Before using the program, please read terms and conditions of the below license agreement.

Any use of the program means that you fully and unconditionally accept the terms and conditions of this license agreement.

If you do not accept the license agreement in full, you may not use the program for any purpose.

1. General Provisions

1.1. This License Agreement (hereinafter referred to as the License) set the terms of use of Yango for mobile devices (hereinafter referred to as the Program) and is signed with any person using the Program in Guatemala (hereinafter referred to as the User) and Ridetech International B.V., being a body authorized to grant the rights to use the Program (hereinafter referred to as the Rightholder).

1.2. By copying the Program, installing it on its mobile device or using the Program in any way, the User expresses its full and unconditional consent to all terms and conditions of the License, subject to applicable laws.

1.3. It is permitted to use the Program only under the terms and conditions of this License. If the User does not accept the terms and conditions of the License in full, the User may not use the Program for any purpose. It is prohibited to use the Program in violation of (failing to fulfill) any of the terms and conditions of the License.

1.4. The Program can be used by the User under the terms and conditions of this License for personal non-commercial purposes free of charge. It is only possible to use the Program under terms and in ways not covered by this License based on a separate agreement with the Rightholder.

1.5. When using the Program, you agree that the following document forms an integral part of this License for the Program:

The said documents (inter alia, any parts thereof) can be amended by the Rightholder after prior notice of the proposed new version. New versions of the documents shall come into effect upon their publication, unless otherwise stipulated by the version itself.

1.6. The Rightholder can provide the User with a translation of this License from English into other languages. However, in the event of a conflict between the License in English and its translation, only the English version of the License shall be legally binding.

2. Rights to the Program

2.1. The exclusive right to the Program is vested in the Rightholder.

3. License

3.1. The Rightholder shall, free of charge and under an ordinary (non-exclusive) license, grant to the User the non-transferable right to use the Program in all countries of the world in the following ways:

3.1.1. to use the Program as intended, wherefore to copy and install (reproduce) it on the User’s mobile device/-s. The User may install the Program on an unlimited number of mobile devices;

3.1.2. to reproduce and distribute the Program for non-commercial purposes (free of charge).

3.2. The Program shall be used (inter alia, be distributed) under the name: Yango. The User may not change and/or delete the name of the Program, the copyright notice or any other references to the Rightholder.

4. Limitations

4.1. Except as used in the scope and in the ways expressly stipulated by this License, the User may not modify, decompile, disassemble, decrypt and perform any other actions with the object code and source code of the Program meant to obtain information on the implementation of algorithms used in the Program, create derivative works using the Program and otherwise use (allow to use) the Program and any components thereof, maps and other images and data stored by the Program on the User’s mobile device, without the Rightholder’s written consent.

4.2. The User may not reproduce and distribute the Program for commercial purposes (inter alia, for a fee), inter alia, as part of software product collections, without the Rightholder’s written consent.

4.3 The User may not distribute the Program in any form other than the form received, without the Rightholder’s written consent.

5. Special Provisions

5.1. Some functions of the Program can only be performed with the Internet available. The User shall independently get and pay for such access under terms and as per tariffs of its communication or Internet provider.

5.2. The Program enables the User to place information on the User’s potential demand for services involving the transportation of passengers and baggage, look through offers of organizations providing services in the said field, and search for such offers using parameters set by the User.

5.3. Information available to the User within the Program (hereinafter referred to as the Data) is provided by the Rightholder’s partners. To get more details on services offered (including the information on the availability of Wi-Fi hotspot inside the vehicle, carrying out of photo/video recording inside the vehicle by the Right Holder's partners - transportation provider or other information), the User can either address the Rightholder’s partners or provide its contact information through the functions of the Program, which can be used by the Rightholder’s partners to contact the User on their own and provide it with the information on services offered.

5.4. The Rightholder shall not be held liable for the content and/or relevance of information provided by the partners, including information on the cost of the partners’ services and on their availability at the moment.

5.5. The User shall independently (without the participation of the Rightholder) discuss with the partners the acquisition of services in accordance with the partners’ rules on the provision of services. The Rightholder shall not be held liable for financial and any other transactions effected by the User and partners and for any consequences of the acquisition of the partners’ services by the User.

5.6. The User agrees that the Rightholder can process the User’s personal information (including personal details), transfer the User’s personal details to the Rightholder’s partners and that the Rightholder’s partners can process personal information in order to provide services to the User within the Program. When the User uses the Program, its personal information is transferred to be processed under the terms and for the purposes determined in the Privacy Policy available at: https://yango.com/legal/yango_privacy_notice

5.7. The User is hereby notified, understands and agrees that the Program can collect anonymized statistical data on the use of the Program and automatically transfer these data to the Rightholder.

5.8. The Program shall be registered and used by applying the User’s mobile phone number. When the User deletes the Program from the memory of the User’s mobile device, the User’s personal information obtained by the Rightholder during authorization in the Program using the User’s mobile phone number and application of the Program will be saved in the Service for 1 (one) year, unless the User sends the Notice on deletion of such data to the Rightholder prior to the expiration of this term. If the Program is re-installed on the device and registered using the same mobile phone number as an identifier, the User’s personal information provided with the use of the said mobile phone number will be restored in full.

5.9. For the avoidance of doubt, the Rightholder does not provide services involving the transportation of passengers and baggage and help desk services.

5.10. The User can withdraw from this License agreement at any time by deleting the Program from the memory of the User’s mobile device.

6. Liability under the License

6.1. The Program is provided “as is”. The Rightholder provides no guarantees of error- and trouble-free operation of the Program or its certain components and/or functions, fitness of the Program for specific goals of the User, does not guarantee the reliability, accuracy, completeness and timeliness of the Data, and provides no other guarantees, which are not expressly stated in this License.

6.2. The Rightholder shall not be held liable for any direct or indirect consequences of any use of or inability to use the Program (including the Data) and/or any losses incurred by the User and/or third parties as a result of any use of, failure to use or inability to use the Program (including the Data) or its certain components and/or functions, inter alia, due to possible errors or failures in their operation, except as expressly stipulated by laws.

6.3. All issues and claims related to the use of / inability to use the Program or the Data and possible violations of laws and/or third-party rights by the Program or the Data shall be sent through the feedback form to support@yango.com.

6.4. This License and all relations associated with the use of the Program shall be governed by laws of the Netherlands.

6.5. Any disputes arising out or in connection with these Terms of Use of Yango shall be decided by the competent court in The Netherlands, unless mandatory conflict of laws provisions provide otherwise.

7. Updates / New Versions of the Program

7.1. This License covers all future updates / new versions of the Program. By agreeing to install an update / new version of the Program, the User accepts the terms and conditions of this License for relevant updates / new versions of the Program, if there is no other license agreement for the update / new version of the Program.

8. Amendments to this License

8.1. This license agreement may be amended by the Rightholder. The said amendments to the terms and conditions of the license agreement shall come into effect from the date of their publication at https://yango.com/legal/yango_mobile_agreement, unless otherwise specified in the relevant publication.

Acuerdo de Licencia de Yango Pro para Dispositivos Móviles

 

Antes de usar el programa, lea los términos y condiciones del acuerdo de licencia a continuación.

Cualquier uso del programa significa que usted acepta total e incondicionalmente los términos y condiciones de este acuerdo de licencia.

Si no acepta el acuerdo de licencia en su totalidad, no podrá utilizar el programa para ningún fin.

1. Disposiciones Generales

1.1. Este Acuerdo de Licencia (en lo sucesivo, la Licencia) establece los términos de uso de Yango para dispositivos móviles (en lo sucesivo, el Programa) y se firma con cualquier persona que use el Programa en Guatemala (en lo sucesivo, el Usuario) y Ridetech International B.V., siendo un organismo autorizado para otorgar los derechos de uso del Programa (en lo sucesivo, el Titular de los Derechos).

1.2. Al copiar el Programa, instalarlo en su dispositivo móvil o utilizar el Programa de cualquier forma, el Usuario expresa su consentimiento total e incondicional a todos los términos y condiciones de la Licencia, sujeto a las leyes aplicables.

1.3. Está permitido usar el Programa solo bajo los términos y condiciones de esta Licencia. Si el Usuario no acepta los términos y condiciones de la Licencia en su totalidad, el Usuario no podrá utilizar el Programa para ningún fin. Está prohibido usar el Programa en violación de (no cumplir) cualquiera de los términos y condiciones de la Licencia.

1.4. El Programa puede ser utilizado por el Usuario bajo los términos y condiciones de esta Licencia para fines personales no comerciales de forma gratuita. Solo es posible usar el Programa bajo términos y formas no cubiertas por esta Licencia según un acuerdo por separado con el Titular de los Derechos.

1.5. Al usar el Programa, usted acepta que el siguiente documento forma parte integral de esta Licencia para el Programa:

Dichos documentos (entre otros, cualquier parte de los mismos) pueden ser modificados por el Titular de los Derechos después de la notificación previa de la nueva versión propuesta. Las nuevas versiones de los documentos entrarán en vigor a partir de su publicación, salvo que se disponga lo contrario en la propia versión.

1.6. El Titular de los Derechos puede proporcionar una traducción de esta Licencia del inglés a otros idiomas al Usuario. Sin embargo, en caso de conflicto entre la Licencia en inglés y su traducción, solo la versión en inglés de la Licencia será legalmente vinculante.

2. Derechos al Programa

2.1. El derecho exclusivo al Programa se otorga al Titular de los Derechos.

3. Licencia

3.1. El Titular de los Derechos deberá, de forma gratuita y bajo una licencia ordinaria (no exclusiva), otorgar el derecho intransferible de usar el Programa en todos los países del mundo al Usuario de las siguientes maneras:

3.1.1. para usar el Programa según lo previsto, por lo tanto, para copiarlo e instalarlo (reproducirlo) en el/los dispositivo/s móvil/es del Usuario. El Usuario puede instalar el Programa en un número ilimitado de dispositivos móviles;

3.1.2. Para reproducir y distribuir el Programa con fines no comerciales (sin cargo).

3.2. El Programa se utilizará (entre otros, se distribuirá) bajo el nombre: Yango. El Usuario no puede cambiar y (o) eliminar el nombre del Programa, el aviso de derechos de autor o cualquier otra referencia al Titular de los Derechos.

4. Limitaciones

4.1. Salvo que se utilice en el ámbito y en las formas expresamente estipuladas por esta Licencia, el Usuario no puede modificar, descompilar, desensamblar, descifrar ni realizar ninguna otra acción con el código objeto y el código fuente del Programa destinados a obtener información sobre la implementación de algoritmos usados en el Programa, crear trabajos derivados usando el Programa y usar (permitir usar) el Programa y cualquiera de sus componentes, mapas y otras imágenes y datos almacenados por el Programa en el dispositivo móvil del Usuario de otra manera, sin el consentimiento por escrito del Titular de los Derechos.

4.2. El Usuario no puede reproducir ni distribuir el Programa con fines comerciales (entre otros, a cambio de una tarifa), entre otros, como parte de colecciones de productos de software, sin el consentimiento por escrito del Titular de los Derechos.

4.3 El Usuario no puede distribuir el Programa de ninguna forma que no sea la recibida, sin el consentimiento por escrito del Titular de los Derechos.

5. Provisiones Especiales

5.1. Algunas funciones del Programa solo se pueden realizar con Internet disponible. El Usuario obtendrá y pagará de forma independiente por dicho acceso en los términos y tarifas de su proveedor de comunicaciones o de Internet.

5.2. El Programa permite al Usuario colocar información sobre la demanda potencial del Usuario de servicios relacionados con el transporte de pasajeros y equipaje, buscar ofertas de organizaciones que brindan servicios en dicho campo y buscar dichas ofertas utilizando parámetros establecidos por el Usuario.

5.3. La información disponible para el Usuario dentro del Programa (en adelante, los Datos) se proporciona por los socios del Titular de los Derechos. Para obtener más detalles sobre los servicios ofrecidos (incluida la información sobre la disponibilidad del punto de acceso Wi-Fi dentro del vehículo, la realización de grabaciones de fotos/videos dentro del vehículo por parte de los socios del Titular de los Derechos - proveedor de transporte u otra información), el Usuario puede dirigirse a los socios del Titular de los Derechos o proporcionar su información de contacto a través de las funciones del Programa que puede ser utilizada por los socios del Titular de los Derechos para contactar al Usuario por su cuenta y proporcionarle la información sobre los servicios ofrecidos.

5.4. El Titular de los Derechos no será responsable del contenido y (o) relevancia de la información proporcionada por los socios, incluida la información sobre el costo de los servicios de los socios y sobre su disponibilidad en el momento.

5.5. El Usuario discutirá, de forma independiente (sin la participación del Titular de los Derechos) con los socios, la adquisición de servicios de acuerdo con las reglas de los socios sobre la prestación de servicios. El Titular de los Derechos no será responsable de las transacciones financieras y de otro tipo realizadas por el Usuario y los socios y por las consecuencias de la adquisición de los servicios de los socios por parte del Usuario.

5.6. El Usuario acepta que el Titular de los Derechos puede procesar la información personal del Usuario (incluidos los datos personales), transferir los datos personales del Usuario a los socios del Titular de los Derechos y que los socios del Titular de los Derechos pueden procesar la información personal para proporcionar servicios al Usuario dentro del Programa. Cuando el Usuario utiliza el Programa, su información personal se transfiere para ser procesada en los términos y para los fines determinados en la Política de Privacidad disponible en: https://yango.com/legal/yango_privacy_notice

5.7. Por lo presente, el Usuario se notifica, entiende y acepta que el Programa puede recopilar datos estadísticos anónimos sobre el uso del Programa y transferir automáticamente estos datos al Titular de los Derechos.

5.8. El Programa se registrará y utilizará mediante la aplicación del número de teléfono móvil del Usuario. Cuando el Usuario elimina el Programa de la memoria del dispositivo móvil del Usuario, la información personal del Usuario obtenida por el Titular de los Derechos durante la autorización en el Programa utilizando el número de teléfono móvil del Usuario y la aplicación del Programa se guardará en el Servicio por 1 (uno) año, a menos que el Usuario envíe el Aviso sobre la eliminación de dichos datos al Titular de los Derechos antes del vencimiento de este plazo. Si el Programa se reinstala en el dispositivo y se registra utilizando el mismo número de teléfono móvil como identificador, la información personal del Usuario proporcionada con el uso de dicho número de teléfono móvil se restaurará en su totalidad.

5.9. Para evitar dudas, el Titular de los Derechos no proporciona servicios que impliquen el transporte de pasajeros y equipaje y los servicios de asistencia al usuario.

5.10. El Usuario puede rescindir este acuerdo de Licencia en cualquier momento eliminando el Programa de la memoria del dispositivo móvil del Usuario.

6. Responsabilidad bajo la Licencia

6.1. El Programa se proporciona "tal cual". El Titular de los Derechos no ofrece ninguna garantía de que el Programa o sus determinados componentes y (o) funciones funcionen sin errores ni problemas, la idoneidad del Programa para los objetivos específicos del Usuario, no garantiza la fiabilidad, exactitud, integridad y actualidad de los Datos y no proporciona otras garantías que no estén expresamente establecidas en esta Licencia.

6.2. El Titular de los Derechos no será responsable de las consecuencias directas o indirectas del uso o la imposibilidad de usar el Programa (incluidos los Datos) y (o) las pérdidas sufridas por el Usuario y (o) terceros como resultado del uso, la falta de uso o la imposibilidad de uso del Programa (incluidos los Datos) o de sus determinados componentes y (o) funciones, entre otros, debido a posibles errores o fallos en su funcionamiento, salvo lo expresamente previsto por las leyes.

6.3. Todos los problemas y reclamos relacionados con el uso o la imposibilidad de usar el Programa o los Datos y las posibles violaciones de leyes y (o) derechos de terceros por parte del Programa o los Datos se enviarán a través del formulario de comentarios a support@yango.com.

6.4. Esta Licencia y todas las relaciones asociadas con el uso del Programa se regirán por las leyes de los Países Bajos.

6.5. Cualquier controversia que surja o esté relacionada con estos Términos de Uso de Yango será resuelta por el tribunal competente de los Países Bajos, a menos que las disposiciones obligatorias sobre conflicto de leyes dispongan lo contrario.

7. Actualizaciones / Nuevas Versiones del Programa

7.1. Esta Licencia cubre todas las futuras actualizaciones / nuevas versiones del Programa. Al aceptar instalar una actualización / nueva versión del Programa, el Usuario acepta los términos y condiciones de esta Licencia para las actualizaciones / nuevas versiones relevantes del Programa si no existe otro acuerdo de licencia para la actualización / nueva versión del Programa.

8. Enmiendas a esta Licencia

8.1. Este acuerdo de licencia puede ser modificado por el Titular de los Derechos. Dichas modificaciones a los términos y condiciones del acuerdo de licencia entrarán en vigencia a partir de la fecha de su publicación en https://yango.com/legal/yango_mobile_agreement, a menos que se especifique lo contrario en la publicación correspondiente.
