1. General Provisions

1.1. Yandex.Taxi B.V. (hereinafter referred to as Yandex.Taxi) invites all legally capable person authorized under applicable laws to drive a passenger taxi, to be employed as a passenger taxi driver, and (or) to do business as a carrier (hereinafter referred to as the User) to use the service to create a driver card for a taxi provider (hereinafter referred to as the Service). Herein, a taxi provider means a partner of Yandex.Taxi having a valid services contract with Yandex.Taxi to access Yandex.Taxi service.

1.2. By filling out the driver form located at https://taxi.yandex.XX/drivers/YYYY/ (where taxi.yandex.XX is a website owned and administered by Yandex.Taxi and XX is a relevant top-level domain; YYYY is a website directory and/or page, where the driver form is posted) and by pressing the Apply button (or a similar button) the User accepts these Terms of Use.

1.3. By accepting these Terms of Use the User confirms and guarantees that they meet the requirements of applicable laws referred to in the clause 1.1 of these Terms.

2. Use of the Service. Certain Functions of the Service

2.1. The Service enables the User to create a User-as-a-driver data set, at no charge, in Yandex.Taxi system (hereinafter referred to as a driver card) to provide access to such driver cards to taxi providers.

2.2. After the driver form posted at the URLs specified in clause 1.2 of these Terms is filled in, a Yandex.Taxi employee will contact the User to specify personal details. This provision is not regarded as a duty of Yandex.Taxi under these Terms.

2.3. The Service uses personal details of the User to create an electronic driver card in Yandex.Taxi system.

2.4. Yandex.Taxi may refuse to create a driver card or delete any existing driver cards, if the User provides incomplete or unreliable data or does not confirm personal details as specified in clause 2.2 of these Terms, and on any other grounds, without any obligation to explain such reasons to the User.

2.5. A driver card can be viewed by all or some taxi providers as may be determined by algorithms of the Service. If a particular taxi provider is interested in the User as a driver of such taxi provider, the latter can contact the User referring to contact details specified in the driver card to sign a contract with the User. Yandex.Taxi is not a party to or an initiator of such contract and is not a representative of any party to such contract. Yandex.Taxi does not guarantee that taxi providers will offer the User such a contract.

2.6. Yandex.Taxi processes User personal information as this term is defined in the Privacy Policy (https://yandex.com/legal/confidential), inter alia, transfers User personal information and/or makes them available to taxi providers to provide the Service to the User under these Terms. Herewith the User gives the consent to such actions of Yandex.Taxi and the consent to receive User personal information from third parties for the said purposes.

3. No Warranties, Limitation of Liability

3.1. Yandex.Taxi does not guarantee the Service's fitness for goals and expectations of the User, as well as its flawless and continued operation.

3.2. Yandex.Taxi shall not be held liable and shall not indemnify against any damage, direct or indirect, the User or third parties suffered from the use or unavailability of the Service.

3.3. The User understands and agrees that Yandex.Taxi does not control and has no impact on legal relations between the taxi providers and drivers of such taxi providers. Any offers the taxi providers make to the User are not part of the Service and shall be dealt with separately and exclusively by the User and the relevant taxi provider.

3.4. For the avoidance of doubt, the Service provided does not authorize the User to act as a driver of a taxi provider. Therefore, the User is prohibited to use Yandex.Taxi service as a driver of a taxi provider, if he or she has no contract with such taxi provider for such activities.

1. Yleistä

1.1. Yandex.Taxi B.V. (jäljempänä Yandex.Taxi) tarjoaa kaikille oikeustoimikelpoisille henkilöille, joilla on soveltuvan lainsäädännön mukaisesti oikeus ajaa taksihenkilöautoa ja harjoittaa elinkeinona taksinkuljettajan ammatia henkilöautolla ja/tai yritystoimintaa kuljetusliikkeenä (jäljempänä Käyttäjä), Kuljettajakortti -palvelun käyttöä (jäljempänä Palvelu). Taksiliikkeeksi näissä Ehdoissa tarkoitetaan Yandex.Taxin yhteistyökumppania, jolla on Yandex.Taxin kanssa voimassaoleva sopimus pääsyn järjestämisestä Yandex.Taxi -palveluun.

1.2. Täyttämällä hakemuslomaketta osoitteessa https://taxi.yandex.XX/drivers/YYYY/ (jossa taxi.yandex.XX on verkkosivusto, jonka omistajana ja ylläpitäjänä on Yandex.Taxi, XX on asianmukainen ylemmän tason verkkoalue ja YYYY tarkoittaa hakemistoa ja/tai sivua, johon kuljettajan hakemuslomake tallentuu) ja painamalla Lähetä hakemus- tai vastaavannimisen painikkeen Käyttäjää katsotaan nämä Ehdot hyväksyneeksi.

1.3. Hyväksymällä nämä Ehdot Käyttäjä vahvistaa ja vakuuttaa olevansa näiden Ehtojen pykälässä 1.1 mainittujen soveltuvan lain vaatimusten mukainen.

2. Palvelun käyttö. Palvelun toiminnot

2.1. Palvelu tarjoaa Käyttäjälle maksutonta mahdollisuutta muodostaa Yandex.Taxi (Yango) -järjestelmään kokonaisuuden Käyttäjän tiedoista kuljettajana (jäljempänä kuljettajakortti), antaakseen taksiliikkeille pääsyn tällaiseen kuljettajakortiin.

2.2. Sen jälkeen kun kuljettajan hakemus on täytetty näiden Ehtojen kohdassa 1.2 mainituissa osoitteissa, Yandex.Taxin edustaja ottaa yhteyden Käyttäjään hakemustietojen tarkistamiseksi. Tätä lauseketta ei katsota näiden Ehtojen mukaiseksi Yandex.Taxin velvollisuudeksi.

2.3. Käyttäjän hakemustietojen perusteella Palvelu muodostaa Yandex.Taxi (Yango) -järjestelmään sähköisen kuljettajakortin.

2.4. Yandex.Taxilla on oikeus hylätä Käyttäjän kuljettajakorttihakemus tai poistaa ajemmin tehdyn kuljettajakortin, mikäli Käyttäjä jätti vajaat tai epäluotettavat tiedot tai ei vahvistanut hakemuslomakkeeseen laitettuja tietoja näiden Ehtojen kohdassa 2.2 mainitulla menettelyllä, tai muista syistä ilman että Käyttäjälle näitä selitettäisiin.

2.5. Oikeus katsoa Kuljettajakorttia voi olla kaikilla tai tietyillä taksiliikkeillä, jotka on määrätty Palvelun menettelyllä. Mikäli jokin taksiliike on kiinnostunut Käyttäjästä kuljettajana, niin tämä taksipalvleu voi ottaa yhteyttä Käyttäjään kuljettajakortissa mainituilla yhteystiedoilla solmiakseen sopimusta Käyttäjän kanssa. Yandex.Taxi ei ole tällaisen sopimuksen osapuolena tai aloitteentekijänä eikä ole tällaisen sopimuksen kumpaankaan osapuolen edustajana. Taksi ei takaa sitä, että taksiliikkeeltä olisi Käyttäjälle esityksiä tai ehdotuksia tällaisen sopimuksen solmimisesta.

2.6. Yandex.Taxi käsittelee Käyttäjän henkilötietoja sen mukaisesti, mitä on määritelty Tietoturvapolitiikassa, (https://yandex.ru/legal/confidential_fi), Ohjelmiston toiminnallisuuden toimittamiseksi, mm. siirtää/luovuttaa Käyttäjän henkilötietoja ja/tai antaa taksiliikkeille siihen pääsyn, Palvelun toimittamiseksi Käyttäjälle näiden Ehtojen mukaisesti. Tällöin käyttäjä myöntyy tällaisiin Yandex.Taxin toimepiteisiin sekä siihen, että Käyttäjän henkilötieto saadaan kolmansilta tahoilta em. tarkoituksessa.

3. Ei takuuta. Vastuunrajoitus

3.1. Yandex.Taxi ei takaa sitä, että Palvelu soveltuu johonkin tiettyyn tarkoitukseen, vastaa Käyttäjän vaatimuksia eikä sitä, että Palvelun käyttö on häiriötöntä ja Palvelu toimii katkoitta ja virheettömästi.

3.2. Yandex.Taxi ei ole vastuussa eikä korvaa mitään suoria, epäsuoria tai välillisiä vahinkoja, jotka ovat Käyttäjälle tai kolmansille tahoille aiheutuneet Palvelun käytöstä tai käytön estymisestä.

3.3. Käyttäjä ymmärtää ja hyväksyy sen, että Yandex.Taxi ei valvo taksiliikkeen ja taksinkuljettajan välisiä oikeussuhteita eikä vaikuta näihin. Mitkään ehdotukset taksiliikeiltä Käyttäjälle eivät kuulu Palveluun ja nämä säädellään erikseen yksinomaan Käyttäjän ja ko. taksiliikkeen välillä.

3.4. Epäilysten välttämiseksi: Palvelun toimittaminen ei anna Käyttäjälle oikeutta toimia taksiliikkeen kuljettajana. Tästä johtuen Käyttäjää on kielletty käyttämästä Yandex.Taxi (Yango) -palvelua taksinkuljettajana, ellei hänellä ole taksipalvelun kanssa tehtyä sopimusta ko. toiminnasta.

(hereinafter referred to as MLU Europe) invites all legally capable person authorized under applicable laws to express its business interest in (i) driving a passenger vehicle, (ii) being engaged as a driver of a passenger vehicle, and (or) (iii) doing business as a carrier (hereinafter referred to as the User) to use the service to create a driver card for a transportation provider (hereinafter referred to as the Service). Herein, a transportation provider means a partner of MLU Europe having a valid services contract with MLU Europe to access MLU Europe service.

1.2. By filling out the driver form located at https://yango.yandex.com/XX_YY/driver (where XX is a language code and YY is a relevant country code) and by pressing the Apply button (or a similar button) the User accepts these Terms of Use.

1.3. By accepting these Terms of Use the User confirms and guarantees that they meet the requirements of applicable laws referred to in the clause 1.1 of these Terms.
