PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING OR USING YANGO CARLASH

 

1. Definitions

In these Terms and Conditions the following terms an expressions shall have the following meaning:

1.1. “Account” shall mean the personal account of the User on Yango Carlash, which contains information about the User, including its previous Bookings, their status, other data needed for the use of the Service.

1.2. “Ad” shall mean Owner’s Materials provided by the Owner and placed on the Yango Carlash interface to provide the User with information on the offer of the Owner to conclude a lease agreement according on the conditions offered by the Owner.

1.3. “Booking” shall mean a request sent by the User to the Owner made via Yango Carlash, containing information on the Vehicle, the rental period and other relevant information

1.4. “Country” shall mean Côte d’Ivoire.

1.5. “Owner” shall mean any individual or legal entity owning a Vehicle that this individual or legal entity wants to offer for rent for ride-hailing activities by placing an Ad about it on Yango Carlash.

1.6. “Owner’s Materials” shall mean the informational materials, containing information on the Vehicle, offers to potential Tenants, including price, Vehicle pictures, descriptions of the Vehicle and other details.

1.7. “Regulatory Documents” shall mean:

i. License Agreement for Yango Pro for Mobile Devices as available at https://yango.com/legal/yangopro_mobile_agreement

ii. Privacy Policy as available at https://yango.com/legal/yango_carlash_privacy_notice

1.8. “Rent”, “Rental” or “Lease” shall mean the provision of the Vehicle to the User by the Owner for temporary possession for a fee agreed by the User and the Owner.

1.9. “Terms” shall mean these Terms and Conditions governing the use of Yango Carlash by the User available online at https://yango.com/legal/yango_carlash_termsandconditions.

1.10. “User” or “Tenant” shall mean an adult internet user that has registered in the Yango Pro App and has unconditionally accepted the Terms and the Regulatory documents:

1.11. “Vehicle” shall mean any transportation vehicle that is offered for lease by its Owner via Yango Carlash.

1.12. “Yango” shall mean RideTechnology Global FZ-LLC.

1.13. “Yango Carlash” or the “Service” shall mean the Yango Carlash electronic platform designed allowing Owners to place Ads on the Vehicles that they offer for rent and allowing the Users to have access to these Ads in order to make Bookings and further agree with the Owners on the rent of Vehicles.

 

2. General Provisions

2.1. These Terms constitute an offer of Yango to a User to use Yango Carlash service in the Country.

2.2. The use of the Service by the User is governed by these Terms.

2.3. By starting to use the Service / its certain functions, the User is deemed to have accepted these Terms and provisions of Regulatory Documents, in full, without any reservations and exceptions. If the User disagrees with any provisions of the Terms and/or Regulatory Documents, the User may not use the Service.

2.4. Yango may, at any time without notice to the User, amend provisions hereof, and may, at any time without notice to the User, amend provisions of the Regulatory Documents. The current version hereof is available at: https://yango.com/legal/yango_carlash_termsandconditions.

2.5. The User bears the risk of failure to review a new version of the Terms and Regulatory Documents. Any continued use of the Service after the Terms or Regulatory Documents have been changed will qualify as the acceptance of the new version.

2.6. The User shall stop using the Service, if he or she disagrees with any amendments to these Terms, that Yango made as prescribed by cl. 2.4 hereof.

2.7. The Service enables the User to get free of charge access to the Ads of vehicles, that the Owners potentially want to rent out, as well as to send rental requests to the Owners, look through offers of Owners providing Vehicles for rent and search for such offers using parameters set by the User.

2.8. All currently available functions of the Service along with any developments and/or newly added functions are subject to these Terms.

2.9. Depending on the User’s region, any or all functions of the Service can be inaccessible or limited. Functions are deemed to be inaccessible (limited) for the User from a certain region, if such User is unable to use them explicitly. It is prohibited to apply any technical and software-based methods to circumvent these limitations. Provisions hereof governing functions of the Service inaccessible (limited) for the User will apply until such functions become explicitly accessible for the User. Information on the accessibility of functions of the Service in a certain region shall be provided to the User upon his or her request sent to Yango.

2.10. For the avoidance of doubt, Yango does not provide any rental services, does not offer Vehicles for rent and does not act as an agent of either User or Owner.

YOU ACKNOWLEDGE THAT YANGO DOES NOT PROVIDE ANY VEHICLE RENTAL SERVICES OR FUNCTION AS AN AGENT FOR RENTAL OF VEHICLES AND THAT ALL SUCH RENTAL SERVICES AND RENTAL OFFERS AND ADS ARE PROVIDED BY THIRD PARTY – OWNERS, WHO ARE NOT EMPLOYED BY YANGO OR ANY OF ITS AFFILIATES. THE RELATIONS BETWEEN YOU AND THE OWNERS ON THE RENT OF VEHICLES ARE REGULATED BY RELEVANT AGREEMENTS BETWEEN YOU AND THE OWNERS, YANGO IS NOT THE PARTY OF THESE AGREEMENTS.

2.11. Yango shall not under or in connection with these Terms and whether in contract, tort (including negligence), misrepresentation, breach of statutory duty or otherwise have any liability to the User for any special, punitive, indirect or consequential loss, whether or not that party had been advised of the likelihood of any such loss or damage.

2.12. Yango shall not be held liable for the content posted by Owners, for the contractual and other types of relationships arising between the User and the Owner via the Service.

2.13. All conversations the User holds with the support team of the Service can be recorded to control quality and improve services.

 

3. Use of the Service. Certain Functions of the Service

3.1. The Service is provided to the User for personal non-commercial use free of charge.

3.2. Information on Vehicles and offers to rent them (hereinafter referred to as the Information) is provided by the Owners. For more information about the Owners and Vehicles please contact Owners directly. The User may contact the Owners or provide their contact details through the functions of the Service for the Owners to independently contact the User and provide their with information about the Vehicles offered.

3.3. Yango shall not be held liable for the content and/or relevance of information provided by the Owners, including information on the rental price and current availability of the Vehicles. The User shall independently (without the participation of Yango) discuss the rental of Vehicles with the Owners in accordance with the Owners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the Owners and for any consequences of the use of Yango Carlash and rental of Vehicles by the User.

3.4. Yango reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

3.5. Yango processes User’s and Owner’s personal data to provide the Service. Users and owners retain a right to access, erasure or rectification and other rights under applicable law and in accordance with the Privacy Notice. Yango assists Users and Owners to connect and further agree on rent of the vehicles. For this purpose, Yango transfers Users’ data to Owners and vice versa. 3.6. Yango reserves the right, at own discretion, to limit and/or suspend the provision of Yango Carlash (or certain functions of the Service, if technologically feasible) in the Country at any moment as it deems necessary for whatsoever reason.

 

4. Governing law and dispute resolution

4.1. The Terms and Conditions and any non-contractual obligations arising out of or in connection with the Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales without regard to the conflict of law provisions.

4.2. Any dispute, difference, controversy or claim arising out of or in connection with this Terms and Conditions, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of arbitration shall be Dubai, United Arab Emirates. The language to be used in the arbitration shall be English.

1. Définitions

Dans ces Conditions générales d’utilisation, les termes et expressions suivants auront la signification suivante :

1.1. « Compte » désigne le compte personnel de l’Utilisateur sur Yango Carlash qui contient des informations sur l’Utilisateur, y compris ses Réservations précédentes, leur statut et d’autres données nécessaires à l’utilisation du Service.

1.2. « Pub » désigne le Matériel du Propriétaire qui est fourni par le Propriétaire et placé sur l’interface de Yango Carlash afin de fournir à l’Utilisateur des informations sur l’offre du Propriétaire de conclure un contrat de location dans les conditions proposées par le Propriétaire.

1.3. « Réservation » désigne une demande qui est envoyée par l’Utilisateur au Propriétaire via Yango Carlash et contient des informations sur le Véhicule, la période de location et d’autres informations pertinentes.

1.4. « Pays » désigne la Côte d’Ivoire.

1.5. « Propriétaire » désigne toute personne physique ou morale qui possède un Véhicule et souhaite l’offrir à la location pour des activités d’agrégateur de taxis en publiant une Pub à ce sujet sur Yango Carlash.

1.6. « Matériel du Propriétaire » désigne le matériel qui contient des informations sur le Véhicule, offres aux Locataires potentiels, y compris le prix, les photos du Véhicule, les descriptions du Véhicule et d’autres détails.

1.7. « Documents réglementaires » désignent :

i. Contrat de licence pour Yango Pro pour appareils mobiles disponible sur https://yango.com/legal/yangopro_mobile_agreement

ii. Politique de confidentialité disponible sur https://yango.com/legal/yango_carlash_privacy_notice

1.8. « Location » désigne la mise à disposition du Véhicule à l’Utilisateur par le Propriétaire pour possession temporaire moyennant des frais convenus entre l’Utilisateur et le Propriétaire.

1.9. « Conditions générales » désignent les conditions générales d’utilisation qui régissent l’utilisation de Yango Carlash par l’Utilisateur et disponibles en ligne sur https://yango.com/legal/yango_carlash_termsandconditions.

1.10. « Utilisateur » ou « Locataire » désigne un internaute majeur qui s’est inscrit dans l’application Yango Pro et qui a accepté sans réserve les Conditions générales et les Documents réglementaires :

1.11. « Véhicule » désigne tout véhicule de transport proposé à la location par son Propriétaire via Yango Carlash.

1.12. « Yango » désigne la société RideTechnology Global FZ-LLC.

1.13. « Yango Carlash » ou « Service » désigne la plateforme électronique de Yango Carlash conçue pour permettre aux Propriétaires de placer des Pubs sur les Véhicules qu’ils proposent à la location et pour permettre aux Utilisateurs d’avoir accès à ces Pubs afin d’effectuer des Réservations et de s’accorder avec les Propriétaires sur la location des Véhicules.

 

2. Dispositions générales

2.1. Les présentes Conditions générales constituent une offre de Yango à tout Utilisateur d’utiliser le service Yango Carlash dans le Pays.

2.2. L’utilisation du Service par l’Utilisateur est régie par les présentes Conditions générales.

2.3. En commençant à utiliser le Service/ses certaines fonctions, l’Utilisateur est réputé avoir accepté les présentes Conditions générales et les dispositions des Documents réglementaires dans leur intégralité, sans aucune réserve ni exception. Si l’Utilisateur n’est pas d’accord avec l’une des dispositions des Conditions générales et/ou des Documents réglementaires, il n’a pas le droit d’utiliser le Service.

2.4. Yango peut modifier les dispositions des présentes Conditions générales ou des Documents réglementaires à tout moment et sans préavis à l’Utilisateur. La version actuelle des présentes est disponible sur : https://yango.com/legal/yango_carlash_termsandconditions.

2.5. L’Utilisateur supporte le risque de ne pas prendre connaissance d’une nouvelle version des Conditions générales et des Documents réglementaires. Toute utilisation continue du Service après la modification des Conditions générales ou des Documents réglementaires sera considérée comme acceptation de la nouvelle version.

2.6. L’Utilisateur doit cesser d’utiliser le Service s’il n’accepte pas les modifications apportées par Yango aux présentes Conditions générales conformément à l’article 2.4 des présentes.

2.7. Le Service permet à l’Utilisateur d’accéder gratuitement aux Pubs de véhicules que les Propriétaires souhaitent potentiellement louer, ainsi que d’envoyer des demandes de location aux Propriétaires, de consulter les offres des Propriétaires qui proposent des Véhicules à louer et de rechercher de telles offres en utilisant les paramètres définis par l’Utilisateur.

2.8. Les présentes Conditions générales s’appliquent à toutes les fonctions actuellement disponibles du Service, ainsi qu’à tous les développements et/ou nouvelles fonctions ajoutées.

2.9. Selon la région de l’Utilisateur, certaines ou toutes les fonctions du Service peuvent être inaccessibles ou limitées. Les fonctions sont considérées comme inaccessibles (limitées) pour l’Utilisateur d’une certaine région si cet Utilisateur n’est pas en mesure de les utiliser explicitement. Il est interdit d’appliquer toute méthode technique ou logicielle pour contourner ces limitations. Les dispositions des présentes régissant les fonctions du Service qui sont inaccessibles (limitées) pour l’Utilisateur s’appliqueront jusqu’à ce que ces fonctions deviennent explicitement disponibles pour l’Utilisateur. Des informations sur la disponibilité des fonctions du Service dans une certaine région seront fournies à l’Utilisateur sur demande adressée à Yango.

2.10. Pour éviter toute ambiguïté, Yango ne fournit aucun service de location, n’offre pas de Véhicules à louer et n’agit pas en tant qu’agent de l’Utilisateur ou du Propriétaire.

VOUS RECONNAISSEZ QUE YANGO NE FOURNIT AUCUN SERVICE DE LOCATION DE VÉHICULES ET N’AGIT PAS EN TANT QU’AGENT DE LOCATION DE VÉHICULES ET QUE TOUS CES SERVICES DE LOCATION, OFFRES ET PUBS DE LOCATION SONT FOURNIS PAR DES TIERS – PROPRIÉTAIRES QUI NE SONT PAS EMPLOYÉS PAR YANGO OU L’UNE DE SES SOCIÉTÉS AFFILIÉES. LES RELATIONS ENTRE VOUS ET LES PROPRIÉTAIRES CONCERNANT LA LOCATION DE VÉHICULES SONT RÉGIES PAR DES ACCORDS PERTINENTS ENTRE VOUS ET LES PROPRIÉTAIRES, YANGO N’ÉTANT PAS PARTIE À CES ACCORDS.

2.11. Yango n’est pas responsable envers l’Utilisateur d’un délit (y compris d’une négligence), d’une fausse déclaration, d’un manquement à une obligation légale ou autre en vertu des présentes Conditions générales ou en relation avec celles-ci ou tout contrat, ainsi que de toute perte spéciale, punitive, indirecte ou consécutive que cette partie ait été informée ou non de la probabilité d’une telle perte ou d’un tel dommage.

2.12. Yango n’est pas responsable du contenu publié par les Propriétaires, des relations contractuelles et autres nées entre l’Utilisateur et le Propriétaire via le Service.

2.13. Toutes les conversations de l’Utilisateur avec l’équipe de support du Service peuvent être enregistrées afin de contrôler la qualité et d’améliorer les services.

 

3. Utilisation du Service. Certaines fonctions du Service

3.1. Le Service est fourni gratuitement à l’Utilisateur pour une utilisation personnelle et non commerciale.

3.2. Les informations sur les Véhicules et les offres de location (ci-après dénommées les Informations) sont fournies par les Propriétaires. Pour plus d’informations sur les Propriétaires et les Véhicules, veuillez contacter directement les Propriétaires. L’Utilisateur peut contacter les Propriétaires ou fournir ses coordonnées via les fonctions du Service pour que les Propriétaires contactent indépendamment l’Utilisateur et lui fournissent des informations sur les Véhicules proposés.

3.3. Yango n’est pas responsable du contenu et/ou de la pertinence des informations fournies par les Propriétaires, y compris les informations sur le prix de location et la disponibilité actuelle des Véhicules. L’Utilisateur doit discuter de manière indépendante (sans participation de Yango) de la location de Véhicules avec les Propriétaires conformément aux règles de prestation de services des Propriétaires. Yango n’est pas responsable des transactions financières ou autres effectuées par l’Utilisateur et les Propriétaires et des conséquences de l’utilisation de Yango Carlash et de la location de Véhicules par l’Utilisateur.

3.4. Yango se réserve le droit de limiter à sa seule discrétion l’accès de l’Utilisateur au Service (ou à certaines fonctions du Service, si cela est technologiquement possible) en utilisant le compte de l’Utilisateur ou de bloquer l’ensemble du compte de l’Utilisateur en cas de violations multiples des présentes, ou de prendre toute autre mesure à l’encontre de l’Utilisateur afin de respecter les exigences législatives ou les droits et intérêts légitimes de tiers.

3.5. Yango traite les données personnelles de l'Utilisateur et du Propriétaire pour fournir le Service. Les Utilisateurs et les Propriétaires conservent un droit d'accès, d'effacement ou de rectification et d'autres droits en vertu de la loi applicable et conformément à l’Avis de Confidentialité. Yango aide les Utilisateurs et les propriétaires à se connecter et à se mettre d'accord sur la location des véhicules. À cette fin, Yango transfère les données des Utilisateurs aux Propriétaires et vice versa. 3.6. Yango se réserve le droit, à sa propre discrétion, de limiter et/ou de suspendre la fourniture de Yango Carlash (ou de certaines fonctions du Service, si cela est technologiquement possible) dans le Pays à tout moment s'il le juge nécessaire pour quelque raison que ce soit.

 

4. Droit applicable et règlement des litiges

4.1. Les Conditions générales et toute obligation non contractuelle qui découle des Conditions générales ou en rapport avec celles-ci sont régies et interprétées conformément aux lois de l’Angleterre et du Pays de Galles, sans tenir compte des dispositions relatives aux conflits de lois.

4.2. Tout litige, différence, controverse ou réclamation découlant des présentes Conditions générales ou en rapport avec celles-ci, y compris (mais sans s’y limiter) toute question concernant leur existence, validité, interprétation, exécution, décharge ou recours applicables, sera soumis et définitivement résolu par arbitrage conformément au règlement d’arbitrage du Centre d’arbitrage international de Dubaï qui est réputé être incorporé par référence au présent article. Le nombre d’arbitres est fixé à un. Le siège de l’arbitrage sera Dubaï, Émirats arabes unis. La langue de la procédure d’arbitrage sera l’anglais.

2.12. Yango shall not be held liable for the content posted by Owners, for the contractual and other types of relationships arising between the User and the Owner via the Service.

2.13. All conversations the User holds with the support team of the Service can be recorded to control quality and improve services.

3. Use of the Service. Certain Functions of the Service

3.1. The Service is provided to the User for personal non-commercial use free of charge.

3.2. Information on Vehicles and offers to rent them (hereinafter referred to as the Information) is provided by the Owners. For more information about the Owners and Vehicles please contact Owners directly. The User may contact the Owners or provide their contact details through the functions of the Service for the Owners to independently contact the User and provide their with information about the Vehicles offered.

3.3. Yango shall not be held liable for the content and/or relevance of information provided by the Owners, including information on the rental price and current availability of the Vehicles. The User shall independently (without the participation of Yango) discuss the rental of Vehicles with the Owners in accordance with the Owners’ rules on the provision of services. Yango shall not be held liable for financial and any other transactions effected by the User and the Owners and for any consequences of the use of Yango Carlash and rental of Vehicles by the User.

3.4. Yango reserves the right, at own discretion, to limit user access to the Service (or to certain functions of the Service, if technologically feasible) using the User's account or block the User’s entire account upon multiple violations hereof, or take any other measures against the User to respect legislative requirements or third-party rights and legitimate interests.

3.5. Yango processes User’s and Owner’s personal data to provide the Service. Users and owners retain a right to access, erasure or rectification and other rights under applicable law and in accordance with the Privacy Notice. Yango assists Users and Owners to connect and further agree on rent of the vehicles. For this purpose, Yango transfers Users’ data to Owners and vice versa. 3.6. Yango reserves the right, at own discretion, to limit and/or suspend the provision of Yango Carlash (or certain functions of the Service, if technologically feasible) in the Country at any moment as it deems necessary for whatsoever reason.

4. Governing law and dispute resolution

4.1. The Terms and Conditions and any non-contractual obligations arising out of or in connection with the Terms of Use shall be governed by and construed in accordance with the laws of England and Wales without regard to the conflict of law provisions.

4.2. Any dispute, difference, controversy or claim arising out of or in connection with this Terms of Use, including (but not limited to) any question regarding its existence, validity, interpretation, performance, discharge and applicable remedies, shall be referred to and finally resolved by arbitration under the Arbitration Rules of the Dubai International Arbitration Centre, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of arbitration shall be Dubai, United Arab Emirates. The language to be used in the arbitration shall be English.

Términos y Condiciones de Yango Carlash

LEA ATENTAMENTE ESTOS TÉRMINOS Y CONDICIONES ANTES DE ACCEDER O UTILIZAR YANGO CARLASH

1. Definiciones

En estos Términos y Condiciones, los siguientes términos y expresiones tendrán el siguiente significado:

1.1. “Cuenta” significará la cuenta personal del Propietario en Yango Carlash, que contiene información sobre el Propietario, incluidas sus Reservas anteriores, su estado y otros datos necesarios para el uso del Servicio.

1.2. “Anuncio” significará los Materiales del Propietario proporcionados por el Propietario y colocados en la interfaz de Yango Carlash para proporcionar al Usuario información sobre la oferta del Propietario para celebrar un contrato de arrendamiento de acuerdo con las condiciones ofrecidas por el Propietario.

1.3. “Reserva” significará una solicitud enviada por el Usuario al Propietario realizada a través de Yango Carlash, que contiene información sobre el Vehículo, el período de alquiler y otra información relevante.

1.4. “País” significará Perú.

1.5. “Propietario” significará cualquier persona física o jurídica propietaria de un Vehículo que dicha persona física o jurídica desea ofrecer en alquiler para actividades de transporte compartido colocando un Anuncio al respecto en Yango Carlash.

1.6. “Materiales del Propietario” significará los materiales informativos que contienen información sobre el Vehículo, ofertas a posibles Arrendatarios, incluido el precio, imágenes del Vehículo, descripciones del Vehículo y otros detalles.

1.7. “Documentos Normativos” significará:

i. Acuerdo de Licencia para Yango Pro para Dispositivos Móviles disponible en https://yango.com/legal/yangopro_mobile_agreement.

ii. Política de Privacidad disponible en https://yango.com/legal/yango_carlash_privacy_notice.

1.8. “Alquiler” o “Arrendamiento” significará la puesta a disposición del Vehículo al Usuario por parte del Propietario para su posesión temporal por una tarifa acordada entre el Usuario y el Propietario.

1.9. “Términos” significará estos Términos y Condiciones que rigen el uso de Yango Carlash por parte del Usuario, disponibles en línea en https://yango.com/legal/yango_carlash_termsandconditions.

1.10. “Usuario” o “Arrendatario” significará a un usuario adulto de Internet que se ha registrado en la aplicación Yango Pro, ha aceptado los Términos y Documentos Normativos.

1.11. “Vehículo” significará cualquier vehículo de transporte que su Propietario ofrezca en arrendamiento a través de Yango Carlash.

1.12. “Yango” significará RideTechnology Global FZ-LLC.

1.13. “Yango Carlash” o el “Servicio” significará la plataforma electrónica de Yango Carlash diseñada para permitir a los Propietarios colocar Anuncios sobre los Vehículos que ofrecen para alquiler y permitir a los Usuarios tener acceso a estos Anuncios para realizar Reservas y acordar con los Propietarios el alquiler de Vehículos.

2. Disposiciones generales

2.1. Estos Términos constituyen una oferta de Yango a un Usuario para utilizar el servicio Yango Carlash en el País.

2.2. El uso del Servicio por parte del Usuario se rige por estos Términos.

2.3. Al comenzar a utilizar el Servicio / ciertas funciones del mismo, se considera que el Usuario acepta estos Términos y las disposiciones de los Documentos Normativos, en su totalidad, sin reservas ni excepciones. Si el Usuario no está de acuerdo con alguna disposición de los Términos y/o Documentos Normativos, el Usuario no podrá utilizar el Servicio.

2.4. Yango podrá, en cualquier momento y sin previo aviso al Usuario, modificar las disposiciones de estos Términos, y podrá, en cualquier momento y sin previo aviso al Usuario, modificar las disposiciones de los Documentos Normativos. 2.5. El Usuario asume el riesgo de no revisar una nueva versión de los Términos y los Documentos Normativos. Cualquier uso continuado del Servicio después de que se hayan modificado los Términos o los Documentos Normativos se considerará como la aceptación de la nueva versión.

2.6. El Usuario deberá dejar de utilizar el Servicio si no está de acuerdo con alguna de las modificaciones que Yango haya realizado a estos Términos tal y como se establece en la cláusula 2.4 de estos Términos.

2.7. El Servicio permite al Usuario acceder de forma gratuita a los Anuncios de vehículos que los Propietarios deseen alquilar, así como enviar solicitudes de alquiler a los Propietarios, consultar las ofertas de los Propietarios que ofrecen Vehículos en alquiler y buscar dichas ofertas utilizando los parámetros establecidos por el Usuario.

2.8. Todas las funciones del Servicio actualmente disponibles, así como cualquier novedad y/o función recién añadida, están sujetas a estos Términos.

2.9. Dependiendo de la región del Usuario, algunas o todas las funciones del Servicio pueden ser inaccesibles o limitadas. Las funciones se consideran inaccesibles (limitadas) para el Usuario desde una determinada región si dicho Usuario no puede usarlas explícitamente. Está prohibido aplicar cualquier método técnico o basado en software para eludir estas limitaciones. Las disposiciones del presente documento que rigen las funciones del Servicio inaccesibles (limitadas) para el Usuario se aplicarán hasta que dichas funciones sean explícitamente accesibles para el Usuario. La información sobre la accesibilidad de las funciones del Servicio en una determinada región se proporcionará al Usuario tras su solicitud enviada a Yango.

2.10. Para evitar cualquier duda, Yango no proporciona ningún servicio de alquiler, no ofrece Vehículos en alquiler y no actúa como agente ni del Usuario ni del Propietario.

USTED RECONOCE QUE YANGO NO PROPORCIONA NINGÚN SERVICIO DE ALQUILER DE VEHÍCULOS NI FUNCIONA COMO AGENTE DE ALQUILER DE VEHÍCULOS Y QUE TODOS ESOS SERVICIOS DE ALQUILER Y OFERTAS Y ANUNCIOS DE ALQUILER SON PROPORCIONADOS POR TERCEROS – PROPIETARIOS, QUE NO SON EMPLEADOS DE YANGO O NINGUNO DE SUS AFILIADOS. LAS RELACIONES ENTRE USTED Y LOS PROPIETARIOS EN EL ALQUILER DE VEHÍCULOS ESTÁN REGULADAS POR ACUERDOS PERTINENTES ENTRE USTED Y LOS PROPIETARIOS, YANGO NO ES PARTE DE ESTOS ACUERDOS.

2.11. Yango no será responsable, en virtud de estos Términos o en relación con ellos, ya sea por contrato, agravio (incluida la negligencia), tergiversación, incumplimiento de una obligación legal o de otro modo, de ninguna pérdida especial, punitiva, indirecta o consecuente, ya sea que dicha parte haya sido informada o no de la probabilidad de dicha pérdida o daño.

2.12. Yango no será responsable del contenido publicado por los Propietarios, ni de las relaciones contractuales o de otro tipo que surjan entre el Usuario y el Propietario a través del Servicio.

2.13. Todas las conversaciones que el Usuario mantenga con el equipo de soporte del Servicio podrán ser grabadas para controlar la calidad y mejorar los servicios.

3. Uso del Servicio. Algunas funciones del Servicio

3.1. El Servicio se proporciona al Usuario para uso personal y no comercial de forma gratuita.

3.2. La información sobre los Vehículos y las ofertas de alquiler de los mismos (en adelante denominada la Información) es proporcionada por los Propietarios. Para obtener más información sobre los Propietarios y los Vehículos, comuníquese directamente con los Propietarios. El Usuario podrá contactar con los Propietarios o facilitar sus datos de contacto a través de las funciones del Servicio para que los Propietarios contacten de forma independiente al Usuario y le faciliten información sobre los Vehículos ofertados.

3.3. Yango no será responsable del contenido y/o la relevancia de la información proporcionada por los Propietarios, incluida la información sobre el precio del alquiler y la disponibilidad actual de los Vehículos. El Usuario deberá discutir de forma independiente (sin la participación de Yango) el alquiler de Vehículos con los Propietarios de acuerdo con las normas de los Propietarios sobre la prestación de servicios. Yango no será responsable de las transacciones financieras o de cualquier otro tipo efectuadas por el Usuario y los Propietarios ni de las consecuencias del uso de Yango Carlash y el alquiler de Vehículos por parte del Usuario.

3.4. Yango se reserva el derecho, a su propia discreción, de limitar el acceso del Usuario al Servicio (o a ciertas funciones del Servicio, si es tecnológicamente factible) utilizando la cuenta del Usuario o bloquear la cuenta completa del Usuario en caso de múltiples infracciones de estos Términos, o tomar cualquier otra medida contra el Usuario para respetar los requisitos legislativos o los derechos e intereses legítimos de terceros.

3.5. Yango procesa los datos personales de los Usuarios y de los Propietarios para proporcionar el Servicio. Los Usuarios y los Propietarios conservan el derecho de acceso, eliminación o rectificación y otros derechos según la ley aplicable y de acuerdo con el Aviso de Privacidad. Yango ayuda a los Usuarios y Propietarios a conectarse y acordar el alquiler de los vehículos. Para este propósito, Yango transfiere los datos de los Usuarios a los Propietarios y viceversa. 3.6. Yango se reserva el derecho, a su propia discreción, de limitar y/o suspender la prestación de Yango Carlash (o ciertas funciones del Servicio, si es tecnológicamente factible) en el País en cualquier momento que lo considere necesario por cualquier motivo.

4. Derecho aplicable y resolución de disputas

4.1. Los Términos y Condiciones y cualquier obligación no contractual que surja de o en conexión con los Términos de Uso se regirán e interpretarán de conformidad con las leyes de Inglaterra y Gales sin tener en cuenta las disposiciones sobre conflicto de leyes.

4.2. Cualquier disputa, diferencia, controversia o reclamación que surja de estos Términos de Uso o en relación con ellos, incluyendo (sin limitarse a) cualquier cuestión relativa a su existencia, validez, interpretación, ejecución, cumplimiento y recursos aplicables, se remitirá y resolverá definitivamente mediante arbitraje de conformidad con las Reglas de Arbitraje del Centro Internacional de Arbitraje de Dubái, cuyas Reglas se consideran incorporadas por referencia a esta cláusula. El número de árbitros será uno. La sede del arbitraje será Dubái, Emiratos Árabes Unidos. El idioma que se utilizará en el arbitraje será el inglés.
