Terms of Use of Yango

PLEASE READ THESE TERMS CAREFULLY BEFORE ACCESSING OR USING YANGO.

1. General Provisions

1.1. These Terms (hereinafter referred to as the Terms) constitute an offer of Yango GCC Electronic Transport Services LLC (hereinafter referred to as Company) to an Internet user (hereinafter referred to as the User) to use Yango service (hereinafter referred to as the Service or Yango) in United Arab Emirates.

1.2. The use of the Service by the User is governed by these Terms and Privacy Notice (https://yango.com/legal/yango_privacy_notice).

1.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

1.4. Yango enables the User to place information on the User’s potential demand for transportation services, look through offers of organizations providing services in the said fields, and search for such offers using parameters set by the User. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

YOU ACKNOWLEDGE THAT COMPANY DOES NOT PROVIDE TRANSPORTATION SERVICES OR FUNCTION AS A CARRIER AND THAT ALL SUCH TRANSPORTATION SERVICES ARE PROVIDED BY THIRD PARTY – TRANSPORTATION PROVIDERS, WHO ARE NOT EMPLOYED BY COMPANY OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND TRANSPORTATION PROVIDERS ON THE ACQUISITION OF SERVICES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND TRANSPORTATION PROVIDER, COMPANY IS NOT THE PARTY OF THESE AGREEMENTS.

1.5. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to the Company.

1.6. All conversations the User holds with the support team and drivers of transportation providers - partners of the Service can be recorded to control quality and improve services.

1.7. By using the Service, the User consents to receive promotional messages, including emails and messages. The User may unsubscribe from promotional messages by using relevant functions of the Service or following instructions specified in a promotional message received.

2. Use of the Service. Certain Functions of the Service

2.1. The Service is provided to the User for personal non-commercial use.

2.2. Information on transportation services is provided by third parties (partners)- transportation providers. The list of partners is available at https://yango.com/partners. For more information about the services offered (including Wi-Fi access point availability in the cabin, in-cabin photo / video surveillance by the partners, and other information), the User may contact the partners of the Service - transportation providers or provide their contact details through the functions of the Service for the partners of the Service to independently contact the User and provide them with information about transportation services offered.

2.3. Company shall not be held liable for the content and/or relevance of information provided by the partners of the Service - transportation providers, including information on the cost and current availability of the transportation providers’ benefits. The User shall independently (without the participation of Company) discuss the acquisition of services with the transportation providers in accordance with the transportation providers’ rules on the provision of transportation services. Company shall not be held liable for financial and any other transactions effected by the User and the transportation providers and for any consequences of the acquisition of the transportation providers’ services by the User.

2.4. The User may access functions of rating the services of the Service partners - transportation providers and commenting / leaving feedback on the Service and/or services of the transportation providers. Users ratings and feedback are posted on the Service website and can be available on third-party websites. Company reserves the right to refuse to post any ratings / feedback and delete / block, at any time, any rating / feedback the User posted, at own discretion and without giving any reason.

2.5. Company reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

2.6. When demand for transportation or other services is higher (including days before holidays, days of mass events and other cases), tariffs of the Service partners can be raised. Company informs of higher tariffs by posting the relevant notice on the Service website https://yango.com or otherwise as Company thinks fit, inter alia, by sending an information message to the User’s mobile phone number or via mobile application.

2.7. If the Service supports ordering rides in advance (hereinafter, "pre-ordered rides") in certain Service tariffs, the order will be available for the Service partner to confirm near the time specified by the User in the order (no earlier than 30 minutes before the pre-ordered ride is scheduled to start). The cost of the pre-ordered ride will be calculated and indicated in the Service when the ride is ordered. The price may change in circumstances listed on the Service website https://yango.com.

2.9. A transportation provider charges fees for a trip cancelled by the User, if such cancellation took place after the vehicle's arrival to the place the User had appointed. The amount of such fees is calculated the same way as the cost of trip/service as per tariff for a period of time from when the vehicle actually arrived to the pick-up place or from the time of arrival specified in information the transportation provider submitted to the User regarding the transportation the User/Users’ parcel ordered (whichever comes later) until the User cancelled the trip/service. The User shall cancel a trip/service by sending a relevant notice to the transportation provider via the Service. A User that has not boarded a vehicle served by the transportation provider within ten (10) minutes taking into account no-charge waiting time specified in a respective tariff is deemed to have cancelled a trip/service, unless otherwise stipulated by the relevant transportation provider's rules or agreements between the User and a representative (driver) of the transportation provider. The cancellation fee for airport-to-city transfers is calculated as described above plus an additional fee charged for out-of-town ride as per tariff.

2.10. The User authorizes Company to process personal information (including personal details) of the User of Service (Yango), to transfer personal information of the User to Company’s partners (transportation providers), and to process personal information for Company’s partners to provide services to the User in the Service. When the User turns to the Service, his/her personal information is transmitted to be processed under the terms and for the purposes determined in the Privacy Notice available at: (https://yango.com/legal/yango_privacy_notice).

3. Function of Cashless Payment for Passenger and Baggage Transportation Services and other services

3.1. The User can pay for transportation services provided to the User in accordance with the information on potential demand for transportation services the User posted via the Service:

3.1.1. Directly to a transportation provider (inter alia, by cash or by any other means stipulated by the said transportation provider, if any, hereinafter referred to in these Terms and the Service interface as cash). The said payment shall be made without the Company being involved and shall not be governed by these Terms. The said payment method may be restricted for the delivery services (if such function is available in the User’s country).

3.1.2. Via cashless payment through Yango; in this case, Company acts in the name of the relevant transportation provider or otherwise (including directly) with an authorized payment processor, electronic money processor, or any other party to settlements involved or otherwise (including directly) (hereinafter referred to as cashless payments). In the case of cashless payments made through Yango, Company receives payments as a limited payment collection agent of the transportation provider. Company does not guarantee that the operation of the Service will be error- and failure-free in view of enabling cashless payments.

Depending on the User's region, cashless payments can be made without Company acting as a payment recipient or with Company involved as another party to settlements or a party to information exchange.

The User shall choose the relevant form of payment in the Service interface. In this respect, if it is impossible to make cashless payments for any reason (including, but not limited to temporary technical inaccessibility of this function, temporary or constant impossibility to make cashless payments using the Linked Card (as defined below) or insufficient funds in the Linked Card), the User undertakes to pay by cash.

For cashless payments, it is possible to effect both one transaction for the entire cost of passenger and baggage transportation or other service and several transactions for certain parts of the cost of the service. Cashless payments can be affected by any of the above means during the trip/service or when the trip/service is over.

In case of cashless payments, the User can, along with payment for transportation service, make an additional cashless payment to the transportation provider as a percentage of the cost of the paid passenger and baggage transportation or other service (hereinafter referred to in these Terms and the Service interface as Tips) as they think fit.

3.2. For cashless payment via Yango the User shall specify the bank card in the Service interface indicating the following details:

• Bank card number
• Date that the bank card is valid to
• Verification code

If the bank card details are true, valid and it is technically feasible to use this card in the Service, the said bank card becomes a Linked Card and can be used for cashless payments (cl. 3.1.2 hereof). All Linked Cards are displayed in the Service interface; for the User’s convenience, the interface displays the last 4 digits of the Linked Card number.

3.3. When a Linked Card is added and when the User chooses the function of cashless payment for a certain trip/service, the amount limited to 5 AED (or any other amount in the User’s region currency) will be charged to confirm that the Linked Card details are true and valid; if the transaction is successfully affected, the said amount will be refunded to the User. Failure to charge the said amount means that it is impossible to add this Linked Card and/or the function of cashless payment is unavailable, respectively.

3.4. When adding the Linked Card and at any time after it was added, the User can set and/or change the default number of Tips via the Service interface; the User can change the amount of Tips for a certain trip/service in the Service interface, when the trip/service is over.

3.5. Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be charged from the Linked Card, if the User, within 30 minutes after the trip/service is over, assigns a high rating to the trip (4–5 stars) in the Service interface and clicks "Done" or assigns neither high nor low rating to the trip/service (specifies no number of stars) and clicks "Done".

3.6. If within 30 minutes after the trip/service is over the User assigns a low rating to the trip/service (1–3 stars) in the Service interface and clicks "Done", no Tips will be charged from the Linked Card.

3.7. If within 30 minutes after the trip/service is over the User did not click "Done", the amount of Tips (in the default amount or in the amount specifically indicated by the User for a certain trip/service) will be blocked in the Linked Card for 24 hours, during which the User can increase or reduce the amount of Tips for this trip/service. When the said time expires, the Tips will be charged in the amount specified by the User (by default or specifically for this trip/service).

3.8. User's cashless payments shall be made with an authorized payment processor or electronic money processor involved and shall be governed by rules of international payment systems, banks (including the bank that issued the Linked card), and other parties to settlements.

3.9. When indicating their details pursuant to cl. 3.2 hereof and further using the Linked Card, the User confirms and guarantees that they indicated reliable and full information on the valid bank card issued in their name; they comply with rules of international payment systems and requirements of the bank that issued the Linked Card, inter alia, in relation to the procedure of cashless payments.

3.10. The User understands and agrees that all actions performed in the Service using the mobile phone number confirmed by the User, inter alia, cashless payments with the use of the Linked Card, are deemed to be performed by the User.

3.11. If the User disagrees with the fact and/or the amount of cashless payments and has any other questions on how to use the Linked Card in the Service, they may contact Company by phone numbers specified by the Service and/or via the help desk (feedback) interface within 14 days from the date of cashless payments or any other actions or events that prompted the request.

If, following the inspection caused by such a request, Company decides to refund the amount of cashless payment, in whole or in part, the said amount shall be refunded to the bank account of the bank card the cashless payment was made with. The refund shall be made with an authorized payment processor or electronic money processor involved and governed by rules of international payment systems, banks (including the bank that issued the Linked Card), and other parties to settlements. If Company is not a party to settlements made via the Linked Card, Company can act as a body that transfers above user requests to transportation providers, dispatch offices, or any other person being a recipient of payments under the above transactions with the Linked Card.

3.12. Company reserves the right to require from User to confirm the details it specified in the Service, including the details of the Linked Card, and request supporting documents in this regard (in particular, identity documents); failure to provide these documents may qualify as the provision of unreliable information and have implications stipulated by cl. 2.5 hereof, if Company thinks fit.

3.13. The provisions on the terms and procedure of payment for passenger and baggage transportation or other services, including delivery services, specified in this Section shall not apply, when a third party pays for such transportation or other services instead of the User under a separate contract Company signed with such third party.

4. Governing law and dispute resolution

4.1. These Terms of Use of Yango arising out of or in connection with these Terms shall be governed by and construed in accordance with law of UAE, as applied in the Emirate of Dubai.

4.2. Any disputes arising out or in connection with these Terms of Use of Yango shall be decided by the competent court in DIFC courts (including Small Claims Tribunal for claims).

5. Amendments to the Terms and Regulatory Documents

5.1. This Terms and Privacy Notice may be unilaterally amended by the Company, at any time without notice to the User. User notification of the amendments introduced to the Terms of Use of Yango posted at: https://yango.com/legal/yango_termsofuse . The said amendments to the Terms shall come into effect from the date of their publication, unless otherwise specified in the relevant publication. The User bears a risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

5.2. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms Company made as prescribed by s. 5.1 hereof.

5.3. You agree that Yango’s right to terminate the Yango Plus program, or these Terms of Use, are not subject to obtaining any prior order of a court.

6. User Loyalty Program – Yango Plus

6.1. Every User participates in Yango Loyalty Program (“Yango Plus”). Yango Plus allows Users accrue bonuses on every ride through Yango (“Points”) and redeem earned Points to future rides via Yango. No additional payment will be collected from the User for participation in Yango Plus.

Yango Plus and Points are valid for 6 months starting from February 3, 2023.

6.1.1. Points earning: 25% of the actual purchase (payment) amount (rounded up to AED 1) with payment via non-cash function within Yango mobile app. The number of Points that are to be earned shall be displayed after order completion in Yango mobile app.

Points shall not be accumulated when payment is made with redeeming Points. Also, in a purchase where the User has paid the consideration partly in actual payment and partly by utilizing Points, Points shall be earned for the part of the consideration paid by utilizing Points.

6.1.2. Points redeeming (utilizing): Payment for rides via Yango that are made via non-cash function of the mobile app. Points cannot be redeemed on toll roads and Yango service fee (if any).

Points may not be utilized under the same transaction in which they were accumulated, but rather only under a separate transaction. Points may also not be accumulated or utilized retroactively.

6.3. Information about the balance of Points accumulated by User under Yango Plus is available on all Yango mobile app.

6.4. No Cash Value or Transferability: Points do not constitute property, do not entitle a User to a vested right or interest, and have no cash value. As such, Points are not redeemable for cash or transferable or assignable for any reason. Points are not transferable (a) upon death, (b) as part of a domestic relations matter, or (c) otherwise by operation of law. The sale or transfer of Points is strictly prohibited. Points may not be sold on any secondary market, and any transfer of Points to a secondary market shall be deemed void. There shall be no carryover or transfer of Points to other User.

6.5. Right to change: Company reserves the right to change, modify, limit, amend or cancel any part of Yango Plus at any time, including rules for earning and redeeming Points. Reasonable efforts will be made to ensure the latest version of is posted here. The User after any change or variation to this section 7 or otherwise will be deemed to be an acceptance by the User to any modification or update. User is solely responsible for remaining knowledgeable of Yango Plus rules.

6.6. Yango Plus has no predetermined termination date until such time as Company decides to terminate it, at any time, with or without notice at Company’s sole discretion.

6.7. The utilization of Points under Yango Plus is subject to the proper operation of the Loyalty program’s operating and computer systems. If malfunctions occur which temporarily prevent the utilization of the Points, we will act to repair such malfunctions as soon as possible, but in any event the User will have no claims or suits against Company, its Partners and anyone on its behalf for the non-utilization of Points during the period of the malfunctions and of their repair.

6.8. Points Expiration: Points are valid for six (6) months starting from February 3, 2023. You can see how many Points are expiring soon in the mobile application. Once expired, Points cannot be used, and this will be reflected in your number of Points.

6.9. Company reserves the right to suspend or discontinue the eligibility of any person who uses, or, in the case of suspension, is suspected of using, Yango Plus in a manner inconsistent with these rules or any local laws. In addition to suspension or discontinuance of Yango Plus, Company shall have the right to take appropriate administrative and/or legal action, including criminal prosecution, as it deems necessary in its sole discretion.

شروط استخدام برنامج يانجو

يرجى قراءة هذه الشروط بعناية قبل الوصول إلى برنامج يانجو أو استخدامه.

1- الأحكام العامة

1-1 تشكل هذه الشروط (المشار إليها فيما يلي باسم الشروط) عرضًا من شركة يانجو جي سي سي للخدمات الإلكترونية للنقل (المشار إليها فيما يلي باسم الشركة) لمستخدم الإنترنت (المشار إليه فيما يلي باسم المستخدم) لاستخدام خدمة Yango (المشار إليها فيما يلي باسم الخدمة) أو Yango) في الإمارات العربية المتحدة.

1-2 يخضع استخدام الخدمة من قبل المستخدم لهذه الشروط وإشعار الخصوصية (https://yango.com/legal/yango_privacy_notice).

1-3 يُعد البدء في استخدام الخدمة / وظائفها المعينة بمثابة موافقة من المستخدم على هذه الشروط والأحكام المنصوص عليها في المستندات التنظيمية - ترخيص استخدام محرك بحث ياندكس وسياسة الخصوصية (يشار إليها فيما بعد بلفظ المستندات التنظيمية)، بالكامل، دون أي تحفظات أو استثناءات. إذا لم يوافق المستخدم على أي من أحكام شروط الاستخدام و/أو المستندات التنظيمية، فلا يجوز للمستخدم استخدام الخدمة.

1-4 يُتيح برنامج يانجو للمستخدم تحديد معلومات حول الطلب المحتمل للمستخدم على خدمات النقل، والبحث عن عروض شركات تقديم خدمات في نفس المجال المذكور، والبحث عن العروض المماثلة باستخدام المقاييس التي يحددها المستخدم. تخضع جميع الوظائف المتوفرة في الخدمة في الوقت الحالي وأي تحديثات و/أو وظائف مضافة حديثاً إلى الخدمة لهذه الشروط.

يُقر المستخدم بأن الشركة لا تقدم خدمات نقل أو تعمل كشركة نقل، وأن جميع خدمات النقل من هذا القبيل مقدمة عن طريق طرف ثالث – مقدمو خدمات النقل، وهم أشخاص لا يعملون لدى الشركة أو لدى أي شركة تابعة لها. وتخضع العلاقة بين المستخدم ومقدم خدمة النقل بشأن الاستفادة من الخدمات للاتفاقيات ذات الصلة المبرمة بين المستخدم ومقدم خدمة النقل، والشركة ليست طرفاً في هذه الاتفاقيات.

1-5 قد لا يمكن الوصول إلى بعض وظائف الخدمة أو جميعها أو تكون محدودة بحسب منطقة المستخدم. وتعتبر الوظائف غير قابلة للوصول (محدودة) بالنسبة للمستخدم من منطقة معينة، إذا تعذر عليه استخدامها بشكل مُعلن وصريح. ويحظر تطبيق أي أساليب تقنية وبرمجية للتحايل على تلك القيود. وتطبق الأحكام المنصوص عليها في هذه الشروط والتي تنظم وظائف الخدمة التي لا يمكن الوصول إليها (المحدودة) بالنسبة للمستخدم حتى يصبح من حق المستخدم الوصول إلى هذه الوظائف بشكل صريح ومُعلن. ويلزم تزويد المستخدم بالمعلومات المتعلقة بإمكانية الوصول إلى وظائف الخدمة في منطقة معينة بناءً على طلب يقدمه المستخدم إلى الشركة.

1-6 يجوز تسجيل جميع المحادثات التي يجريها المستخدم مع فريق الدعم وسائقي مقدمي خدمات النقل - شركاء الخدمة للرقابة على جودة الخدمات وتحسينها.

1-7 يوافق المستخدم بموجب استخدامه للخدمة على تلقي الرسائل الترويجية، بما في ذلك رسائل البريد الإلكتروني والرسائل. يجوز للمستخدم إلغاء الاشتراك في الرسائل الترويجية من خلال استخدام الوظائف ذات الصلة في الخدمة أو باتباع التعليمات المحددة في الرسالة الترويجية التي يتلقاها.

2- استخدام الخدمة. وظائف معينة في الخدمة

2-1 تُقدم الخدمة للمستخدم بغرض الاستخدام الشخصي غير التجاري.

2-2 تُقدم المعلومات الخاصة بخدمات النقل من قبل أطراف ثالثة (الشركاء) - مقدمو خدمات النقل. وتتوفر قائمة بأسماء الشركاء على الرابط: https://yango.com/partners . وللحصول على المزيد من المعلومات حول الخدمات المعروضة (بما في ذلك المعلومات المتعلقة بتوفر نقطة اتصال لاسلكي " Wi-Fi " داخل السيارة أو القيام بالمراقبة عن طريق تسجيل صور/فيديو داخل السيارة بواسطة الشركاء أو معلومات أخرى)، يمكن للمستخدم مخاطبة شركاء الخدمة – مقدمو خدمات النقل أو تقديم معلومات الاتصال الخاصة به من خلال وظائف البرنامج لشركاء الخدمة حتى يتسنى لهم التواصل على نحو مستقل مع المستخدم وتزويدهم بالمعلومات المتعلقة بخدمات النقل المعروضة.

2-3 لا تتحمل الشركة مسؤولية المحتوى و/أو ملائمة المعلومات المقدمة من قبل الشركاء في الخدمة – مقدمو خدمات النقل، بما في ذلك المعلومات المتعلقة بتكلفة الخدمات المقدمة بواسطة مقدمي خدمات النقل ومدى توفرها في الوقت الحالي. ويتعين على المستخدم، على نحو مستقل (دون تدخل الشركة)، التفاوض مع مقدمي خدمات النقل بشأن الحصول على الخدمات وفقاً لقواعد مقدمي خدمات النقل الخاصة بتقديم خدمات النقل. ولا تتحمل الشركة مسؤولية أي تعاملات مالية وأي معاملات أخرى تتم بين المستخدم ومقدمي خدمات النقل، كما لا تتحمل مسؤولية أي عواقب تترتب على حصول المستخدم على الخدمات التي يقدمها مقدمو خدمات النقل.

2-4 يجوز للمستخدم الوصول إلى وظائف تقييم الخدمات المقدمة من الشركاء في الخدمة – مقدمو خدمات النقل والتعليق/وإبداء ملاحظاتهم على الخدمة و/أو الخدمات المقدمة من مقدمي خدمات النقل. ويتم نشر تقييمات المستخدمين وتعليقاتهم على الخدمة على الموقع الإلكتروني للخدمة ويمكن توافرها على المواقع الإلكترونية لأي طرف ثالث. وتحتفظ الشركة بحقها في رفض نشر أي تقييمات/تعليقات وحذف/حظر، في أي وقت، أي تقييم/تعليق نشره المستخدم وفق سلطتها التقديرية ودون إبداء أية أسباب.

2-5 تحتفظ الشركة بالحق، وفق سلطتها التقديرية، في تقييد وصول المستخدم إلى الخدمة (أو تقييد بعض وظائف الخدمة، إذا كان ذلك مجدياً من الناحية التقنية) عن طريق استخدام حساب المستخدم أو حظر حساب المستخدم بالكامل عند وقوع حالات انتهاك متعددة للشروط، أو اتخاذ أي تدابير أخرى ضد المستخدم مراعاةً للمتطلبات التشريعية أو حقوق الغير والمصالح المشروعة.

2-6 عند ارتفاع معدلات الطلب على خدمات النقل أو الخدمات الأخرى (بما في ذلك الأيام التي تسبق العطلات أو أيام التجمعات الجماهيرية والحالات الأخرى)، يمكن رفع تعريفة شركاء الخدمة. وتقوم الشركة بالإبلاغ عن زيادة التعريفة عن طريق نشر إشعار ذي صلة على الموقع الإلكتروني للخدمة على رابط https://yango.com أو بأي طريقة أخرى على النحو الذي تراه الشركة مناسباً، من جملة أمور أخرى، عن طريق إرسال رسالة إعلامية إلى رقم الهاتف المحمول للمستخدم أو عبر تطبيق الهاتف المحمول.

2-7 إذا كانت الخدمة تدعم طلب الرحلات مسبقاً (يشار إليها فيما بعد "الرحلات المطلوبة مسبقاً") مقابل تعريفة خدمة معينة، سيُقدم الطلب إلى شريك الخدمة للتأكيد على قبول الرحلة في وقت قريب من الموعد الذي حدده المستخدم في طلبه (في موعد أقصاه 30 دقيقة قبل موعد بدء الرحلات المطلوبة مسبقاً). وسيتم احتساب تكلفة الرحلة المطلوبة مسبقاً وتحديدها في الخدمة عند طلب الرحلة. ويجوز أن يتغير السعر حسب بعض الظروف المذكورة على الموقع الإلكتروني للخدمة على رابط https://yango.com.

2-9 يفرض مقدم خدمة النقل رسوماً على أي رحلة يقوم المستخدم بإلغائها، إذا حدث ذلك الإلغاء بعد وصول السيارة إلى الموقع الذي حدده المستخدم. ويتم احتساب قيمة هذه الرسوم بنفس طريقة حساب تكلفة الرحلة/الخدمة وفق التعريفة والوقت الزمني المستغرق منذ وصول السيارة بالفعل لموقع الإقلال أو منذ وقت الوصول المحدد في المعلومات التي يوضحها مقدم خدمة النقل للمستخدم فيما يتعلق بالطرد الخاص بالمستخدم المطلوب (أيهما يكون أبعد) وحتى إلغاء المستخدم للرحلة/الخدمة عن طريق إرسال إشعار ذي صلة إلى مقدم خدمة النقل عبر الخدمة. ويُعتبر عدم استقلال المستخدم للسيارة التي يوفرها مقدم خدمة النقل في غضون عشر (10) دقائق، أخذاً في الاعتبار وقت الانتظار المجاني المحدد في التعريفة ذات الصلة، على أنه إلغاء للرحلة/الخدمة، ما لم ينص على خلاف ذلك في القواعد ذات الصلة الخاصة بمقدم خدمة النقل أو الاتفاقيات المبرمة بين المستخدم وممثل مقدم خدمة النقل (السائق). ويتم احتساب رسوم إلغاء رحلات النقل من المطار إلى المدينة على النحو الموضح أعلاه بالإضافة إلى رسوم إضافية يتم فرضها على الرحلات خارج المدينة وفقاً لتعريفة الخدمة.

2-10 يصرح المستخدم للشركة بمعالجة المعلومات الشخصية (بما في ذلك التفاصيل الشخصية) لمستخدم الخدمة (Yango)، ونقل المعلومات الشخصية للمستخدم إلى شركاء الشركة (موفرو خدمة النقل)، ومعالجة المعلومات الشخصية لشركاء الشركة لتقديم الخدمات إلى المستخدم في الخدمة. عندما يستخدم المستخدم الخدمة، يتم نقل معلوماته الشخصية لتتم معالجتها وفقًا للشروط وللأغراض المحددة في إشعار الخصوصية المتاح على:

3**- وظيفة الدفع غير النقدي لخدمات نقل الركاب والأمتعة والخدمات الأخرى**

3-1 يجوز للمستخدم دفع مقابل خدمات النقل التي تُقدم إلى المستخدم وفقاً للمعلومات الواردة بشأن الطلب المحتمل على خدمات النقل الذي يقدمه المستخدم عبر الخدمة:

3-1-1 مباشرةً إلى مقدم خدمة النقل (من جملة أمور أخرى، نقداً أو بأي وسيلة أخرى يحددها مقدم خدمة النقل المذكور، إن وجدت، ويشار إليها فيما بعد في هذه الشروط وعلى واجهة الخدمة بلفظ "الدفع نقداً"). ويجب دفع المبلغ المذكور دون تدخل من الشركة ولا تخضع هذه العملية لهذه الشروط. قد يتم تقييد طريقة الدفع المذكورة لخدمات التوصيل (إذا كانت هذه الوظيفة متوفرة في بلد المستخدم).

3-1-2 عبر وظيفة الدفع غير النقدي من خلال يانجو؛ وفي هذه الحالة، تتصرف الشركة باسم مقدم خدمة النقل المعني أو بأي صورة أخرى (بما في ذلك التصرف المباشر) أمام أي معالج دفع معتمد أو معالج أموال إلكتروني أو أي طرف آخر مرتبط بالتسويات المعنية، أو بأي صورة أخرى (بما في ذلك التصرف المباشر) (يُشار إليها فيما يلي باسم "المدفوعات غير النقدية"). وفي حال إجراء مدفوعات غير نقدية عن طريق يانجو، ستقوم الشركة بتحصيل المدفوعات بصفتها وكيل تحصيل سداد محدود لمقدم خدمة. ولا تضمن الشركة أن تشغيل الخدمة سيكون خالياً من الأخطاء أو العيوب عند تفعيل وظيفة المدفوعات غير النقدية.

اعتماداً على منطقة المستخدم، يمكن إجراء المدفوعات غير النقدية دون تدخل الشركة كمستلم للمدفوعات أو بمشاركة الشركة في التسويات كطرف آخر أو دخولها كطرف في عملية تبادل المعلومات.

ويتيعن على المستخدم اختيار طريقة الدفع ذات الصلة من واجهة الخدمة. وفي هذا الصدد، إذا تعذر استخدام إمكانية المدفوعات غير النقدية لأي سبب (بما في ذلك على سبيل المثال لا الحصر تعذر الوصول المؤقت لهذه الوظيفة أو تعذر الدفع غير النقدي باستخدام البطاقة المقترنة_(حسب تعريفها أدناه) بصورة مؤقتة أو دائمة، أو عدم وجود أموال كافية في البطاقة المقترنة) فإن المستخدم يتعهد بالدفع نقداً.

وفيما يتعلق بالمدفوعات غير النقدية، يمكن تنفيذ معاملة واحدة مقابل التكلفة الكاملة لخدمة نقل الركاب والأمتعة أو أي خدمة أخرى، بينما يمكن تنفيذ العديد من المعاملات مقابل أجزاء معينة من تكلفة الخدمة. ويُمكن تفعيل وظيفة المدفوعات غير النقدية من خلال أي من الوسائل المذكورة أعلاه أثناء الرحلة/الخدمة أو عند انتهائها.

وفي حالة المدفوعات غير النقدية، يمكن للمستخدم، بالإضافة إلى دفع مقابل خدمة النقل، أن يسدد مدفوعات غير نقدية إضافية لمقدم خدمة النقل كنسبة مئوية من تكلفة خدمة نقل الركاب والأمتعة أو أي خدمة أخرى (يشار إليها فيما بعد في هذه الشروط وواجهة الخدمة بلفظ "الإكراميات") على النحو الذي يراه مناسباً.

3-2 بالنسبة للدفع غير النقدي عبر يانجو، يتعين على المستخدم تحديد البطاقة المصرفية في واجهة الخدمة مع الإشارة إلى التفاصيل التالية:

• رقم البطاقة المصرفية
• تاريخ نهاية صلاحية البطاقة المصرفية
• رمز التحقق

إذا كانت تفاصيل البطاقة المصرفية صحيحة وسارية ويمكن من الناحية الفنية استخدام هذه البطاقة في الخدمة، فتصبح هذه البطاقة بطاقة مقترنة بالحساب ويمكن استخدامها لسداد مدفوعات غير نقدية (البند 3-1-2 أعلاه). تُعرض جميع البطاقات المقترنة على واجهة الخدمة؛ ومن أجل توفير الراحة للمستخدم، لا تعرض الواجهة سوى آخر أربعة أرقام من البطاقة المصرفية المقترنة.

3-3 عند إضافة أي بطاقة مقترنة وعند اختيار المستخدم لوظيفة الدفع غير النقدي لأي رحلة/خدمة معينة، فسيتم خصم مبلغ محدد قدره 5 درهم (أو أي مبلغ آخر بالعملة المتداولة في منطقة المستخدم) مقابل تأكيد صحة وصلاحية البطاقة المقترنة؛ وإذا تم تنفيذ المعاملة بنجاح، فسيتم إعادة المبلغ المذكور إلى المستخدم. وعدم خصم المبلغ المذكور يعني أنه لا يمكن إضافة هذه البطاقة المقترنة و/أو استخدام وظيفة الدفع غير النقدي، على التوالي.

3-4 عند إضافة البطاقة المقترنة وفي أي وقت بعد إضافتها، يُمكن للمستخدم تحديد و/أو تغيير مبلغ الإكراميات الافتراضي على واجهة الخدمة؛ ويجوز للمستخدم تغيير مبلغ الإكراميات لرحلة/خدمة معينة عبر واجهة الخدمة عند انتهاء الرحلة/الخدمة.

3-5 تُخصم الإكراميات (بالمبلغ الافتراضي أو بالمبلغ الذي يحدده المستخدم على وجه الخصوص لأي رحلة/خدمة معينة) من البطاقة المقترنة، إذا منح المستخدم، في غضون 30 دقيقة بعد انتهاء الرحلة/الخدمة، تقييماً مرتفعاً للرحلة (4-5 نجوم) على واجهة الخدمة وضغط على زر "تم" أو إذا منح تقييماً ليس مرتفعاً وليس منخفضاً للرحلة/الخدمة (دون تحديد لعدد النجوم) وضغط على زر "تم".

3-6 إذا منح المستخدم، في غضون 30 دقيقة بعد انتهاء الرحلة/الخدمة، تقييماً منخفضاً للرحلة (3-1 نجوم) على واجهة الخدمة وضغط على زر "تم"، فلن تخصم أي إكراميات من البطاقة المقترنة.

3-7 إذا لم يضغط المستخدم، في غضون 30 دقيقة بعد انتهاء الرحلة/الخدمة، على زر "تم" فسيتم حجز مبلغ الإكراميات (بالمبلغ الافتراضي أو بالمبلغ الذي حدده المستخدم لرحلة/خدمة معينة) في البطاقة المقترنة لمدة 24 ساعة، بحيث يُمكن للمستخدم في غضون هذه المدة زيادة مبلغ الإكرامية لهذه الرحلة/الخدمة أو تقليله. وعند انتهاء المدة المذكورة، سيتم خصم الإكرامية بالمبلغ الذي حدده المستخدم (افتراضياً أو تحديداً لهذه الرحلة/الخدمة).

3-8 يلزم سداد المدفوعات غير النقدية المستحقة على المستخدم عن طريق معالج دفع معتمد أو معالج أموال إلكتروني على أن يخضع هذا الإجراء لقواعد أنظمة الدفع الدولية والمصارف (بما في ذلك المصرف الذي أصدر البطاقة المقترنة) وأطراف عمليات التسوية الأخرى.

3-9 عند تحديد التفاصيل الخاصة بالمستخدم طبقاً للبند 3-2 أعلاه وعند استخدام البطاقة المقترنة؛ فإن المستخدم يؤكد ويضمن أن المعلومات المقدمة عن البطاقة المصرفية السارية الصادرة باسمه هي معلومات موثوقة وكاملة؛ وأنه يمتثل لقواعد أنظمة الدفع الدولية ومتطلبات المصرف الذي أصدر البطاقة المقترنة، من جملة أمور أخرى، فيما يتعلق بإجراءات المدفوعات غير النقدية.

3-10 يتفهم المستخدم ويوافق على أن جميع الإجراءات التي يتم تنفيذها في الخدمة باستخدام رقم الهاتف المحمول الذي أكده المستخدم وعمليات المدفوعات غير النقدية باستخدام البطاقة المقترنة، من جملة أمور أخرى، تعتبر إجراءات قام المستخدم بتنفيذها.

3-11 إذا لم يوافق المستخدم على عملية و/أو مبلغ المدفوعات غير النقدية وكان لديه أي استفسارات أخرى بشأن كيفية استخدام البطاقة المقترنة في الخدمة، فيمكن للمستخدم التواصل مع الشركة عن طريق الاتصال على أرقام الهاتف المحددة من قبل الخدمة و/أو عبر واجهة مركز المساعدة (التعليقات والملاحظات) في غضون 14 يوماً من تاريخ المدفوعات غير النقدية أو أي إجراء أو أحداث أخرى أدت إلى تقديم هذا الطلب.

إذا قررت الشركة، بعد إجراء الفحص المترتب على هذا الطلب، رد مبلغ المدفوعات غير النقدية، كلياً أو جزئياً، فسيتم رد المبلغ المذكور إلى الحساب المصرفي للبطاقة المصرفية التي تم استخدامها في سداد المدفوعات غير النقدية. وتنفذ عملية رد المبالغ عن طريق معالج دفع معتمد أو معالج أموال إلكتروني يخضع لقواعد أنظمة الدفع الدولية والمصارف (بما في ذلك المصرف الذي أصدر البطاقة المقترنة) وأطراف عمليات التسوية الأخرى. وإذا لم تكن الشركة طرفاً في التسويات المنفذة عبر البطاقة المقترنة، فيمكن للشركة العمل كهيئة تنقل طلبات المستخدم الواردة أعلاه إلى مقدمي خدمات النقل أو مكاتب الإرسال أو أي شخص آخر يتلقى المدفوعات بموجب المعاملات المذكورة أعلاه بشأن البطاقة المقترنة.

3-12 تحتفظ الشركة بالحق في أن تطلب من المستخدم تأكيد التفاصيل التي حددها في الخدمة، بما في ذلك تفاصيل البطاقة المقترنة، وطلب تقديم مستندات داعمة في هذا الصدد (على وجه الخصوص، مستندات إثبات الهوية)؛ وقد يعتبر عدم تقديم هذه المستندات على أنه بمثابة تقديم معلومات غير موثوقة ويترتب عليه العواقب المنصوص عليها في البند 2-5 أعلاه، إذا تراءى للشركة ذلك.

3-13 لا تنطبق الأحكام المتعلقة بشروط وإجراءات الدفع مقابل خدمات نقل الركاب والأمتعة أو الخدمات الأخرى، بما في ذلك خدمات التوصيل، المحددة في هذا القسم، عندما يقوم طرف ثالث بدفع مقابل خدمات النقل أو الخدمات الأخرى بدلاً من المستخدم بموجب عقد منفصل تبرمه الشركة مع هذا الطرف الثالث.

4- القانون الحاكم وتسوية النزاعات

4-1 تخضع شروط استخدام Yango الناشئة عن أو فيما يتعلق بهذه الشروط وتفسر وفقًا لقانون دولة الإمارات العربية المتحدة ، على النحو المطبق في إمارة دبي.

4-2 يتم الفصل في أي نزاعات تنشأ عن شروط استخدام Yango أو تتعلق بها من قبل المحكمة المختصة في محاكم مركز دبي المالي العالمي (بما في ذلك محكمة الدعاوى الصغيرة للمطالبات).

5- التعديلات على الشروط والمستندات التنظيمية

5-1 يجوز تعديل الشروط الماثلة وإشعار الخصوصية من قبل الشركة منفردة في أي وقت دون توجيه إشعار إلى المستخدم. ويتم نشر إشعار المستخدم بالتعديلات الطارئة على شروط استخدام برنامج يانجو على الرابط: https://yango.com/legal/yango_termsofuse . وتدخل التعديلات الطارئة على الشروط حيز النفاذ اعتباراً من تاريخ نشرها، إلا إذا نص المنشور ذي الصلة على خلاف ذلك. ويتحمل المستخدم مسؤولية عدم الاطلاع على أي نسخة جديدة من الشروط والمستندات التنظيمية. ويعتبر أي استخدام مستمر للخدمة بعد التعديلات الطارئة على الشروط والمستندات التنظيمية بمثابة موافقة على النسخة الجديدة.

5-2 يتعين على المستخدم التوقف عن استخدام الخدمة إذا كان لا يوافق على أي تعديلات أجرتها الشركة على النحو المنصوص عليه في البند 5-1 أعلاه.

6- برنامج ولاء المستخدم - Yango Plus

6-1 يشارك كل مستخدم في برنامج الولاء فيYango ("Yango Plus"). يسمح Yango Plus للمستخدمين بتجميع مكافآت على كل رحلة عبر Yango ("النقاط") والاستفادة من النقاط المكتسبة في رحلات مستقبلية عبر Yango. لن يتم تحصيل أي مدفوعات إضافية من المستخدم مقابل المشاركة في Yango Plus.

نقاط Yango Plus صالحة لمدة 6 أشهر اعتبارًا من 3 فبراير 2023.

6-1-1 الحصول على النقاط: 25% من مبلغ الشراء الفعلي (المدفوعات) (مقربًا إلى 1 AED) مع الدفع عن طريق وظيفة غير نقدية داخل تطبيق Yango للهاتف الجوَّال. سيتم عرض عدد النقاط التي سيتم الحصول عليها بعد إكمال الطلب في تطبيق Yango للهاتف الجوَّال.

لا يجوز تجميع النقاط عند الدفع باستخدام النقاط فقط. وفي إحدى عمليات الشراء، إذا قام المستخدم بسداد جزء من المبلغ المطلوب عن طريق السداد الفعلي والجزء الآخر عن طريق استخدام النقاط، فسيتم الحصول على النقاط مقابل الجزء الذي تم سداده عن طريق استخدام النقاط.

6-1-2 استرداد النقاط (الاستخدام): الدفع مقابل رحلات Yango من خلال وظيفة غير نقدية في تطبيق الهاتف الجوَّال. لا يمكن استخدام النقاط لسداد رسوم المرور على الطرق ورسوم خدمة Yango (إن وجدت).

لا يجوز استخدام النقاط في نفس المعاملة التي تم تجميعها فيها، ولكن في إطار معاملة منفصلة فقط. لا يجوز أيضًا تجميع النقاط أو استخدامها بأثر رجعي.

6-3 تتوفر معلومات حول رصيد النقاط التي جمعها المستخدم في Yango Plus في جميع تطبيقات Yango للهاتف الجوَّال.

6-4 لا توجد قيمة نقدية أو قابلية للتحويل: النقاط لا تشكل ملكية، ولا تمنح المستخدم حقًا أو فائدة مكتسبة، وليس لها قيمة نقدية. ووفقًا لذلك، لا يمكن استرداد قيمة النقاط نقدًا أو تحويلها أو التنازل عنها لأي سبب من الأسباب. النقاط غير قابلة للتحويل (أ) عند الوفاة، (ب) كجزء من مسألة تتعلق بالعلاقات الأسرية، أو (ج) خلافًا لذلك بحكم القانون. يُحظر تمامًا بيع أو تحويل النقاط. لا يجوز بيع النقاط في أي سوق آخر، ويُعتبر أي تحويل للنقاط إلى سوق آخر باطلاً. ولا يجوز ترحيل النقاط أو تحويلها إلى مستخدم آخر.

6-5 حق التغيير: تحتفظ الشركة بالحق في تغيير أو تعديل أو وضع قيود للاستخدام أو إصلاح أو إلغاء أي جزء من نقاط Yango Plus في أي وقت، بما في ذلك قواعد الحصول على النقاط واستخدامها. سيتم بذل جهود معقولة لضمان نشر أحدث إصدار من هذه القواعد هنا. إذا حدث أي تغيير أو تعديل في هذا القسم أو القسم 7 أو غير ذلك من الأقسام، فإن المستخدم يُعتبر موافقًا على أي تعديل أو تحديث. المستخدم هو المسؤول الوحيد عن البقاء على اطِّلاع بقواعد Yango Plus.

6-6 ليس هناك تاريخ إنهاء مُحدَّد مُسبقًا لبرنامج Yango Plus حتى الوقت الذي تقرر فيه الشركة إنهاءه، في أي وقت، بإشعار مُسبق أو بدونه وفقًا لتقدير الشركة وحدها.

6-7 يخضع استخدام النقاط في Yango Plus للتشغيل السليم لأنظمة الكمبيوتر والتشغيل الخاصة ببرنامج الولاء. وفي حالة حدوث أعطال تمنع استخدام النقاط مؤقتًا، فسنعمل على إصلاح هذه الأعطال في أقرب وقت ممكن. ولكن هذا في حالة عدم وجود أي مطالبات أو دعاوى من قِبَل المستخدم ضد الشركة وشركائها وأي شخص ينوب عنها بسبب عدم الاستفادة من النقاط خلال فترة الأعطال وإصلاحها.

6-8 انتهاء صلاحية النقاط: النقاط صالحة لمدة ستة (6) أشهر بدءًا من 3 فبراير 2023. يمكنك معرفة عدد النقاط التي ستنتهي صلاحيتها قريبًا في تطبيق الهاتف الجوَّال. بمجرد انتهاء الصلاحية، لا يمكن استخدام النقاط، وسوف ينعكس ذلك في عدد النقاط الخاصة بك.

6-9 تحتفظ الشركة بالحق في الإيقاف المؤقت أو إيقاف أهلية أي شخص يستخدم، أو في حالة الإيقاف المؤقت، يشتبه في استخدامه Yango Plus بطريقة لا تتفق مع هذه القواعد أو أي قوانين محلية. بالإضافة إلى الإيقاف المؤقت أو إيقاف برنامج Yango Plus، يحق للشركة اتخاذ الإجراءات الإدارية و/أو القانونية المناسبة، بما في ذلك الملاحقة الجنائية، كما تراه ضروريًا وفقًا لتقديرها الخاص.
