Picker App Privacy Notice

Picker App is mobile and web-based applications (hereinafter ‘application’ or ‘applications’) for collecting orders from retailers, stores, warehouses and other organizations registered on Yango Deli Platform (hereinafter referred to as ‘Partner’). This Privacy Notice explains what personal data are collected, how and why it is used and shared, as well as the rights you have as a data subject.

1. WHO IS PROCESSING YOUR PERSONAL DATA?

1.1. Your personal data is processed by:

Partner with whom you maintain contractual or any other collaboration.

The Partner acts as a data controller and determines the purposes and means of the processing of personal data.

Yango – the entity specified in the list below that operates in the country in which you are using the application. Yango acts as s data processor under applicable privacy laws and processes data on behalf of its Partners.

1.2. Our applications use Yango ID as a single authentication tool. This tool is provided by different companies, depending on the country of your mobile phone operator, as defined in the Yango ID Service Terms of Use (available at the following address: https://yango.com/legal/yangoid_tou/). 2. WHAT PERSONAL DATA IS PROCESSED, HOW AND WHY?

2.2. In order to prevent and investigate fraudulent behavior, we may process your personal data that you have previously provided to us. Such prevention and investigation of fraudulent behavior is based on the requirements of applicable law (depending on the country where the service is provided) or Yango's legitimate interests. We may retain the results of the investigation for the period of time required by applicable law or for as long as necessary to protect a Yango's legitimate interest.

3. HOW IS YOUR PERSONAL DATA PROTECTED?

3.1 We have implemented appropriate technical and organizational measures to protect your personal data against unauthorized, accidental or unlawful destruction, loss, modification, misuse, disclosure or access, and against all other unlawful processing.

3.2 These security measures have been implemented taking into account the state of the art, the cost of implementation, the risks posed by the processing, and the nature of the personal data concerned.

3.3 Personal data is processed automatically without access by our staff in most cases. However, if such access is necessary, your personal data can only be accessed by employees whose duties require the use of this information. These employees are required to follow internal rules and protocols for processing personal data, and to comply with technical and organizational security measures to protect your personal data.

4. Who Do We Share Your Personal Data with?

4.1. Your personal data are only shared with parties that directly assist in providing the services within the app:

  • our partners involved in obtaining and handling orders and in providing software solutions for the same purpose;
  • our affiliates providing authentication tools;
  • our affiliates and third parties who provide us with servers, data storage, and other infrastructure facilities; and
  • our affiliates and third parties assisting us with customer support.

5. What Are Your Rights?

You have a number of rights under data protection law. Since we act as data processor, acting on behalf of Partner, you always can address your data subject request directly to the Partner as data controller.

The rights available to you depend on our reason for processing your information and applicable law:

5.1. Right of Access

You always have access to your personal data. You have the right to ask us for copies of your personal information.

5.2. Right to Rectification

You have the right to ask us to rectify information you think is inaccurate. You also have the right to ask us to complete information you think is incomplete. After you log into the app using our authentication tool, you can correct your personal data in the app. If you did not succeed to correct the data from within the app, please contact our customer support team.

5.3. Right to Withdraw Your Consent

You have the right to withdraw your consent to processing your data if such a processing is based on your consent.

5.4. Right to Erasure

You have the right to ask us to erase your personal information in certain circumstances, such as, if data are no longer needed for our purposes, or we process your data without any valid legal grounds or anywise unlawfully, or you have withdrawn your consent (if processing was based on your consent), or we obtained your data when you were a child, or in other circumstances according to applicable law. After you log into the app using our authentication tool, you can erase your personal data from the app or delete your account entirely.

5.5. Right to Restriction of Processing

You have the right to restrict the processing of your personal data in certain circumstances. For example, should you wish to correct your personal data, you can request via our customer support team that the processing of your data be restricted until such data have been rectified. Please contact our customer support team to proceed.

5.6. Right to Data Portability

If your personal data has been processed by automated means based on your consent or based on a contract with us (e.g. in order to provide you with the features of the app), you have the right to receive such data in a structured, commonly used and machine-readable format.

5.7. Right to Object

You have the right to object to the processing of your personal data should you consider that the processing violates your rights. Please bear in mind that the right to object can be exercised only if we are processing your data based on our legitimate interests.

You have the right not to be subject to automated decision-making, including profiling. We do not pursue automated decision-making, including profiling.

5.8. Right to Lodge a Complaint

We are always ready to consider your complaints and suggestions. Please send them to our customer support team.

In the event of substantial changes to this Privacy Notice, we may use any available means (push notification in the application, SMS, or email) to notify you.
