Terms of Use of Yango Maps — Support service

1. General Provisions

1.1. MLU B.V. (hereinafter, referred to as the “Yango Maps”) invites an Internet user (hereinafter, referred to as the "User") to use service available on its online maps (hereinafter, referred to as the "Service") on the terms and conditions specified below.

1.2. By starting to use the Service/its certain functions, the User is deemed to have accepted these Terms of Use (hereinafter referred to as the “Terms”) in full, without any reservations and exceptions. If the User disagrees with any of the provisions of the said documents, the User shall not use the Service.

1.3. The current version of the Terms is always available at: at: https://yango.com/legal/yangomaps_termsofuse. Yango Maps may amend these Terms at any time without notice to the User. Revised Terms shall come into effect once posted online at the specified URL, unless otherwise stipulated in the revised Terms.

1.4. If Yango Maps has made any amendments to these Terms according to the procedure specified in Clause 1.3 hereof, and the User disagrees with these amendments, the User shall stop using the Service.

1.5. The Service enables the User to gain free access to updated mapping and other reference information. All currently available functions of the Service along with any developments and/or newly added options are subject to the Terms.

1.6. By using the Service, the User consents to receiving informational notices necessary for service provision and essential updates. The User may unsubscribe from the notices, including but not limited to advertising messages, by using relevant functions of the Service or following instructions specified in a message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. The Service functionally enables the User to add, at his or her choice and discretion, user information, including signs, marks, inscriptions, messages, etc. (hereinafter referred to as the "User Objects") on the maps. Insertion of the User Objects does not modify source data and is only acceptable to ensure service usability. The User may create, store and make freely available online links to the User Objects. Other users of the Service may also distribute links to the User Objects.

2.3. The User shall fully and solely bear all risks and responsibility for choosing the location of the User Objects, compliance with the laws, the contents, integrity, accuracy and reliability of descriptions of added User Objects. Yango Maps shall bear no responsibility for the designation and description of any User Object, shall not confirm or disprove the legislative compliance, accuracy and reliability of the description of any User Object. Yango Maps reserves the right, without notice and at its discretion, to delete any User Object or a set of User Objects, if the information in its description conflicts with applicable laws, contains abusive language, and in other cases when the designation and/or the description of the User Objects and/or the distribution of a link to the User Objects violates these Terms, and to protect interests of Yango Maps, service users, and other third parties.

2.4. The Service functionally enables the User to automatically plot routes on the maps showing an optional route from the point of departure to the destination indicated by the User (hereinafter referred to as the "Route"). The routing does not modify source data and is only acceptable to make the Service convenient for the User.

The user shall independently and entirely bear all risks and responsibility for choosing the Route and following the chosen Route. Yango Maps does not guarantee the correctness, optimality, relevance and/or compliance of the Routes with traffic rules and shall not be responsible for the User's choice of the Route and the consequences of following it. The User shall take all measures of care and caution before choosing any Route and during its use.

2.5. The Service may contain information about the current level of traffic congestion, a short-term forecast of congestion, as well as information about the average traffic congestion during the day.

The information available about traffic congestion is based on an analysis of anonymized data and shall be for reference only.

The color display of the road congestion level used in the Service shall not be an indication of the status of the road, the possibility of its free use, actual functioning and pass ability, and shall be only an indicator of an approximate degree of its congestion in the current period of time (green stands for “open”, yellow for “medium congestion”, and red for “high congestion”).

2.6. The Service uses items of intellectual property copyrighted to relevant right holders and information provided by its holders.

3. Use of Information on Organizations

3.1. The Service functionally enables the User to place, view and search information on businesses and organizations located at addresses displayed in the Service (hereinafter referred to as "Yango for Business”), including addresses, names, contact details, opening hours, services rendered / goods sold and user feedback (collectively referred to as " Information on Organizations”).

3.2. Yango for Business may contain information on organizations provided by partners of the Service, information placed by the administration of the Service, and information placed by Users as specified in cl. 3.5–3.7 hereof.

Yango Maps reserves the right (but not the obligation) to request at any time that the accuracy of information placed in the Service and/or the way a person exercising the right of managing an organization card in the Service relates to the organization’s activities be confirmed.

3.3. Information specified in the Yango for Business is for reference only. Yango Maps shall not be held liable for the accuracy, relevance and reliability of Information on Organizations and for the conformity of specified prices to prices valid at the time the User contacted an organization to buy goods / obtain services. Yango Maps takes no part in legal relations established between the User and an organization and shall not be held liable for the quality of goods it sells / services it renders.

3.4. Other Users of the Service can also view and edit information found in Yango for Business (except for feedback on organizations). Yango Maps shall not be held liable for changes Users made and for the use of Information on Organizations by third parties.

3.5. The User can place Information on Organizations in the Service following relevant forms. Yango Maps, without informing the User and giving any reasons, may not accept information on Organizations for placement or at any time remove or change Information on Organizations at own discretion.

3.6. The Service enables Users to post feedback on organizations. Feedback should express the User's value judgment of goods/services and (or) credibly describe actual circumstances that made him or her address an organization. Yango Maps shall not be held liable for the reliability, relevance, and accuracy of information in feedback. If a representative of an organization files a complaint, feedback can be deleted from the Service, if it violates feedback rules.

Feedback may be deleted and/or not admitted for publication by the Service as a result of the moderation procedure or upon receiving the claim from a third party regarding non-compliance of the feedback with the Service rules. If a negative decision is taken after the feedback goes through the moderation procedure or the claim is acknowledged to be justified, such feedback may be not admitted or limited for publication in the Service.

The User accepts that the feedback on organizations left by him and grades that he has put may be published and used by Yango Maps within the Service and other Yango services. In so doing, the User’s feedback on organization is published and used “as it is” retaining the author’s grammar and punctuation and indicating the name under which the feedback was published and the account image (avatar).

3.7. The User, who has placed Information on Organizations in the Service, shall fully and independently bear all risks and responsibility for the content of the information he or she provided, its legislative compliance, integrity, accuracy and reliability. Yango Maps shall not be held liable for the User placing (inter alia, in bad faith) Information on Organizations that is false, irrelevant, infringing third-party rights and legitimate interests and neither confirms nor disproves the legislative compliance, accuracy and reliability of Information on Organizations.

4. Miscellaneous

4.1. The User authorizes Yango Maps to process personal information of the User, to transfer personal information of the User to Yango Maps’ partners. When the Users turn to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Yango Maps Privacy Policy available at: https://yango.com/legal/yangomaps_privacy.

4.2. Yango Maps does not guarantee the safety of information presented in the Service in any volume and/or for any period of time, including in the event of a change of data in connection with the development or change of the Service.

4.3. The Service information may be used by Yango Maps in other Yango Maps services and applications, as well as in advertising or marketing materials posted on Yango Maps resources on the Internet to attract the attention of other users to the content of the Service, to the Service in general, or to other Yango Maps applications and services, goods, works and services of third parties, both with the indication of the author of the information (as the name of the author, the name (pseudonym) of the User which he/she indicated when logged in or in the settings of his/her data in the corresponding section of the Service will be indicated), and without it, without the need for a special permission from the User and without payment of royalties, with the right of Yango Maps to grant the rights to use information to third parties for use in the specified advertising or marketing materials. In this case, the User acknowledges and agrees that Yango Maps is not obliged to review the information posted by the Users in the Service. If the User is not entitled to grant Yango Maps the right to use any information in this way, he/she shall refrain from posting such information.

4.4. Yango Maps reserves the right, at its own discretion, to restrict the User’s access to the Service (or to certain functions of the Service, if technologically possible) using his or her account, or to fully block the User’s account in case of severe or repeated violations of these Terms, or to take other measures against the User to ensure that legislative requirements are met or third-party rights and legitimate interests are respected.

4.5. When using the Service, the User can report of inaccurate data placed in the Service (incorrect name, map positioning, irrelevant data, objects that need to be removed) giving relevant details in a special contact form of the Service. When sending a message, the User consents to publish the message form he or she completed. The User undertakes not to specify any information qualified by applicable laws as sensitive information, including own personal details, personal details of third parties and information prohibited for distribution.

4.6. Any information used in the Service is intended for personal non-commercial use only. In this respect, it is prohibited to copy, reproduce, process, distribute, make available to the public (publish) in the Internet, use the data in any way in the media and/or for commercial purposes without the right holder’s prior written permission, except as expressly stipulated by the functionality of the Service, these Terms, terms of use of other Yango Maps services. It is also prohibited to use or launch any automated system that accesses the Service for data extortion excluding the purposes of indexing the Service data in search results.

4.7. The information provided in the Service shall be for reference only. Yango Maps does not guarantee that the Service, the quality of any product, service, information obtained using the Service, meets/will meet the User's requirements, and that the functions of the Service will be provided on a continuous basis, in a prompt manner, reliably and without errors.

Yango Maps does not guarantee the accuracy, relevance, completeness, or reliability of information that can be obtained via the Service. The information of the Service shall not be intended to be used for any purpose or in any capacity (for example, to establish and/or confirm any facts, as evidence in making legally significant decisions, to provide information and make accurate calculations, research, obtaining exact coordinates and information about official names, determining a position regarding the status of objects or territories, etc.).

İstifadəçi bu sənədlərin müddəalarından hər hansı biri ilə razılaşmadıqda, İstifadəçinin Xidmətdən istifadə etmək hüququ yoxdur.

1.3. Şərtlərin cari versiyası həmişə növbəti ünvanda mövcuddur: https://yango.com/legal/yangomaps_termsofuse. Yango Maps bu Şərtləri istənilən vaxt İstifadəçiyə xəbərdarlıq etmədən dəyişə bilər. Yenidən nəzərdən keçirilmiş Şərtlər, bu Şərtlərdə başqa hal nəzərdə tutulmayıbsa, göstərilən URL ünvanında yerləşdirildiyi andan qüvvəyə minir.

1.4. Yango Maps xidməti tərəfindən İstifadəçinin razılaşmadığı bu Şərtlərin 1.3-cü bəndində nəzərdə tutulmuş qaydada bu Şərtlərə hər hansı dəyişiklik edildikdə o, Xidmətdən istifadəni dayandırmalıdır.

1.5. Xidmət İstifadəçiyə müasir kartoqrafik və digər sorğu məlumatlarına pulsuz çıxış imkanı təklif edir. Xidmətin mövcud olan bütün hazırki funksiyaları, eləcə də onların hər hansı inkişaf və (və ya) yenilərinin əlavə edilməsi Şərtlərin predmetidir.

1.6. Xidmətdən istifadə etməklə İstifadəçi xidmətin göstərilməsi və əhəmiyyətli yeniləmələr üçün zəruri olan məlumat bildirişlərini almağa razılaşır. İstifadəçi Xidmətin müvafiq funksiyasından istifadə etməklə və ya alınan mesajda göstərilən təlimatlara əməl etməklə, bildirişlər, o cümlədən, reklam mesajları abunəliyini ləğv edə bilər.

2. Xidmətdən istifadə. Xidmətin ayrı-ayrı funksiyaları

2.1. Xidmət İstifadəçiyə şəxsi qeyri-kommersiya istifadəsi üçün təqdim olunur.

2.2. Xidmət İstifadəçiyə müstəqil və öz seçiminə uyğun olaraq istifadəçi məlumatlarını, o cümlədən işarələr, qeydlər, mətn imzaları, mesajlar və s. (bundan sonra “İstifadəçi obyektləri”) xəritələrə əlavə etmək funksiyasını təmin edir. İstifadəçi obyektlərinin daxil edilməsi başlanğıc məlumatları dəyişdirmir və yalnız İstifadəçi tərəfindən Xidmətdən istifadənin rahatlığı üçün icazə verilir. İstifadəçi İnternet şəbəkəsində sərbəst girişdə İstifadəçi Obyektlərinə keçidlər yaratmaq, saxlamaq və yerləşdirmək hüququna malikdir. İstifadəçi obyektlərinə keçidlər Xidmətin digər istifadəçiləri tərəfindən də yayıla bilər.

2.3. İstifadəçi Obyektlərinin yerinin seçilməsi, qanuna uyğunluğu, əlavə edilmiş İstifadəçi Obyektlərinin təsvirinin məzmunu, tamlığı, düzgünlüyü və etibarlılığı ilə bağlı bütün riskləri və məsuliyyəti İstifadəçi müstəqil və tamamilə öz üzərinə götürür. Yango Maps hər hansı İstifadəçi Obyektinin işarələnməsi və təsvirinə görə məsuliyyət daşımır və hər hansı İstifadəçi Obyektinin təsvirinin qanuni uyğunluğunu, düzgünlüyünü və etibarlılığını təsdiq və ya təkzib etmir. Əgər onların təsvirindəki məlumat qüvvədə olan qanuna ziddirsə, təhqiramiz ifadələr ehtiva edirsə və digər hallarda İstifadəçi Obyektlərinin təyinatı və (və ya) təsviri və/və ya İstifadəçi Obyektlərinə keçidin yayılması bu Şərtləri pozursa, həmçinin Yango Maps, xidmət istifadəçilərinin və digər üçüncü şəxslərin maraqlarını qorumaq üçün Yango Mapsın əvvəlcədən xəbərdarlıq etmədən və öz mülahizəsinə əsasən, hər hansı İstifadəçi Obyektini və ya bir sıra İstifadəçi Obyektlərini pozmaq hüququ var.

2.4. Xidmət İstifadəçiyə İstifadəçinin müəyyən etdiyi yola düşmə nöqtəsindən təyinat məntəqəsinə (bundan sonra “Marşrut”) marşrut seçimini göstərən xəritələrdə avtomatik marşrutların qurulması funksiyasını təqdim edir. Marşrutların qurulması başlanğıc məlumatları dəyişdirmir və yalnız İstifadəçi tərəfindən Xidmətdən istifadənin rahatlığı üçündür.

İstifadəçi Marşrutun seçilməsi və seçilmiş Marşrutla getməyə görə bütün riskləri və məsuliyyəti müstəqil və tamamilə öz üzərinə götürür. Yango Maps Marşrutların düzgünlüyünə, optimallığına, aktuallığına və (və ya) yol hərəkəti qaydalarına uyğunluğuna zəmanət vermir və İstifadəçinin Marşrut seçiminə və ona əməl etməyin nəticələrinə görə məsuliyyət daşımır. İstifadəçi Marşrut seçməzdən əvvəl və ondan istifadə zamanı diqqətli və ehtiyatlı davranmalıdır.

2.5. Xidmətdə tıxacın cari səviyyəsi, sıxlığın qısamüddətli proqnozu, eləcə də gün ərzində orta tıxac haqqında məlumatları əks etdirə bilər.

Tıxaclar haqqında məlumat anonim məlumatların təhlili əsasında əldə edilir və sorğu xarakteri daşıyır.

Xidmətdə istifadə olunan yol tıxacının səviyyəsinin rəngli təsviri yol statusunun, ondan sərbəst istifadə imkanının, faktiki istismarının və keçicilik qabiliyyətinin göstəricisi deyil və yalnız cari müddət ərzində onun sıxlığının təxmini dərəcəsinin göstəricisidir (yaşıl – sərbəst, sarı – orta sıxlıq, qırmızı – yüksək sıxlıq).

2.6. Xidmətdə hüquqları müvafiq müəllif hüquqları sahiblərinə məxsus olan əqli mülkiyyət obyektlərindən, habelə onun sahibləri tərəfindən təqdim edilən məlumatlardan istifadə edilir.

3. Təşkilatlar haqqında məlumatlardan istifadə

3.1. Xidmət İstifadəçiyə Xidmətdə (bundan sonra “Biznes üçün Yango”) göstərilən ünvanlarda yerləşən kommersiya müəssisə və təşkilatları haqqında məlumatların, o cümlədən ünvan, ad, əlaqə məlumatları, iş saatları, göstərilən xidmətlər/ satılan mallar və İstifadəçi rəyləri (bundan sonra birgə – “Təşkilat haqqında məlumat”) haqqında məlumatların yerləşdirilməsi, baxılması və axtarışı funksiyasını təmin edir.

3.2. Yango for Business Xidməti Xidmətin tərəfdaşları tərəfindən təqdim edilən təşkilatlar haqqında məlumatlar, Xidmətin administrasiyası tərəfindən yerləşdirilən məlumatlar, habelə hazırki şərtlərin 3.5. – 3.7. bəndlərində göstərilən şərtlərlə İstifadəçilər tərəfindən yerləşdirilən məlumatları əks etdirə bilər.

Yango Maps istənilən vaxt Xidmətdə yerləşdirilən məlumatların düzgünlüyünün və (və ya) Xidmətdə təşkilat kartı ilə sərəncam vermək hüququnu həyata keçirən şəxsin təşkilatın fəaliyyətinə necə münasibət göstərdiyinin təsdiqini tələb etmək hüququnu (lakin öhdəliyini deyil) özündə saxlayır.

3.3. Yango for Business xidmətində verilən məlumat yalnız sorğu xarakteri daşıyır. Yango Maps, təşkilat haqqında məlumatda göstərilən məlumatların düzgünlüyünə, aktuallığına və etibarlılığına, habelə göstərilən qiymətlərin İstifadəçinin malların alınması / xidmətlərin göstərilməsi üçün təşkilata müraciət etdiyi zaman müəyyən edilmiş real qiymətlərə uyğunluğuna görə məsuliyyət daşımır. Yango Maps İstifadəçi ilə təşkilat arasında yaradılmış hüquqi münasibətlərin iştirakçısı deyil və satdığı malların/xidmətlərin keyfiyyətinə görə məsuliyyət daşımır.

3.4. Xidmətin digər İstifadəçiləri də Yango for Business-də mövcud olan məlumata baxa və redaktə edə bilərlər (təşkilat haqqında rəylər istisna olmaqla). Yango Maps İstifadəçilər tərəfindən edilən dəyişikliklərə, eləcə də təşkilat haqqında məlumatları üçüncü tərəflər tərəfindən istifadəsinə görə məsuliyyət daşımır.

3.5. İstifadəçi müvafiq formaları doldurmaqla təşkilatlar haqqında məlumatları Xidmətdə yerləşdirə bilər. Yango Maps İstifadəçini xəbərdar etmədən və hər hansı səbəbləri izah etmədən təşkilatlar haqqında Məlumatı yerləşdirmək üçün qəbul etməyə bilər və ya istənilən vaxt təşkilatlar haqqında məlumatları öz mülahizəsinə uyğun olaraq silə və ya dəyişdirə bilməz.

3.6. Xidmət İstifadəçilərə təşkilatlar haqqında rəylər yazma imkanı verir. Rəy İstifadəçinin mallar/xidmətlər haqqında dəyər mülahizəsini ifadə etməli və (və ya) onu təşkilata müraciət etməyə vadar edən faktiki halları dəqiq təsvir etməlidir. Yango Maps rəydə əks olunan məlumatların düzgünlüyünə, aktuallığına və dəqiqliyinə görə məsuliyyət daşımır. Təşkilatın nümayəndəsinin şikayətinə əsasən, rəylərin dərci qaydalarının pozulduğu halda Rəy Xidmətdən silinə bilər.

Rəy moderasiya proseduru nəticəsində və ya üçüncü tərəfin rəyin Xidmətin qaydalarına uyğun gəlməməsi barədə iddiası alındıqdan sonra Xidmət tərəfindən silinə və (və ya) dərcinə icazə verilməyə bilər. Moderasiya prosedurundan keçdikdən sonra rəy barədə mənfi qərar qəbul edilərsə və ya iddianın əsaslı olduğu qəbul edilərsə, belə rəy qəbul edilməyə bilər və ya Xidmətdə dərc edilməsi məhdudlaşdırıla bilər.

İstifadəçi təşkilatlar haqqında verdiyi rəy və qiymətləndirmələrin Xidmət və digər Yango xidmətləri daxilində Yango Maps tərəfindən dərc oluna və istifadə oluna biləcəyi ilə razılaşır. Eyni zamanda, İstifadəçinin təşkilat haqqında rəyi “olduğu kimi” müəllifin qrammatikası və durğu işarələri qorunub saxlanılaraq və rəyin hansı ad altında dərc edildiyini və hesab şəklini (avatar) göstərməklə dərc olunur və istifadə olunur.

3.7. Təşkilat haqqında Məlumatı yerləşdirmiş istifadəçi təqdim etdiyi məlumatların məzmununa, qanunvericiliyə uyğunluğuna, tamlığına, düzgünlüyünə və etibarlılığına görə bütün riskləri və məsuliyyəti müstəqil və tamamilə öz üzərinə götürür. Yango Maps İstifadəçi tərəfindən (o cümlədən vicdansız məqsədlər üçün) həqiqətə uyğun olmayan, aktual olmayan, üçüncü şəxslərin hüquq və qanuni maraqlarını pozan təşkilatlar haqqında məlumatların yerləşdirilməsinə görə məsuliyyət daşımır, həmçinin təşkilatlar haqqında məlumatların qanuna uyğunluğunu, düzgünlüyü və etibarlılığını təsdiq və ya təkzib etmir.

4. Digər müddəalar

4.1. İstifadəçi Yango Maps-a İstifadəçinin şəxsi məlumatlarını emal etmək, İstifadəçinin şəxsi məlumatlarını Yango Maps tərəfdaşlarına ötürmək səlahiyyəti verir. İstifadəçilər Xidmətdən istifadə etdikdə, onların şəxsi məlumatları emal edilməsi üçün https://yango.com/legal/yangomaps_privacy ünvanında qeyd edilən Yango Xəritələrinin Məxfilik Siyasətində göstərilən şərtlərə və məqsədlərə uyğun olaraq ötürülür.

4.2. Yango Maps, Xidmətin inkişafı və ya dəyişdirilməsi ilə əlaqədar məlumat dəyişiklikləri də daxil olmaqla, hər hansı dərəcədə və (və ya) hər hansı bir müddət ərzində Xidmətdə təqdim olunan məlumatların təhlükəsizliyinə zəmanət vermir.

4.3. Xidmətin məlumatı Yango Maps tərəfindən Yango Mapsın digər xidmətlərində və tətbiqlərində, o cümlədən digər istifadəçilərin diqqətini Xidmətin məzmununa, bütövlükdə Xidmətə və ya Yango Mapsın digər tətbiq və xidmətlərinə, üçüncü tərəflərin mallarına, işlərinə və xidmətlərinə, həm məlumatın müəllifinin (bu halda, İstifadəçinin qeydiyyat zamanı və ya Xidmətin müvafiq bölməsindəki məlumatlarının parametrlərində göstərdiyi adı (təxəllüs) müəllifin adı kimi göstəriləcək) göstərilməsi ilə, həm də göstərilmədən, İstifadəçidən xüsusi icazə almadan və göstərilən reklam və ya marketinq materiallarında məlumatdan üçüncü şəxslər tərəfindən istifadə hüququnun Yango Maps tərəfindən verilməsi hüququ ilə müəllifə mükafat ödəmədən cəlb etmək üçün istifadə edilə bilər. Eyni zamanda, İstifadəçi qəbul edir və razılaşır ki, Yango Maps xidməti İstifadəçilər tərəfindən Xidmətdə yerləşdirilən məlumatlara baxmaq məcburiyyətində deyil. Əgər İstifadəçinin Yango Mapsa hər hansı məlumatı bu şəkildə istifadə etmək hüququnu vermək hüququ yoxdursa, o, belə məlumatı yerləşdirməkdən imtina etməlidir.

4.4. Yango Maps, öz mülahizəsinə əsasən, İstifadəçinin hesabından istifadə edərək Xidmətə (və ya texnoloji imkan daxilində Xidmətin müəyyən funksiyalarına) çıxışını məhdudlaşdırmaq və ya bu şərtlərin ciddi və ya dəfələrlə pozulması halında İstifadəçinin hesabını tamamilə bloklamaq, qanunvericiliyin tələblərinə və ya üçüncü şəxslərin hüquq və qanuni maraqlarına riayət etmək üçün İstifadəçiyə qarşı digər tədbirlər görmək hüququnu özündə saxlayır.

4.5. İstifadəçi Xidmətdən istifadə edərək Xidmətdə yerləşdirilən məlumatların qeyri-dəqiqliyi (xəritədə yanlış ad, yerləşmə, məlumatların qeyri aktuallığı, obyektin silinməsi zərurəti) barədə müvafiq məlumatları Xidmətin xüsusi əlaqə formasında qeyd etməklə məlumat verə bilər. İstifadəçi mesaj göndərməklə doldurduğu mesaj formasının dərcinə razılıq verir. İstifadəçi mesajda qüvvədə olan qanunvericiliklə məhdud çıxışı olan məlumat kimi təsnif edilən məlumatı, o cümlədən şəxsi məlumatları, üçüncü şəxslərin şəxsi məlumatları, habelə yayılması qadağan olunan məlumatları göstərməməyi öhdəsinə götürür.

4.6. Xidmətdə istifadə olunan hər hansı məlumat yalnız şəxsi qeyri-kommersiya məqsədləri üçün nəzərdə tutulub. Eyni zamanda, müəllif hüquqları sahibinin əvvəlcədən yazılı icazəsi olmadan məlumatların hər hansı surətinin çıxarılması, çoxaldılması, emalı, yayılması, internet şəbəkəsində ictimaiyyətə çatdırılması (dərc edilməsi), kütləvi informasiya vasitələrində və (və ya) kommersiya məqsədləri üçün istifadə edilməsi Xidmətin funksion imkanlarında, bu Şərtlərdə, digər Yango Maps xidmətlərindən istifadə şərtlərində birbaşa göstərildiyi hallar istisna olmaqla, qadağandır. Axtarış nəticələrində Xidmət məlumatlarının indeksləşdirilməsi məqsədləri istisna olmaqla, məlumatları çıxarmaq üçün Xidmətə girişi olan hər hansı avtomatlaşdırılmış sistemdən istifadə etmək və ya işə salmaq həmçinin qadağandır.

4.7. Xidmətdə təqdim olunan məlumat yalnız sorğu xarakteri daşıyır. Yango Maps Xidmətin, hər hansı xidmətin, məhsulun keyfiyyətinin, Xidmətdən istifadə etməklə əldə edilən məlumatın İstifadəçinin tələblərinə cavab verdiyinə/verəcəyinə və Xidmətin funksiyalarının fasiləsiz, sürətli, etibarlı və səhvsiz təmin ediləcəyinə zəmanət vermir.

Yango Maps Xidmətdən istifadə etməklə əldə edilə bilən məlumatların düzgünlüyünə, aktual olmasına, tamlığına və ya etibarlılığına zəmanət vermir. Xidmətin məlumatı hər hansı bir məqsəd və ya hər hansı bir keyfiyyətdə istifadə üçün nəzərdə tutulmayıb (məsələn, hüquqi əhəmiyyətli qərarlar qəbul edərkən sübut kimi hər hansı faktı müəyyən etmək və (və ya) təsdiq etmək, məlumat vermək və dəqiq hesablamalar aparmaq, araşdırmalar aparmaq, rəsmi adlar haqqında dəqiq koordinatlar və məlumatlar əldə etmək, obyektlərin və ya ərazilər vəziyyəti ilə bağlı mövqe müəyyən etmək və s.).

1. General Provisions

1.1. MLU Africa B.V. (hereinafter referred to as MLU Africa) invites an Internet user (hereinafter referred to as the "User") to use Yango Maps service (hereinafter referred to as the "Service").

1.2. By starting to use the Service/its certain functions, the User is deemed to have accepted these Terms in full, without any reservations and exceptions. If the User disagrees with any of the provisions of the said documents, the User may not use the Service.

1.3. The current version of the Terms is always available at: at: https://yango.com/legal/yangomaps_termsofuse. MLU Africa may amend these Terms at any time without notice to the User. Revised Terms shall come into effect once posted online at the specified URL, unless otherwise stipulated in revised Terms.

1.4. If MLU Africa has made any amendments to these Terms according to the procedure specified in Clause 1.3 hereof, and the User disagrees with these amendments, the User shall stop using the Service.

1.5. The Service enables the User to gain free access to updated mapping and other reference information. All currently available functions of the Service along with any developments and/or newly added options are subject to these Terms.

1.6. By using the Service, the User consents to receiving informational notices necessary for service provision and essential updates. The User may unsubscribe from the notices, including but not limited to advertising messages, by using relevant functions of the Service or following instructions specified in a message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. The Service functionally enables the User to add, at his or her choice and discretion, user information, including signs, marks, inscriptions, messages, etc. (hereinafter referred to as the "User Objects") on the maps. Insertion of the User Objects does not modify source data and is only acceptable to ensure service usability. The User may create, store and make freely available online links to the User Objects. Other users of the Service may also distribute links to the User Objects.

2.3. The User shall fully and solely bear all risks and responsibility for choosing the location of the User Objects, compliance with the laws, the contents, integrity, accuracy and reliability of descriptions of added User Objects. MLU Africa shall bear no responsibility for the designation and description of any User Object, shall not confirm or disprove the legislative compliance, accuracy and reliability of the description of any User Object. MLU Africa reserves the right, without notice and at its discretion, to delete any User Object or a set of User Objects, if the information in its description conflicts with applicable laws, contains abusive language, and in other cases when the designation and/or the description of the User Objects and/or the distribution of a link to the User Objects violates these Terms, and to protect interests of MLU Africa, service users, and other third parties.

2.4. The Service functionally enables the User to automatically plot routes on the maps showing an optional route from the point of departure to the destination indicated by the User (hereinafter referred to as the "Route"). The routing does not modify source data and is only acceptable to make the Service convenient for the User.

The user shall independently and entirely bear all risks and responsibility for choosing the Route and following the chosen Route. MLU Africa does not guarantee the correctness, optimality, relevance and/or compliance of the Routes with traffic rules and shall not be responsible for the User's choice of the Route and the consequences of following it. The User shall take all measures of care and caution before choosing any Route and during its use.

2.5. The service may contain information about the current level of traffic congestion, a short-term forecast of congestion, as well as information about the average traffic congestion during the day.

The information available about traffic congestion is based on an analysis of anonymized data and shall be for reference only.

The color display of the road congestion level used in the Service shall not be an indication of the status of the road, the possibility of its free use, actual functioning and passability, and shall be only an indicator of an approximate degree of its congestion in the current period of time (green stands for “open”, yellow for “medium congestion”, and red for “high congestion”).

2.8. The Service uses items of intellectual property copyrighted to relevant right holders and information provided by its holders.

3. Use of information on organizations

3.1. The Service functionally enables the User to place, view and search information on organizations located at addresses displayed in the Service, including addresses, names, contact details, opening hours, services rendered / goods sold and user feedback (hereinafter referred to as the "Information on Organizations").

3.2. The Service may contain information on organizations provided by partners of the Service, information placed by the administration of the Service, and information placed by Users as specified in cl. 3.5–3.7 hereof.

MLU Africa reserves the right (but not the obligation) to request at any time that the accuracy of information placed in the Service and/or the way a person exercising the right of managing an organization card in the Service relates to the organization’s activities be confirmed.

3.3. Information specified in the Service is for reference only. MLU Africa shall not be held liable for the accuracy, relevance and reliability of Information on Organizations and for the conformity of specified prices to prices valid at the time the User contacted an organization to buy goods / obtain services. MLU Africa takes no part in legal relations established between the User and an organization and shall not be held liable for the quality of goods it sells / services it renders.

3.4. Information found in the Service can be viewed and edited by other Users of the Service (except for feedback on organizations). MLU Africa shall not be held liable for changes Users made and for the use of Information on Organizations by third parties.

3.5. MLU Africa may, without informing the User and giving any reasons, not accept Information on Organizations for placement or at any time remove or change Information on Organizations at own discretion.

3.6. The Service enables Users to post feedback on organizations. Feedback should express the User's value judgment of goods/services and (or) credibly describe actual circumstances that made him or her address an organization. MLU Africa shall not be held liable for the reliability, relevance, and accuracy of information in feedback. If a representative of an organization files a complaint, feedback can be deleted from the Service, if it violates feedback rules.

The Feedback may be deleted and/or not admitted for publication by the Service as a result of the moderation procedure or upon receiving the claim from a third party regarding non-compliance of the Feedback with the Service rules. If a negative decision is taken after the Feedback goes through the moderation procedure or the claim is acknowledged to be justified, the Feedback may be not admitted/limited for publication in the Service.

The User accepts that the feedback on organizations left by him and grades that he has put may be published and used by MLU Africa within the Service and other MLU Africa services. In so doing, the User’s feedback on organization is published and used “as it is” retaining the author’s grammar and punctuation and indicating the name under which the feedback was published and the account image (avatar).

3.7. The User, who has placed Information on Organizations in the Service, shall fully and independently bear all risks and responsibility for the content of the information he or she provided, its legislative compliance, integrity, accuracy and reliability. MLU Africa shall not be held liable for the User placing (inter alia, in bad faith) Information on Organizations that is false, irrelevant, infringing third-party rights and legitimate interests and neither confirms nor disproves the legislative compliance, accuracy and reliability of Information on Organizations.

4. Miscellaneous

4.1. The User authorizes MLU Africa to process personal information of the User, to transfer personal information of the User to MLU Africa’s partners. When the User turns to the Service, their personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Policy available at: (https://yango.com/legal/yangomaps_privacy).

4.2. MLU Africa does not guarantee the safety of information presented in the Service in any volume and/or for any period of time, including in the event of a change of data in connection with the development or change of the Service.

4.3. The Service information may be used by MLU Africa in other MLU Africa services and applications, as well as in advertising or marketing materials posted on MLU Africa resources on the Internet to attract the attention of other users to the content of the Service, to the Service in general, or to other MLU Africa applications and services, goods, works and services of third parties, both with the indication of the author of the information (as the name of the author, the name (pseudonym) of the User which he/she indicated when logged in or in the settings of his/her data in the corresponding section of the Service will be indicated), and without it, without the need for a special permission from the User and without payment of royalties, with the right of MLU Africa to grant the rights to use information to third parties for use in the specified advertising or marketing materials. In this case, the User acknowledges and agrees that MLU Africa is not obliged to review the information posted by the Users in the Service. If the User is not entitled to grant MLU Africa the right to use any information in this way, he/she shall refrain from posting such information.

4.4. MLU Africa reserves the right, at its own discretion, to restrict the User’s access to the Service (or to certain functions of the Service, if technologically possible) using his or her account, or to fully block the User’s account in case of repeated violations of these Terms, or to take other measures against the User to ensure that legislative requirements are met or third-party rights and legitimate interests are respected.

4.5. When using the Service, the User can report of inaccurate data placed in the Service (incorrect name, map positioning, irrelevant data, objects that need to be removed) giving relevant details in a special contact form of the Service. When sending a message, the User consents to publish the message form he or she completed. The User undertakes not to specify any information qualified by applicable laws as sensitive information, including own personal details, personal details of third parties and information prohibited for distribution.

4.6. Any information used in the Service is intended for personal non-commercial use only. In this respect, it is prohibited to copy, reproduce, process, distribute, make available to the public (publish) in the Internet, use the data in any way in the media and/or for commercial purposes without the right holder’s prior written permission, except as expressly stipulated by the functionality of the Service, these Terms, terms of use of other MLU Africa services.

4.7. The information provided in the Service shall be for reference only. MLU Africa does not guarantee that the Service, the quality of any product, service, information obtained using the Service, meets/will meet the User's requirements, and that the functions of the Service will be provided on a continuous basis, in a prompt manner, reliably and without errors.

MLU Africa does not guarantee the accuracy, relevance, completeness, or reliability of information that can be obtained via the Service. The information of the Service shall not be intended to be used for any purpose or in any capacity (for example, to establish and/or confirm any facts, as evidence in making legally significant decisions, to provide information and make accurate calculations, research, obtaining exact coordinates and information about official names, determining a position regarding the status of objects or territories, etc.).
