Terms of Use of the Pro-User Card Service

1. General Provisions

1.1. The company, listed in section 4 below and operated under the brands Yango, Yandex Go, Deli (“Company”) invites all legally capable person authorized under applicable law (1) to drive a passenger taxi and (or) to be employed as a passenger taxi driver or (2) to deliver goods or food and (or) to be employed as a deliverer of goods or food (“User”) to use the web-service to create a pro-user card for taxi providers, delivery services, or Company (“Service”). A taxi provider or delivery service (“Company Partner(s)”) mean a partner of Company which concluded (or will conclude) a contract with Company to access Company’s services.

1.2. By filling out the electronic form located at Company’s website (the website owned and (or) administered by Company) or in the mobile application (the software owned and (or) administered by or licensed to the Company), and by pressing the “Send” or a similar button, or by ticking the box, the User accepts these Terms of Use.

1.3. By accepting these Terms of Use the User confirms and guarantees that the User meet the requirements referred to in the cl.1.1.

2. Use of the Service. Certain Functions of the Service

2.1. The Service offers the User to create, free of charge, a dataset about User in Company’s system (“Pro-User Card”) and to provide the access to Pro-User Card to Company Partners.

2.2. After filling out and sending the form specified in cl. 1.2, Company, its affiliate, a Company’s employee, or a person (employee or representative of legal person) acting on behalf or by the order of the Company (or its affiliate), may contact the User to specify, correct or add details to Pro-User Card. It can be completed also by the automatic systems and chatbots through any means of communication, including messengers.

This provision is not an obligation of Company under these Terms of Use.

2.3. The Pro-User Card forms with data and information provided by the User and can be amended with the information provided by the Company or Company Partners if Company or Company Partner have or had contractual or other legal relations with the User.

2.4. Company may refuse to create a Pro-User Card or delete any Pro-User Card if the User provides incomplete, misleading or inaccurate data, or if the User does not provide confirmation of the accuracy of such data, and on any other grounds, without any obligation to explain such reasons to the User.

2.5. Pro-User Card can be viewed by all or some Company Partners depending on the Service algorithms. If any Company Partner is interested in the User as in taxi driver or deliverer of goods of food, it can contact the User via contact details specified in the Pro-User Card to discuss and enter into the contract with the User. Company is not a party to or an initiator of such contract and is not a representative of any party to such contract. Company does not guarantee that Company Partner will offer the User such a contract.

2.6. Company processes User personal data, inter alia, transfers User personal data and/or makes it available to Company Partners and Company’s contractors or service providers, for the purposes and on the legal ground of providing the Service to the User under these Terms of Use. In case the consent is the only legal ground for processing of personal data according to the law of the country where the User is using the Service, herewith the User gives the consent to Company to such data processing, including the consent to receive User personal data from third parties for the said purposes.

3. No Warranties, Limitation of Liability

3.1. Company does not guarantee the Service meets expectations and goals of the User, as well as its error-free and continued operation.

3.2. Company shall not be held liable and shall not indemnify against any damage, direct or indirect, the User or third parties suffered from the use or unavailability of the Service.

3.3. The User understands and agrees that Company does not control and has no impact on legal relations between the Company Partner and Users. Any offers Company Partners make to the User are not the part of the Service and shall be handled exclusively between the User and Company Partner.

3.4. For the avoidance of doubt, the usage of Service does not authorize the User to act as a taxi driver or a deliverer of goods or food. Therefore, the User is prohibited to use Company web-services or mobile applications in such capacity until the User has contract or other legal relation with Company Partner or otherwise have legal rights to act as a taxi driver or a deliverer of goods or food.

Los Términos de Uso del Servicio de Tarjeta Pro-Usuario

1. Provisiones Generales

1.1. La sociedad que figura en la sección 4 a continuación y que opera bajo las marcas de Yango, Yandex Go, Deli (“Sociedad”) invita a toda persona legalmente capaz autorizada por la ley aplicable (1) para conducir un taxi de pasajeros y (o) para ser empleada como taxista de pasajeros o (2) para entregar bienes o alimentos y (o) para ser empleada como repartidor de bienes o alimentos (“Usuario”) a utilizar el servicio web para crear una tarjeta pro-usuario para proveedores de taxis, servicios de entrega o la Sociedad (“Servicio”). Un proveedor de taxi o servicio de entrega (“Socio(s) de la Sociedad”) significa un socio de la Sociedad que celebró (o celebrará) un contrato con la Sociedad para acceder a los servicios de la Sociedad.

1.2. Al completar el formulario electrónico ubicado en el sitio web de la Sociedad (el sitio web propiedad de y (o) administrado por la Sociedad) o en la aplicación móvil (el software propiedad de y (o) administrado por o licenciado a la Sociedad) y al presionar el botón “Enviar” o similar o al marcar la casilla, el Usuario acepta estos Términos de Uso.

1.3. Al aceptar estos Términos de Uso, el Usuario confirma y garantiza que cumple con los requisitos a que se refiere la cláusula 1.1.

2. Uso del Servicio. Ciertas Funciones del Servicio

2.1. El Servicio ofrece al Usuario crear, de forma gratuita, un conjunto de datos sobre el Usuario en el sistema de la Sociedad (“Tarjeta Pro-Usuario”) y proporcionar acceso a la Tarjeta Pro-Usuario a los Socios de la Sociedad.

2.2. Después de completar y enviar el formulario especificado en la cláusula 1.2, la Sociedad, su afiliado, un empleado de la Sociedad o una persona (empleado o representante de una persona jurídica) que actúe en nombre o por orden de la Sociedad (o su afiliado) puede comunicarse con el Usuario para especificar, corregir o agregar detalles a la Tarjeta Pro-Usuario. También se puede completar mediante sistemas automáticos y chatbots a través de cualquier medio de comunicación, incluidos mensajeros.

Esta provisión no es una obligación de la Sociedad bajo estos Términos de Uso.

2.3. Los formularios de la Tarjeta Pro-Usuario incluyen los datos e información facilitados por el Usuario y podrán ser modificados con la información proporcionada por la Sociedad o los Socios de la Sociedad si la Sociedad o los Socios de la Sociedad tienen o han tenido relaciones contractuales o de otro tipo con el Usuario.

2.4. La Sociedad puede negarse a crear una Tarjeta Pro-Usuario o eliminar cualquier Tarjeta Pro-Usuario si el Usuario proporciona datos incompletos, engañosos o inexactos, o si el Usuario no proporciona confirmación de la exactitud de dichos datos, y por cualquier otro motivo, sin ninguna obligación de explicar dichas razones al Usuario.

2.5. La Tarjeta Pro-Usuario podrá ser vista por todos o algunos Socios de la Sociedad dependiendo de los algoritmos del Servicio. Si algún Socio de la Sociedad está interesado en el Usuario como taxista o repartidor de bienes o alimentos, puede contactar al Usuario a través de los datos de contacto especificados en la Tarjeta Pro-Usuario para discutir y celebrar el contrato con el Usuario. La Sociedad no es parte ni iniciadora de dicho contrato y no es representante de ninguna de las partes de dicho contrato. La Sociedad no garantiza que el Socio de la Sociedad ofrecerá al Usuario dicho contrato.

2.6. La Sociedad procesa los datos personales del Usuario, entre otras cosas, transfiere los datos personales del Usuario y (o) los pone a disposición de los Socios de la Sociedad y de los contratistas o proveedores de servicios de la Sociedad, para los fines y sobre la base legal de proporcionar el Servicio al Usuario según estos Términos de Uso. En caso de que el consentimiento sea la única base legal para el procesamiento de datos personales de acuerdo con la ley del país donde el Usuario utiliza el Servicio, por lo presente el Usuario da el consentimiento a la Sociedad para dicho procesamiento de datos, incluido el consentimiento para recibir datos personales del Usuario de terceros para dichos fines.

3. Sin Garantías, Limitación de Responsabilidad

3.1. La Sociedad no garantiza que el Servicio cumpla con las expectativas y objetivos del Usuario, así como su funcionamiento continuo y libre de errores.

3.2. La Sociedad no será responsable por ni indemnizará contra ningún daño, directo o indirecto, que el Usuario o terceros sufran por el uso o falta de disponibilidad del Servicio.

3.3. El Usuario entiende y acepta que la Sociedad no controla ni tiene impacto en las relaciones legales entre el Socio de la Sociedad y los Usuarios. Cualquier oferta que los Socios de la Sociedad hagan al Usuario no es parte del Servicio y se gestionará exclusivamente entre el Usuario y el Socio de la Sociedad.

3.4. Para evitar dudas, el uso del Servicio no autoriza al Usuario a actuar como taxista o repartidor de bienes o alimentos. Por lo tanto, el Usuario tiene prohibido utilizar los servicios web o las aplicaciones móviles de la Sociedad en dicha capacidad hasta que el Usuario tenga un contrato u otra relación legal con el Socio de la Sociedad o de otra manera tenga derechos legales para actuar como taxista o repartidor de bienes o alimentos.
