YANGO SHOP TERMS OF USE
PLEASE READ THESE CONDITIONS CAREFULLY BEFORE ACCESSING OR USING YANGO SHOP
1. General terms and conditions
1.1. These terms and conditions (the “Terms”) constitute an offer by RideTechnology Global FZ-LLC (“Yango”) to an Internet user (the “User”) for the use of Yango SHOP, the electronic catalog, showcase or listing of consumer goods offered by third-party merchants, retailers, sellers or service providers in Pakistan (the “Service”).
1.2. Use of the Service by the User is governed by these Terms. All currently available features of the Service, as well as any developments and/or new features added, are subject to these Terms.
1.3. By starting to use the Service or any of its functions, the User is deemed to have accepted the present Terms, the license agreement available at https://yango.com/legal/yango_mobile_agreement and other documents relating to the Service, if any (the “Regulatory Documents”), in their entirety, without any reservations or exceptions. If the User does not agree with any of the provisions of the Terms and/or the Regulatory Documents, the User may not use the Service.
1.4. The Service is provided free of charge to Users.
2. Use of the Service
2.1. The Service may contain product names, descriptions, images, characteristics, prices, availability indicators, ratings, links and other related information concerning goods displayed within the Service.
2.2. The Service is made available for convenience and information purposes only..
2.3. The Service is intended solely to assist the User in identifying goods offered by third parties.
2.4. Products displayed in the Service are purchased on the relevant third-party website or platform and not within the Service. Where the User selects a product displayed in the Service, the User may be redirected to the website or application of the relevant merchant in order to review the relevant product details, terms and conditions and complete the purchase.
2.5. Any agreement for the purchase of goods displayed in the Service shall be concluded directly between the User and the relevant third-party merchant or seller. Yango shall not be the seller, reseller, supplier, distributor, agent or contracting party in relation to such purchase.
2.6. Any purchase made following the User’s access to a third-party website or application shall be subject to the terms, conditions, policies and notices of the relevant third party, including terms of sale, payment terms, delivery terms, returns policy, refund policy and privacy documentation. Yango shall not be responsible for the content of such third-party terms or for the performance by the relevant third party of its obligations.
2.7. Yango does not participate in the purchase of any products displayed in the Service and does not process, receive, hold or transmit any payment in respect of such purchases. Any ordering, payment, billing, fulfilment, delivery, return or refund in relation to such products is carried out solely by and between the User and the relevant third-party merchant or seller. Yango shall not be a party to, or responsible for, any such transaction.
2.8. Yango does not warrant that the information shown in the Service, including product descriptions, images, specifications, prices, discounts, promotions, delivery options or availability, is accurate, complete, current or free from errors. Such information may change at any time and may differ from the information shown on the relevant merchant’s website or platform at the time of purchase.
2.9. In the event of any inconsistency between the information shown in the Service and the information shown on the relevant merchant’s website or platform, the information displayed by the relevant merchant at the time of purchase shall prevail.
2.10. Yango may determine, at its sole discretion, the manner in which products, merchants and offers are displayed in the Service, including their order, ranking, grouping, visibility or removal. Yango may add to, update, suspend, withdraw or discontinue the Service, or any part of it, at any time.
2.11. The Service may contain links, redirects or other technical means enabling access to third-party websites, applications or resources. Yango does not control such third-party resources and, to the extent permitted by law, shall not be responsible for their availability, content, products, services or practices.
2.12. Any questions, claims, complaints or disputes relating to products displayed in the Service, including in relation to quality, safety, description, availability, delivery, warranty, returns or refunds, shall be addressed by the User directly to the relevant merchant or seller, unless applicable law provides otherwise.
3. Limitation of Liability
3.1. To the fullest extent permitted by law, Yango shall not be liable for any loss, damage, cost or claim arising out of or in connection with: (a) reliance by the User on information displayed in the Service; (b) any inaccuracy, incompleteness or unavailability of information in the Service; (c) any act or omission of a third-party merchant or seller; or (d) any transaction, communication or dispute between the User and a third-party merchant following redirection from the Service.
4. Intellectual Property
4.1. Yango retains all rights, titles, and interests in the Service (including software, logos, and proprietary content).
4.2. Content displayed in the Service is sourced from third-party Sites and is protected by intellectual property laws. The User may not reproduce, distribute, or exploit such content beyond personal use for the purpose of product discovery.
5. Personal data
5.1. When the User accesses the Service, their personal data is processed under the conditions and for the purposes described in the Privacy Notice available at the following address: (https://yango.com/legal/yango_privacy_notice).
6. Use of the Service
6.1. By using the Service and its features, the User agrees to act in good faith and to comply strictly with all applicable legal regulations in Pakistan and the Terms of Service and, among other things, warrants that it has, and shall have, full authority and competence to perform the use of the Service.
7. Modifications
7.1. Yango may, at any time and without notice, modify the provisions hereof, and may, at any time and without notice, modify the provisions of the Regulatory Documents. The current version hereof is available at the following address: https://yango.com/legal/yango_sb_termsofuse
7.2. The User takes the risk of not consulting a new version of the conditions and regulatory documents. Continued use of the Service after the conditions or regulatory documents have been modified shall constitute acceptance of the new version.
7.3. The User must cease to use the Service if he/she does not agree with the modifications made to the present conditions in accordance with article 7.1 hereof.
8. Applicable law and settlement of disputes
8.1. The Terms of Use and any non-contractual obligations arising out of or in connection with the Terms of Use shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions.
8.2. Any dispute, difference, controversy or claim arising out of or in connection with these Terms of Use, including (but not limited to) any question regarding their existence, validity, interpretation, performance, discharge and applicable remedies, shall be submitted to and finally resolved by arbitration in accordance with the Arbitration Rules of the Dubai International Arbitration Centre, which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of the arbitration shall be Dubai, United Arab Emirates. The language used in the arbitration shall be English.
