Compensation Policy

Compensation Policy of RideTechnology Global FZ-LLC (the “Company”)

This Compensation Policy constitutes an integral part of the Terms of Use of Yango for the Users in Ghana placed at https://yango.com/legal/yango_termsofuse

1. Purpose

The purpose of this Policy is to provide a comprehensive framework for managing compensation of the damage and losses occurred as the result of placing the request for the transportation services via the Yango electronic ride-hailing platform in Ghana.

2. Scope

This Policy applies to the Yango Users, Yango partners and their affiliates and Yango partner’ Drivers.

3. Interpretation

Capitalized words and expressions that are not defined in this Compensation policy shall have the meaning attached to them in the Terms of Use of Yango.

4. Representations and Warranties by the Company

4.1 The Company only provides the User with the electronic services enabling the User to place information on the User’s potential demand for passenger and baggage transportation services, look through offers of Yango partners providing services in the said field, and search for such offers using parameters set by the User. Yango does not provide transportation services or function as a carrier. All such transportation services are provided by the Yango partners in Ghana, list of which is available at https://yango.com/partners and their Drivers.

4.2 The legal relations and transportation services rendered by and between the User and the Yango partners\their Drivers regulated by relevant agreements between such parties, of which the Company is not a party.

4.3 The Company does not, will not, and has no intention to exercise any degree of control over the Yango partners and (or) the Drivers, including without limitation:

a. the Yango partners\or their Drivers’s way of provision of the Transfer or other services to the Users;

b. the operation of the Yango partners\’s business generally;

c. acts or omissions of the Drivers; and/or

d. the operation and maintenance of any Vehicles.

5. Limitation of Liability of the Company

5.1 The Company shall not be liable or otherwise responsible for any direct or indirect health, property and/or any damage, monetary losses, and expenses, loss of business, contracts, contacts, goodwill, reputation and any loss that may arise from interruption of the business and/or any other type of loss or damage which, directly or indirectly, results from, relates to, or is connected with of the transfer requested via the Yango service\ transportation rendered by the Yango Partners, their Affiliates, and/or Drivers to the Users.

5.2. The User has the right to address the claim for damages directly to the Yango Partners\Drivers in line with applicable legislation of Ghana. In case the User failed to reach to the Yango Partner\find Yango Partners contacts at https://yango.com/partners, the User can request this information from the Company by sending the respective request to support@yango.com.

5.3. Without any prejudice to the above, the Company provides support in searching for lost items on the terms available at: https://yango.com/en_gh/support/taxi-all-app-yango-uber/forgot.html. In case the lost item was not found, and the User intend to claim for compensation, cl. 5.3. hereto shall apply.

6. Liability of the Yango partners

The Yango partners shall, among other things, at its own expense use all efforts to settle any complaints, and (or) actions that have been threatened to be submitted or have been submitted by its Affiliates, Drivers, and /or the Users (customers, partners, users, and other persons) which, directly or indirectly, results from, relates to, or is connected with (without limitation):

a. the use of and (or) inability to use the Service by the Yango partners, Drivers, Users, and (or) any person for whatever reason or cause;

b. the transfer services rendered by the Yango partner and/or its Drivers to Users; and

c. the Yango partner’s intentional, negligent, or innocent non-performance or improper performance of any of its duties under the E-Service Agreement, the Law, and the country law and applicable industry regulations.

7. Liability of the User

7.1 The Users are also bound by any waivers and acknowledgment in the terms of use of the Services available at https://yango.com/legal/yango_termsofuse and the License Agreement available at https://yango.com/legal/yango_mobile_agreement.

8. Amendment

This Policy may be amended from time to time by the Company and changes will be posted as provided in cl.1.4. of the Terms of Use of Yango.
