“Special family subscription offer” gift terms

(hereinafter referred to as the “Terms” and “Gift”, “Present” respectively)

1. General provisions

1.1. This is a Gift for a limited number of users for testing purposes which is provided for users in accordance with the Terms located at: http://yango.com/legal/uae_special_family_subscription_offer. The Organizer has the right to amend, cancel or withdraw the access at any time without giving any reasons.

1.2. The Gift is provided within the territory of the following countries: United Arab Emirates, Kingdom of Saudi Arabia, Qatar, Kuwait, Bahrain, Oman, Egypt, Jordan.

1.3. The organizer of the Gift: Funtech Loyalty Card Services LLC, registration number 2060503, located at: UAE, Dubai, Trade Center Second, The Offices 2, Unit № TO2-FLR03-03.04-2 (hereinafter referred to as the “Organizer”, “Funtech”).

1.4. The period of the Gift provision is from December 22, 2023 to October 30, 2025. The Organizer reserves the right to change the duration of the Gift provision.

2. Definitions

Yango Play Subscription shall mean the provision of the User with the opportunity, for a fee and for a limited period of time, to obtain a remote access to the part of the Content, excluding the Crunchyroll Channel Content, for viewing and/or listening via the Internet.

Yango Play х Crunchyroll Subscription shall mean the provision of User with the opportunity, for a fee and for a limited period of time, to obtain remote access to the part of the Content, including the Crunchyroll Channel Content, for viewing and/or listening.

Crunchyroll Channel shall mean a “Crunchyroll” branded component (subsection) of the “Movies and Series” or “Watch” section of the Service.

Crunchyroll Channel Content shall mean, collectively, content (including any audio or video content) and materials which are made available through the Crunchyroll Channel.

Subscription Terms or Terms shall mean these Terms available at: https://yango.com/legal/uae_yango_play_conditions.

Subscription shall mean a Yango Play Subscription or a Yango Play x Crunchyroll Subscription, as applicable (hereinafter together - the “Subscriptions”).

Yango Play Service or Service shall mean Yango Play Service, which Terms of Use are available at: https://yango.com/legal/yango_play_mobile_agreement (hereinafter the “Terms of Use”).

Content shall mean the Content as it defined in the Terms of Use.

Subscription Content shall mean the relevant part of the Content available to the User pursuant to the respective Subscription on these Terms.

Participant– an Internet user with electronic device IP address Funtech believes to be related to one of the following countries: the United Arab Emirates, Kingdom of Saudi Arabia, Qatar, Kuwait, Oman, Bahrain, Egypt, Jordan, who purchased the Subscription and who is granted access to the Content under the Subscription.

Member of the Participant’s family – person living together with the Participant who is Participant’s relative and with electronic device IP address Funtech believes to be similar to electronic device IP address of User when making Subscription.

Apps shall mean mobile and/or smart TV apps (including, for the avoidance of doubt, different versions of such apps for different operating systems and devices) associated with the Service.

The Rules may use other terms defined by the Terms and the Terms of Use.

3. Participation of the Gift provision

3.1. A Participant of the Gift provision may be a capable individual, who purchased the Subscription and who has the IP address of a device on the Internet, according to the Organizer, belonging to one of the following countries: the United Arab Emirates, Kingdom of Saudi Arabia, Qatar, Oman, Bahrain, Kuwait, Jordan or Egypt.

4. Procedure for participation on the Gift provision

4.1. Within the period of the Gift provision, the Participant who meets the requirements specified in the section 3 of the Rules, is given the opportunity to add no more than 3 (three) Members of the Participant’s family to an active Subscription free of charge.

4.2. In order to add Members of the Participant’s family to the active Subscription, the Participant shall share the invitation link with the Member of the Participant’s family. The invitation link to share is placed in the section “Family” of the User Account.

4.3. In order to gain access to the Subscription Content the member of the Participant’s family shall:

4.3.1. Follow the link received from the Participant and register their User Account according to the rules specified in the Terms of use located at: https://yango.com/legal/yango_play_mobile_agreement

4.3.2. Accept the Participant’s invitation by clicking the button “Accept invitation” in the Apps.

4.4. By adding Member of the Participant’s family to the Subscription, the Participant guarantees that the Member of the Participant’s family added by him is a capable individual, who is reached the age necessary to access certain Content within the Subscriptions and have also accepted the Terms, Terms of Use and the Rules.

4.5. Member of the Participant’s family, who has performed actions aimed at gaining access to the Subscription Content shall be considered to have accepted the Rules, the Terms and the Terms of Use and the provisions of all documents referred to by the Terms, in full, without reservation or exception. If Member of the Participant’s family disagrees with the provisions of these documents, the Member of the Participant’s family shall stop using the Subscription.

If the account ceases to be a family account (the user deletes his family members), the restrictions on the number of devices provided for in clause 1.7. of the Terms will be applied.

5. Other conditions

5.1. Organizer reserves the right to suspend or terminate this Gifts provision or change the Terms at any time, as well as the right to cancel the Gifts provision at any time, for any reason. The Participant waives any demand or claim against the Organizer in this context. Organizer also has the right, for technical reasons, to prematurely suspend the possibility of participating. Information about the suspension/termination/modification of the Terms/ suspension of the possibility of the participating will be posted on http://yango.com/legal/uae_special_family_subscription_offer.

5.2. By participating in the Gifts provision and demonstrating his consent, the Participant fully and unconditionally agrees to the Terms, as well as to the Documents, which referred to by the Terms, accepts them and undertakes to fulfill them.

شروط هدية "عرض الاشتراك العائلي الخاص"

(يشار إليها فيما بعد بـ "الشروط" و"الهدية" على التوالي)

1. أحكام عامة

1.1. هذه هدية لعدد محدود من المستخدمين لأغراض الاختبار ويتم تقديمها للمستخدمين وفقًا للشروط الموجودة على الرابط التالي: http://yango.com/legal/uae_special_family_subscription_offer. يحق للمنظم تعديل أو إلغاء أو سحب الوصول في أي وقت دون إبداء أي أسباب.

1.2. يتم تقديم الهدية داخل أراضي الدول التالية: الإمارات العربية المتحدة، المملكة العربية السعودية، قطر، الكويت، البحرين، عمان، مصر، الأردن.

1.3. منظم الهدية: شركة Funtech Loyalty Card Services LLC، رقم التسجيل 2060503، وموقعها في: الإمارات العربية المتحدة، دبي، المركز التجاري الثاني، المكاتب 2، وحدة رقم TO2-FLR03-03.04-2 (يشار إليها فيما يلي باسم "المنظم"، "Funtech").

1.4. فترة تقديم الهدايا هي من 22 ديسمبر 2023 إلى 30 أكتوبر 2025. يحتفظ المنظم بالحق في تغيير مدة تقديم الهدية.

2. التعريفات

اشتراك Yango Play يعني توفير الفرصة للمستخدم، مقابل رسوم ولفترة زمنية محدودة، للحصول على وصول عن بعد إلى جزء من المحتوى، باستثناء محتوى قناة Crunchyroll، للمشاهدة و/أو الاستماع عبر الإنترنت.

يٌقصد باشتراك Yango Play × Crunchyroll إتاحة الفرصة للمستخدم، مقابل رسوم ولفترة زمنية محدودة، للحصول على وصول عن بُعد إلى جزء من المحتوى، بما في ذلك محتوى قناة Crunchyroll، للمشاهدة و/أو الاستماع.

ويُقصد بـ قناة Crunchyroll المكوّن أو القسم الفرعي الذي يحمل علامة "Crunchyroll" ضمن قسم "الأفلام والمسلسلات" أو "المشاهدة" في الخدمة.

أما محتوى قناة Crunchyroll فيُقصد به مجمل المحتوى (بما في ذلك أي محتوى صوتي أو مرئي) والمواد التي يتم إتاحتها من خلال قناة Crunchyroll.

شروط الاشتراك أو الشروط يُقصد بها هذه الشروط المتاحة على الرابط التالي: https://yango.com/legal/uae_yango_play_conditions.

الاشتراك يُقصد به اشتراك Yango Play أو اشتراك Yango Play × Crunchyroll، بحسب ما يكون مناسبًا (ويُشار إليهما معًا فيما بعد بـ "الاشتراكات").

تعني الخدمة أو خدمة Yango Play خدمة Yango Play، والتي تتوفر شروط الاستخدام الخاصة بها على الرابط: https://yango.com/legal/yango_play_mobile_agreement (يشار إليها فيما بعد باسم "شروط الاستخدام").

المحتوى يعني المحتوى كما هو محدد في شروط الاستخدام.

محتوى الاشتراك يعني الجزء المعني من المحتوى المتاح للمستخدم بموجب الاشتراك المعني ووفقًا لهذه الشروط.

المشارك — مستخدم إنترنت لديه عنوان IP لجهاز إلكتروني تعتقد شركة Funtech أنه مرتبط بإحدى الدول التالية: الإمارات العربية المتحدة، المملكة العربية السعودية، قطر، الكويت، عمان، البحرين، مصر، الأردن، والذي قام بشراء الاشتراك ومن تم منحه الوصول إلى المحتوى بموجب الاشتراك.

عضو في عائلة المشارك — الشخص الذي يعيش مع المشارك الذي هو قريب المشارك وله عنوان IP للجهاز الإلكتروني تعتقد Funtech أنه مشابه لعنوان IP للجهاز الإلكتروني للمستخدم عند إجراء الاشتراك.

يُقصد بالتطبيقات تطبيقات الهاتف المحمول و/أو تطبيقات التلفزيون الذكية (بما في ذلك، وللتوضيح، الإصدارات المختلفة من هذه التطبيقات لأنظمة التشغيل والأجهزة المختلفة) المرتبطة بالخدمة.

قد تستخدم القواعد مصطلحات أخرى تحددها الشروط وشروط الاستخدام.

3. المشاركة في تقديم الهدايا

3.1. قد يكون المشارك في تقديم الهدية فردًا قادرًا، قام بشراء الاشتراك ولديه عنوان IP لجهاز على الإنترنت، وفقًا للمنظم، وينتمي إلى إحدى الدول التالية: الإمارات العربية المتحدة أو المملكة العربية السعودية أو قطر أو عمان أو البحرين أو الكويت أو مصر أو الأردن.

4. إجراءات المشاركة في تقديم الهدايا

4.1. خلال فترة تقديم الهدية، يُمنح المشارك الذي يستوفي المتطلبات المحددة في القسم 3 من القواعد، الفرصة لإضافة ما لا يزيد عن 3 (ثلاثة) أعضاء من عائلة المشارك إلى أحد الاشتراكات النشطة مجانًا.

4.2. من أجل إضافة أعضاء عائلة المشارك إلى الاشتراك النشط، يجب على المشارك مشاركة رابط الدعوة مع عضو عائلة المشارك. يتم وضع رابط الدعوة للمشاركة في قسم "العائلة" في حساب المستخدم.

4.3. من أجل الوصول إلى محتوى الاشتراك، يجب على فرد عائلة المشارك ما يلي:

4.3.1. اتباع الرابط الذي تم استلامه من المشارك والقيام بتسجيل حساب المستخدم الخاص به وفقًا للقواعد المحددة في شروط الاستخدام الموجودة على الرابط التالي: https://yango.com/legal/yango_play_mobile_agreement

4.3.2. قبول دعوة المشارك بالنقر فوق الزر "قبول الدعوة" في التطبيقات.

4.4. من خلال إضافة عضو من عائلة المشارك إلى الاشتراك، يضمن المشارك أن عضو عائلة المشارك الذي أضافه هو فرد قادر، وقد وصل إلى السن اللازم للوصول إلى محتوى معين ضمن الاشتراكات وقد قبل أيضا الشروط وشروط الاستخدام والقواعد.

4.5. يعتبر عضو عائلة المشارك، الذي قام بإجراءات تهدف إلى الوصول إلى محتوى الاشتراك، قد قبل القواعد والشروط وشروط الاستخدام وأحكام جميع المستندات المشار إليها في الشروط، بالكامل، ودون التحفظ أو الاستثناء. إذا لم يوافق أحد أفراد عائلة المشارك مع أحكام هذه الوثائق، فيجب على عضو عائلة المشارك التوقف عن استخدام الاشتراك.

4.6. عند قيام المشارك بإضافة أفراد العائلة إلى الحساب، يُعتبر الحساب "حسابًا عائليًا". وفي هذه الحالة:

• سيكون لمالك الحساب العائلي ولكل فرد من أفراد العائلة إمكانية الوصول إلى محتوى الاشتراك على ما يصل إلى خمسة أجهزة فريدة ومعتمدة، و
• يُسمح بتشغيل المحتوى في وقت واحد على جهازين كحد أقصى لكل شخص مرتبط بالحساب العائلي.

وإذا لم يعد الحساب يُعتبر حسابًا عائليًا (بأن يقوم المستخدم بحذف أفراد عائلته)، فسيتم تطبيق القيود المتعلقة بعدد الأجهزة كما هو منصوص عليه في البند 1.7 من الشروط.

5. شروط أخرى

5.1. يحتفظ المنظم بالحق في تعليق أو إنهاء بند الهدايا هذا أو تغيير الشروط في أي وقت، بالإضافة إلى الحق في إلغاء بند الهدايا في أي وقت ولأي سبب. يتنازل المشارك عن أي طلب أو مطالبة ضد المنظم في هذا السياق. يحق للمنظم أيضًا، لأسباب فنية، تعليق إمكانية المشاركة قبل الأوان. سيتم نشر المعلومات حول تعليق/إنهاء/تعديل الشروط/تعليق إمكانية المشاركة على http://yango.com/legal/uae_special_family_subscription_offer.

5.2. من خلال المشاركة في توفير الهدايا وإظهار موافقته، يوافق المشارك بشكل كامل وغير مشروط على الشروط، وكذلك على المستندات، والتي تشير إليها الشروط، ويقبلها ويتعهد بالوفاء بها.
