.com/legal/yango_privacy_notice ).
4. Advertising Content
4.1. The purpose for which Sellers publish information in the Service is to establish contact with a potential Buyer who is interested in concluding a Contract concerning the Product in the Advertisement. Advertisements may be published in the product categories available on the Service. The choice of category is the responsibility of the Seller. The Service may, at its discretion, move the Product to a more relevant category.
4.2. The price of the products offered in the advertisements, as well as the final price of the product agreed on between the parties and the agreed terms and methods of payment, are left to the discretion and responsibility of the Users. The Service is not responsible for the fairness, accuracy, or market suitability of such prices, terms, and methods of payment.
4.3. For further information on the products offered (including their origin, quality, size, color, weight, technical specification, current availability, title and any other relevant information) and on the Seller, the Buyer may contact the Seller or provide his/her contact details through the Service's functions so that the Seller can independently contact the Buyer and provide information on the products offered.
4.4. The texts, images and videos that Users publish in advertisements, the public part of their profile, and comments constitute User content (the “User Content”). Placement of User Content is permitted for informational purposes only.

Sexually transmitted diseases, other forms of genito-urinary diseases, Acquired Immune Deficiency Syndrome (AIDS) or diseases connected with the human reproductive functions, Alcoholism, Amenorrhoea, Appendicitis, Arteriosclerosis, Asthma, Bladder Stones, Blindness, Cancer, Convulsion, Deafness, Diabetes, Diphtheria Diseases of the reproductive organ, Dropsy Epilepsy or fits Erysipelas, Fibroid, Gallstones, Goitre, Heart disease, Hernia or rupture, Hypertension, Infertility, Kidney failure, Kidney stones, Leprosy, Leukemia, Locomotortazy, Systemic Lupus, Erythematosis, Mental disorders, Nephritis or Bright’s disease, Obesity, Paralysis, Pleurisy, Pneumonia, Poliomyelitis, Prostate diseases, Scarlet fever, Septicaemia, Sexual impotence, Smallpox, Tetanus, or lock-jaw Trachoma, and Tuberculosis;
- Sex services;
- Child Pornography;
- Human organs and body parts;
- Electronic counterfeit making equipment;
- Human Trafficking services;
- Food that is not of the nature, substance, quality, or prescribed standard;
- A drug, herbal medicinal product, cosmetic, medical device or household chemical on its own or as a treatment, preventive, or cure for a disease, disorder or an abnormal physical state, unless the advertisement has been approved by the Food and Drugs Authority.
7.4. The User is fully responsible for and warrants to only offer for sale Products that have the requisite approvals in the form of marking, phytosanitary, veterinary, certificates, and other documents applicable to certain Products, etc. proving their compliance with consumer protections and other applicable regulations of the laws of Ghana.
7.5. The User shall provide Buyers with all information required to ensure the sale of certain Products in Ghana.
7.6. The User is aware and confirms that, should he fail to comply with the above requirements, he shall be solely responsible for any adverse effects.
7.7 Users must share their documentation approving the advertisement of special products with the Service.
7.8 The User agrees to indemnify and hold the Service harmless from any and all liabilities, claims, damages, or expenses (including reasonable attorney's fees) arising from or related to the User’s non-compliance with applicable laws and regulations. This indemnity obligation shall extend to any actions, proceedings, or claims initiated by third parties resulting from the User's failure to adhere to such legal requirements.
8. Penalties for breach of the terms of use of the Service
8.1. If the violation of the Terms is identified based on the User's complaints or in the results of the Service's checks, the Service has the right to take the following measures with respect to the User who has committed the violation: restrict access to the User's Profile or to certain features of the Service, including but not limited to: temporarily, for example, restricting access to messaging via the Service, restricting the display of that User's ads in search results, hiding the display of ads on the map, rejecting or blocking ads, restricting access to the Service from certain IP addresses and telephone numbers, suspension of the Users account or blocking the User’s access to the Service as a whole.
8.2. Access to the profile may be restricted, inter alia, in the event of complaints from other Users concerning such a profile, identification of actions leading to spam, repeated or malicious violations of the terms of service (including the publication in advertisements of information that does not correspond to reality), hacking of the profile, publication of false reviews, the liquidation of the legal entity represented by the User, as well as in the event that the service identifies signs of fraud in the User's behavior, the imposition of additional services and conditions, not included in the initial product offering, or if the User has registered a new profile in the service in place of the previously blocked profile.
8.3. If the User completely eliminates the violations of the conditions, the Service may, at its discretion, restore access to the Profile.
8.4. The Service reserves the right to carry out random checks of Users' compliance with the Terms at any time and at its own discretion, including by automated methods.
8.5. The Service is not liable for any losses caused to Users in connection with the actions listed in this section of the Terms.
8.6. The User acknowledges that in the event of a violation of applicable laws or the rights of third parties when using the Service, the User may be subject to administrative, criminal, or civil liability, without any liability to the Service.
9. Safety recommendations for Users
9.1. Without prejudice to the provisions of Article 1.7 hereof, the Service provides the following recommendations to enhance the safety of Users when using the Service:
- ensure that the User has made the correct request;
- refrain from transferring the prepayment, especially during the first transaction with the seller;
- avoid opening third-party links sent by other Users;
- ensure data security by refraining from sending passport, family, home address, financial, tax or other sensitive data to other Users;
- do not share credit card data: do not give anyone a card's CVV/CVC code, expiry date or bank SMS code;
- when selling a computer or mobile device, log out of all accounts, disassociate all profiles, and reset the device to factory settings;
- check the product carefully to ensure that it has not been replaced by a similar product that is damaged or does not work;
- carefully check cash payments made following the conclusion of the Offer;
- hold meetings with Sellers and Buyers during the day in safe public places; and
- take a picture of the Product and videotape its operation when you send or accept Products via delivery services.
9.2. The provisions of this “Safety Recommendations” section are of an informative nature and should not be considered as legal advice nor should it be relied upon by the User as a complete measure guaranteeing the safety of the operation.
10. Modifications
10.1. Yango may, at any time and without notice, modify the provisions hereof, and may, at any time and without notice, modify the provisions of the Regulatory Documents. The current version hereof is available at the following address: https://yango.com/legal/yango_sb_termsofuse. The User takes the risk of not consulting a new version of the conditions and regulatory documents. Continued use of the Service after the conditions or regulatory documents have been modified shall constitute acceptance of the new version.
10.2. The User must cease to use the Service if he/she does not agree with the modifications made to the present conditions in accordance with Article 10.1 hereof.
11. Applicable law and settlement of disputes
11.1. The Terms of Use and any non-contractual obligations arising out of or in connection with the Terms of Use shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
11.2. Any dispute, difference, controversy or claim arising out of or in connection with these Terms of Use, including (but not limited to) any question regarding their existence, validity, interpretation, performance, discharge and applicable remedies, shall be submitted to and finally resolved by arbitration in accordance with the Arbitration Rules of the Dubai International Arbitration Centre, which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of the arbitration shall be Dubai, United Arab Emirates. The language used in the arbitration shall be English.

1. GENERAL TERMS AND CONDITIONS
1.1. These terms and conditions (the “Terms”) constitute an offer by RideTechnology Global FZ-LLC (“Yango”) to an Internet user (the “User”) for the use of Yango Sell&Buy, the electronic catalog of goodsand other offers (the “Products”) in Bolivia (the “Service”).
1.2. Use of the Service by the User is governed by these Terms. All currently available features of the Service, as well as any developments and/or new features added, are subject to these Terms.
1.3 By starting to use the Service or any of its functions, the User is deemed to have accepted the present Terms, the license agreement available at https://yango.com/legal/yango_mobile_agreement and other documents relating to the Service, if any (the “Regulatory Documents”), in their entirety, without any reservations or exceptions. If the User does not agree with any of the provisions of the Terms and/or the Regulatory Documents, the User may not use the Service.
1.4. The service is provided free of charge to Users.
1.5. The Service enables the User to :
- Consult advertisements posted by Users (the “Advertisement”) and search for these Advertisements using parameters defined by the User;
- Place information on the User's potential offer to sell Products in the available categories ;
- Communicate with Users who have placed Ads and who are potentially interested in concluding a sales contract (the “Contract”);
- Leave comments, as well as replies to comments concerning certain Sellers' Products.
The Users who offer the Products in the Advertisements are hereinafter referred to as the “Sellers”, and the Users who wish to purchase the Products by concluding the Transaction with the Sellers via the Services are hereinafter referred to as the “Buyers”.
1.6. The User's ad search requests are processed by the Service's automatic algorithms in order to provide relevant information in the search results. Users use the information published in the advertisements to enter into contracts with other Users at their own risk, without any direct or indirect involvement or control by the Services or its representatives.
1.7. For the avoidance of doubt, the Service does not act as a party, agent, intermediary, buyer arranger, seller, employer, intermediary, representative of a User, beneficiary or other interested person in connection with Contracts negotiated or entered into between Users, nor does it provide payment processing, delivery, agency or help desk services.
YOU ACKNOWLEDGE THAT THE SERVICE DOES NOT PROVIDE AGENCY, INTERMEDIARY, PAYMENT PROCESSING, DELIVERY OR TRANSPORTATION SERVICES, NOR DOES IT ACT AS A PARTY TO A TRANSACTION, AGENT OR INTERMEDIARY, AND THAT TRANSACTIONS ARE ENTERED INTO WITH THIRD PARTIES AT YOUR DISCRETION, RISK AND EXPENSE. THE RELATIONSHIP BETWEEN YOU AND ANY OTHER PARTY TO A TRANSACTION IS GOVERNED BY THE RELEVANT AGREEMENTS BETWEEN YOU AND SUCH OTHER PARTY. THE YANGO SELL&BUY SERVICE IS NOT A PARTY TO TRANSACTIONS AND IS NOT RESPONSIBLE FOR THE OUTCOME OF TRANSACTIONS ENTERED INTO WITH THIRD PARTIES THROUGH THE SERVICE.
1.8. During the period of testing, updating or technical development of the Service, all or part of the functions of the Service may be inaccessible or restricted. Functions are considered restricted for the User if he/she cannot explicitly use them. It is forbidden to apply technical or software methods to circumvent these limitations. The provisions herein governing the functionalities of the Service restricted to the User shall apply until such functionalities become explicitly accessible to the User. Information on the accessibility of Service functions in a certain region will be provided to the User upon request to the Service.
2. USER DATA
2.1. The information provided by the User to the Service and/or to other Users must be reliable, up to date and must not violate the law or the rights of third parties. Users are required to update this information in their Service profile if necessary.
2.2. The Service cannot guarantee that all information published by Users in the Service is true or correct. Users should exercise caution when entering into contracts.
2.3. The Service is not responsible for the illegal actions of third parties in relation to information that a User has independently published in the Service and made available to other Users.
2.4. The Service may request data from the User in order to confirm his/her identity or to verify information provided to the Service.
3. PERSONAL DATA
3.1. The User publishes his personal data on his public account (the “Profile”) or Advertisements so that other Users can contact him or obtain the most complete information about the Products offered in the Advertisement, so that the User independently discloses the personal data to an indefinite number of people.
3.2. The User consents to the processing of his/her personal data by the Service. When the User accesses the Service, his/her personal data is processed under the conditions and for the purposes described in the Privacy Notice available at the following address: (https://yango.com/legal/yango_privacy_notice ).
4. ADVERTISING CONTENT
4.1. The purpose for which Sellers publish information in the Service is to establish contact with a potential Buyer who is interested in concluding a Contract concerning the Product in the Advertisement. Advertisements may be published in the product categories available on the Service. The choice of category is the responsibility of the Seller. The Service may, at its discretion, move the Product to a more relevant category.
4.2. The price of the products offered in the advertisements, as well as the final price of the product agreed in the agreement and the agreed terms and methods of payment, are left to the discretion and responsibility of the Users. The Service is not responsible for the fairness, accuracy or market suitability of such prices, terms and methods of payment.
4.3. For further information on the products offered (including their origin, quality, size, color, weight, technical specification, current availability, title and any other relevant information) and on the seller, the buyer may contact the seller or provide the seller's contact details through the Service's functions so that the seller can independently contact the buyer and provide information on the products offered.
4.4. The texts, images and videos that Users publish in advertisements, the public part of their profile and comments constitute User content (the “User Content”). Placement of User Content is permitted for informational purposes only.
4.5. The Service does not act as a creator and distributor of User Content. Users create, modify, publish and make available to an unlimited number of people and delete User Content (including personal data) independently, without the participation or consent of the Service.
4.6. The User warrants that the User Content fully complies with applicable laws and the Terms and does not infringe the rights of third parties, including their intellectual property rights.
4.7. The Service may pre-screen User content to ensure that it complies with the Terms and may refuse to publish such content at its sole discretion. Due diligence does not relieve the seller of full responsibility for the User's content, in accordance with article 4.6.
4.8. The Service is not responsible for the content and/or relevance of the information relating to the Product, nor for the details of the Transaction provided by the Sellers in the Advertisements or for any information exchanged between the Buyers and the Seller as described in the Conditions. The User must discuss independently (without the involvement of the Service) the sale or acquisition of the Product with other Users. The Service is not responsible for financial and other transactions carried out by Users and for the consequences of the sale or acquisition of Products via the Service.
4.9. The Service has the right to retain archived copies of User Content.
4.10. The Service has the right to take all necessary measures concerning the User's content on the basis of requests from authorized authorities or holders of intellectual property rights or means of individualization in the cases and in accordance with the procedures established by the legislation of the Ivory Coast.
4.11. The User grants the Service and Yango's affiliates the right to use the User Content and the intellectual property or means of individualization contained therein, during the term of validity of the exclusive rights to the corresponding intellectual property or means of individualization, by any means, under a free, non-exclusive license and for worldwide use.
The Service has the right to display User Content and the Intellectual Property or means of individualization included therein in advertisements for the Service and Yango affiliates.
At the same time, the Service is not obliged to provide reports on the use of User Content and the Intellectual Property and means of individualization contained therein in accordance with the Terms.
Notwithstanding the preceding paragraph, Users retain a right of access to their personal data in accordance with applicable law and the Privacy Notice.
4.12. The Service may ask Users to disclose data relating to Contracts entered into on a voluntary basis for internal statistical purposes and in cases where such disclosure is required by the provisions of applicable legislation in Bolivia.
4.13. The User may access the functions for rating Sellers and commenting on Products/Businesses. The Service reserves the right to refuse to publish ratings/comments and to delete/block, at any time, any rating/comment published by the User, at its own discretion and without giving any reason. Thanks to the Service's functionalities, the Seller can also access aggregated information concerning ratings made by Users, which are calculated on the basis of the average of recent ratings. Ratings and comments are provided by Users at their discretion to express their subjective opinion and evaluate communication or Contracts with other Users. The Service is not responsible for their credibility or content.
5. COMMUNICATION WITH USERS
5.1. Authorized Users may write to other Users to request or receive information about the Products or Market conditions. Messages and calls may not be used for any other purpose, including transferring communication between Users to other messaging or communication channels by sending links to other sites, resources and services on the Internet.
5.2. The User undertakes only to send messages and calls to other Users for the purposes set out in the Terms of Use and to comply with the provisions of applicable legislation on the protection of personal data.
5.3. The Service does not have access to Users' correspondence and is not responsible for its content.
6. SERVICE COMMUNICATIONS
6.1. Service notifications (the “Service Notifications”) are part of the functionality of the Service. Notifications about unread notifications are displayed in the Service's mobile application, a counter is displayed on the application's home page. Service notifications may also include a request for confirmation of registration to the Service, notification of restricted access to a profile or ads, Service alerts related to the User's actions in the Service, notification of changes to Service features, terms of use or new Service features. The User may not unsubscribe from Service notifications.
6.2. Service notifications may be sent via your profile's notification center, on your device in the form of push notifications, as well as in messages on the Service. The User may unsubscribe from Service messages by using the relevant functions of the Service.
7. USE OF THE SERVICE
7.1. By using the Service and its features, the User agrees to act in good faith and to comply strictly with all applicable legal regulations in Bolivia and the Terms of Service and, among other things, warrants that it has, and shall have, full authority and competence to perform the use of the Service, offer the Products, sell the Products, post the User Content of the Products and enter into negotiations and that it legally holds all rights including intellectual property rights, licenses, consents, permits and other titles, required by applicable law to perform actions set out in this clause 7.1 hereof.
7.2. The User must not:
- offer for sale Products whose sale is restricted or prohibited in Bolivia;
- publish deliberately false information in the Profile, in Advertisements or in feedbacks;
- provide deliberately false information to other Users of the Service;
- contact Users for purposes other than those related to the potential Operation;
- use information from advertisements and communications with other Users for purposes not covered by the Terms;
- collect contacts from other Users for unfair purposes, including, but not limited to, spam and irrelevant calls on matters unrelated to advertisements published on the Service;
- copy information contained in advertisements using automatic means ;
- commit actions that provoke violence, hatred or a disrespectful attitude, contain threats or insults, justify or incite illegal or unfair actions, do not respect moral standards or commercial practices, including the use of obscene and coarse language or the distribution of obscene images or any other type of unacceptable video or audio recordings.
- use the Service, the Service's functionalities or the information published in the Advertisements for purposes not provided for in the Terms;
- take any action likely to interfere with the normal operation of the Service.
- commit any other action prohibited by the Terms or by the legislation applicable in Bolivia.
7.3. Transactions carried out on the Service are regulated by the Laws of Bolivia. Users are responsible for avoiding offering, advertising or selling products that are prohibited and/or restricted in the jurisdiction. By accepting the Agreement, you acknowledge that you may not publish products related to:
1) Medicines and related products: Laboratory reagents, Medical equipment (glucometer, blood pressure monitor, etc.), Medical samples, Baby formula, Baby bottles, Teats, Steroids, Food supplements, Aphrodisiacs, Growth hormone, Product to develop certain parts of the body.
1) Lightening cosmetics or hygiene products:
- Creams, soaps, gels, serums, capsules containing mercury and its derivatives
- Creams, soaps, gels, serums, capsules containing more than 2% hydroquinone
- Creams, soaps, gels, serums, capsules containing corticosteroids and corticoids
- Creams, soaps, gels, serums, capsules containing retinol derivatives (vitamin A)
2) Drugs (narcotics) and illicit substances declared in the International Conventions as well as in the lists of controlled substances in force and published by the competent authority in Bolivia.
3) Tobacco and similar products:
- Nicotine-based products
- Cigarettes
- Electronic cigarettes
4) Dangerous products:
- Explosives / fireworks
- Fuels and certain propellants
- Toxic substances
- Radioactive products
5) Ready-to-use products:
- Currencies, including cryptoassets or other intangible assets, virtual or digital assets
- Reptile skin
6) Products for security forces:
- Signal blockers
- Camouflage clothing/items
- Military uniforms
- Tear gas
- Police shields
- Defensive weapons (knives, Tasers, assault bombs)
- Gas mask
7) Products that may be used to commit crimes
- Weapons and toys similar to real weapons.
- Lock picking devices
8) Products subject to special regulations:
- Metallurgical minerals, precious stones, industrial precious metals
- Slot machines and all kinds of gaming machines
- Pesticides
9) Trash
10) Counterfeit goods
11) Animals, exotic animals and derivatives, protected species and others declared with restricted or prohibited sale.
12) Works of art, archaeological works and any works related to Cultural Heritage
13) Products that have not been subject to a customs regime that allows their possession and/or commercialization, or that have been clandestinely introduced into the national territory (contraband products).
7.4. The User is fully responsible for and will only offer for sale Products that have the marking, phytosanitary, veterinary and other documents applicable to certain Products, marking, certificates etc. proving their compliance with consumer protections and other applicable regulations of the laws of Bolivia.
7.5. The User shall provide Buyers with all information required to ensure the sale of certain Products in Bolivia.
7.4. The User is aware and confirms that, should he fail to comply with the above requirements, he shall be solely responsible for any adverse effects, , as well as the sole interlocutor in the event of any investigation or determination by the competent authorities.
8. PENALTIES FOR BREACH OF THE TERMS OF USE OF THE SERVICE
8.1. If the violation of the Terms is identified on the basis of the User's complaints or in the results of the Service's checks, the Service has the right to take the following measures with respect to the User who has committed the violation: restrict access to the User's Profile or to certain features of the Service, including temporarily, for example, restricting access to messaging via the Service, restricting the display of that User's ads in search results, hiding the display of ads on the map, rejecting or blocking ads, restricting access to the Service from certain IP addresses and telephone numbers.
8.2. The User takes the risk of not consulting a new version of the conditions and regulatory documents. Continued use of the Service after the conditions or regulatory documents have been modified shall constitute acceptance of the new version.
10.2. The User must cease to use the Service if he/she does not agree with the modifications made to the present conditions in accordance with article 10.1 hereof.
11. INTELLECTUAL PROPERTY
11.1. The User who incorporates images and/or photographs in the publication of a product on Yango Sell&Buy must be the owner or legally authorized to exercise the rights of publication, reproduction, adaptation and/or distribution of the images.
11.2. The User acknowledges and accepts that the publication of images and/or photographs is his/her sole responsibility and therefore, exempts RideTechnology Global FZ-LLC from legal liability to third parties for the violation of intellectual property rights or other related rights. Without prejudice to the above, RideTechnology Global FZ-LLC may preventively and at its sole discretion, eliminate images that: i) are registered with the National Intellectual Property Service (SENAPI), or ii ) when the Company reasonably interprets as possible violations of intellectual property rights; depending on the severity of the case, RideTechnology Global FZ-LLC may, without prior notice, eliminate the publication or set of publications of the User in question, reserving the right to initiate legal actions for civil, criminal and/or administrative liability.

Mediante los términos y condiciones (los "Términos'') se constituye una oferta de RideTechnology Global FZ-LLC ("Yango") a un usuario de Internet (el "Usuario") para el uso de Yango Sell&Buy, el catálogo electrónico de listados de propiedades y otras ofertas (los "Productos") en Bolivia (el "Servicio").
1.2. El uso del Servicio por parte del Usuario y/o Visitante se rige por estos Términos. Todas las características actualmente disponibles del Servicio, así como cualquier desarrollo y/o nuevas características añadidas, están sujetas a este Acuerdo.
1.3. Al comenzar a utilizar el Servicio o cualquiera de sus funciones, se considera que el Usuario ha aceptado los presentes Términos, el acuerdo de licencia disponible en https://yango.com/legal/yango_mobile_agreement y otros documentos relacionados con el Servicio, si los hubiera (los "Documentos Regulatorios"), en su totalidad, sin reservas ni excepciones. Si el Usuario no está de acuerdo con alguna de las disposiciones de los Términos y/o los Documentos Regulatorios, el Usuario no podrá utilizar el Servicio.
1.4. El Servicio se proporciona gratuitamente a los Usuarios.
1.5. El Servicio permite al Usuario:
- Consultar anuncios publicados por los Usuarios (los "Anuncios") y buscar estos Anuncios iutilizando parámetros definidos por el Usuario;
- Publicar información sobre la posible oferta del Usuario para vender Productos en las categorías disponibles;
- Comunicarse con Usuarios que hayan publicado Anuncios y que estén potencialmente interesados en celebrar un contrato de compraventa (el "Contrato");
- Dejar comentarios, así como respuestas a comentarios relacionados con los Productos de ciertos Vendedores.
Los Usuarios que ofrecen los Productos en los Anuncios serán referidos en adelante como los "Vendedores", y los Usuarios que deseen comprar los Productos mediante la conclusión de la Transacción con los Vendedores a través de los Servicios serán referidos en adelante como los "Compradores".
1.6. Las solicitudes de búsqueda de anuncios del Usuario son procesadas por los algoritmos automáticos del Servicio para proporcionar información relevante en los resultados de búsqueda. Los Usuarios utilizan la información publicada en los anuncios para celebrar contratos con otros Usuarios bajo su propio riesgo, sin ninguna participación directa o indirecta ni control por parte de los Servicios o sus representantes.
1.7. Para evitar cualquier duda, RideTechnology Global FZ-LLC no actúa como parte, agente intermediario, comprador, concertador, vendedor, intermediario, representante de algún usuario, beneficiario de alguna persona interesada en conexión con Contratos negociados o incurridos entre Usuarios, ni otorga procesamiento de pagos, entregas, agencias o servicios auxiliares o de atención al cliente.
USTED RECONOCE QUE EL SERVICIO NO CONSTITUYE AGENCIA, INTERMEDIACIÓN, PROCESAMIENTO DE PAGOS, ENTREGA O TRANSPORTE, NI ACTÚA COMO PARTE EN UNA TRANSACCIÓN, AGENTE O INTERMEDIARIO, NI COMERCIALIZA LOS PRODUCTOS OFERTADOS EN LA PLATAFORMA YANGO SELL&BUY, Y LAS TRANSACCIONES SON REALIZADAS CON TERCERAS PERSONAS A SU DISCRECIÓN, CUENTA Y COSTO. LA RELACIÓN ENTRE USTED Y CUALQUIER OTRA PARTE EN UNA TRANSACCIÓN ES GOBERNADA POR EL ACUERDO RELEVANTE ENTRE USTED Y DICHA PARTE. EL SERVICIO YANGO SELL&BUY NO ES UNA PARTE DE LA TRANSACCIÖN PACTADA CON TERCEROS A TRAVÉS DEL SERVICIO.
1.8. Durante el período de pruebas, actualización o desarrollo técnico del Servicio, todas o parte de las funciones del Servicio pueden estar inaccesibles o restringidas. Las funciones se consideran restringidas para el Usuario si no puede utilizarlas explícitamente. Está prohibido aplicar métodos técnicos o de software para eludir estas limitaciones. Las disposiciones aquí establecidas que regulan las funcionalidades del Servicio restringidas para el Usuario se aplicarán hasta que dichas funcionalidades se vuelvan explícitamente accesibles para el Usuario. La información sobre la accesibilidad de las funciones del Servicio en una determinada región se proporcionará al Usuario previa solicitud al Servicio.
2. TRATAMIENTO DE DATOS DE USUARIOS
2.1. La información proporcionada por el Usuario al Servicio y/o a otros Usuarios debe ser fiable, actualizada y no debe violar la ley ni los derechos de terceros. Los Usuarios están obligados a actualizar esta información en su perfil del Servicio si es necesario.
2.2. El Servicio no puede garantizar que toda la información publicada por los Usuarios en el Servicio sea verdadera o correcta. Los Usuarios deben ejercer cautela y debida diligencia al celebrar contratos.
2.3. El Servicio no es responsable de las acciones ilegales de terceros en relación con la información que un Usuario ha publicado de manera independiente en el Servicio y ha puesto a disposición de otros Usuarios.
2.4. El Servicio puede solicitar datos al Usuario para confirmar su identidad o verificar la información proporcionada al Servicio.
3. DATOS PERSONALES
3.1. El Usuario publica sus datos personales en su cuenta pública (el "Perfil") o Anuncios para que otros Usuarios puedan contactarlo u obtener la información más completa sobre los Productos ofrecidos en el Anuncio, de modo que el Usuario divulga de manera independiente los datos personales a un número indeterminado de personas.
3.2. El Usuario acepta expresamente el tratamiento de sus datos personales por parte del Servicio. Cuando el Usuario accede al Servicio, sus datos personales son tratados en las condiciones y con los fines descritos en el Aviso de Privacidad disponible en la siguiente dirección: (https://yango.com/legal/yango_privacy_notice).
4. CONTENIDO PUBLICITARIO
4.1. El propósito por el cual los Vendedores publican información en el Servicio es establecer contacto con un potencial Comprador interesado en concluir un Contrato relacionado con el Producto en el Anuncio. Los Anuncios pueden ser publicados en las categorías de productos disponibles en el Servicio. La elección de la categoría es responsabilidad del Vendedor. El Servicio puede, a su discreción, mover el Producto a una categoría más relevante.
4.2. El precio de los productos ofrecidos en los anuncios, así como el precio final del producto pactado en el contrato y los términos y métodos de pago acordados, quedan a discreción y responsabilidad de los Usuarios. RideTechnology Global FZ-LLC no es responsable de la imparcialidad, exactitud o idoneidad del mercado de dichos precios, términos y métodos de pago.
4.3. Para obtener más información sobre los productos ofrecidos (incluido su origen, calidad, tamaño, color, peso, especificaciones técnicas, disponibilidad actual, título y cualquier otra información relevante) y sobre el vendedor, el comprador puede ponerse en contacto con el vendedor o proporcionar los datos de contacto del vendedor. a través de las funciones del Servicio para que el vendedor pueda contactar de forma independiente con el comprador y proporcionarle información sobre los productos ofrecidos.
4.4. Los textos, imágenes y vídeos que los Usuarios publican en anuncios, su perfil público y los comentarios constituyen Contenido del Usuario (el “Contenido del Usuario”). La colocación de Contenido de usuario está permitida únicamente con fines informativos.
4.5. El Servicio no actúa como creador ni distribuidor de Contenido de usuario. Los usuarios crean, modifican, publican y ponen a disposición de un número ilimitado de personas y eliminan contenido del usuario (incluidos datos personales) de forma independiente, sin la participación o el consentimiento del Servicio.
4.6. El Usuario garantiza que el Contenido del Usuario cumple plenamente con las leyes aplicables y los Términos y no infringe los derechos de terceros, incluidos sus derechos de propiedad intelectual.
4.7. El Servicio puede realizar una evaluación previa del contenido del Usuario para garantizar que cumple con los Términos y puede negarse a publicar dicho contenido a su exclusivo criterio. La diligencia debida no exime al vendedor de la plena responsabilidad por el contenido del Usuario, de conformidad con el artículo 4.6.
4.8. El Servicio no es responsable del contenido y/o relevancia de la información relacionada con el Producto, ni de los detalles de la Transacción proporcionada por los Vendedores en los Anuncios o de cualquier información intercambiada entre los Compradores y el Vendedor como se describe en las Condiciones. El Usuario debe discutir de forma independiente (sin la participación del Servicio) la venta o adquisición del Producto con otros Usuarios. RideTechnology Global FZ-LLC no es responsable de las transacciones financieras y de otro tipo realizadas por los Usuarios ni de las consecuencias de la venta o adquisición de Productos a través del Servicio.
4.9. RideTechnology Global FZ-LLC tiene derecho a conservar copias archivadas del Contenido del usuario.
4.10. RideTechnology Global FZ-LLC tiene derecho a tomar todas las medidas necesarias relativas al contenido del Usuario sobre la base de solicitudes de autoridades competentes o titulares de derechos de propiedad intelectual o medios de individualización en los casos y de acuerdo con los procedimientos establecidos por la legislación de Bolivia.
4.11. El Usuario otorga a RideTechnology Global FZ-LLC y a los afiliados de Yango el derecho de utilizar el Contenido del Usuario y la propiedad intelectual o los medios de individualización contenidos en el mismo, durante el plazo de vigencia de los derechos exclusivos sobre la propiedad intelectual o los medios de individualización correspondientes, por cualquier medio, bajo una licencia gratuita, no exclusiva y para uso mundial.
RideTechnology Global FZ-LLC tiene derecho a mostrar el Contenido del Usuario y la Propiedad Intelectual o los medios de individualización incluidos en el mismo en los anuncios del Servicio y de las afiliadas de Yango.
Al mismo tiempo, RideTechnology Global FZ-LLC no está obligada a proporcionar informes sobre el uso del Contenido del Usuario y la Propiedad Intelectual y los medios de individualización contenidos en el mismo de acuerdo con los Términos.
Sin perjuicio de lo dispuesto en el párrafo anterior, los Usuarios conservan el derecho de acceso a sus datos personales de conformidad con la legislación aplicable y el Aviso de Privacidad.
4.12. El Servicio podrá requerir u obtener de los Usuarios la divulgación de datos relativos a Contratos celebrados de forma voluntaria para fines estadísticos internos y en los casos en que dicha divulgación sea requerida por las disposiciones de la legislación aplicable en Bolivia.
4.13. El Usuario podrá acceder a las funciones de calificación de Vendedores y comentarios sobre Productos/Negocios. RideTechnology Global FZ-LLC se reserva el derecho de negarse a publicar calificaciones/comentarios y de eliminar/bloquear, en cualquier momento, cualquier calificación/comentario publicado por el Usuario, a su propia discreción y sin dar ningún motivo. Gracias a las funcionalidades del Servicio, el Vendedor también puede acceder a información agregada sobre las valoraciones realizadas por los Usuarios, que se calculan sobre la base de la media de las valoraciones recientes. Las calificaciones y comentarios son proporcionados por los Usuarios a su discreción para expresar su opinión subjetiva y evaluar la comunicación o los Contratos con otros Usuarios. El Servicio no es responsable de su credibilidad o contenido.
5. COMUNICACIONES ENTRE USUARIOS
5.1. Los Usuarios Autorizados podrán escribir a otros Usuarios para solicitar o recibir información sobre los Productos o las condiciones del Mercado. Los mensajes y las llamadas no se pueden utilizar para ningún otro propósito, incluida la transferencia de comunicación entre Usuarios a otros canales de mensajería o comunicación mediante el envío de enlaces a otros sitios, recursos y servicios en Internet.
5.2. El Usuario se compromete únicamente a enviar mensajes y llamadas a otros Usuarios para las finalidades establecidas en las Condiciones de Uso y a cumplir con lo dispuesto en la legislación aplicable en materia de protección de datos personales.
5.3. RideTechnology Global FZ-LLC no tiene acceso a la correspondencia de los Usuarios y no es responsable de su contenido.
6. COMUNICACIONES DE SERVICIO
6.1. Las notificaciones de servicio (las “Notificaciones de servicio”) son parte de la funcionalidad del Servicio. Las notificaciones sobre notificaciones no leídas se muestran en la aplicación móvil del Servicio y se muestra un contador en la página de inicio de la aplicación. Las notificaciones de servicio también pueden incluir una solicitud de confirmación de registro en el Servicio, notificación de acceso restringido a un perfil o anuncios, alertas de Servicio relacionadas con las acciones del Usuario en el Servicio, notificación de cambios en las características del Servicio, términos de uso o nuevas características del Servicio. El Usuario no podrá darse de baja de las notificaciones del Servicio.
6.2. Las notificaciones del servicio pueden enviarse a través del centro de notificaciones de su perfil, en su dispositivo en forma de notificaciones push, así como en mensajes en el Servicio. El Usuario puede darse de baja de los mensajes del Servicio utilizando las funciones relevantes del Servicio.
7. USO DEL SERVICIO
7.1. Al utilizar el Servicio y sus funciones, el Usuario acepta actuar de buena fe y cumplir estrictamente con todas las regulaciones legales aplicables en Bolivia y los Términos de Servicio y, entre otras cosas, garantiza que tiene y tendrá plena autoridad y competencia para el uso del Servicio, ofrecer los Productos, publicar el Contenido de Usuario de los Productos y entrar en el Negocio, y que posee legalmente todos los derechos, licencias, consentimientos, permisos y otros títulos, requeridos por la ley aplicable para utilizar el Servicio y entrar en el Negocio en relación con los Productos respectivos.
7.2. El Usuario no debe:
- Ofrecer en venta Productos cuya venta esté restringida o prohibida en Bolivia;
- Publicar información deliberadamente falsa en el Perfil, en Anuncios o en comentarios;
- Proporcionar información deliberadamente falsa a otros Usuarios del Servicio;
- Contactar a los Usuarios para fines distintos a los relacionados con la posible Operación;
- Utilizar información de anuncios y comunicaciones con otros Usuarios para fines no cubiertos por los Términos;
- Recopilar contactos de otros Usuarios con fines desleales, incluidos, entre otros, spam y llamadas irrelevantes sobre asuntos no relacionados con los anuncios publicados en el Servicio;
- Copiar información contenida en anuncios utilizando medios automáticos o automatizados;
- Cometer acciones que provoquen violencia, odio o una actitud irrespetuosa, contengan amenazas o insultos, justifiquen o inciten a acciones ilegales o desleales, no respeten las normas morales o prácticas comerciales, incluido el uso de lenguaje obsceno y grosero o la distribución de imágenes obscenas o cualquier otro tipo de grabaciones de video o audio inaceptables.
- Utilizar el Servicio, las funcionalidades del Servicio o la información publicada en los Anuncios para fines no previstos en los Términos;
- Tomar cualquier medida que pueda interferir con el funcionamiento normal del Servicio.
- Cometer cualquier otra acción prohibida por los Términos o por la legislación aplicable en Bolivia.
7.3. Las transacciones efectuadas en el Servicio están reguladas por las Leyes del Estado Plurinacional de Bolivia, los Usuarios son responsables de evitar ofrecer, anunciar o vender productos prohibidos y/o restringidos en la jurisdicción. Al aceptar el Acuerdo reconoce que no puede publicar productos relacionados a:
1) Medicamentos y productos relacionados: Reactivos de laboratorio, Equipos médicos (glucómetro, tensiómetro, etc.), Muestras médicas, Leches para bebés, Biberones, Tetinas, Esteroides, Complementos alimenticios, Afrodisíacos, Hormona de crecimiento, Producto para desarrollar determinadas partes del cuerpo.
2) Cosméticos aclarantes o productos de higiene:
a. Cremas, jabones, geles, sueros, cápsulas que contienen mercurio y sus derivados.
b. Cremas, jabones, geles, sueros, cápsulas que contengan más del 2% de hidroquinona
c. Cremas, jabones, geles, sueros, cápsulas que contienen corticoides y corticosteroides.
d. Cremas, jabones, geles, sueros, cápsulas que contengan derivados del retinol (vitamina A).
3) Drogas (estupefacientes) y sustancias ilícitas declaradas en las Convenciones Internacionales así como en las listas de sustancias controladas vigentes y publicadas por la autoridad competente en Bolivia.
4) Tabaco y productos similares:
a. Productos a base de nicotina
b. Cigarrillos
c. Cigarrillos electrónicos
5) Productos peligrosos:
a. Explosivos / fuegos artificiales
b. Combustibles y ciertos carburantes.
c. Sustancias tóxicas
d. Productos radiactivos
6) Productos listos para usar:
a. Monedas. Incluyendo criptoactivos u otros bienes intangibles, activos virtuales o digitales.
b. Piel de reptil.
7) Productos para fuerzas de seguridad:
a. Bloqueadores de señal
b. Ropa/artículos de camuflaje
c. Uniformes militares
d. Gases lacrimógenos
e. Escudos policiales
f. Armas defensivas (cuchillos, Tasers, bombas de asalto)
g. Máscara de gas
8) Productos susceptibles de ser utilizados para cometer delitos
a. Armas y juguetes similares a armas reales.
b. Dispositivos para abrir cerraduras
9) Productos sujetos a regulaciones especiales:
a. Minerales metalúrgicos, piedras preciosas, metales preciosos industriales
b. Máquinas tragamonedas y todo tipo de máquinas de juego
c. Pesticidas
10) Basura
11) Libros electrónicos y software falsificados
12) Productos de marca
13) Animales, animales exóticos y derivados, especies protegidas y otras declaradas con venta restringida o prohibida.
14) Obras de Arte, arqueológicas y cualquiera relacionada con el Patrimonio Cultural
15) Productos que no hubiesen sido sometidos a un régimen aduanero que permita su tenencia y/o comercialización, o que hubiesen sido introducidos clandestinamente al territorio nacional (productos de contrabando).
7.4. El Usuario es totalmente de ofrecer a la venta solamente Productos que cuenten con el marcado, documentos fitosanitarios, veterinarios y otros aplicables a ciertos Productos, marcado, certificados, etc. que demuestren su cumplimiento con las protecciones al consumidor y otras regulaciones aplicables de las leyes de Bolivia.
7.5. El Usuario deberá proporcionar a los Compradores toda la información requerida para asegurar la venta de ciertos Productos en Bolivia.
7.6. El Usuario es consciente y confirma que, en caso de incumplir los requisitos anteriores, será el único responsable de cualquier efecto adverso, así como el único interlocutor ante cualquier investigación o determinación por las autoridades competentes.
8. SANCIONES POR INCUMPLIMIENTO DE LOS TÉRMINOS DE USO DEL SERVICIO
8.1. Sí la violación de los Términos se identifica sobre la base de las quejas del Usuario o en los resultados de las verificaciones del Servicio, el Servicio tiene derecho a tomar las siguientes medidas con respecto al Usuario que ha cometido la violación: restringir el acceso al Perfil del Usuario o ciertas características del Servicio, incluyendo temporalmente, por ejemplo, restringir el acceso a la mensajería a través del Servicio, restringir la visualización de los anuncios de ese Usuario en los resultados de búsqueda, ocultar la visualización de anuncios en el mapa, rechazar o bloquear anuncios, restringir el acceso al Servicio desde ciertas direcciones IP y números de teléfono, entre otras acciones que se consideren necesarias.
8.2. El acceso al perfil puede restringirse, entre otros, en caso de quejas de otros Usuarios sobre dicho perfil, identificación de acciones que conduzcan a spam, violaciones repetidas o maliciosas de los términos de servicio (incluida la publicación en anuncios de información que no no se corresponden con la realidad), piratería del perfil (hack), publicación de reseñas falsas, liquidación de la persona jurídica representada por el Usuario, así como en el caso de que el servicio identifique signos de fraude en el comportamiento del Usuario, la imposición de servicios adicionales y condiciones, no incluidos en la oferta inicial del producto, o si el Usuario ha registrado un nuevo perfil en el servicio en sustitución del perfil previamente bloqueado.
8.3. Si el Usuario elimina por completo las violaciones de las condiciones, el Servicio podrá, a su discreción, restablecer el acceso al Perfil.
8.4. El Servicio se reserva el derecho de realizar comprobaciones aleatorias del cumplimiento de los Términos por parte de los Usuarios en cualquier momento y a su propia discreción, incluso mediante métodos automatizados.
8.5. El Servicio no es responsable de las pérdidas causadas a los Usuarios en relación con la acción enumerada en esta sección de los Términos.
8.6. El Usuario reconoce que en caso de violación de las leyes aplicables o de los derechos de terceros identificada en la utilización del Servicio, el Usuario puede estar sujeto a responsabilidad administrativa, penal y/o civil, entre otras.
9. RECOMENDACIONES DE SEGURIDAD PARA LOS USUARIOS
9.1. Sin perjuicio de lo dispuesto previamente del presente Acuerdo, se proporciona las siguientes recomendaciones para mejorar la seguridad de los Usuarios en la utilización del Servicio:
- Asegurarse de que el Usuario haya realizado la solicitud correcta;
- Abstenerse de transferir el pago anticipado, especialmente durante la primera transacción con el vendedor;
- Evitar la apertura de enlaces de terceros enviados por otros Usuarios;
- Garantizar la seguridad de los datos. Evitar enviar datos de pasaporte, familiares, domicilio, financieros, fiscales u otros datos sensibles a otros Usuarios;
- No compartir datos de tarjetas de crédito: no brindar a nadie el código CVV/CVC, la fecha de caducidad o el código SMS bancario de una tarjeta;
- Al vender una computadora o dispositivo móvil, cerrar sesión en todas las cuentas, desasociar todos los perfiles y restablecer el dispositivo a la configuración de fábrica;
- Revisar el producto cuidadosamente para asegurarse de que no haya sido reemplazado por un producto similar que esté dañado o no funcione;
- Comprobar cuidadosamente los pagos en efectivo realizados tras la finalización de la Oferta;
- Celebrar reuniones con Vendedores y Compradores durante el día en lugares públicos seguros;
- Tome una fotografía del Producto y grabe en video su funcionamiento cuando envíe o acepte Productos a través de servicios de entrega.
9.2. Las disposiciones de esta sección “Recomendaciones de seguridad” son de carácter informativo, no deben considerarse como asesoramiento legal y el Usuario no debe confiar en ellas como una medida completa que garantiza la seguridad de la operación.
10. MODIFICACIONES
10.1. RideTechnology Global FZ-LLC podrá, en cualquier momento y sin previo aviso, modificar las disposiciones del presente, y podrá, en cualquier momento y sin previo aviso, modificar las disposiciones de los Documentos Normativos. La versión actual del presente está disponible en la siguiente dirección: https://yango.com/legal/yango_sb_termsofuse . El Usuario asume cualquier responsabilidad por no haber consultado toda nueva versión de las condiciones y documentos reglamentarios. El uso continuado del Servicio después de que las condiciones o documentos reglamentarios hayan sido modificados constituirá la aceptación de la nueva versión.
10.2. El Usuario deberá dejar de utilizar el Servicio si no está de acuerdo con las modificaciones introducidas en las presentes condiciones de conformidad con el artículo 10.1 del presente.
11. DE LA PROPIEDAD INTELECTUAL E INDUSTRIAL.
11.1. El Usuario que incorpore imágenes y/o fotografías en la publicación de un producto en Yango Sell&Buy, deberá ser titular o estar legalmente autorizado para ejercer los derechos de publicación, reproducción, adaptación y/o distribución de las imágenes.
El Usuario reconoce y acepta que la publicación de las imágenes y/o fotografías es de su absoluta responsabilidad y por lo tanto, exime a RideTechnology Global FZ-LLC de responsabilidad legal frente a terceros por la vulneración de derechos de propiedad intelectual u otros relacionados. Sin perjuicio de lo descrito anteriormente, RideTechnology Global FZ-LLC de forma preventiva y a su entera discrecionalidad, podrá eliminar las imágenes que: i) estén registradas en el Servicio Nacional de Propiedad Intelectual (SENAPI), o ii) cuando la Empresa razonablemente interprete como posibles vulneraciones a los derechos de propiedad intelectual; dependiendo en la gravedad del caso, RideTechnology Global FZ-LLC sin previo aviso podrá eliminar la publicación o el conjunto de publicaciones del Usuario en cuestión, reservándose el derecho de iniciar acciones legales por responsabilidad civil, penal y/o administrativa.
12. LEY APLICABLE Y SOLUCIÓN DE CONTROVERSIAS
12.1. Los Términos de Uso y cualquier obligación no contractual que surgiese de, o en conexión con, los Términos de Uso, será sujeta a las normas de Inglaterra y Gales, sin recurso a sus normas especiales de conflicto de leyes.
12.2. 1. General terms and conditions
1.1. These terms and conditions (the “Terms”) constitute an offer by RideTechnology Global FZ-LLC (“Yango”) to an Internet user (the “User”) for the use of Yango Sell&Buy, the electronic catalogue of property listings and other offers (the “Products”) in Pakistan (the “Service”).
1.2. Use of the Service by the User is governed by these Terms. All currently available features of the Service, as well as any developments and/or new features added, are subject to these Terms.
1.3. By starting to use the Service or any of its functions, the User is deemed to have accepted the present Terms, the license agreement available at https://yango.com/legal/yango_mobile_agreement and other documents relating to the Service, if any (the “Regulatory Documents”), in their entirety, without any reservations or exceptions. If the User does not agree with any of the provisions of the Terms and/or the Regulatory Documents, the User may not use the Service.
1.4. The service is provided free of charge to Users.
1.5. The Service enables the User to:
- Consult advertisements posted by Users (the “Advertisement”) and search for these Advertisements using parameters defined by the User;
- Place information on the User's potential offer to sell Products in the available categories;
- Communicate with Users who have placed Ads and who are potentially interested in concluding a sales contract (the “Contract”);
- Leave comments, as well as replies to comments concerning certain Sellers' Products.
1.6. The Users who offer the Products in the Advertisements are hereinafter referred to as the “Sellers”, and the Users who wish to purchase the Products by concluding the Transaction with the Sellers via the Services are hereinafter referred to as the “Buyers”.
1.7. The User's ad search requests are processed by the Service's automatic algorithms in order to provide relevant information in the search results. Users use the information published in the advertisements to enter into contracts with other Users at their own risk, without any direct or indirect involvement or control by the Services or its representatives.
1.8. For the avoidance of doubt, the Service does not act as a party, agent, intermediary, buyer arranger, seller, employer, intermediary, representative of a User, beneficiary or other interested person in connection with Contracts negotiated or entered into between Users, nor does it provide payment processing, delivery, agency or help desk services.
YOU ACKNOWLEDGE THAT THE SERVICE DOES NOT PROVIDE AGENCY, INTERMEDIARY, PAYMENT PROCESSING, DELIVERY OR TRANSPORTATION SERVICES, NOR DOES IT ACT AS A PARTY TO A TRANSACTION, AGENT OR INTERMEDIARY, AND THAT TRANSACTIONS ARE ENTERED INTO WITH THIRD PARTIES AT YOUR DISCRETION, RISK AND EXPENSE. THE RELATIONSHIP BETWEEN YOU AND ANY OTHER PARTY TO A TRANSACTION IS GOVERNED BY THE RELEVANT AGREEMENTS BETWEEN YOU AND SUCH OTHER PARTY. THE YANGO SELL&BUY SERVICE IS NOT A PARTY TO TRANSACTIONS AND IS NOT RESPONSIBLE FOR THE OUTCOME OF TRANSACTIONS ENTERED INTO WITH THIRD PARTIES THROUGH THE SERVICE.
1.9. During the period of testing, updating or technical development of the Service, all or part of the functions of the Service may be inaccessible or restricted. Functions are considered restricted for the User if he/she cannot explicitly use them. It is forbidden to apply technical or software methods to circumvent these limitations. The provisions herein governing the functionalities of the Service restricted to the User shall apply until such functionalities become explicitly accessible to the User. Information on the accessibility of Service functions in a certain region will be provided to the User upon request to the Service.
2. User data
2.1. The information provided by the User to the Service and/or to other Users must be reliable, up to date and must not violate the law or the rights of third parties. Users are required to update this information in their Service profile if necessary.
2.2. The Service cannot guarantee that all information published by Users in the Service is true or correct. Users should exercise caution when entering into contracts.
2.3. The Service is not responsible for the illegal actions of third parties in relation to information that a User has independently published in the Service and made available to other Users.
2.4. The Service may request data from the User in order to confirm their identity or to verify information provided to the Service.
3. Personal data
3.1 The User publishes their personal data on their public account (the “Profile”) or Advertisements so that other Users can contact their or obtain the most complete information about the Products offered in the Advertisement, so that the User independently discloses the personal data to an indefinite number of people.
3.2 When the User accesses the Service, their personal data is processed under the conditions and for the purposes described in the Privacy Notice available at the following address: (https://yango.com/legal/yango_privacy_notice).
4. Advertising content
4.1. The purpose for which Sellers publish information in the Service is to establish contact with a potential Buyer who is interested in concluding a Contract concerning the Product in the Advertisement. Advertisements may be published in the product categories available on the Service. The choice of category is the responsibility of the Seller. The Service may, at its discretion, move the Product to a more relevant category.
4.2. The price of the products offered in the advertisements, as well as the final price of the product agreed in the agreement and the agreed terms and methods of payment, are left to the discretion and responsibility of the Users. The Service is not responsible for the fairness, accuracy or market suitability of such prices, terms and methods of payment.
4.3. For further information on the products offered (including their origin, quality, size, colour, weight, technical specification, current availability, title and any other relevant information) and on the seller, the buyer may contact the seller or provide the seller's contact details through the Service's functions so that the seller can independently contact the buyer and provide information on the products offered.
4.4. The texts, images and videos that Users publish in advertisements, the public part of their profile and comments constitute User content (the “User Content”). Placement of User Content is permitted for informational purposes only.
4.5. The Service does not act as a creator and distributor of User Content. Users create, modify, publish and make available to an unlimited number of people and delete User Content (including personal data) independently, without the participation or consent of the Service.
4.6. The User warrants that the User Content fully complies with applicable laws and the Terms and does not infringe the rights of third parties, including their intellectual property rights.
4.7. The Service may pre-screen User content to ensure that it complies with the Terms and may refuse to publish such content at its sole discretion. Due diligence does not relieve the seller of full responsibility for the User's content, in accordance with article 4.6.
4.8. The Service is not responsible for the content and/or relevance of the information relating to the Product, nor for the details of the Transaction provided by the Sellers in the Advertisements or for any information exchanged between the Buyers and the Seller as described in the Conditions. The User must discuss independently (without the involvement of the Service) the sale or acquisition of the Product with other Users. The Service is not responsible for financial and other transactions carried out by Users and for the consequences of the sale or acquisition of Products via the Service.
4.9. The Service has the right to retain archived copies of User Content.
4.10. The Service has the right to take all necessary measures concerning the User's content on the basis of requests from authorized authorities or holders of intellectual property rights or means of individualization in the cases and in accordance with the procedures established by the legislation of the Ivory Coast.
4.11. The User grants the Service and Yango's affiliates the right to use the User Content and the intellectual property or means of individualization contained therein, during the term of validity of the exclusive rights to the corresponding intellectual property or means of individualization, by any means, under a free, non-exclusive license and for worldwide use.
4.12. The Service has the right to display User Content and the Intellectual Property or means of individualization included therein in advertisements for the Service and Yango affiliates.
4.13. At the same time, the Service is not obliged to provide reports on the use of User Content and the Intellectual Property and means of individualization contained therein in accordance with the Terms.
4.14. Notwithstanding the preceding paragraph, Users retain a right of access to their personal data in accordance with applicable law and the Privacy Notice.
4.15. The Service may ask Users to disclose data relating to Contracts entered into on a voluntary basis for internal statistical purposes and in cases where such disclosure is required by the provisions of applicable legislation in Pakistan.
4.16. The User may access the functions for rating Sellers and commenting on Products/Businesses. The Service reserves the right to refuse to publish ratings/comments and to delete/block, at any time, any rating/comment published by the User, at its own discretion and without giving any reason. Thanks to the Service's functionalities, the Seller can also access aggregated information concerning ratings made by Users, which are calculated on the basis of the average of recent ratings. Ratings and comments are provided by Users at their discretion to express their subjective opinion and evaluate communication or Contracts with other Users. The Service is not responsible for their credibility or content.
4.17 The Service does not store any items mentioned in the advertisements and does not provide warehousing or storage services. All handling, delivery, and logistics of Products are the responsibility of the Seller. Yango does not take possession of or provide storage for any Products listed or sold via the Service.
4.18 While the Service reserves the right to pre-moderate advertisements to ensure compliance with the Terms, this is done at its sole discretion and does not imply any obligation to screen all content. Yango is not responsible for the accuracy, quality, legality, or appropriateness of any advertisement content. The Seller remains solely responsible for all information and materials provided in their advertisements.
4.19 The Service serves solely as a platform that allows Users to post content, including advertisements, at their own discretion. While Yango strives to ensure that the content posted complies with relevant laws and is appropriate for the platform, there may instances where such content is posted by a Seller despite the screening measures in place. Users are fully responsible for the content they post and for ensuring compliance with applicable laws. Yango shall not be held legally liable for any content posted by Users or for any consequences arising from such content.
5. Communication with Users
5.1. Authorized Users may write to other Users to request or receive information about the Products or Market conditions. Messages and calls may not be used for any other purpose, including transferring communication between Users to other messaging or communication channels by sending links to other sites, resources and services on the Internet.
5.2. The User undertakes only to send messages and calls to other Users for the purposes set out in the Terms of Use and to comply with the provisions of applicable legislation on the protection of personal data.
5.3. The Service does not have access to Users' correspondence and is not responsible for its content.
6. Service communications
6.1. Service notifications (the “Service Notifications”) are part of the functionality of the Service. Notifications about unread notifications are displayed in the Service's mobile application, a counter is displayed on the application's home page. Service notifications may also include a request for confirmation of registration to the Service, notification of restricted access to a profile or ads, Service alerts related to the User's actions in the Service, notification of changes to Service features, terms of use or new Service features. The User may not unsubscribe from Service notifications.
6.2. Service notifications may be sent via your profile's notification centre, on your device in the form of push notifications, as well as in messages on the Service. The User may unsubscribe from Service messages by using the relevant functions of the Service.
7. Use of the Service
7.1. By using the Service and its features, the User agrees to act in good faith and to comply strictly with all applicable legal regulations in Côte d'Ivoire and the Terms of Service and, among other things, warrants that it has, and shall have, full authority and competence to perform the use of the Service, offer the Products, post the User Content of the Products and enter into the Business, and that it legally holds all rights, licenses, consents, permits and other titles, required by applicable law to use the Service and enter into the Business in connection with the respective Products.
7.2. The User must not:
- offer for sale Products whose sale is restricted or prohibited in Pakistan, including but not limited to those listed in cl.7.3.;
- publish deliberately false information in the Profile, in Advertisements or in feedbacks;
- provide deliberately false information to other Users of the Service;
- contact Users for purposes other than those related to the potential Operation;
- use information from advertisements and communications with other Users for purposes not covered by the Terms;
- collect contacts from other Users for unfair purposes, including, but not limited to, spam and irrelevant calls on matters unrelated to advertisements published on the Service;
- copy information contained in advertisements using automatic means ;
- commit actions that provoke violence, hatred or a disrespectful attitude, contain threats or insults, justify or incite illegal or unfair actions, do not respect moral standards or commercial practices, including the use of obscene and coarse language or the distribution of obscene images or any other type of unacceptable video or audio recordings.
- use the Service, the Service's functionalities or the information published in the Advertisements for purposes not provided for in the Terms ;
- take any action likely to interfere with the normal operation of the Service.
- commit any other action prohibited by the Terms or by the legislation applicable in Pakistan.
7.3. Users accept and agree that it is forbidden to offer the following products in advertisements and other features of the service to the Users:
- Drugs and controlled substances
- Weapons, arms, ammunition
- Alcohol and Intoxicants
- Tobacco products
- Animals and pets, including, but not limited to the endangered wildlife and animals as per Protection, Preservation, Conservation, and Management) Act, 1974.
- Human organs and tissues
- Human Trafficking and Sexual Services
- Counterfeit and pirated goods.
- Pornographic material;
- Stolen goods;
- Hazardous materials;
- Lottery tickets and gambling devices;
- Prescription drugs without a valid prescription or beyond their expiry date;
- Unregistered or unlicensed medical products/devices;
- Religious objects and other Items that can be considered blasphemous or offend religious sentiments or public decency;
- Forging official documents.
- Cars and automobiles
- Real estate
- Food and beverages
- Pharmaceuticals and prescription drugs
- Branded products without the appropriate authority or license to distribute, retail or otherwise resell the same.
- Blasphemous material
- Haram (prohibited) items
- Alcoholic beverages or any intoxicants, including items containing alcohol.
- Anti-religious or anti-nationalist goods
- Adult goods (any explicit sexual material including sex toys)
- Misleading religious or cultural symbols
- Invasive or illegal surveillance equipment
- Politically sensitive material
- Discriminatory or hate speech materials
- Unlicensed or pirated content such as movies, music, software, or books, especially those that infringe on intellectual property rights
- Illegal prescription drugs not approved by the Pakistan Drug Regulatory Authority
- All other products that legally require special licenses or authorizations, which have not been specifically provided for herein.
7.4. The User is fully responsible for and will only offer for sale Products that have the marking, phytosanitary, veterinary and other documents applicable to certain Products, marking, certificates etc. proving their compliance with consumer protections and other applicable regulations of the laws of Pakistan.
7.5. The User shall provide Buyers with all information required to ensure the sale of certain Products in Pakistan.
7.6. The User is aware and confirms that, should they fail to comply with the above requirements, they shall be solely responsible for any adverse effects.
8. Penalties for breach of the terms of use of the Service
8.1. If the violation of the Terms is identified on the basis of the User's complaints or in the results of the Service's checks, the Service has the right to take the following measures with respect to the User who has committed the violation: (i) restrict access to the User's Profile or to certain features of the Service, including temporarily, for example, restricting access to messaging via the Service, (ii) restricting the display of that User's ads in search results, (iii) hiding the display of ads on the map, (iv) rejecting or blocking ads, (v) restricting access to the Service from certain IP addresses and telephone numbers.
8.2. Access to the profile may be restricted, inter alia, in the event of complaints from other Users concerning such a profile, identification of actions leading to spam, repeated or malicious violations of the terms of service (including the publication in advertisements of information that does not correspond to reality), hacking of the profile, publication of false reviews, the liquidation of the legal entity represented by the User, as well as in the event that the service identifies signs of fraud in the User's behaviour, the imposition of additional services and conditions, not included in the initial product offering, or if the User has registered a new profile in the service in place of the previously blocked profile.
8.3. If the User completely eliminates the violations of the conditions, the Service may, at its discretion, restore access to the Profile.
8.4. The Service reserves the right to carry out random checks of Users' compliance with the Terms at any time and at its own discretion, including by automated methods.
8.5. The Service is not liable for any losses caused to Users in connection with the action listed in this section of the Terms.
8.6. The User acknowledges that in the event of violation of applicable laws or the rights of third parties when using the Service, the User may be subject to administrative, criminal or civil liability.
9. Safety recommendations for Users
9.1. Without prejudice to the provisions of Article 1.7 hereof, the Service provides the following recommendations to enhance the safety of Users when using the Service:
- ensure that the User has made the correct request ;
- refrain from transferring the prepayment, especially during the first transaction with the seller;
- avoid opening third-party links sent by other Users;
- ensure data security. Avoid sending passport, family, home address, financial, tax or other sensitive data to other Users;
- do not share credit card data: do not give anyone a card's CVV/CVC code, expiry date or bank SMS code.
- when selling a computer or mobile device, log out of all accounts, disassociate all profiles and reset the device to factory settings;
- check the product carefully to ensure that it has not been replaced by a similar product that is damaged or does not work
- carefully check cash payments.
- to hold meetings with Sellers and Buyers during the day in safe public places;
- take a picture of the Product and videotape its operation when you send or accept Products via delivery services.
9.2. The provisions of this “Safety Recommendations” section are of an informative nature, should not be considered as legal advice and should not be relied upon by the User as a complete measure guaranteeing the safety of the operation.
10. Modifications
10.1. Yango may, at any time and without notice, modify the provisions hereof, and may, at any time and without notice, modify the provisions of the Regulatory Documents. The current version hereof is available at the following address: https://yango.com/legal/yango_sb_termsofuse.
10.2. The User takes the risk of not consulting a new version of the conditions and regulatory documents. Continued use of the Service after the conditions or regulatory documents have been modified shall constitute acceptance of the new version.
10.3. The User must cease to use the Service if he/she does not agree with the modifications made to the present conditions in accordance with article 10.1 hereof.
11. Applicable law and settlement of disputes
11.1. The Terms of Use and any non-contractual obligations arising out of or in connection with the Terms of Use shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
11.2. Any dispute, difference, controversy or claim arising out of or in connection with these Terms of Use, including (but not limited to) any question regarding their existence, validity, interpretation, performance, discharge and applicable remedies, shall be submitted to and finally resolved by arbitration in accordance with the Arbitration Rules of the Dubai International Arbitration Centre, which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of the arbitration shall be Dubai, United Arab Emirates. The language used in the arbitration shall be English.
